I submitted a request for an inquiry of my case to the senators office on Thursday last week. Here is the response i Received today... ONLY 3 WORKING DAYS LATER...

 

 

After a review of our systems is was found that Case MSC 13 909 XXXXX, Form I-130 filed on behalf of XXXXXXXX is currently pending. NBC continues to receive I-130s and ship them to the field for adjudication. Based on the current volume of pending immigrant visa petitions, our current processing time for I-130s is approximately 6 months from the date of this response.

 

NBC will review and adjudicate I-130 Immediate Relative requests for expedite (if the file is located at the NBC.) If you request your case be expedited the case will need meet USCIS expedite criteria.  All expedite requests must be accompanied by supporting documents that demonstrate that one or more of the expedite criteria have been met.   Information regarding the expedite criteria can be found at the link below.

BTW...Today is the date of the response....  The last response stated a 12 months waiting period.  Today it states 6 months from the date of this response. The 12th of September will be 5 months in process.    So what is the friggin difference???  And I still can't find out where my file is.

False hope.... The approval for yesterday was an expedite.  Not sure if the expedite was ever approved, but they did submit a request in MAY.

Yes. And I just found out my friends visa was approved too. It was first week of march priority.

False hope.... The approval for yesterday was an expedite.  Not sure if the expedite was ever approved, but they did submit a request in MAY. 

 

 

Anyhow, my senators office sent me an email today telling me they made another inquiry to the USCIS  and expressed the senators interest in my case ( whatever that means)

 

The USCIS has a goal of 5 months.... In my opinion, ALL April filers should be making an inquiry.    Just sayin'

Yeah I put 11/11 to 10/12 ;-(

The last thing you want to do is lie.... When they do your background check they will know anyway.  You have to tell the truth. 

 

it is what it is.... If you overstayed, then read up on the hardship waiver and have it ready so you can submit it as soon as they tell you .

But I haven't got any mail or anything say that I'm on a ban... Who did your Husband find out that he was on 1

you wont get a notice...... He was given 6 months when he entered the US.  When he went home, Immigration took his Visa.

 

You just know that if you overstay, you can't come back  or you can't come back until your ban is over and you re-apply for a visa....

 

When you filled out your I-130, did you state when you were in the US and for how long and where you lived?

It was about 1year

OK, typically an overstay gets you a ban from the US 

 

180 days gets you a 3 year ban

360 days gets you a 10 year ban

 

I don't know about  the type of visa you had but in our case, my husband overstayed his B2 visa by 2.5 years. He has a 10 year ban so we have to file an I-601 waiver after our I-130 is approved. That is supposed to only be another 4 months of processing at the NSC but I was told by my lawyer today that those processing times are about 6 months ( at least for all the waivers he has submitted)   there are tons of threads about the waiver on VJ..  our waiver is ready to go, I just need to get this I-130 approved and get to our interview.

Is it bad that now I've came across this site I feel more at eased knowing that I'm not the only 1 going though this....!!



I filed my I-130 on 19th of April 2012 longest 5months and of my life.. I overstayed in the U.S to be with my wife and then left to start the filing process. I was on a ( Esta visa) .. I've been back in London for about a year now dying to see my wife. Does any1 no if this could hurt my case in anyway.?.!??

The files were only going to the local offices to ease the volume.  I am not sure why everyone still thinks all files are being forwarded to local offices. Tier 2 reps have told me and several others that local offices were only getting files if there was something wrong or missing.  I was also told the same thing by my attorney.   Sending files to local offices is NOT the norm.   

 

The kansas facility is supposed to help with the volume.  We have to wait until they start processing. My file is in Missouri according to the address on the NOA1, from what  I gather, May + have the Kansas address.   IMO, MSC will process what they have and the Kansas facility will start processing what they have.  The mystery is why they haven't been processing normally while waiting for the new facility to open...Makes me wonder what they have in store for us.   The thought of NVC trying to keep up with the new volume when they do actually start working.... its a sad and scarey thought

yep, so with NBC giving many approvals, then backlog at the National Visa Center...I guess that means we'll be right in the same boat when NVC gets the approved I-130.  Another 4-8 month wait!!! Incredible.  Of course by then the "undocumented" already illegally in the country will probably be allowed to process, so.....Need I say more?

