I am new to this. I received the website from a friend of mine who married a Turkish man. She said this site helped her tremendously so I hope it will do the same for me. I am still researching to figure out all the forms and visas and such. I am an American women and will marry my Brazilian fiance here in Brazil. We are still in the beginning stages collecting various documents. My divorce decree, letter of being single, etc. He was in the US previously entering illegally and living for 6 years. He was issued a drivers license. He also was arrested in 2008 for driving with an expired drivers license. He left on his own he was not deported. He returned to Brazil because of his elderly mother and has been here for almost 1 year. In January 2009 he tried to get a visa to return to the US and was denied. He Say's he was told he was denied because the interviewer didn't believe his application." No one told him he was banned for 10 years.
He thinks the reason he was denied is not because they know he was there illegally but because he lied and said he never applied for a visa before. Which he did in 1999 and was also denied then, he believes because he had no binding ties in Brazil. Presumably he was probably at risk of trying to stay in the US. I am wondering what we should do? Is there a way to find out if he was banned for 10 years without causing ourselves more pain? I'm worried he does have a 10 year ban and that is why he was denied. But we have a friend who also was in the US living with his whole family illegally for 7 years they all left and came back to Brazil on their own not deported. The children were in school,had drivers license etc and they were recently given tourist visas. Hope this makes sense because I'm totally confused myself. Any help will be appreciated.


Overstaying 360 days or more is an automatic 10 year ban. Deported or not. He will need an I-212 Waiver to return.

I am a Canadian.

I came to the US and met the man of my dreams.

What would happen should we marry here-in the US now? (and deal with the paperwork after the fact?)

I am a frequent visitor and have a passport but it has never been stamped, so I couldn't establish a time of entry

And what sort of time table of events are the best way to go?

I have tried to find the answers here before posting, but I seem to get more and more confused

Misrepresentation is a life time ban with no chance of filing a waiver.
I'm sure you can find a lawyer who will appeal the case BUT I'm thinking it will be a long expensive journey with no guarantees....

Sorry me again. I did some research (stupid me) extreme hardship is part of 601. OK...but how am I supposed to WHAT we will be denied for. I'm trying to start a 601 packet to be ready for overstay but what if they find something else. Maybe I'm being paranoid. Also this will be the SECOND interview if I get reaffirmed...I have to wait for the second interveiw? I can't submit it prior?

And I did the K-3 and the I-130 (so far they are taking the same amount of time to be reaffirmed). If I close the K3 then would we still need an interveiw and an I-601 for the CR-1 visa????? :blink: I'm so confused would the I-130 be considered a first interveiw eventhough it was sent to be RE-affirmed from the NVC????

:ot: If I am a born and bred US citizen and I can't under understand the legal immigration process...I feel bad for any immigrant trying to stay here. :(

My husband needed two waivers. We tried to give them to the consulate when we had our FIRST interview but we learned that they need to determine whether you are even eligible for a waiver. They did tell us that he was eligible and they scheduled another interview where we were to submit the waivers. They told us at the embassy that adjudication of waivers is a long process and to expect to wait another year. Waivers also cost $545.00 each. . You can usually ask someone at the embassy about the adjudification time for waivers.

Also, I hired an immigration attorney to do my paperwork BECAUSE I knew the waiver would be a challenge. My waiver was 4 inches thick. I know I could have never put that package together by myself. Good Luck

We constantly hear that undocumented immigrants are not obeying the "rule of law" or that because we are "country of laws" undocumented immigrants need to be arrested and deported regardless of their situation and the consequences to either them or the U.S. These phrases are thrown about randomly because they surely sound good. Who does not want to live in a "country of laws" where we are governed by the "rule of law?" But an understanding of the concept of the "rule of law" in the context of the U.S. immigration system might better serve our national debate on immigration and bring us closer to resolving a problem that is not intractable.

Deserved respect is paid to the Constitution as a basis for all of our laws. As such, we should acknowledge that the framers of the U.S. Constitution believed that an unjust law was not really a law at all. And, as noted in Wikipedia:

James Wilson said during the Philadelphia Convention in 1787 that, "Laws may be unjust, may be unwise, may be dangerous, may be destructive; and yet not be so unconstitutional as to justify the Judges in refusing to give them effect." George Mason agreed that judges "could declare an unconstitutional law void. But with regard to every law, however unjust, oppressive or pernicious, which did not come plainly under this description, they would be under the necessity as judges to give it a free course."[27]

We are left with a conundrum on the "rule of law." Does it mean that we are to enforce all laws, regardless of their deleterious effect? Because that is exactly what we are faced with and what the Obama administration is doing with our current immigration system. The enforcement of our immigration laws (most recently revised in 1996) in regards to detention, prosecution and removal costs the United States billions of dollars a year, negatively and disastrously impacting innocent families and children, and stripping U.S. businesses of necessary labor to compete in the global marketplace.

