Per Lovemytico lawyers recommendations Im going to fillout a K3 also. Im gonna prepare it tomorrow and hope to have it in the mail Saturday. Most of my previous forms like the g320 are filled out from my I130. I just need to xerox prroof of marriage etc. And I have extra passport pics.

Hopefully K3 would be fast as I know 129f apps are getting noa2 in around 2 months time.

Where have the 2 months approvals come from?  I haven't seen those...

Confused.

NO,  it's one or the other.  If your K-3 gets approved first, you can opt to go with that  OR  you can ignore that approval and wait for the I-130.

If the I-130 gets approved first, it is my understanding that they close the K-3 and you move along with the I-130 and pay the bills online and go through the NVC process.

Hi everyone - for what it's worth I asked some folks a few weeks ago about the K-3, including an immigration lawyer and an immigration paralegal, and both of them recommended against it.

 

Basically, filing now, based on expected processing times, means the best case scenario was the 2 things would probably get adjudicated at the same time, so you're unnecessarily complicating your own paperwork.  Additionally, because the first thing we filed was a CR-1, and that requires a consulate interview, once the interview was scheduled, he would have to go back to Germany to do it.  

 

The conclusion we came to was that it was extra work with next to no probably payoff.  Just my .02.

I received the exact opposite information about the K-3 two days ago by my immigration attorney. I was advised to file the K-3 so that is what I did yesterday. 

 

If you go the K-3 route, your approved petition goes to the NVC for a very short time only to get a Case number and then it gets shipped to the Embassy where you have your interview. Once you enter the US on a K-3, you have to adjust your status here.  You don't do anything with the I-130 because you already entered on the K-3.   If you don't pay the I-130 fees, nothing happens.   You don't have to go back to the embassy for an interview if you already took the K-3 route. 

 

I was told that the  files are adjudicated in different service centers. My I-130 is at the MSC and my K-3 was shipped to the TSC. 

 

If it so happens that they meet up together, the K-3 would get cancelled.... It depends on what service center is faster.   and right now... the K-3 posted processing times for the TSC is only 5 months.... I decided it was better to have 2 files than just one.  I am not willing to accept the 16.6 month processing times for the I-130.   

 

As for extra work,  not really....my attorney already had all the info needed for the package. The I-129F is free to file and my lawyer is not charging anything for the filing.  Only thing is cost me was the gas to drive to his office to sign the petition. 

 

I'm not saying my decision is the best one, I'm just throwing out the info I was given by my attorney..

I got my NVC number today by calling the NVC center. I'm so happy, it took two weeks from the approves of the NOA2 and they said it might take another 20-30 days before I receive anything from them.

Tico, what did you put for questions 14 and 14a on the I-129F? I'm kind of at a loss because we filed the I-130 but don't have an Alien Registration Number yet. But maybe I'm confusing stuff.

I visited my local office with an infopass today. My priority date is April 4th.

 

1. The lady said that approvals were now taking 6-8 months (nothing new there).

 

2. She said that my I-130 application was at the NBC and that it was pre-adjudicated. She said that pre-adjudicated means that someone has looked at it and confirmed that I sent all the necessary documents. She said that she was not authorized to tell me when this pre-adjudication was done.

 

3. She said that it is now waiting for final adjudication from someone else. This process can take anywhere from a few days to a maximum of 2 months. (It is possible that she was saying a maximum of 2 months to be consistent with her earlier statement that approvals are taking 6-8 months overall)

 

My questions are:

 

1. Has anyone ever heard of pre-adjudication before?

 

2. Do you know how long it typically takes to go from pre-adjudication to final adjudication?

 

(Final aside. i handed her my paper work and she looked up my file based on that. Afterwards, I realized that I never confirmed with her that she was looking at the right file. (Suppose she had typed in the incorrect receipt number of some such)!! I worried about that afterwards. Lesson to all: It is always good to confirm with someone that they are looking at the right file. At least you do not sit there afterwards, like me, and wonder about it!!)

