Glad you enjoyed my humor CanadianPlum smile.png. I'm glad someone is getting some good news.. I have been curious how people living together out of the country get approved showing US income above poverty level.. Maybe they are not that strict who knows..

One more week and I make my where is my file phone call.. I love to act dumb when I call so I fit right on in.. Haha.. I like saying really? What happens next? Is it all on the fancy computer? Did you like the pretty tabs I put on the pages? What's a teir 2 person? Ohh love to talk to one!! Of course the southern accent just goes all to well acting like a idiot!!

Also Happy Hump Day back.. Haha

Aug 22 and I have many "happy days" with the wifey for 2 weeks.. :x

I love the humor too. We have to stick together and keep each other in good spirits...  Waiting stinks !!

Please keep us informed on your uninformative phone call.  HA HA    When your call gets answered, that is tier one. All they can see is what we see when we check our status on the USCIS website.  They read it to you too.. the whole nine yards.. then you say... yea yea  I already know that.  when you ask for more detailed info, they will tell you that they have  6 months to make a decision,  then you have to ask for  tier 2 person and that you would like more detailed information about where your file is.  They have to transfer you... they will ask more info and verify your info.. then you get transferred.. and lately... the wait is about 100 minutes so they give you an option to get a call back and you won't lose your place in line.. They do call back, at least that is one good thing.

Aug 24th I will be with my Hubby for 10 days.   The perfect birthday gift to myself ( to see my husbands face)    I miss him..

I found this information. I got it from another thread... but I thought is was interesting. The lag in processing could be due to the USCIS holding training for more staff... not that it would  or should slow down the regular workflow..  It was just a thought

December, 2012 ? NBC will expand to a second facility in Overland Park, KS. Forms I-90 and I-130 will be processed and adjudicated at this facility.

2013 (exact date TBD) - I-601A Application for Provisional Unlawful Presence Waiver will be adjudicated at NBC. NBC plans to train officers and staff in February 2013 for this workload.

USCIS has provided information to the public regarding the Workload Transfer from Service Centers to Field Operations (NBC and Field Offices) on its website. A link to the website location is provided:

Hi everyone.... IT'S HUMPDAY !

last night I met a couple who have only known each other for 2 years.  He is from Mexico and she is a USC. He is 38 and she is only 23. They have a 3 months old son together.  He entered the US about 17 years ago ( +/- a few years )   He entered without inspection back then and has been living here ever since.

Anyhow..  They told me they were just approved by the USCIS in May and were getting their I-601 waiver documents ready to submit.   They showed me the NOA2. Their priority date is January 23rd and the NOA2 date is May 17th. Filed at the NBC.    I was really happy to hear they got approved so fast ( considering the stories that are flying around VJ of longer processing times)   I asked her many questions and she was basically clueless. She had no idea where her case was processed or actually anything about the whole thing. ( basically dumb as a rock) She only works part time as a server in a retirment home. Andshe collects some kind of assistance for that baby.  I'm not against public assistance at all, I only mention that because I would think the USCIS would look at that as a bad thing. Her low income and the need for public assistance and the fact that she has nobody who can co-sponser... And they were approved.

I just wanted to share because it gave me some positive feelings.

I make WAYYYYYYY over the poverty guidelines and I have been with my husband over 3 years.  They have a 14 year age difference. My husband and I are 13 years apart.    He also  has to file two waivers. The only thing that made me jealous is that he is here with her and I have to wait here in the US until the USCIS decides to get around to adjudicating my petition.   grrrrrr

Very good questions!! I remember reading something similar happening.. What the adjusticater did was just merge the two together and the I-130 took it's place.. If it goes to the bottom of the pile or not (who knows).. To be honest the best thing to do is call.. Have all your info with you when you do.. The first person you talk to will be a idiot and will get you confused.. Insist to talk to a tier 2.. To be honest it is the only way you will get piece of mind..
When you call and I know you will.. I would like to know what all they say smile.png

I wanna know too  ... but I'm not convinced that Tier 2 is above the idiot level either...  that is who I talked to today.   They read from a script. They say as little as possible.    When you call,  have your questions written down so you don't forget... and you will because the answers you get will confuse you...

DId you file the I-30 and the I-129F?  You can read many many threads on VJ about the K-3 being obsolete these days.  You are still allowed to file it but it will most likely be joined with the I-30. Then when the I-30 is approved, the K-3 will be cancelled.   Some say the stand-alone I-30 gets processed faster...

I remember seeing something about an "A" number on another thread. I think it is assigned when they receive your petition.  Not sure though.. I'm sure you can get some good answers if you surf around.

ALSO,  Create a timeline so we can follow your progress...timeline.gif

Im about 113 days waiting for noa2. End of july will be 121 days and the waiting sucks. I kinda give up and my plan B is to move to her country as it was my birthcountry also.

These beaurocrats are really slow. Im sure they dont do a whole lot at work and they all work there forever until retirement and can never get fired. Thats our tax dollars at work too....

as far as I'm concerned;

if you are going to implement a policy and charge a fee.. then you better make sure the system works.