There is an maxim in the law--"bad facts make for bad law." That reverse is also true in the immigration context. Bad law makes for bad facts. If we really want to solve the immigration problem, we need to begin not by offering "amnesty," but by looking at our laws and seeing which laws have caused the immigration problem to worsen since 1996.

The first of those laws is found in the Immigration & Nationality Act (INA), section 212(a)(9) (B)(i)(II). This law has caused more familial separation, hardship and heartache, them most of the rest of the bad immigration laws combined. This laws says that if you are in the U.S. illegally for more than 1 year and leave (even if you are leaving to "fix" your immigration situation by trying to reenter legally with a visa), you cannot come back to the U.S. for 10 years. So, if you came into the U.S. illegally, and ultimately married a U.S. citizen, you CANNOT become legal until you leave the U.S. for 10 years. Now ask this simple question, would you leave? The answer is clear, No, you would not, and neither have millions of people in these mixed citizenship homes.

Recent estimates suggest that there are at least 3 million undocumented people married to U.S. Citizens in this situation today in America. If you simply changed this law, and said there was no bar if you left to immigrate legally to the U.S., we could solve a significant percentage of the undocumented immigration problem overnight and without any costs to taxpayers. Why not make legality the norm, why not look at and change very specific laws like this one, or others like the "permanent bar" law (INA § 212(a)(9)©), or the law pertaining to bond eligibility (INA § 236), or who we define as an "aggravated felon" (INA § 101(a)(43)? By making very minor changes to our immigration laws, we can restore legality to the system and make the "rule of law" something that can be respected, instead of a platitude to the masses.

The rule of law has as its basis "good" laws. Our immigration system is full of bad laws. Laws that are unworkable in their enforcement and unfair in their impact. The Rule of Law needs to be something we can live by, not something that nothing more than a platitude.

and you don't think there will be a crazy amount of people paying off others to marry them just so they can become legal ? THey would have to secure the boarders and make sure NOBODY crosses. The human trafficing is still happening.... If they hear that all they have to do is marry someone in the US, they can stay without a penalty? or come back without a ban? Really?

HI everyone....

Has anyone had to file an I-601 in Costa Rica? I know the waiver gets sent to Honduras for processing. I was just curious to see how long the actual wait is. I was told by the US embassy in CR that is takes a year. My attorney says its much shorter. I want to hear other experiences. Please share !!!

I would guess that the file was scanned and placed in a box to be shipped to the NVC.  Maybe they wait for a batch to send instead of sending them one by one.  Sometimes it takes a long while before they get back to the NVC... OR it could be there already, it just hasn't been scanned in yet.

Her passport would have given it away if she didn't state the truth on the forms.  And the background check would have uncovered it too.   Then you would have alot of explaining to do.   Its better to file the waiver.  I have mine all ready.  its about 2 inches thick. We just need to get through the USCIS and interview.  The good thing is the waivers are now processed in the US.  The processing time is stated at 4 months ( but we all know that is just an estimate)   I would suggest getting an immigration attorney if you aren't sure what to do about the waiver.

Ok people I have to submit an EXTREME HARDSHIP. I don't know where to start, I would like a little more information on how to do it if anybody can help me please. I have (2) daughters and one is 4 and the other is a year. I was told they couldn't be included in the hardship. I have a question for you ladies. Can I show them proof that I was hospitalized for losing so much blood after my 6 weeks postpartum? Well the reason I ask is because I was hospitalized and then after that I had to go treatment for iron injection and till this day I still take iron pills because I'm so bad in anemic. That's all the things I can only get together. So if anyone could help me I would appreciate it so much thank you very much!

You don't have to answer the questions here      its just some examples of what you have to cover. 

 

I have to file a waiver also....  I have several reasons why I can't live in his country.  My waiver is about 2 inches thick.  I also hired an immigration attorney to make sure it was written well.

The I-601 waiver is processed at the NSC. Posted at 4 months but I was told just today that they are taking 6-8 months.  I don't know where the I-212 is processed.

Filed I601-A on April 3rd. Called on 8/9/13 to check status & was told they were processing Feb 10th applications. Then on August 20th received a letter that it was approved. They had told me it was going to be another 2 months? So just a note to others that not all the information you get from USCIS is totally true. I guess some applications are easier then others.