I'm thinking maybe the pre-adjudication was a newer employee( trainee) and maybe it just needs to be looked over by a senior employee or supervisor.  That is a good sign since you didn't get an RFE.


yea thats basically unsustainable for me =/. I guess im stuck waiting for the I-130 then...

If you filed the employment authorization really quick, you could probably get it in 3 months....you might still consider it  because it might take him 3-5 months to find a position anyway.  I was out of work for a year and a half... It took a really long time for me to find something that wasn't a contract position.

Question; can our spouses work on the K3?

 

Because this is the problem for me: i don't make enough to support so my husband needs work asap.

you would have to qualify just like the I-130. They use the same income requirements.   So ... if you qualify for the I-130, you will be fine with the K-3. You can also get a co-sponsor if you need to.

 

And no, they can't work until they get a work authorization. That is the big difference between the I-130 and the K-3.  With the I-130, you get an instant Greencard. With the   K-3, you need to adjust their status when they get  here. But you are reunited much faster with the K-3

how does one go about submitting a 129f - for the k3 after the fact? do you have to make a whole new packge? include all the information already included? please help as i am now thinking about this as well! Thanks!

its not really .."after the fact"  since you can't file for the I-129F until you receive your NOA1 for your I-130.

 

Click on the guides button above and find the I-129F section.  You do have to send a package but its alot of the same items you already sent with the I-130 package.    Just send copies.    and its Free to file..

 

I was just told my file goes to the Texas Service Center.  Check the processing times for the I-129F K-3

(NOWHERE NEAR THE NBC...LOL)

I know this is probably technically OT, but LoveMyTico, you have the lawyer, so maybe you can help the rest of us make the decision to proceed in this direction or not....

 

If indeed the I-130s don't get processed until 16months out, then potential my husband could get his K-3 & be in the US before I even see an NOA2 from the I-130....NVC would then get the case for permanent resident, the K-3 becomes void after 30 days of this? I know getting K-3 we should apply for Adjustment of status soon after arrival in the US, but does the AOS close the I-130 petition then? My husband wouldn't have to go back to India if I-130 gets a case # at NVC before we are able to file AOS in the states, right?

 

Its the time frame surrounding submitting multiple petitions that confuses me and what negates what. Maybe you can clear some of it up for us.   

if you go with the K-3, then you go to your interview and if he gets approved, he flies here and you adjust after he gets here....

If the I-130 approval comes after that, you just ignore the invoices since you already have your interview and are following the K-3 path.  The I-130 goes nowhere until you pay the invoices.  It's one or the other..

That sounds good and yes it seems that we might not be required to pay anything for filing the I-129F.

 

You're right about the lawyers part. As my LoveMyTico mentioned that the lawyers are asking all of their I-130 clients to file the I-129F they surely must know better.

I can only speak about my lawyers office... but I will say in my opinion, an attorney wouldn't suggest filing something if it was pointless. It is free to file and my lawyer is not getting any more money from me. I paid a flat fee.    His job is to get me an approval..

Oh boy! You've really got me thinking.

 

I'm also thinking about filing an I-129F after reading what your lawyer told you. I mean there's no harm in filing it, right? Or is there?

some people on VJ will argue that it slows your process down.. But really, ?  look at the processing times now... K-3 is at 5 months... and I was called in to file it by my lawyer... I didn't ask...That told me they are asking all their I-130 clients to come in and file the K-3 now. 

 

Its free to file.. so why not give yourself a better chance?  I'm going with the first approval..... if its the K-3, I'm fine with that... the K-3 spends WAYYYY less time at the NVC. it only stays there to get a case number and then it is quickly forwarded to the embassy...  You would avoid the 8-10 week processing at the NVC

 

and Costa Rica is SUPER easy to deal with.

Yes, that is a very good question. If it is indeed that dreaded 16 month estimate then it's absolutely terrible.