 

We need to find a National News Network to check out what's happening.  FOX perhaps?

K3 per USCIS website is still a option BUT it also says that you have to file I-130 first then I-129f and when the I-130 gets approved then it cancels the I-129f.. So you kinda roll the dice when you file..
I-129f full processing time is 6-12 months (make it through NBC/NVC/Consulate/interview ect)
I-130 goal (5 months) but being told 6-9 months maybe 12..
So the K3 visa typically never makes it all the way through before the I-130 is approved..

As far as it going to the bottom of the pile? If that was true then service requests, calling, inquiry ect should do the same correct? That makes common sense.. But I can see how if the I-129f gets canceled at NVC then maybe it would sit at a officers desk until I-130 gets attached which could delay at that point..

But it's just how I interpret everything.. I'm no expert..






originally the K-3 was created because the I-130 took a very long time. The K-3 allowed the couple to wait together in the US. A bit after 2009, they were being processed faster so the K-3 and I-130 were meeting.  Since the K-3 requires adjustment once you get to the US, they just cancel the K-3 and proceed with the I-130 since that one is an instant GC.

 

I did  K-3 in 2009... It is much faster at the NVC (less than 2 weeks)  and I remember the I-130 being approved about 2 months later. My K-3 took 10 months back then.  When I started getting the requests for paying the fees for the I-130, I was told just to ignore them since I was going with the K-3.  I was also told if  the K-3 was denied, I could still go after the I-130... However, I didn't need either one of them since I withdrew the petition after all that.

My husband actually said that he would be willing to pay an extra  $5000 if he could speed up the process and be with me.

 

We are married but it doesn't seem like it...  I hate visiting.

 

We have no choice but to sit and wait.  and they know it.   I have zero faith in the USCIS because I heard of TWO cases in my town  where the people married just for a greencard and they were approved with no problem. They didn't have any pictures to prove an ongoing relationship... I could go on but you guys get  the picture. I even heard that the illegal  girlfriend of the guy who married for a GC was blabbing all over that it was only for papers and she was going to amrry him when he finally divorces  the american so she can be legal too... She actually set it up for him..  it makes me sick.. UGHHH

At this point, i feel that USCIS just doesnt give a ####### about American citizens...their priority is giving amnesty to illegal immigrants...screw the citizens. I am so fed up! I am an april filer...I would be surprised if I got a NOA2 by next summer at this rate. It looks so grim! And all the k1 approvals flying out...ranting33va.gif  I wish just one Congressman would really bring this issue forward...but its never going to happen. We dont matter unfortunately...can you tell I am not in a good mood? grrrr!

I'm trying to think realistic which isn't good..
April 1 --- my NOA1
Jan 1 --- NOA2 6-9 months (probably 9)
May 1 --- Get through NVC and interview (probably 4 months)
June 1 --- Me and wife finally living together in US

I  don't think it will be January.. I really think things are going to pick up this month. At least your wife gets her GC when you go for your interview.... we still have to file a waiver. Knowing how unreliable and inconsistent information received from Tier 2 are; I can only keep my hopes high when a tier 2 I spoke with about four weeks ago told me the NBC new office in Overland Park, Kansas will begin processing I-130 the last week of September. The same tier 2 stated I should hear something by the first week of October. In the mean time, starting Sep 14, I will begin putting in service request via Senator and House of Rep offices.

 

So sick of USCIS. Just bought a air ticket a few min ago to check on my wife on a 12 day visit in December to Cameroon. I can't wait to see my beauty.

I'll be inquiring again soon. I was told the senators office would check every 30 days for me.. so its about that time again.  

 

I am surprised someone actually gave you an approximate time..  Who knows... maybe they actually will start processing at the end of this month... but they still have Feb and March before us.  a November interview would work out fine for us.  October would be better, but I know that is pushing it.  My husband is ready to get his medical exam and everything else at the drop of a hat.     

 

The thought of the NVC being backed up scares the hell out of me....  I hope they hired more people .....

