In a nutshell, I-130s were left on a shelf while USCIS prioritized DACA requests. Instead of hiring more staff to deal with the influx of paperwork, they simply reallocated existing staff away from our petitions and left essentially no one working on them.

Before it was Feb. 12, 2013. It means that none of us who filed after that can file a service request or get help from the Ombudsman, and probably not from our Senators or Congresspeople. 

And the Ombudsman's office told me they are not allowed to get involved until we are out of  normal processing. So, they "fix" the date so they won't get bothered. Its a lovely process they have set up.

The processing times seems to have gained some speed. I see that NSC is down to 75 days.
Are these numbers correct? I'm still trying to figure out how this works.

It just depends on where it was sent. Texas and Nebraska are taking closer to 60 days to approve whereas California seems to be moving faster. Just keep checking your online status for a change wink.png

im at 63 days . transferred to TSC on Nov 27th.  I don't see an approval coming anytime soon.   Hope and pray you got sent to CSC.

The petition won't work. I honestly think the service centers flip flop between the types of petitions they process. Last year the k1s were processed super fast and the i130s took a life time. I was stuck at TSC for what seemed like an eternity. This whole process sucks. I don't know why they can't get their ####### together. There were all kinds of letter writing campaigns last year. I don't think any of it made a difference.

I think that is age discrimination. A big NO-NO. Also, ask yourself...Does the USCIS have time to separate the older applicants from the younger applicants? They might as well just adjudicate the file instead of touching it 10 times to separate them from the others.

today TSC went from 5.5 months to 6 months whats the deal ??? We are nearing our  3 month  mark but it gets further away than closer ... I know 5 months was the previous time to call but does mean don't call us until after 6 months??? would a complaint to our congressmen now help ??

I follow some Facebook groups and I was noticing that the processing times are going back up .  Some people are reporting 7 and 8 months now.   I wonder if it is their idea of a solution to the NVC backlog......  TSC changed to 5 months on March 18th 2014.   and you say it went back up to 6 months today??  oh man

my I -130 was transferred to TSC back on November 27th 2013.  My entire wait was 11 months from my initial filing April 12, 2013.  The transfer letter said 60 days...    it was all lies  !!  The last 2 weeks of waiting, I sent emails EVERYDAY to all the head directors.  I guess they got tired of my emails..    It was the most frustrating situation EVER....   All I can say is....  send emails ad get your senator involved.  Who knows.... Maybe you can request your file to be transferred to CSC which used to be the fastest......

I know a girl who's husband was here illegally. They were married here for 5 years before he was asked to leave. He had SEVERAL drug charges, DUI's and domestic abuse arrests under his belt. He went back to Guatemala. His wife petitioned with an I-130. They were approved and are now in the VISA process.
Their interview was here, which I thought was crazy. The beneficary didn't even have to attend.

My husband has never had any charges against him here or in Costa Rica
I am hoping they see that my husband is a good person. We just want to be together.

My husband was here illegally for just about 2 years. innocent.gif To make along story short, he was arrested because there was an immigration warrant.
He wasn't doing anything illegal when he was picked up. (aside from the obvious of being here illegally) He was detained at York county Prison in York, PA for just about a month. Then they sent him back.

I would have married him here and alot sooner if I knew he was going to get deported. April 1st 2007, he told me he wanted to marry me one year from that day !! He was taken away (July 07) and all I could do was visit him every weekend until he was flown home. ( aug 07 ) I flew to Costa Rica and married him in Nov 07.
My situation is that I am not able to move out of the country due to a custody agreement with my ex-husband that says I must reside in a certain county/school district until my daughter graduates high school. ( in 10 more years) My daughter was also diagnosed with a brain tumor AUG 06. She is now treated at Children's Hospital of Philadelphia. Which happens to be one of the best Children's hospitals in the country. I need my husband here to support me emotionally and financially. It is very difficult for me to travel back and forth to see him with things the way they are.

I retained an immigration attorney because of the deportation. He has been wonderful. He hasn't held up any paperwork and always answers my questions. We plan on filing a hardship waiver when we go to the interview. The attorney was referred to me by a comany attorney. When I researched him, I found out he was voted best Immigration attorney in Philadelphia Magazine. I was very weary about hiring an attorney but I know the deportation might pose a problem and I didn't think I should deal with that myself.

I was just wondering if anyone knows of anyone who has similar circumstances. And what was the outcome? The attorney told me the deportation shouldn't be a problem due to the fact that he has never been in trouble with the law beside this.
I worry because my husband is 13 years younger than me. It is a real relationship. We were together before he was deported. When he was taken away from me I was devastated. After getting hit with my daughters diagnosis, it was so hard to lose him too . Now, my heart is breaking because I can't be with him. It is a huge hassle financially to fly to Costa Rica and see him. I am holding my breath hoping this goes smooth.
Any input is appreciated.

I have a hard time understanding why the government gives the ones who are trying to be legal a hard time. What about all the illegals who overstayed their visas or are undocumented and continue to work here and have no plans to become legal? They have kids here and they suck up free healthcare and send their kids to our public school. Then our school taxes are raised to cover these people. The cost to send one USC to a public school is amazing... and we have to foot the bill for the illegals too.... HMMMMMM
I think that if you are illegal and are trying to become legal to be a part of the working society in the US, then you should be approved.