 

So the 5 months is on the USCIS website, correct? Have you read anything about them officially starting K-3s again on the there?

my lawyer called me in to sign the I-129F petition and suggested we file it since the processing times for the I-130 are extened to 12 months +.  When I went to the office, they showed me the email they received stating the processing time for the I-129F at 5 months ( and I checked when I got home)

I only know that my lawyer and the paralegal both said they are "re-starting" the K-3 processing.   Since they are processed at different service centers initially, in my opinion, I have a better chance of getting the K-3 before the I-130  even though I have 6 months already in .... I would hate to pass on the K-3 and still be sitting here waiting this time next year.   I don't give 2 shits about the cost of adjusting when he gets here and I make enough money to carry him until his employment authorization gets processed. 

 

The way the USCIS minces words and tries to fool everyone.. I would NOT put it past them to be giving 6-12 month estimates from the date they blurt out that info.  That would make the 16 month estimate a reality.

Trying to be positive...at least they are agreeing on 9 months as the last number? Do they  mean 6-9 months from TODAY or do they mean 6 -9 months from the time you filed....  THAT IS THE QUESTION.  The responses we were getting last month from the senators office were saying " 6 months from the date of this notice"    SO if they mean 6-9 months from today...  That means the 16 month estimate...  There is nothing good about that.

 

 

If you haven't files a K-3 , I suggest everyone does.... 5 month processing times are posted...  at least you can call and complain after the posted time.. You can't do that with the I-130 right n ow

I finally called USCIS for the first time inquiring about noa2. I was surprised that I wasnt put on hold and it took me maybe 5 minutes to reach an operator. However, the operator pretty much read through his PC and said that my file was still awaiting processing. Once it is processed they will inform me. He couldnt say how long I need to wait and I said maybe another year waiting??? And he said he doesnt know. I said ok thanks.

Maybe we will hear something this year. Im not gonna hold my breath.

You can't talk to the first operator who takes the call... that is a tier 1. They can only see what you can see when you look up your case online. You have to ask to be transferred to the tier 2 operator who has more access to the computer database.  Sometimes you get a nice one but most times they are rude and not very willing to help.  You have to insist a little bit.    Tier 2 is the call that is usually a 90 minute wait and they offer a call back feature.  They do actually call you back as long as you call early enough in the day.

 

Try again, see what you come up with.. also remember, you can probably talk to several tier 2 operators in a day and you will get all different answers.

Hello everyone.

I decide to share my case because I am losing my patient and start getting stressed out. I am USC and I filed the I-130 for an Immediate Relative which is my Wife. I sent the  the form on March 4th, the case was Update on March 6 th and I received an email on March 7th, on March 9th I've got a Hard copy. Since then no sign. I called the Uscis, they  do not know much about reading what I can read every When I put My receipt number. Also they asked me same Question if  I've tried to call them before.

So I would like to know if there's a similar case out here, as well if there is anyone who knows about the processing time if it's based on the States and the country where you are from originally???

You are a March filer.    Processing times are 9-12 months.  The USCIS posted the average processing time at 16 months.  So sit back and relax.. we are all in the same waiting game.    Join the March thread and fillout your timeline.  When other filers get information, they post it so everyone can be updated. 

 

I personally read Feb thru September threads to watch for new info and approvals. 

 

Alot of people report that their case never shows up on the USCIS website until they are actually approved.  You have to call and ask to speak to a tier 2 rep to get any kind of info.  Tier 1 can only read what your NOA1 says.

yesterday we received un email from USCIS saying : On October 4, 2013, your address was changed relating to the I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN that you filed,,,,,,,,,,,,,,,,,

But never change the address so I called them . It went much faster this time. 

The address has not been changed. For some reason their computer system indicated a change was made during our last inquire, but no change was actually made.

 

I  hope you get an approval Monday morning.....  And the sweet thing is... I'm only 2 days behind you...  MAYBE we are in the same box or storage area....

