Why did your lawyer do that?

He received notification ( and I was given a copy of  the email notification )  that they were going to "re-start" processing the K-3's so he called all of his clients with pending I-130's and filed a K-3 for them.   He didn't charge me anything extra. ( so money was not his motiovation)  He told me it is his job to get us approved the fastest way possible.  So that is what I'm going with.  If K-3's were obsolete, don't you think they would remove the option from the official USCIS website?  Don't you think they would stop reporting the K-3 processing times as 5 MONTHS?  

 

It just makes sense to me to cover all your options.  I'll take either/or... What ever one comes first.

I honestly wish people would stop saying the K-3 is obsolete....  IF that were the case, my lawyer would not have called me in to file it six months after I filed my I-130.   ( PD 10-18-2013)  So Telling people it is obsolete is falser than false...  smh.

I can't answer this question as I myself don't know. But, I have a question for u. How can u file an I-129F (fiance) and an I-130 (spousal) both in the same time frame? U can't be engaged and married to one person at the same time. Either, ur engaged or ur married. I'm curious because I have seen a lot of people do this. Won't one application impact the other?

Have you  read up on he process?  Click on the GUIDES link above and read up !  You can't file a K-3 WITHOUT first filing an I-130.  K-3 is for married people..  smh

I have read a few posts from others who spoke directly to tier 2 reps and it was suggested that they file a k-3... and this was only a few weeks back....   I think the information is all over the place.  I recently filed a K-3 six months after my I-130 . I was informed by my lawyer that they are re-starting the K-3 processing.. so... I guess you have to go with your gut and do what is right for you !

Considering I filed in Oct 2012 and I've been in the USA since June 2013, I think they have a few cases that are backlogged from that time, but really that's not when they're processing.   Take a look at igor's list. 

There is probably one case left in the pipeline with that date so that gives them reason to use that date. Technically they aren't lying  just covering their butts.   I was hoping to see a ton of March approvals this week

Looks like he has k3 visa.
And it's good news ur case is shipped to NVC.
Just call and ask them for case number and inn.
And then pay fees and send paper work.


If the K-3 was approved, it gets shipped to the embassy after a short stay at the NVC.  No fees are paid at the NVC for the K-3. You do have to adjust status once  they enter the US.

 

The K-3 is much quicker through the NVC . it just gets a case number and then shipped right out

I had the interview february 6, 2014.. igot approved and they said they will deliver it to my mailing address together with my original documents.. How many days or weeks does it take? Im excited to book my flight already!

And what is the procedure after recieving the noa2 for i129f? Call the nvc and ask for a case number? What exactly is this case number? How much time does the nvc take to process ghe i129f?

The NVC does not process the K3. It only goes from the service center to the NVC for a case number then shipped to the embassy( usually witnin a week or 2) for completion and interview. It is hard to say how long since every embassy is different.   You don't need the I-130 to be approved to go this route.   Actually, the I-130 usually will cause the K-3 to get closed but in the last few weeks I have seen many K-3's actually make it to the embassy before the approved I-130 even gets logged in at the NVC.   Once it gets to the embassy you can contact the embassy directly.

 

The embassy will contact you regarding the process and what they need before the interview ( medical etc.)   You would bring your original docs to the interview and any other documentation for proof etc.

 

Keep calling to see if there is a case number for both of your files

The k3 goes to the NVC for a case number then shipped to the embassy.  The embassy takes over.  Its much faster because you bypass the NVC process.  When the embassy gets your case, they will send out information for the medical etc.     GOOD LUCK   I hope my K3 gets approved first.

Hello guys. I hope everything is fine with everybody. As of now, both our 130 and 129 are pending, till I pay the corresponding visa fees. Our 130 is at NVC while our 129 is at the US Embassy in Manila. Which one should we pursue? My wife is currently in Dubai right now, working, but she will be going back to the Philippines at the end of her contract on July. Right now, our next step is to pay the visa application fee.

If  you don't care about paying to adjust after entering the US. Go with the K3. You'll save yourself the 3 months of processing at the NVC.

On march 4 my husband received letter from NVC that our approved K3 is sent to Embassy in Skopje. It written to submit on line form DS 160, but about medical examination. I don't know should i wait Embassy to inform me or should I go to medical?

This is only my opinion... But go ahead and pursue the K3 unless you want to wait another 3 months for your I-130 to be processed ..  You can have Visa in hand and be in  the US before NVC gets around to your I-130.

Got an email from embassy this morning telling me they are ready to process our k3 visa and they have sent a letter out with instructions. Mharvian, did you have to pay the $240 fee at the embassy? Just waiting on the letter which I might receive tomorrow, it was only sent out today. Have everything ready. So excited.