Let's start a petition on CHANGE.ORG, we can send it to Obamas office.  maybe he will sign it too   HAHHAHAHAHAHHAHAHAHHAHA

Thanks LoveMyTico (great username!!!). If only they sent them somewhere different to be processed, then they might have a fighting chance!!! protest6wz.gif

I think i did read something about the K-3's going to a different place ( don't quote me though... possibly the VSC)  but then they get joined somewhere along the line...  maybe you can search the forums for that topic.  I would hate to be next in line for the I-130 and then all of a sudden someone comes along and yanks my I-30 to join it the K-3 and then put it back in the box all the way at the end....

Keep us updated on what they say. After hearing that 12 month processing non sense it has made me furious. I wanna call too but I know I will get into bad conversation.
After hearing all this about uscis. I think they should be paid on the number of files they process

I agree, if they got paid by the file.....  we'd all have our approvals by now.   We did pay a fee.... I guess that is to pay for the storage of our files.  can't we get a petiton together on CHANGE.ORG?  This certainly needs a CHANGE

I'm starting to wonder if maybe it's worth filing a K3 now, or would that also take a year and possibly slow down the process even more?

K-3's are pretty much done and overwith. If you file one, it will join up with the I-130 and that could slow things down. they will get approved together and then the K-3 will get cancelled.  Waste of time these days. Its free to file, but IMO, might slow things down .

OK, I just got a call back from someone who OBVIOUSLY hates her job,  I asked if my case has been transferred yet since its been 3 months. She stated ( and not very nicely) WE HAVE 6 MONTHS TO DECIDE ON YOUR CASE !  I said, yes ma'am, I understand that but could you tell me where the case is right now. She said, ITS NOT AT THE FIELD OFFICE. and again stated the 6 month thing.. So I asked, " does that mean you have 6 months to transfer it or that  you have 6 months for the whole process?"   she said  WE HAVE 6 MONTHS TO DECIDE ON YOUR CASE ALTOGETHER.  And for anyone who knows me personally, they know I would never put up with that attitute in person.. BUT I had to bite my tongue more than once.. UGHHH..

SLOW AT WORK = Jen calling USCIS...  hahaha

There was a 100+ minute wait... so I entered my number.. waiting for the call back.

Why don't they just let the people who answer the phones the first time have access to all of the info ? It really would save us all time.  I know I'm not the only person who realizes this....  you'd think they would streamline the process.

Have you both came up with a "just in case plan"? I know if I don't hear anything or get stuck for RFE then I'm moving to her in Dec.. I plan to be a seasonal worker in the US and quit paying taxes!! Haha

As much as I would love to move to Costa Rica, I can't because I have children here. I couldn't leave without them and I can't take them with me. It wouldn't go over well with their father..

My  "just in case" plan is probably going to be camping out at the congressmen office. But seriously...... We never even thought of a "plan 2" because anything less than my husband being with me here in the US is unacceptable..

As paying customers we aren't getting what we paid for!! 4-6 weeks should be max processing time.. As far as time to get a background check then I have had mine pulled to get onto 2 different power plants for work.. I sent in request one day and they had my background pulled and accepted the very next day.. So it doesn't take long at all!

I agree.. 4-6 weeks MAX.

I had a background check done on me when I started my job. It took a week    My husband has lived in one house his entire life. I lived in the same town my entire life.... It doesn't take long.   Our files are collecting dust in a storage room.... in the dark....... cray5ol.gif

well, I checked my timelines ESTIMATED date and it actually went back a little... It was into November on Saturday.

Based on timeline data, your I130 may be adjudicated between September 28, 2013 and October 30, 2013*.

I really would like to take a tour of the immigration buildings and process.. I would like to see it with my own eyes..

I imagine about 10-15 people sit in a cubicle eating donuts.. Nobody working hard and talking to each other about how they need more money and this job sucks.. Person go gets a box of applications sits it on the desk then takes break.. I imagine it as simple as A, B, C checklist and half the stuff we send in is pointless.. But of course we can't know the checklist because it is secret..

Then I imagine when you call it goes to different office.. Person working there maybe part time employee with low wage working through college or whatever.. Person doesn't have any knowledge but same as us.. Only see what it show on computer screen..

It sad to say but it's messed up how I imagine it.. Lot of people not working, unhappy, don't care, and feel unappreciated.. Which causes all of us to wait longer and grow more frustrated every day

So they say the first step is checking our backgrounds etc...... how friggin long can that actually take? and from what I understand( after reading many, many posts) It really is only about a 15 minute adjudication.  It really is not fair .. we paid our fees. We are not asking for anything for free. Was the fee for rental space in a box somewhere?      The USCIS has decided to united the K-1 filers first. ( and I'm not saying they don't deserve to be approved)  It doesn't make sense to keep the married couples apart longer than the unmarried couples.... We already made the commitment.. we are married. Before I married my husband in March, I was stalking the procesing times in the USCIS website. I didn't know the NBC existed so I was looking at the VSC . It reported 6 months for the longest time. My thoughts were" wow, they must have gotten their ####### together and they are processing faster". As soon as I get married and file the papers, it jumps to infinity again. Our attorney said it has been steady for the last 6 years at about 6 months.. Of course give or take a little either way... One of my friends just married a guy from the Dominican Republic.. Her attorney said 8 months. ( last week)

