if you are filing an i601, it is around 6-9 months average time to approve/deny then another 1-3 months to get visa and come back, if you are filing an i601a then they process in about 4-5 months average.

why does it take another 1-3 months to get the Visa?  I would think it depends on the embassy.

I want to know if the waivers move faster if there is only one waiver filed or is there no difference?    We need to file the I601 but still haven't gotten approval from the USCIS (TSC) yet.   its been 10 1/2 months.   My lawyer told me all waivers get processed at the NSC.  I read on VJ that I601's go to NSC and the I-601a's go to TSC and CSC.    I wish the USCIS would get their ####### together

I've been trying to keep up with the comments on this forum, is anyone filing the provisional waiver 601a from the US?  My husband has been here illegaly for 12 years and I am waiting for our noa2 for the i30 to start the provisional waiver from here. Our lawyer has told us that USCIS is denying the waiver for reasons that they did not post on the website when the law first passed. I am really nervous about his waiver not being approved. We have a baby together, mortgage, bank accounts in common. I know i have to prove extreme hardship, so does this mean that i have to go to a counselor or that sort of stuff. I would like to get some feedback from some of you that have already or are going through the process for my peace of my mind. Thanks in advanced!

Read the guides.  You  need to  have really  good hardship reasons.   Having a child together is not a hardship.

Hello ! I will need your great advice what should I buy ( Place Pressboard folder ) with 2 hole on the folder to put my RFE copy ( I-601 waiver) in it but I am not sure if USCIS will accept or not accept  or I would get common regular folder as organized filing paper ? I will have to be prepare return to USCIS for my RFE by next week . Can u any to be share with me about this how it work like I said .

Don't waste your time and money on anything fancy.  That will only piss them off. Your file might not fit in the file cabinet and they will have to spend the time taking it all off and replacing it with a plain folder.    Use an acco fastener. Secure everything and make it as SIMPLE as possible.

Put your case number on every piece of paper you submit and keep copes for yourself

just remember..  the hardship is on the USC.... Its a good idea to back up more than one reason.  Have you read the waiver guides ?

I really tired of waiting n waiting but finally received email from USCIS today  it say RFE oh I have to make additional some information or something like and have to return it to USCIS as soon also I wonder what is ( To determine applicant's eligibility for the benefits sought ?) it will be approval after they get my RFE ?

My husband is in El Salvador, we are using the Nebraska Service center, The received our application for I-601 on Feb 2 and we just got approved June 26th, So you should be hearing something soon. I signed up for email notifications on my case status on the USCIS website. It is hard waiting, we are still waiting even though we have been approved. They told us it could take another 90 days to hear from the embassy to get through the next step.  It will be going on 2 weeks this Wednesday that we head anything yet. Good luck to you and you should hear something soon.

That is the processing time for the I-601 ? 


My waiver is already done... Just waiting to get approved by the USCIS and goto our interview....  I have been ready for this since the day I filed....  It is so frustrating just sitting here waiting

The I-212 is a waiver asking permission to re-enter the US after deportation/removal.   I'm surprised you didn't research this.   Just because the consulate didn't ask doesn't mean you don't have to file it. That is the process.  The I-601 is a hardship waiver. Hardship on the petitioner.  There are guides for waivers on VJ.  You have to have some very solid reasons.  and not just one or two.  Immigration doesn't care if the beneficiary is more comfortable in the US and has a job  etc...  The hardship is for you.   Research EXTENSIVELY or get a lawyer who is experienced in writing waivers.  Expensive but well worth it

Why do you need to file the I-212? Was he deported or did he commit a crime? I thought overstaying for 180 days+ you file I-601... someone please clarify!




He was deported but no other criminal records. The I-212 is asking permission to be readmitted to the United States. He was found inadmisable due to his overstay in the US. The 601 is a hardship waiver. Read immigrate2us. you can find out alot about waivers there.
A friend of mine has a husband who had a voluntary departure. They had to file both waivers also. He overstayed 5 years. All cases are different.

each waiver costs $545.00 to file.

I spoke to my attorney about this and he said there is no way to know whether the processing will be faster. He did say that the US is much more strict with the waivers and that the waivers adjudicated abroad have a better approval rate. :blink:

With all the love in my heart I would suggest you get some counseling immediately.  If you are so depressed that you cannot care for your son you could be in grave danger.  You need to talk to a professional ASAP.

My guess is you're looking at 601a waivers, which are processed at TSC and CSC.  601 waivers are only adjudicated at NSC.  The provisional waivers are taking less time and are averaging 4 months.  A standard waiver, where the one party at least is located outside of the United States, is currently taking about 6 months.

If you check out immigrate2us.net, you'll find that what I'm reporting is accurate.  601 waivers have a LIN# which means they are being processed out of NSC.

I don't see them listed as I-601 a waivers.    I have learned that just because someone posts it on a forum doesn't make it true.  I'm not saying you're lying about what is on another forum... just that I don't believe everything I read.

The posted time is no longer 4 months.  On the USCIS site, you'll see what priority date they were processing approximately 2 months ago.  As I mention, the current average is about 6 months.  You can't do a service request until the case is past the normal processing time.

 

She mentioned in another thread something about a bar fight.  Unclear if that fight was in the US and resulted in jail time, etc... or if there was an overstay.  

 

I think all that we know is that you can't beg and plead a consulate officer to do anything that bends the rules.  

  Not sure what website you're looking at... the I-601 waivers are posted at 4 months for both TSC and CSC.   and  yea, you can get people involved once the 4 months hits.   You do it the way you want...  but there are things you can try do to make some noise.