YES.... where are you NOELANNE??  let us know if the letter came or not !!!  You should call them and ask them to email it so you can get started.  I know Costa Rica will email the packet.

I-130 takes exactly 11months to process. I-129F takes exactly 6 months. I applied April 30th for I-130 and May 7th for I-129F. We got approved this month. Obviously it not obsolete since I-130 is slow and not catching up with I-130. We still need to wait 4 to 5 months for the I-130 to approve! You still have two mnths, and it will take EXACTLY 2 months to get a response.......All the best to you!!

 I've been waiting 7 months so far for my I-130 and only a month for my K-3.  April files have started to transfer to service centers.. Hopefully mine will be transferred next week and I won't be waiting 11 months.  yes.gif

There is only one reason needed to ask for expediting a case. We just happen to have two reasons. Yes, i have a "pre-existing"

conditon, but i wanted to show the reasons i do not go out and get a second or third job to keep things together until he can arrive. 

 

I am so upset that my husband is not being allowed to join me. Not just to help me pay the mortgage, but fix our home up as winter is approaching fast.

At the rate that this big top adventure is going, i will be homeless anyway. So all the hard work i have done to save our home seems to be in vain.

And believe you me, the USCIS people do not care one iota if this were to happen, BECAUSE IT DOES NOT EFFECT THEM PERSONALLY! 

If it appears to you readers out there that i am bitter, oh yes.... i truly am, especially from the news i recieved today. Get this:

I contacted our Illinois Senator Mark Kirk last week in despiration. His office called me today and told me that the USCIS office personnel stated to her



that "their 129f is NOT even in expedite status!" when I have the reciept right in front of me stating it is! And so did she, but she justified their incompentence of the right hand not knowing what the left hand is doing. Now i am not saying that i am ungrateful for their help, but in all honesty...it was no help.

These USCIS and State dept. people are controlling our lives, and that is what really upsets me. Who do they think they are? They have had 3 full  months to mull
over our papers in "expedite" status. And not even one incling of courtsey to respond or give a time frame on the expedite process. QUOTE UNQUOTE: " YOU WILL RECIEVE A DECISION OR NOTICE OF FURTHER ACTION SHORTLY."


 

I guess Chanel 4 in St. Louis is my only hope. I find the more you expose unjust treatment, things will start to change. Hey look what whistleblowers

have done here in Illinois: OUR LAST 4 of 7 GOVERNORS WENT TO PRISON because they were all called out! hhahahaha there's one to put in your trivia hat. rofl.gif

after reading the expedite reason, I'm just thinking it wasn't approved because it was a pre-existing condition.  They are really strict on expedites.  When the government gets their sh!t together and goes back to work, I suggest contacting the senator's office and making a big deal about it.  Or getting them to submit the same expedite.  Be a monkey on their backs.

 

I heard  through my attorney that the K-3 is going to be processed again, so maybe there is hope.....  I am going to file a K-3 today. My I-130 PD is April 12th. which ever comes first is where I'll be.  I wish I could live with my husband while this is being processed. It just isn't possible.  cray5ol.gif

The charts are showing that there is a big slow down with the I-130 now.  looks like 100 days more time added since 2-20-2013  So my question is then why would a K3 not be a good Idea at this time.  It is unclear to me how the two (I-130 and I-129f) are linked at USCIS.  On the surface getting the wife here earlier with a K3 is the best way for me.  The extra cost is well worth it.  So I wonder if your information is dated and things have changed back to a situation where we need the K3?  USCIS website says I-129f for already married is 5 months,  the I-130 are taking 9-10 months?  Plus as you have said a lot of time saved in the next step too. 

I spoke to an advocate yesterday in PA. She specifically told me that K-3s are now taking LONGER than I-130 petitions to process.  The normal processing times are now 9-12 months for an I-130.

Speaking of nebraska- at the top of their processing page right now says "posted January 21 2014" but above the processing times it says "as of November 2013"... Anyone know/guess why? Error? Is it actually as of the January 21 date?

Nope, it not a mistake.   They posted the info on January 21st  but they are the numbers as of November 2013.  It is a big joke... so when you call and they tell you March 2014...  just know they are reading from a screen with numbers from November.   I guess they assume the average filer is too stupid to question what they are told or what they read on their website.

It's disappointing that "current processing times" don't track with their stated 5 month goal. Heaven forbid that we should be allowed to fuss over USCIS not hitting their own stated goals. Perhaps if congress forbade the agency from cashing our checks before the petitions are processed we would see a real change.






God forbid they hurry.... This is my second round with the USCIS. First time was in 2008. It took 8 months to get an approval. Back then you couldn't track anythiing online. I hope they get their ####### together and start cranking out the approvals. Its sad that so many people have to wait so long to do things the legal way....