Obiously it is a case by case basis but it is rather annoying that they don't give monthly updates and that every single person you talk to gives a different answer. I will say that I think 12 months is a little far fetched. It has happened but I don't think that is normal. It is also obvious that the USCIS throws out a generic answer to get everyone to stop calling. It annoys the ####### out of me because we already paid for processing. We aren't asking for something for free. It seems to me, the USCIS is not doing their job. ( duhhh)

Getting the congressman involved at only 4 months is actually being a little ahead of the game. You aren't supposed to involve thecongressmen unti you are at or past the posted processing times. I'd be afraid someone would put my file at the bottom of e pile if I were being to pushy. HA HA just a thought

as I recall when I filed back on 2008... aside from it taking 10 months at the VSC to get an approval...( that sucked ) There was a thread on VJ with about 7 or 8 of us . All June filers.... One day ( March 2009) we all got approved.... one by one... I was the last to get my approval.. The email didn't come until 8pm at night.. Thinking about it now... With all the other filers who aren't members here, it was pretty cool that we all got our approvals that day. The countries included 2 from Costa Rica, 1 from the phillipines, 1 from russia, 1 from Jordan, 1 from Canada, 1 from the Netherlands and a few more that would chime in now and again. Back then we were all going for the K-3. Of course that isn't around anymore.... I just thought I'd share...

AND this is depressing too.....******Based on timeline data, your I130 may be adjudicated between September 30, 2013 and November 1, 2013*******.

When I first filed and put my info on here, it was estimating sometime in July. I know its just an estimate based on the timelines... Its just depressing

I know for a fact we will have a RFE, we have it all ready to express once we get it, so should only set us back no more than a week I would think?

Good luck and god bless to all of us. x

I agree. It's hard to not be jealous. I've been married 2 and half years and my cousin has interview date and moving to US in 6 weeks on a K1 that moved VERY fast. waaahhh!!

at least you'll know when they are actually working on your file when you get the RFE... supposidly sitting on someones desk just waiting for the requested info to come in.... Let us know ....please..

What do you think the timelines are for? It is to compare so you can get an idea if your time is coming. Thats the whole reason we are all here... to follow the progress of others .. Most people take off after their approvals and never come back to fill out the timelines. It makes them very inacccurate.
Thats why its so exciting when you actually see someone from your filing month get approved

I have been to Costa Rica 3 times already this year. I have a trip planned in August for 10 days. Probably October and December too Depending on his interview. Costa Rica is fast. I'll be able to make the appointment for the interview and plan my trip around that.

I noticed something though...
I am signed up for updates on the USCIS website for my current petition. I had a previous petition( that I withdrew back in 2009) that I was signed up for but I signed up for a new account when I filed the current one.
So I tried to sign into my account to check that status and it kept telling me I was not entering the correct user name or password. So I recovered my information and when I signed in with my reset password, someone added my previous petition and my current petition to the same account. I did NOT do that... I was using two different email accounts, that is how I know it wasn't my mistake. So I am not sure what that means, but I'm going to go with maybe someone was looking at my case and happened to look it up and discovered there were two separate petitons and combined them to make it easier to process... I had to mention my previous withdrawn petition on the I-130 I filed in April... so I am really hoping they are getting ready to process it...
Any thoughts?
Looking forward to a productive week ... We want APPROVALS !!

but sometimes when you get an RFE, the person processing your case just sets it aside and starts working on other cases.  When you send the info back to them, it has to go through channels and then to that particular processor.  And then when they get to it is when you get processed.. and hoping you sent the correct requested info...

I sent in EVERYTHING because I didn't want to delay my case one extra minute.   I almost submitted my file in without the translations... Then when I thought about it, I decided to wait  and just harrass the translator to get them done faster.

you have to go by the processing times published by the USCIS.  Getting the congressmen involved when you are still within their published processing times will only get you an answer you can get by talking to a tier 2 person.( my personal experience) my first petition took 8 months to be processed. I got the congressmen involved twice.  it didn't help one bit..  That was back in 2008.

btw.... they don't update the processing times regularly because that would create inquiries.  Also, have you noticed that you can't get status on the NBC for I-130's?  They do that on purpose.  also, the field offices can't be tracked for I-130's either.    If you look at the VSC stats, the page is dated for June but there is a little blub right above the chart stating April.  So, its off by 3 months. And you can't even go by VSC because our files aren't there.    wow.gif

All those links you list are fiance visa petitions though, not spouse petitions....

hahaha  I got a little excited for a second thinking I missed something....  But K-1s are a different animal....   This thread is for April filers for the I-130...

mostly K-1s.....   Those are getting approved left and right.   NBC doesn't process those.

I'm interested in the I-130 stats.   It seems they put them all in a box, shoved them in a closet and shut the door.