I don't think its 11 months for a waiver.  The posted time is 4 months.  If you don't hear anything before that, then you can get the congressional office involved and the ombudsmans office.  Don't just settle for 11 months....

collect your evidences....approvals are currently from

5.5 - 12 mths...some ppl get lucky and some dont

have you ever seen expedites approved? and if so, what is the processing time for them ? 3- 4 months or less?

wow 6-8 months, that's heart breaking :( my husband has been away for almost two years we already had all the interviews and now its all on the waiver approval. Our lawyer has been working on the waiver since February I feel like its been long enough and needs to just be sent out already. how long has your lawyer been working on your waiver?

I only went to his office to give him paperwork and talk about it like 2 weeks ago.   But he promised to have it done by the interview.  He gave me Hippa releases for my mom and my daughter so their office can call the doctor's directly. I have to write up a few things.. but for the most part I think everything is coming along.  I think I would be very angry if my lawyer was taking a few months.  I want this thing filed. If they are speeding up the approvals, I was hoping for December or January.  NVC is jsut about done. Just waiting for them to review one document that they checklisted us for. Its been almost 2 weeks since they got that..  This waiting game really sucks !!

My husband has been gone for about 2.5 years now.

 

What did they give to you at the interview for the waiver?  My lawyer says all we have to do is fax him the paper and he will include that with the  package. He can't submit it without whatever they will give us.   ( I plan on going to the interview , that is why he told me to just fax it. I'll be in Costa Rica spending time with my husband) hopefully he will submit the waiver before I return !!

I-601's are at about 6-8 months although I just saw a post where a few were approved from December.  Our lawyer is working on or waiver as we speak.  As soon as we go to the interview, the lawyer told me to fax the paper over tohim and he will send it out the same day !! We are waiting for the NVC to complete our case. it should be any day now.

Waiver approved at NSC and it took 10 months total because they also gave us a RFE. Had to file waiver for deportation/moral turpitude and illegal presence.

SO, you had to file two waivers?  correct?     How long did the RFE take for them to respond?

 

We have to file an I-601 after our interview.  I sure hope it doesn't take 10 more months. I am still waiting for my I-130 tto be approved and its been just about 10 months. 

 

Did you contact anyone for an inquiry during that 10 months?

I find that really ODD..  I was told by my lawyer that all 601's go to NSC.  Of course you send it to the lockbox and then they route it to NSC.  I never heard of any waivers getting adjudicated in a local office.     Maybe someone can chime in on that but I am almost 100% sure they go to NSC.   The 601a's might go to another service center.

 

My 601 is being sent today GOD WILLING to the Phoenix lockbox and then it will go to the NSC.  So far as I have seen lately, the waivers are getting approved in 3-4 months.  and you can never EVER go by the times they post on the website.   They are lies.  Last year they were 8-12 months..  This year they are being processed faster... but that still doesn't mean yours couldn't take 8 months. I think it really depends on the circumstances for the waiver.   Ours is straight up overstay..  no deportation or voluntary departure and no illegal activity

Because he was here illegally we couldn't file to change his status, and we were told that we were not going to need the I-601 since the NVC did not ask for it.  It is so upsetting to me that he could be here this whole time that we are waiting for this form to be approved.

NVC doesn't ask for it, the embassy tells you if you are eligible after your interview. Then they give you instructions on how to file the waiver.  Not sure how the 601a works but that is how it works for the 601. You can't file  the waiver until after your interview

It would seem some people posting on here are pro-vaccine and anti-religious freedom. To that, I say "Whatever toots your horn, and it's a good thing you don't make policy for USCIS". We are going to try. He did receive the usual childhood vaccines in France, but as an adult a 10 year regular DTaP booster is required for entry into the US, as is the HEP B. When he was 19 he decided against vaccines, to the effect that his enlistment in the French Army was curtailed by one year because he continued to refuse the (sometimes experimental) vaccines required to remain enlisted. It is HIS body, and he does have a right to say what goes into it.

You asked questions and you are getting answers;. It seems you do not like the answers that are being given, 

 

With that I will tell you a little story that happened just this past week at my daughter's school.   I got a call and a letter from the school stating that a student has been diagnosed with Pertussis ( whooping cough)  highly contagious.  Most likely from a kid who was not properly vaccinated or from a child who's parents are against vaccinations. As a parent, I feel that every child should be vaccinated.  It protects the health of not only that child but everyone the child comes in contact with.  IMO it is irresponsible to put others at risk and I would imagine the USA feels the same way.   The letter I received explains what the symptoms are and to take your child to the doctor immediately if those symptoms show up. Also that if the child is infected, they have to take antibiotics, And the entire family should take the antibiotics too even if they show no symptoms. They also highly recommend getting revaccinated   So for me, its not worth the stress. 

 

 

You are free to practice any religion you wish ( yay USA)  and to request a waiver. You stated that he just decided not to get any more vaccinations when he was 19. I am not sure his personal preference would be enough to get the waiver.. The USA has a right to say who enters just the same as your husband has the right to say what goes in his body

Our Attorney has told us to get an analysis done by a psychologist. We have a family friend who can do it free of charge, but I don't know how to sound, if you know what I mean.

 

 

Should I say that I've been going regularly? Or recently? I don't want to sound crazy! :rofl:  but I don't want to sound like I just went there just for immigration... or is that ok? I asked our family friend and she all in for it. She's amazing.
NOW, what to do? I truly am stressed. We are so poor, ugh.

What you "say" is the truth.   Seems to  me if you have to ask what to say, you aren't really telling the truth.  What will you do if the adjudicator asks for proof you have been seeing a psychologist for a certain period of time? The adjudicator reads waivers all day long... They will be able to pick out truth from the not so true...

Yep,  I'm pretty much sick and tired of this waiting.  We are at 16 months.   November will be 3 years that he went back to Costa Rica.   It seems never ending.
