Waivers (I-601 and I-212) and Administrative Processes (221g)March 2014 I-601 Filers

my waiver was received at the Phoenix Lockbox on Monday the 11th.  will I get a notice that the lockbox received it or will I only get a notice when the NSC receives it?  and how long will that take?

My case starts with MSC abbreviation for national benefits center for I-601 but there are no processing times for these types of cases. so how do i get an idea of the appropriate time frame for this case i have been waiting since march 5th?

tons of April filers were getting approved on the waiver page on Facebook. Regular 601's

Our interview is tomorrow...we will be sending our waiver in this week. I Hope the approvals keep coming. I dread waiting another 6 months. We have an expedite reason, so if the whole waiver process takes 3 months....I'm fine with that. good luck to everyone waiting

Waivers (I-601 and I-212) and Administrative Processes (221g)March 2014 I-601 Filers

I did my own waiver I just researched the internet and I put every possible hardship that I could think of, supported it with evidences and sent it. I was approved 5 months after that and received my visa package a month after that. I'm getting ready to travel to the us now.

I hope time goes by fast for you guys and I'm very sure your waivers will be approved

CONGRATS !!!

We hired a lawyer and hopefully he writes a great waiver for us.( he is writing it now)  Our interview is July 15th. Lawyer told me to fax the paper saying he can file a waiver right after the interview... and off it will go !! A 5 month approval would be amazing !!!

I am so afraid after 14 Months waiting to get an Interview that our waiver could possibly be denied. This is my worst fear.

the waivers get filed at the NSC... why do you think it will be denied?

Waivers (I-601 and I-212) and Administrative Processes (221g)Psych eval for my I-601

spoke to my lawyer yesterday.. Had a long conversation but one of the highlights was that IMMIGRATION DOES NOT CARE . You can try to paint a sad picture and present many hardships.  They don't care. They do their job and go home to their own families   and don't think twice about us.  They follow the guidelines they are given to adjudicate a file and that is it.   They don't care about an eval you paid thousands for.  My lawyer told me to sit back, stop reading the forums, PRAY and just wait.  Just let them do their jobs.

Very hard to do....  I just  hope they keep adjudicating at the 3.5 to 4 month timeframe...

Waivers (I-601 and I-212) and Administrative Processes (221g)I-601 WAIVER UPDATES

I can't fathom 10 months right now. I am due to give birth in December and my fiance is not with me, still in the Bahamas and he cannot enter until this is resolved and he has a waiver. Of course our decision to have a child, but very disheartening.

how far are you in this process? Did you file the waiver?

Waivers (I-601 and I-212) and Administrative Processes (221g)I-601 WAIVER UPDATES

I know... our petition was held under background security checks for months. There are still some December filers waiting for approval.

Don't be fooled.   My file sat for 10 months before they picked it up and started working on it.  It wasn't under background checks, That was the excuse they were throwing out to everyone because security checks take it out of the normal processing time and the reported processing date no longer applies and you can't put in a service request.  They told me my file was assigned to an officer mid Dec 2013... and they said I should hear something in 2 weeks.  We weren't approved until March 18th 2014. I wrote letters and got my senator involved. They seriously didn't even look at it until the beginning of March.

My friend applied in February 2014 and was approved in July 2014. But she refuses to listen to me and won't read the forums. She thinks her lawyer is trustworthy. ( HAHA)  Lets just say she has been at the NVC since July and she only just paid her IV fee when it could have been paid at the same time as the AOS fee.   She has another 50-60 more days to wait.

We only spent 2 months at the NVC  ( even with 2 checklists)  I followed the NVC wiki to the "T" and I did most of the NVC myself and told my lawyer I had it taken care of.  The checklists were mistakes made by my lawyer that I caught and fixed before it cost me more time.  You have to stay on top of the NVC. I used to call 3 times per day.

I know... our petition was held under background security checks for months. There are still some December filers waiting for approval.

you should update your timeline with the correct country.  Were you on the Facebook group?

Waivers (I-601 and I-212) and Administrative Processes (221g)I-601 WAIVER UPDATES

I follow a few Facebook groups for waivers and I have been seeing the processing time at about 3.5 months. Two people reported 3 months in the last few days. One with a June 23rd  filing date, approval Sept 23rd. Regular straight forward I-601.  I guess it depends on the difficulty level of your file.   I spoke to my lawyer yesterday about how they process waivers.  He said he has not visited the  NSC as of yet but as far as he understands, they receive them and  just give them to the adjudicators. No special order.  He is almost 100% sure that the Waiver adjudicators only do WAIVERS.  My question was if they process all types of files....

.He is against me reading the forums . He says I should just sit back, pray and let them do their job.   That's not in my nature.   I like to follow the forums and groups to see the progress even though I fully understand that every case is different.

