Yes good ole tico time.  I applied for residency back in February 2012 and I still haven't heard anything.  You'd think I'd be used to it and think USCIS was a breeze!  "Only" waiting a year for residency approval. . .ClockWatch2.gif

 

I know I'm lucky to be with my husband, but I've been here over two years and I'm ready to go back to the USA.  Most days are great.  But that 10% that sucks, really sucks.  The infrastructure here is so freaking awful.  Roads are constantly collapsing and there's no street signs.  It's also dangerous (crime AND traffic).  I mean we go to a dance class not even two blocks away and have to be careful walking at night.  We live basically in prisons of bars and even that's not enough to keep out thieves.  (car got broken into a few months back, even though it was behind a gate)  Although in the mountains, your esposo probably doesn't have to deal with crime as much.  And it's a VERY expensive country to live in, where you make nothing.  That's the number 1 reason we decided to move to the USA- $$.  My esposo works 60+ hours a week and makes a fraction of what he would working 40 hours in the USA.  I make half what I did in the USA, and everything, everything costs more.  Except for mangoes, platanos and avocado!

 

Anyways, rant over.  I'm trying not to hate on CR too much.  I was so sure we'd be back in the USA by Feb 2014, and now that that's looking not so realistic, it's made me a little bitter towards CR.

Yea.. I know exactly what you are talking about...  Food is ridiculous.  a small jar of peanut butter is 3500...  Really?  if you want american food, you have to goto Walmart  which is NOT cheap. When you shop at Walmart in the US, you expect the prices to be lower... its the opposite over there.   There is a produce truck that makes it way around the mountain..  Green beans and chayote, papas etc.  really cheap  and then  Limes, bananas, mangos, oranges, avacados, plantanos and some flor thing.. all in the back yard.  but if you want meat... forget trying to go inexpensive.... When I am there, I try and cook for the family and give them an american flare for a change. My mother in law still insists on making rice  even when I make shimp with alfredo..  or spaghetti.   I can't eat that much starch  but I love everyone and I enjoy their company even though my spanish is terrible.  My husband doesn't think I can drive in the mountain( i guess because I am a girl)  so he never lets me drive.  He told me I can use the horse...    definitely laid back.... I keep reminding him that he married an american and we aren't like the Ticas.  We are on the go all the time. Don't ask me to stay in the house all day, everyday.    I need the mall, I  need the convenience store to be convenient  the pulperias just don't cut it...LOL LOL  

 

Don't you miss the shopping in the US?  I've been to CR about 22 times.... I was over the souveniers the 2nd time I was there...   If I ever lived there, I'd be shopping online and having it sent to my daughter and then have  her ship a box quarterly...  SERIOUSLY ! 

 

 

My brother came to CR with me last  year for the first time.. He was complaining the whole time about the roads and the lack of street signs...  I have learned to accept it, he had a very hard time... it was funny

 

and the bars on the windows are everywhere    EVEN in the mountain.  They lock everything like fort knocks !!   I was robbed back in 2009. They took eveyrthing, even my passport.  What a pain that was  to get taken care of....

@Lovemytico- is your husband in San Jose?  OMG this freaking bailey bridge DESPICHE is a nightmare!!!  It now takes me one hour to get home from work instead of 20 minutes.  They say it'll take two full months to fix.  And we all know in tico time, 2 months = pura vida whenever we get to it.

No, he is about an hour and a half from SJ.  He lives in the mountains.  You need a 4X4 to get to his house.  He is a farmer !!  ( sexy )   hahahahahaha 

and yes,  Tico time is "whenever I get to it"  FOR REAL...  if you ever want to stand in line,  take a trip to CR..LOL LOL LOL     customer service is unheard of.....  

 

He used to work in La Uruca and it would take him 1 1/2 hours to get to work and 1 1/2 hours to get home on a motorcycle....  now he steps out his back door and he is at work !  I love the life he has there.  You are really lucky that you get to live there.

Agreed. The transfer to Nebraska posted about in that thread is consistent with the workload transfer notice announced by USCIS on August 8, I don't think this affects I-130 filers trapped at the NBC-Missouri. Hopefully if there's going to be some batch transfer of those petitions they'd post a similar transfer notice online.