I was told that there were a bunch of new hires to handle the case loads. But since the processing times haven't been updated, who would know ???? A long time ago, the K1 was alot faster.... I really wonder what they are thinking at the USCIS... A longtime ago, the K3 was supposed to be faster than the I-130... Now it seems to slow things down. I was going to file both but I have been reading that the K-3 slows the whole process and they get combined anyway. I think I will be only filing the I-130.

There was a post a long time ago from a former USCIS employee. He gave some insight on how things were done.  I wish I could find it. With that said, of course it is 2013 and things are worse than ever. 

 

I do understand why they don't give too much status detail...  then people would be calling asking for MORE information. They probably want to stay as general as they can because everyone works at a different pace. Some cases are easy as pie and others require RFE's or addition background checking. It makes sense for them to go in order, but I would rather the processor move on to other files instead of sit there waiting for answers on the cases that are holding them up.  I agree 100% for more detailed status on the USCIS page.  All we want to know is if our case is being worked on... not sitting in a cold cement storage unit in an unlabled crate..rofl.gif

 

Does anyone kinow how extensive the background check is?  My new employer did a background check on me at the same time I filed our petition. It took 3 weeks for my employment check to be finished.  It could be a big deal if the US government is checking on information in all the other countries.  and don't forget the countries they consider HIGH RISK.     My petition is going to be examined with a fine toothed comb as this is my second time petitioning. I am not worried, there is nothing to hide... I just know it will probably take longer.  Even though you have to provide divorce decrees etc... I'm sure they are checking all of that. I know in Costa Rica, its like pulling teeth to get any government office to move faster than a dead snail...

Most of us have seen people file after us and get NOA 2 before we do.

 

How do USCIS differentiate? I realise some get expedited for various reasons but what about the others?

 

Is it by Country (in other words do they batch them together and process by country).

 

Is it by surname ?

 

Is it by date of birth perhaps ?

 

I just can't  understand why there are differences in date processing . Its almost as if they are drawn out of a box randomly.

 

I think it must be some officers are quicker than others and i guess its as simple as staff shortages/ holidays .

We paid a fee...I don't care if 15 people have a vacation planned for the same week... Everywhere you go, companies  get coverage for the people who are out of the office. Or  they only allow a certain amount of people in a dept  to take time off at one time so they don't fall behind.   It really is no excuse for why there is such a backlog.  As someone stated in another thread... 4-6 weeks tops should be enough time  to process the cases.   Background checks don't take that long...I'm really frustrated also.

country has nothing to do with the field offices.. it has to do with where the petitioner lives

uscis will ensure the file is complete and will do limited background checks, nvc is where the more extensive background checks will occur as I understand it

the high fraud thingy is embassy related

I know it  has to do with where the petitioner lives  but then why do some get transferred and others don't?  Like if there are two files for NYC area.   One beneficiary  from Costa Rica and one from Pakistan or Iran ( for example sake)   I was thinking maybe the high fraud file would goto the Field office and the other would stay at the NBC...  Im just trying to make sense in my head.... Probably impossible  LOL

Very interesting indeed. I have heard from many filing since that May mark yes they are holding everything not adjudicating just waiting for the launch at end of month.

 

I know many who filed in January and February and their local offices have been horrible. Files sitting waiting for interviews that never got scheduled, My friend had an petitioners interview for June no one even let her know. This after 2 service request and 2 INFOPASS. Here it is September and she is waiting fro the interview still.

 

Another friend at Atlanta (now that's a real hot mess) took 12 months for NOA2. She got that in July and guess what her file still hasn't made t to NVC then sent it by accident to NRC (now that has happened a few times).

 

It's just been horrific. I really fell for everyone. I am trying to get as much information as I can and report back. Hang on people.a change is coming.

Just curious....  what contry was the beneficiary from that went to Atlanta?  I'm really pissed at all the confusion the USCIS is creating..  I'm trying to see if the country matters.... like if the high fraud countries are sent to the field offices for extensive background checks... its just a thought.. becuase my lawyer told me that come cases were getting sent to field offices for more work to be done on them....  maybe that is what he meant...  I'm just thinking outloud....

The new service center (well its not new) will be open September 28th. So hopefully we will see approvals like we did in August 2012 when the NBC started adjudicating stand alone I=130 45 days and less. All you can do is wait.

where did you get the info about September 28th being the day they open??  This is the first time I heard of an actual date.

 I don't think its in over hand to transfer our case anywhere.

it wouldn't bother me so much if the files being approved were Feb and March... But seriously... SEPTEMBER???????  JULY???????   That is a slap in the face... THANKS USCIS...