This is the last stretch of this long journey for us.  3 months will be November 22nd. We are hoping it will all be over this year.  ( HOPING  )

GOOD LUCK TO EVERYONE !!

Waivers (I-601 and I-212) and Administrative Processes (221g)I-601 WAIVER UPDATES

So on Sept 2nd, our lawyer called USCIS and requested an expedite for our waiver. On Sept 19th, the lawyer sent me a message saying the expedite was denied..

So my husband and I made a call to the USCIS yesterday, after waiting an hour and 45 minutes for a tier 2 officer since our case cannot be seen online yet, we find out that the waiver was not denied and that the USCIS sent a letter on Sept 23rd  to the attorney requesting them to submit the expedite in writing along with all the information backing up our request.  So I call the attorney and he is totally UNAWARE of this letter and insists the expedite was denied.  I told him I just talked to USCIS and I want him to fax the info to the USCIS .

The paralegal filed an expedite using my name as the applicant on Aug 26th. That expedite was denied since I AM NOT THE APPLICANT.. ( don't even get me started on how she didn't know the difference between applicant and petitioner) She called a second time to re-request on Sept 2nd and that is the expedite I called about yesterday.  I think the lawyer is confused and is referring to the denied expedite that was requested wrong..   How is it that I know more than the lawyers office?    They didn't even want to take the time to call and check on our case. It is literally like pulling teeth to get them to earn some of the 6K we paid.   My husband is in Costa Rica and  had to make a 3-way call to the USCIS since they wont talk to me without him on the line. We are beyond frustrated with the lawyer.

I drafted a letter explaining in my own words why I am requesting an expedite. I sent that and a few other pieces of evidence that can go along with the original evidence the lawyer already has.

USCIS gave me the fax number that was on the letter that was sent to the lawyer that they insist they have not received yet.   :ranting:  I have had it with lawyers who don't want to work for the money they charge. Whatever happened to customer service?  I just can't stand this process... and the lawyer makes everything so much more difficult than it needs to be.   If I don't keep on top of them, they never check on anything.  Why do I have to beg for someone to do their job?   I waited on hold for an hour and 45 minutes yesterday because the call back feature doesn't work with 3 way calling. It would have taken the lawyer 5 minutes to talk to the tier 1 operator and then put in their number to be called back and then they could have worked on something else while waiting for the call back...  UGHHHHHH

Sorry   HAD TO VENT. :sleepy:

Waivers (I-601 and I-212) and Administrative Processes (221g)I-601 WAIVER UPDATES
I do a three-way call with the USCIS and my husband in Costa Rica. It works well because my phone plan allows me to call my husband's landline for free. It is frustrating that I can't call. I have seen approvals coming in Around 3.5-4 months. Are you able to track your case on the USCIS website? Our waiver was accepted August 26th but I'm still not able to check the case on their website.

Waivers (I-601 and I-212) and Administrative Processes (221g)I-601 WAIVER UPDATES

Our lawyer sent our waiver on August 8th, arrived at the Phoenix Lockbox August 11th. I didn't hear anything so I bugged my lawyer 100 times to check for me. Come to find out, Lawyer sent wrong fee so the waiver was rejected. Lawyer sent new Waiver August 21st, Received at Phoenix Lockbox August 22nd. August 26th I finally receive a text and email with acceptance and case number. Lawyer calls to request an expedite on August 27th and gets a confirmation code. So to this ...date, none of us have received the NOA1 in the mail. And it gets even better... I am still not able to check status on the USCIS website AND I called and talked to an operator and she said I have to wait 30-45 days.... I explained that the lawyer requested an expedite and the 5 day waiting period is up tomorrow but I am worried because we haven't gotten the NOA1 and the website says the case number does not exist. I have been doing this immigration thing for just about 17 months. I know the drill but this just seems a little odd to me. Shouldn't the case number be in the system by now??? at the very least????? And being the petitioner gets me nowhere with the operators.... Such a dumb rule ..

Waivers (I-601 and I-212) and Administrative Processes (221g)I-601 WAIVER UPDATES

Some ppl are getting approvals in 90 days , some are waiting

14 mths and not everyone is inclined to give specific dates as

no 2 cases are alike , there are hooks & curves, however a

timeline does give ppl an idea when they MAY be getting a decision

NSC process seem to have speed up  a bit

I have been noticing that NSC is transferring the -130s to other facilities. I hope that frees up the waiver adjudicators so the can approve faster.