I would be fine with them just processing what they have and get them outta there ! ! ! ! !  LOL    I don't want anything transferred to the NSC because that is where my waiver has to go after we have our interview...  And those are already past the posted processing times ( big surprise)

This actually looks to me like it is specific to F2A filers that started out at VSC.

there is also a person posting who is just adjusting status...  I have a feeling its not for the stand alone I-130s.  I think the filers up til the end of April have to sit tight....  We are stuck at the MSC for now.

 yea, some people get their approval and take a hike and never come back to update their timelines.  Sucks for  us...

Ummm am I really seeing only 2 .. Only 2 VJ people approved this month?!? One per week?!? ... Umm there is over 100 people in front of me on VJ!! So another 100+ weeks at this rate.. Honestly #######....

ok,  I'm going to say this only for the sake of keeping myself from freaking out...  hahahhahaa and its Monday morning and I want to try and be positive 

 

I read on another thread that MAYBE they are using the files for training... so maybe ( just maybe )  because they are training, someone else has to review the files first.   And once they get the second review, they will release them....

 

I am trying to figure out why they think it is smart to hold off on the backlog processing.... it doesn't make sense why they wouldn't want to continue processing while the new people train... 

 

I also read on another thread that Division 8 at the Kansas facility is due to open on Sept 28th.  I am hopeful that they will get all these files out the door......... but then the NVC process is worrying me.  I hope they hired some experienced people for the NVC  otherwise the wait for that will be painful...

I am a May filer and I will scream for joy if we get approved soon! Everyone doesn't deserve to wait long but I will congratulate anyone who is approved smile.png

I say  May+ because that is when they started sending files to the Kansas facility.  No other reason.    I know my file is still in Missouri. I guess I should have clarified that.  And of course I would be happy for ANY approval.

Hi, I am also April filer, and we are still waiting for the approval. I am wondering if it would be best to just request for our file to be transferred to our local field office. Would that help in speeding up the process?

if you can't get a straight answer from them when you call, what makes you think they will jump if you request a file transfer ?  At this point, do you really want to pull your file from the que?     Someone posted on the MAY thread that they heard the USCIS is working on petetions filed 6 months ago.    Not that you can believe everything you read  but do you really want to take a chance since you've been at the NBC so long?   You don't know the stats of the field offices for the current year.

I was feeling pretty bad on Wednesday.  I feel frustrated most days but Wednesday was worse. I had a talk with my husband. He agrees with me. He is mad that they take our money but drag their asses. The USCIS could at the very least post I-130 processing information for the NBC. I understand the files going to the NBC is not the Norm, but seriously?  We just want to know what the time frame is.  I think they keep us in the dark so they don't have to answer to anyone when they don't hit their goals.    A 5 month goal is a joke.   They lost their credibility.  They tell lie upon lie.  Every single tier 2 person gives a different answer. What is the real truth?  I don't even bother calling the USCIS anymore. It just makes me  more upset cray5ol.gif

Can someone explain this sentence "At this time, the stand-alone Immediate Relative Form I-130 petitions are being sent to the NBC for transition to the local field office of jurisdiction for adjudication" to me. The sentence is not clear. Does this mean NBC has started shipping I-130 back to local offices? I thought they stopped shipping the out.

my lawyer told me they WERE sending them to the field offices if there was a problem...

 

Lately, Nobody has received a letter stating they were transferred  so its a completely BS stmt.  its so annoying. They just say whatever they want to keep all of us at bay.

I got the same exact letter....  only thing I can say is..... request it again in 30 days....  I was told by my congressional office that they would be happy to inquire every 30 days for me..... so I just got my second inquiry....  same #######  but its better than sitting around doing nothing....

yea, I know its nothing to live by... my comment was just about how its nice to see it go from January to April.. it just proves there is life at the USCIS....   You can't go by anything on VJ anymore since everyone is shipped to the NBC...  and of course the USCIS doesn't post anything about processing times for the I-130's.

for the first time ,the I-130s are showing april 2013... yesterday it said January 2013.  I know its all  a bunch of garbage... but its nice to see April... I also know that is for VSC....  its impossible to track NBC ...  the thing that bothers me is that my estimated processing time moved all the way up to Dec now.  sigh......  be sure to update your times lines people ! !  it helps the rest of us

but the problem with the K-3 is that it is the exact opposite of what it is supposed to be..... The k-3s are taking even longer than the I-130s to process.  If they had a simple B-2 visa with a 6 month limit specifically for waiting for processing.. that would be cool.. Not the K-3 ....  something that would be processed at the embassy  not the USCIS...  Maybe that would speed the process up . And if they can't process the case within 6 months, then the spouse gets an extension...     Just a thought... they  made the K-3 too complicated.