BACK today  from visiting with my husband ...  It was sooooo hard to leave him.    I was able to read posts on VJ while I was there but I couldn't comment on anything from my galaxy Note.   It was killing me  HA HA

 

I wanted to comment on the 5 month USCIS goal.   It is just that.... a "GOAL"  that is the standard target.    Of course they have a goal... but of course they never get there. 

 

I was trying to plan out my next visit. I was hoping the next one would be for the interview.  My target is a November interview   since my original target was squashed by the USCIS  ( haha)  

 

Holiday tomorrow...  let's hope they all come back from their 3 day weekend and process their little asses off.

I checked the USCIS processing times today. I-130 national USCIS average has been reduced to 9.5 months from over a year. I am hoping this means they are actually doing something...time will tell. ClockWatch2.gif

 

I am still waiting for response from my senators about our expedite. My letter to my state congressman is being forwarded to another, as the chart stating which one was for my district is apparently outdated. I sent physical letters and evidence of the situation in Egypt to my senators today since email has had no response.

its a bogus chart though. You have no way of seeing the progress for the NBC.  We can only follow the VSC and our files aren't even there.   And its as of June.. Its now the end of August and there aren't any approvals coming through... Lucky for the K-1s.  They are still at 5 months. ( grr) 

 

I remember submitting an expedite request back in 2009. After I submitted it, I was told to wait 60 days for the decision. My file was already in process for 8 months. and FYI... my reason was that my youngest  daughter was diagnosed with a brain tumor.  They didn't find that to be important.  Just sayin'

I am trying to limit how much I come on here now, as seeing all those ****ing K1 approvals is really p*ssing me off... I'm not saying they don't deserve happiness, but I want to be with my HUSBAND. This wait is beyond a joke.

We all deserve happiness, I just question the priorities at the USCIS.  You'd think they would send the I-130's for priority processing or at least to catch up .... since we are the married ones.  Also, I don't understand how the DCF's get processed faster since they are already together.

 

I really thought the USCIS was all about keeping families together or shortening the time they are apart.  its all #######...Tier 1 and Tier 2 are clueless. The operators are rude and not helpful at all. The USCIS website has processing times dated back in MAY. And it does seem like the processig came to a complete stop in Feb.  

 

I still have to file a waiver. Those posted times are at 4 months.  But after trolling the waiver threads... thats a joke too.  I will be going for an infopass at my 6 month mark.  This is all soooooo annoying

 

If my husband was here, I wouldn't care if they took 2 years to process our file...  I just want to start living a normal life with him. Normal is NOT flying to visit every so often.  I can't keep taking time off. I just started this job. I can't afford to get fired. My husband is more important but if I don't have a job, I can't get him here. I won't meet the income guidelines.    This is a horrible circle we are all caught up in.

 

Sorry to sound like a B!t@h fest.....  I know we are all waiting. We all miss our spouses...

I figured it would happen with all that is happening in Egypt right now, but it wasn't quite real until he told me today what he thought. I filed for an expedite on our case last week and have contacted my state senators and congressman. We are hoping and praying it will be approved. But being at the National Benefits Center it could be a month until I even receive the letter on what to do next, like sending in the evidence and whatnot. I was on hold with USCIS for over 2 hours trying to talk to a tier 2 officer. The customer service reps couldn't file an expedite because the case is at the NBC. 

When I inquired about our case, the advocate asked me if I wanted to file for an expedite.  She told me she has only ever seen ONE request get approved. I don't have an expedite reason except that the USCIS makes me angry...  You have a better reason ! ! LOL

Keep us informed.  I hope you get it !

I talked to my husband today and he told me it probably won't be safe enough for me to visit Egypt for a good long while, possibly up to ay ear. He lives in downtown Cairo and even he hasn't been able to go out much with what is going on.

We are just hoping and praying we will get our NOA2 soon. 

Sucks to think I probably won't be able to to Egypt in December for our wedding anniversary like I was planning. 

aww.  that really sux.   I feel bad that you can't travel for a visit.... I hope we all get approved soon so we can spend the holidays with out families.

This one could be a reality. I remember reading a thread where there was a plumbing issue at one of the service center and 100/1000 of petitions were useless. I also think we might have been caught on the flooding that was in Missouri last week. Who knows...