You make enough to support a family of four. I'm at the NVC stage and waiting to receive my packet, will let you know what you will need and do when it come!! I am a family of two and make over $70,000 and only need to make over $18,500. Just report the last 3 years of taxes you paid but they only want a copy of your last tax year (2013). It's optional if you want the send copies of the other tax years. I hope this helps you.

With Child support, I'm up in the 70K range.  And who knows, at the rate they are processing, I will have already filed my 2013 taxes and I wont have to worry about what income they will consider.

As long as you make over $18,985 around that for 2 individuals and I think it was around $34, 576 for a family of 8. You should be fine. But it just depend on how large your family is. You do not need to add any child support or otherwise, unless you want too.

I saw the charts and I read so much about the income. I really think it is the ( not so bright) paraleagal who doesn't know the circumstance of my case.

 

  Last year my tax return shows low income due to being unemployed but with that income and child support, its is $40,000.  Now this current year,  I am empployed and make way above the 125% poverty level. Combine that with child suppport... Its WAY over the guidelines. 

 

So I would be using Child support as a supporting factor for last year, I don't need it to qualify with my current salary.  I can show 20 years of print outs from the couny  for child suppport if they need it. I could probaby get the bank to print out all the deposits into my account. 

 

From everything I have been reading ( with a few exceptions) the NVC is supposed to use CURRENT income.  I only need to support a family of 4.   

 

 

The paralegal just blurted out that I will need a co-sponsor... I was like,  " For what?  I make way over the income requirements and even last year with the child support""   Then she says, we can just submit it to the NVC and see what they say... I told her I want this sorted out BEFORE I get approved so there is ZERO delays......

I have a question pertaining to income.

 

The income requirements go by your CURRENT income? correct? My last 3 years of tax returns show lower income but I started a new job April 2013 ( this year) and my income is way above the requirements plus I have child support and survivors social security benefits for my kids .

I have read tons of threads about the income requirements .. Am I correct, or am I missing something? And do they include child support and SS benefits when calculating income?

 I don't really have any details.  I was going to wait for the 6 month mark before I did any inquiries because it seemed like there really wasn't anything to do before then.  So I don't even know if it was sent to my local office or not.  Wish I could give you more details.  All I know is that there was nothing special about my case....no expidites, no Congressmen or Senators involved, and not living abroad with my hubby.  Just a plain old USC filing for my husband.  There is hope!!!!

To be very honest, I wasn't expecting to make this post for at least another month....but I just got a text message from USCIS saying "On September 30, 2013 we mailed you a notice that we have approved this I-130"....blah, blah blah...I didn't even read the rest.  dancin5hr.gif I'm still in shock.  The only bad thing....my hubby's phone is turned off or out of battery.....I can't wait to tell him.  I'm so happy right now!

He said the adjudications will stop if the governemnt shuts down... So now I'm confused.  I'm leaning towards what the nice woman at the Ombudsman's office told me.

Just spoke to the sweetest woman at the Ombudsman's office. Called about my inquiry. She said it is still being processed

 

But I took the opportunity to ask many many questions since I figured out she had my case pulled up in front of her..

Here are some of the things she said .

 

The cases are not being transferred to local offices anymore

The last update for processsing times for the NBC is 7-9 months  Reported to them by the NBC about a month ago.

 

Her office has not been told yet  whether or not the Kansas facility will be processing the stand alone I-130's

 

The USCIS and NVC will be open tomorrow if there is a partial shutdown.  She could not answer for the embassies. That she did not know.

 

My case is still in line.  Not assigned

 

Background checks on the USC are done immediately. Backgorund checks on the beneficiary are not finished until the case gets to the embassy. It depends on their last name and how common it is.  

 

All countries go under the same background check.

 

I asked her a few questions about my case specifically and she said if there were any issues, I would have already gotten an RFE.