I think I am going to contact my local politicians as well. Anyone think I'll have any more luck because my friend told me to write to Cory Booker because he wants my vote? hahah.

they all want your vote but there is only so much they can do.  They make an inquiry.... its up the the USCIS on what they tell them.   Again we are at the mercy of the USCIS. There is no competition so they do what they want.   its soooooo annoying.

 

I did find out that my file is still at NBC  not the field office.  I also found out that if you inquire  more than once a month, it hinders your process.   I was specifically told not to inquire with more than one congressional office.    Pick an office that has good customer service otherwise you end up with the same information you can get off the website by yourself... GOOD LUCK

I understand that you are on a bad mood today, the waiting is terrible, 8 years ago when I made a petition for my daughter, that was a toddler at the time, I had to wait for the I130 to be approved for 4 years, I suffered a lot with the process and now i have to wait for my husband form to be approve too,but we conquer and are happy and together now.
What I can't understand is that I come to this place to shared immigration experiences, that way we can all help each other while waiting, but every time I read something is made me sad that people gets mad and start hating on undocumented persons, I thought your husband needs a waiver, and you said he was here without documents once, I am really sure he had a good reason for that to happend, I don't know the reason for his overstay visa, but I don't judge him nor any other person that is here without documents because I don't know the situation behind every person. We have to put our positive thoughts on this process and let out the bad energy. I hope this don't offend you that is not my intention and sorry if i did but I just want to come here and don't have to read all this hate.

If 3000 files come in everyday and they collect $400+ dollars for each, don't  you think they have enough in their budget to get these files processed and out the door in a timely manner?   Its common sense...  I'm actually really offended that they make all of us wait.  We aren't asking for anything for free.  We just want to be with our Spouses.  We followed the guidelines set by them. We paid the fee... and now treated like second class citizens  while they talk about spending oodles of dollars to help Syria... and other foreign issues.    And all the illegals sit pretty in the US and all the idiots who got one over on the governement by marrying only for a greencard.   I can name 3 people right on my street who had or have a fraud marriage only for a greencard. I can name several illegals who run businesses and make money hand over fist .... I do things the legal way and it seems I am the one who suffers.( and all of us here on VJ)

IMO, it doesn't matter the reason for being undocumented.  If you are in the US with your family and illegal  and I am a USC and I have to file papers and WAIT... that to me is not fair. and waiting isn't an issue if it is a reasonable amount of time.... I don't hate them, I know several in my neighborhood.... Its just  not fair.    My husband was here  on a B2, he had an overstay and returned home ( on his own)  for serious family matters.   He did not enter the US undocumented.   I will say though, I know undocumented people and overstays  who married only for a greencard and are now residents....  They never had to leave the US and were never questioned . That is not fair either since my husband can't even come here and wait for his papers to be processed.  They never got separated from their families. They just filed the papers and waited  and while they were waiting, they were issued an employment authorization so they could work .  UGHH  so irritating

I already talked to Senator  Casey's office and Senator Toomey's office and I asked who I can place a complaint with and they sent a link to the ombudsman. So, I sent in a complaint saying how ridiculous the backlog is and it is horrible how they are treat the USC's   etc.....

 

I was told that the processing times are now 9-12 months for the I-130 and the waivers are not 4 months, its more like 6-8 months..  tack on 8 weeks for the NVC....   thats about 15 months MORE for me to wait...and thats not even  including the 5 months I already waited.

I don't understand this.. I talked to a tier2 in California that could look at all my information.. So I assumed that either my file was scanned into the computer or someone had done some data entry.. Which means pulling it out of a box or que to answer questions sounds stupid.. IMO

I just spoke to a very nice lady at the other PA senators office.  She explained that there is a huge backlog ( as if I didn't already  know that)  I asked about filing a K-3 ... she said the K-3's are taking even longer to process... I stated that I thought the K-3's were supposed to be the faster of the 2 and were created to cut down the processign time when the I-130's were taking too long.  she said yea, that was how it was originally, but not now.   The stand alones are faster.  I also asked who I could complain to... 