 

My wife is from Brazil & has been living in the US for over 8 years & we have been married over 2 years. She did enter the country EWI too. My question is though does anyone know how long it will be until we get an interview appointment? I've been told anywhere from 4 weeks to 4 months.

HELP!!!!

My husband is in El Salvador. We finally were approved for I601 on June 26, 2013. The Lawyer's assistant faxed a copy of the approval to My husband in EL Salvador and told him to take it to the Embassy and consulate along with his passport and then they will stamp it and then he can come home. It sounded to good to be true, so I called the Embassy in El Salvador and they want me to email them the approval (which shouldn't they have it?) and then they will verify all the information, then they will mail him a package that lets him know what to do next. I have tried to make an appointment through the Embassy website but states no appointment times available. So confused as to what to do next!! Can anyone help clarify????? #LOST #Desperate

Im sorry but for me this isnt routine and its being done because if i had the baby naturally... IT IS LIFE OR DEATH SINCE I ALMOST BLEED TO DEATH WITH THE LAST CHILD I HAD. AND YOUR REMARK ABOUT HAVING THREE C-SECTIONS... GOOD FOR YOU!! FOR YOUR ITS ROUTINE.

FYI,  most times they do c-sections is because it is life and death .. otherwise they wouldn't do them. I've had 3 of them and my first one was an emergency life or death..... so stop name calling ....   Call me what you want....  Child birth is not a reason to expedite and several have posted the same information.    The USCIS does not hand out expedites because someone is scared ... Blah blah blah   its seems to me you think you are the only woman to ever give birth by c-section.

YOU have no clue.   I have to laugh...  you come here to whine and ask about an expedite because you are having a baby.  Talk to all the other posters who had to have their babies without their husbands.  Of course it would be nice to be together but Like my lawyer told me, the USCIS didn't ask you to have a baby before your husband has his visa...  Please stop the drama..

 

My reason for expedite was because my youngest daughter was diagnosed with a brain tumor and had to have surgery..and btw, her tumor could not be removed. Now, if that wasn't a reason to expedite, then I am assuming a c-section wouldn't be either. put it this way,  ( as I was told by my attorney)  the USCIS did not ask you to have a child before your husband gets here.  I wish I had the email so I could copy and paste the reply I received.

  I had 3 c-sections.  Yea, its major surgery BUT routine. And it takes 30-60 days for them to even approve or deny an expedite. You can try but.........don't expect them to stop everything and process the expedite.  I don't  mean to sound like a jerk... I totally understand your situation ... I was just told they don't care

 

 

Also,  the information given above  is not incorrect.    It is routine.    Having a child is not a reason for expedite.

 

The advocate I spoke to at Senator Casey's office told me that expedites are few and far between. She has only seen 1 in 100 get approved and it isn't an easy task. 

 

Good Luck.  Maybe a sympathetic mom will be the one reviewing your request.

Lovemytico: my baby was born in mexico im a US citizen so I registered her atbthe embassy so she has her birth certificate and passport and social security number THE QUESTION IS MY WIFE IS IN MEXICO WITH MY DAUGHTER..MY WIFE WENT TO THE INTERVIEW SHE WAS DENIED BECAUSE SHE NEEDED THE 212 WAIVER BECAUSE SHE TRIED TO ENTER THE US AND THE LAWYER SAID SHE DIDNT AFTER HER INTERVIEW I SENT THE WAIVER PAYED 585 WITH 601 A HARDSHIP WITH NO PROOF SO I CALLED AND IM TRYING TO EXPEDITE HER WAIVER BECAUSE MY DAUGHTER NEEDS MEDICAL ATTENTION THE THING I NEED IS A EXAMPLE OF HOW SHOULD THE COVERLETTER START WHEN I GO TO INFOPASS APPOINTMENT I WANT TO TAKE THAT COVER LETTER AND THE DOCUMENTS I HAVE OF MY BABY ILLNESS...?

OK well, I was trying to help  but now that you want to cop an attitude, I'll explain that you can't just walk up and ask for an expedite and expect it to be approved. There is a process.  It has to be reviewed and granted , then the waiver gets adjudicated.  And they do it whenever they please. 

 

As for your daughter, if she is already a USC and has all her travel docs, don't be surprised if the USCIS tells you to go ahead and take her to the US by yourself.. Nothing is stopping you from doing that. Your wife is not sick, she is. 

 

 

I know about waivers, so just chill.  They are super picky about approving expedites, especially now.   If you get the expedite, good for your daughter, if not, sorry !