 

I asked how accurate the "Halloween" timeframe is that was told to me last Thursday. She said it was accurate.  I can go with that.  She said they are pretty set on the 7-9 month processing times. 

 

I hope this helps everyone feel better... even a little bit. 

Tomorrow is October 1st and the USCIS will be open for business.dancin5hr.gif  Maybe they can work on processing the I-130's since some of the other  government offices will be closed ( if the shutdown happens)

I don't think the shutdown affects the USCIS because of the fees they get. So at least NOA2's will be received. Right? Somebody correct me if I'm wrong.

I'm just passing along what my lawyer said this morning.

 

 

 

  If it directly affects the USCIS... I don't know... but it will definitely get held up at the NVC.   The NVC is a different government office

Just watch the news.  Google "government shutdown"  I believe Tuesday is the deadline for them to come to an agreement or the government will shutdown all none essential services ( such as visa processing)    Im so angry

Hate to be a Debbie Downer, but  this morning I sent a message to my lawyer asking if the USCIS processing will be affected by a government shut down.   His answer was "yes"   so we should all say our prayer tonight so the government gets its sh!t together .   Its not enough that the USCIS hasn't been processing  but now a shutdown.     What a horrible time it is to be stuck in this process.....

I really hope you're wrong....that's is almost criminal and makes me want to vomit. Absolutely disgusting....

 

 

USC's and we can't even get OUR goevernment to process paperwork that we paid alot of money for. But a GC holder gets priority??? REALLY????

 

Wanting to vomit is a light statement !!

Hmmm...does a receipt no. starting with MSCXXXXXXX means that my case is being processed at NBC?

 

 

MSC is the NBC  but it can be either Missouri or Kansas.. You can find the address at the bottom of your NOA1,  I believe April filers all went to Missouri

I just posted this in March thread  but I wanted to share with my fellow April filers...  Sorry if you already read this....

 

 

I just spoke to tier2.

She was very nice. She said:

 

1. no, your file has not been transferred to Philadelphia.

2. They only send files to field offices in batches of 500 to the field offices that don't have a big backlog.

3. My files has not been assigned

AND..... after looking through some screens,

4. "I feel like you should get your decision around Halloween time.... "

 

so, there it is !!! Lie number 1501.

 

I have to admit...its nice to hear but very hard to believe..

I'm going to take a break and ignore all.. The more I read or do math the more disappointed I get.. I hate calling and getting different answers than y'all.. I was even told when I called that since i did things the legal way "not cheat" I will get the short end of the stick and wait longer until there is immigration reform.. I even did math and came up with VJ makes up .16% of petitions.. That's 1.6 in every 1000 petitions so knowing there is between 80-90 local offices, Vermont, Texas, CSC, and 2 offices of NBC and not seeing 3 people approved every day is same as saying they can't do 2000 petitions so they are NOT working on them!! Them giving everyone different answers means they don't care.. Ignorance may be bliss with USCIS right now

if they approve that reform that is on the table right now, that means amnesty for 11 million "undocumented" people filing their I-130 for approval while they get to stay here and wait... I am glad I filed now... They can't keep up now with a tiny change    can you imagine  after that reform gets approved?....   The reform will not be able to make the process faster because there will be a zillion more files to process.   They really think we are stupid.

So, the estimated time isn't as bad as I thought it would be.....

 

 

Based on timeline data, your I130 may be adjudicated between November 13, 2013 and December 4, 2013*.

 

I'll actually be in CR with my hubby at the time.. God Willing !!   I have email on my phone in the moutains, and it would be nice to be able to celebrate with him in person instead of video chatting   ! ! !! !   I don't like the fact that we will probably not be spending our first anniversary together in the US..I'll  just be happy they get things rolling.. The wait is killing me but its such a small amount of time when you consider you get the rest of your lives together.....  ( Im trying really hard to believe that... maybe if I say it over and over...  HAHAHA)