 

Since I already made an inquiry with the other senators office, she suggested I wait til next month and she will make an inquiry for me and ask specific questions.

 

She explained that if you ask specific questions, they will actually go get your file and page through it.  Get your information and respond. it does pull it out of que . She also explained that the priority date realyl doesn't matter for the I-130's since there is already a visa waiting .  They process however they process.  I suppose it is whatever box they ge that day. She did tell me that they receive about 3000 cases a DAY. They are understaffed. ( as if we already didn't know that)

Who do you think is better to write? Senator or Congressman? I wrote my congressman but only got a generic email they will contact me later.. Now I guess I get to see which happens first.. NOA2 or email from congressman..

to get  someone to inquire about your case, they have you sign  a release of information .  You can call or write but they will email the release and they won't check for you until they have it.  It only authorizes you to receive  a generic letter...LOL   I kind of feel like that letter is a slap in the face...... a shut up letter.

 

at least I know my file is still at the NBC.     TOMORROW will be our 5 month mark....   GRRRRRRRRR

I replied to the advocate that sent me the response from  the USCIS. I asked where my file actually is.   This was her reponse:

Are you going to file a K3 at this stage do you think?
 

I would be afraid that it would throw a wrench in the process.  If I knew it would get processed right away..... maybe   I don't want to confuse them.  Doesn't the K-3 get processed somewhere else?  I didn't read up on it because my lawyer said it would  be better to do a stand alone... I know he completed the application for it , but he just filed the I-130

I have to admit that I shed my first tears over this last night (I've been trying so hard to stay positive...) If we don't get NOA2 until March, then that means that we might not be reunited with our loved ones until June or July next year?!..... This is completely breaking my heart....

Yea,  I'm very upset...  if I go by what they say, that takes my I-130 approval to February, then NVC nightmare, then I STILL have to file a waiver which is posted at 4 months at NSC  but I have been reading 6 months+.   I am VERY upset about this. I didn't even mention it to  my husband last night.  I wish I could go stay with him while we wait.   I can't even imagine what the H3LL the USCIS thinks they are doing... its a big joke I guess......  Let's see how long these people will wait it out.........

Actually one had an RFE and  I contacted the person. The RFE came from NYC field office. So nothing there for us to be happy.

an RFE means that at least it was being looked at.   Once they send in the info that was requested, they  might get an approval soon

There are 2 IR1 approvals that got updated today.

If there were 2 approvals on VJ, imagine the approvals that aren't from VJ...  Its pretty good considering it has been dead lately.

Yes, 6 months from this notice. Mine was 6 month as well and then after creating another service request 2 months later it was still 6 months, should have been 4 months, right?. Well, they don't even know how to subtract 2 from 6, how in the world would they know how to adjudicate a petition.

Good news about this is they responded within 3 working days not 14 days. Should it feel us better? Absolutely not!

I wish I could just pick up everything and go move with my husband.     SIGH crying.gif ......   but I can't.  

 

 I saw a cute couple a Kohl's yesterday. I heard the man tell the cashier he is turning 95 on Tuesday.   His wife was holding his arm and gazing at him with a smile....  I love seeing couples like that !   I told my husband that is what I want....  He said " don't worry honey" 

 

This waiting really sux.  Our lives are all on hold...

I submitted a request for an inquiry of my case to the senators office on Thursday last week. Here is the response i Received today... ONLY 3 WORKING DAYS LATER...

 

 

After a review of our systems is was found that Case MSC 13 909 XXXXX, Form I-130 filed on behalf of XXXXXXXX is currently pending. NBC continues to receive I-130s and ship them to the field for adjudication. Based on the current volume of pending immigrant visa petitions, our current processing time for I-130s is approximately 6 months from the date of this response.

 

NBC will review and adjudicate I-130 Immediate Relative requests for expedite (if the file is located at the NBC.) If you request your case be expedited the case will need meet USCIS expedite criteria.  All expedite requests must be accompanied by supporting documents that demonstrate that one or more of the expedite criteria have been met.   Information regarding the expedite criteria can be found at the link below.

BTW...Today is the date of the response....  The last response stated a 12 months waiting period.  Today it states 6 months from the date of this response. The 12th of September will be 5 months in process.    So what is the friggin difference???  And I still can't find out where my file is.