I would take the information up there. You can always make a simple cover letter i.e. see attached evidence as to my request for an expedite., however, i have heard of people taking the information up to the local office in an orgainzed manner so the officer(s) know what they are looking at and usually they can assist with getting the expedite in the system or letting you know what and where to send the evidence to. If you have a doctor letter from Mexico, get it translated also.

If I were you, Id get the baby all the documents he/she needs to come to the US.  I don't even know if a newborn needs a passport. Get the US citizens stuff in order, so if they approve the expedite, you can leave right  away.

I think you have to get the expedite approved before the waiver will be approved.  If they said take the info to your local office, I am guessing they mean the proof that the expedite was granted.  If the expedite was not granted yet, you need to call and ask the status .

How will you prove a hardship if you go live with him over there?   The point of the waiver is to get him in the US because you are NOT able to go live with him. You might run the risk of them telling you he has to ride out his Ban.  Just sayin'

Waivers (I-601 and I-212) and Administrative Processes (221g)HELP: My fiance needs waivers, and our NOA2 expires next month.

I was told just this morning that Waivers are 6-8 months ( if you're lucky) by my attorney and I only asked about the I-601 because that is all we need. You need 2 waivers. I don't know if they process them together or how that works.

I thought the whole point of the I601a was to get everything in order and approved BEFORE hand.....  what a scam

More specifically,it became effective March 4, 2013. So, I am curious as to where people are getting that it takes a huge amount of time? I filed for my husbandin May of 2013 and in was approved August 31, 2013. It was about 3 1/2 to 4 months.

And by the waivers I mean the i-601a. The one that took several years was the i-601.

I'm talking about the I-601 also

 

Back in 2008 they were taking a year outside of the US.

 

 

Centralized Filing and Adjudication for Form I-601, Application for Waiver of Grounds of Inadmissibility

Beginning June 4, 2012, immigrant visa applicants who are applying for a waiver of a ground of inadmissibility from outside the United States will file the Form I-601, Application for Waiver of Grounds of Inadmissibility, by mail with a USCIS domestic Lockbox facility, rather than with a USCIS international field office, or a U.S. Embassy or Consulate. The Lockbox facility will send all Form I-601 applications submitted by international filers to the USCIS Nebraska Service Center (NSC) for adjudication.

USCIS international field offices that accept Form I-601 filings by appointment will no longer schedule new appointments for filing Form I-601

Not to sound contradictory, but in fact in most cases before the i-106a, these cases were taking several years. We know at least two people who have been waiting 5 and 8 years respectively. With the i-106a, the cases are actually going a lot faster than before. Initially, most lawyers woud tell us to be ready to wait at least 3 years to get it approved. One of my friends from Boston was approved but was given still 3 years as punishment and she had a newborn son. Just some info.

I don't know when your friend filed, but years ago the waivers used to be processed outside of the US. That has changed and now they are processed within the US at the NSC.  Before the I-601a existed, they were being processed within 4 months. Ever since the I-601a's came about, the I-601's have been pushed out to 6-8 months while the I-601a's are flying through. 

 

If your friend filed before the I-601's started being processed in the US, ten I can absolutely understand why it has taken so long. Back in 2008 I was about to file a waiver for my husband at that time. It would have been processed in Honduras and the timeframe they gave me was up to 1 year.   I was never EVER told 3 years.  The embassy told me a year and my lawyer told me a year. ( not SEVERAL years )

thank you. Hopefully, yours will go by fast. On the immigrate2us page, there are still people that filed waivers in march of 2013 and a couple from 2012 also  and at the same time people are getting approved from October 2013 all ready. so it could be anytime really, hopefully quickly though. good luck. 

I hope by the time I file our waiver that they will be somewhat caught up and the processing time goes back to 4-6 months.    The current processign times really depress me.  It took 11 months and 6 days just to get approved  at the TSC.  Right now I am praying my K3 makes it to the embassy because the NVC is another 3 month wait.  We know we need the waiver so I hope they just let us go with the K3 to save time. We don't care about the adjustment fee. We just care about the time we already lost.   I hope you all get approved . This waiting game really sucks !

waivers should not take this long to process. This is just ridiculous.  It would be nice if they would just process them at the interview. They already have all the info right in front of them.  I don't mind paying the money for the waiver, its the lost time I get so angry about.  I can't even get through the TSC for my I-130 petition.  I am so stressed out over this #######.

if you are filing an i601, it is around 6-9 months average time to approve/deny then another 1-3 months to get visa and come back, if you are filing an i601a then they process in about 4-5 months average.

why does it take another 1-3 months to get the Visa?  I would think it depends on the embassy.