I agree with your opinion it's disgusting that our goverment is willing to bend over backwards to help the dishonest (except those who came not by choice but by the sins of their parents) that jump the border. But, those who are waiting in line get no mercy little consideration. I been through the process twice know the ins and outs. It is totally upside down. They keep talking about help for the illegals what about help for the legals? why are they left hung out to dry? If they are more than willling to help the dishonest become honest then they should help the honest in their sacrifice waiting and being seperated from their families by accelerating the process to shorten the suffering. I never hear anything nothing to ease their plight. This all disgusts me.

On the other hand these people come here illegally out of desperation to feed their families. if they had another choice i'm sure they would stay with their families. But that doesn't make it right. We have families of our own to feed and those jobs they take can be given to americans who are out of work..

I beleive their should be a temporary visa system where if there are a demand for jobs for immigrants to fill they can come in a regulated and controlled flow to fill the demand so that all rights are protected citizen's and aliens. But we can't continue to lose our rights and oportunities and pay the burden for others responsabilities when we as americans have got our own burdens to take care of.


As it stands now, there aren't even enough jobs for the Americans. The illegal people are costing the American tax payers huge amounts of money. Maybe the government should charge a huge fee for all the illegals who want to become legal. They have a certain amount of time to pay or they have to get out. Then the US government will at least have money to put towards something that benefits the USC.

Is your husband DOCUMENTED as being in this country????

If Immigration KNOWS that he is here (illegally), then he's dead meat (i.e. as soon as found, he will be deported and BANNED from this country for TEN years).

However, if they DON'T KNOW that he's here, he should get OUT A.S.A.P. without them knowing (easy enough), and then you should file a I-130 and I-129F with Immigration to bring him here legally (as long as they have NO history/documentation of his having been here illegally, he should be approved. If they DO have histroy/documentation of his having been here illegally, then it's 10 years exclusion).

it was a pain in the A$$ for me to get my marriage certificate from CR. IT took 5 months and then I had to have it translated just to get my drivers license changed here. ( and I'm the USC)
Be careful you don't get caught lying. Make sure there is nothing in his name and that he isn't listed on anything that could trace him back to your house.

YOU overstayed, the reason doesn't matter..... YOU overstayed period. You knew it was wrong and you knew you weren't allowed to work. You did both. Seriously... As a USC, I am working my butt off to support my american family. I married a foreigner and I am trying to go threw the process LEGALLY. Why can't you do the same? I want to be with him but the laws are the laws. I visit him every 6 or 8 weeks. I do what I have to do.

IMO, don't you think using a SS# for the United States is claiming to be an US citizen? Misrepresenting yourself so you can work? if she overstayed under 180 days, I believe she does not have a ban from the US. You wouldn't hear anything about an overstay until you get to your interview. The approval from the USCIS is only an approval granting you an interview. The embassy will determiine your approval and tell you whether you are eligible to file a waiver. Research overstays... over 180 days is a 3 year ban, over 360 is a 10 year ban. Misrepresentation is a lifetime ban.
Be sure to be honest at your interview. If they ask, don't lie. Trust me.... they already know.

No lawyer. . .no RFE. . .trust me, my waiver had more than enough documentation. I did have inquiries going multiple directions through both Senate and House liaisons. In country waivers typically take a lot longer than out of country waivers. . .I got very lucky and got a 'quick' response.

We are filing the 601 and the 212.
How do you get Senators involved? I have the local congressional office involved. I think they are tired of hearing from me. I will keep them involved though. I thought the Senators office would just pass it down to the local congressional offices.


Hi everyone, I am new to this site and my husband was deported 3 years ago. He came to America as a child and his parents failed to renew his alien card when he turned 16. He was charged at age of 19 with a crimmal offense and was deported after serving his time. I have moved to Uk to be with him as we had a daughter together that was 6 years old. All of his family as well as all my family (as I am an a american citizen) are in America. We are going to apply for the i212 but it seems so complicted and confusing on what steps to take first. I was told he had to apply for a immigrant visa first then if that is approved then apply for his i212?

Is that what you guys had to do? Also, anything you reccommend me putting with the letter to prove hardship. My mom has absolutley no family alive and she is a widow. She has just been diagnosed with MS and its really bad. I feel bullied for being american and my daughter has been hit at school an dconstantly made fun of as well. Have any of you had any luck with teh i212?

I really appreciate your help. I just want us to be able to go back home. Its so hard.

His immigration request is filed in london and thats where he had his embassy visit but the I-212 has been sent to Atlanta GA.

You are moving in the right direction, collecting as much information as you can is a great first step. Its a lot to take in so pace yourself and ask questions! A lot of people have made it through this process and have a lot to proud of and are happy to pass their information along to you. You can do it!



Did you try to google examples of approved hardship letters? Also try looking for denied hardship letters too. It will give you a good idea of what not to say or where you need to add more detail. READ READ READ it helped me understand so much.
I had my attorney do the 601 and the 212. Im not a good letter writer so I felt that was the best way to go. He interviewed me for 3 hours so he could type up an affidavit. Our waiver is about 4 inches thick.

you will need to file an I-212 AND an I-601.
I am going through the same situation. I hired a good immigration attorney because I wanted to be sure the waivers were done right the first time. One of the waivers is about 4 inches thick. I need to go back to my husband country and go for a second interview so the Interviewing Officer can type a letter of recommendation when I submit the waivers to be processed.

At least you can be in the UK with your husband... I can't relocate to my husbands country due to my daughter having medical conditions and being treated here in the US....

We were told that the waivers will take another 9 months to 1 year to be processed. My heart is broken in a million pieces. It has caused alot of strain on our relationship.