Wishful thinking ..... I know

Waivers (I-601 and I-212) and Administrative Processes (221g)I-601 WAIVER UPDATES

Our waiver was originally sent on August 8th  but YET AGAIN our lawyer made another huge mistake. HIs associate sent a check for the wrong amount, so our original waiver was rejected for that reason.  Thank GOD I am such a pain in the rear-end and bugged the lawyers office about the case number and NOA1 otherwise they would not have checked and noticed the USCIS did not cash their check. SOOOO they sent another waiver package on August 21st ( another 2 weeks LOST) and I finally got a text message with our case number on August 26th. Yesterday they received the first waiver back  from the USCIS.  Thankfully the second package was already sent and accepted.   I would have been even more angry if they didn't realize the  mistake until yesterday. This is another perfect example of how you can't trust the lawyers and you need to stay on top of them.  Since our regular attorney was on vacation when the waiver was originally mailed, the other attorney in the office cut a check for the waiver application fee and a biometrics fee.  The regular I-601 doesn't require a biometrics fee.  It was a sloppy mistake and yet again we are paying for their mistake.

Our waiver is a simple case. We only have a simple overstay with no other issues. No deportation, no voluntary departure, and  no criminal history whatsoever.

There really isn't a current thread for progress updates for the I-601 waivers.  I wanted to start a thread where everyone can just post their progress.  If everyone could create a timeline and put it in their signature it would really  be helpful.  It doesn't matter when you filed.  Any reported progress really helps everyone along the journey !!

Oh, one more question...how much time before your second anniversary are you planning to adjust status? Ours is in February (just a couple weeks after you Lisa biggrin.gif ) It says that they are taking 6 months to do the aos...I'm betting it will take longer for mena men. What do you think? Do you think November/December is too early? I don't want to be bothered with lifting conditions. Or do you think it goes from the time you file and not the time it gets approved? In which case we would want to wait till after our second anniversary???

first, kicking.gif its about time!!!! you need to wait until you have the ead card in hand to make the SS application hun.

It's the time you get approved. I think we'll file around Jan or Feb, our anniversary is in Jan and that will give us a breath after all of the christmas shopping innocent.gif
Its probably smarter just to wait until after your 2 yrs..just to be safe. They have everything they need anyway(EAD, SS#)

We'll go thru that journey together too wink.gif luv.gif

awww wub.gif

U'd think they would have some kind of secure connection with the agencies that provide certified information so they can stream line these processes. THey make you run all over the place for stupid certified papers proving stupid stuff that was already proven GRRRRRRR.....

As for us, life is busy right now. Diego is in school from 9 - 3 and then working from 6 - 10 during the week. He got his license last week. I'm still working on getting my mom's old car registered, so he can drive it. For now we're sharing my company car (nice benefit that spouses are permitted to drive the company car). It's the last month of the fiscal year for my company so I'm doing my best to work miracles. haha. Can't remember if I told y'all that my company is being bought out. Nothing will happen for another 4 - 8 months, so I'm not freaking out yet. It could be a good excuse to move back to the South.

Hope everyone is doing well! star_smile.gif

Question for you all...how is everyone adjusting with their spouses? Having difficulties? Or smooth sailing?

For the most part, after the first couple of shaky weeks, we've been fine. I'm hearing from others that this isn't the norm and adjustment can take months and years. I seemed to think with our little group of friends that we're all doing okay. Now I'm asking and curious to see if I was just being blind blink.gif

Ours is normal. There are adjustments and we had our share of crazy petty arguments but we are doing fine. After my first month in here, there follows some "not so good" days.. tongue.gif

K-3 Spousal Visa Case Filing and Progress Reportsprocessing time for K3 while i130 ios pending since 6 months

hi guys does anybody knows whats the processing time for k3 visa ?

Posted time is 5 months.  There is a lot of talk about the K-3 starting again since the I-130 is estimated over a year.

I just filed my K-3 after waiting for 6 months so far for my I-130.  My lawyer advised it would be a good idea.

K-3 Spousal Visa Case Filing and Progress ReportsStrange Development (Advise)...........

Will your lawyer get paid more for the adjustment of status forms or will that be included in the same fee you paid for a CR1 visa path?

No, I can do that myself....  I just need him for our special circumstance. Once my husband is here, We're good. We will have a year and 9 months to put aside the adjustment fee.  yes.gif yes.gif yes.gif

K-3 Spousal Visa Case Filing and Progress ReportsStrange Development (Advise)...........

Why did your lawyer do that?

He received notification ( and I was given a copy of  the email notification )  that they were going to "re-start" processing the K-3's so he called all of his clients with pending I-130's and filed a K-3 for them.   He didn't charge me anything extra. ( so money was not his motiovation)  He told me it is his job to get us approved the fastest way possible.  So that is what I'm going with.  If K-3's were obsolete, don't you think they would remove the option from the official USCIS website?  Don't you think they would stop reporting the K-3 processing times as 5 MONTHS?

It just makes sense to me to cover all your options.  I'll take either/or... What ever one comes first.
