Hi all

August filer here. My 130 was touched in October but my 129F hasnt been touched since August!! SCARY!!! I wish i knew what was going on

I'm a July Filer for my K-3 ( NOA1 July 29th) . My NOA1 for my I-130 is June 23rd. I never got touched for the K-3 and only one touch on Oct 2nd for my I-130. I'm disgusted at this system they have.
I talked with my immigration attorney last night. I asked him if I will cause any problems with my case if I call and bug them. He said no, but you attract more bees with honey. He told me to be nice. He also told me to CALL my congressman not to write. It is more effective. He told me that VSC is like one big warehouse and it is almost impossible to find out if my case is on someones desk.

This girl I know is married to a guy from Guatemala. He was asked to leave the country due to several drug charges, domestic violence charges and a few DUI's. He never had papers when he was here before. He was Illegal. He left when they asked him to leave as an alternative to deportation. She filed an I-130. ( no K-3) and he was approved to re-enter the country. They already had an interview. It was here not in Guatemala and he didn't attend. They are almost finished the process.. anyway, she heard nothing for the longest time.... She called to bug them and the very next day she had an approval AND an interview date. I was so surprised shocked.gif that he got approved with all those criminal offenses. ranting33va.gif There is hope for all of us. good.gif GOOD LUCK TO EVERYONE THIS WEEK ! We all can use a little Christmas magic !!!

whistling.gif I just called my local congress woman !! I filled out the privacy release form and I faxed it back. They told me they will make an inquiry on my cases. I hope they can tell me something !! innocent.gif

i Agree she is really long overdue! good.gif good.gif good.gif good.gif good.gif good.gif

I want to be a little fly on the wall at VSC and find my file and slip it on to someones desk. HAHA
I called the information line yesterday to see if they received my fax. I spoke to one person who was TOTALLY useless so I asked for another. She was the rudest, most disrespectful person I ever talked to . With every question I asked, she said " Why would you think that?" All nasty like I was an idiot or something. It took everything I had to not rip her a new BUTT.
I will be calling today. I can't see how an electronic fax didn't get received. Its not like I was sending a random fax. It was their request for evidence I was responding to.

notimeforhaterz is NEXT. I want to see an approval for her TODAY. NO BS FROM VSC...

Sonia,
There are some nice reps that work there. I talked to one who felt so bad for me she actually let me talk to an officer at VSC. She started off annoyed and a tad rude but ended up helping me with an inquiry(which told me NOTHING) heh

If you are decent and nice to them, they are nice back or the most part

I know, but for how long? I heard NVC turns out to be slower....I don't know what to do ? How long to wait.....I am simply desperately impatient............

K-3 Spouse Visa Process & ProceduresWe know waiting is a b*tch...but what are you grateful for?
Yes, I got some really nice reps yesterday. The second one I was transferred to actually wished me luck at the end of the phone call. She was very sincere... I thanked her for being so nice and for giving me the information I was calling for. I told her that the rep I had the day before was cold and seemed annoyed at the world. She apologized for how I was treated by the other rep.

So, We can't be mad at the people who answer the phones. I am sure VSC keeps them in the dark as well. I know I would feel terrible having to listen to desperate people calling everyday.

Oh BTW... I'm not locked out of the USCIS site anymore. No touches but at least I can check !! kicking.gif

I NEED A HANDGUN !!!! Aren't you afraid of guns? HMMMM I'm not sure I could shoot someone ...it depends I guess.
My husband carries a gun and wears a bullet-proof vest for his job in Costa Rica. A few months ago, someone jumped him at 1am and took his gun and his vest. He didn't fight because he didn't want to get hurt. His employer made him pay for half of the stolen gun..... and in Costa Rica, that was very expensive. The Crime in Costa Rica is unbelieveable. IF I lived there I would probably have a gun.
My husband's house was robbed back in March when I was there for 20 days. Somebody was watching the house and knew I was there.( they think americans are rich) When we went to the grocery store one day, they came in and took everything. Even my passport. It was a huge pain in the A$$ to get a replacement in time to go home. Within 15 minutes of robbing the house they Charged $1500.00 on my one credit card and $500.00 on my debit card. Most of the $1500.00 was cash advances and gasoline.
An american friend happened to call right as the police were there and cancelled all my cards for me. After the card was cancelled there were about 12 -13 more attempts that were denied. Even chinese food. dry.gif

Like how they won't undate the processing times on the website. God forbid they get phone calls from people who are out of the processing times.

My husband is bummed out. He just wants to be here with me. Yesterday his motorcycle broke down and now he needs to take 2 buses to get to work everyday. I feel bad that I can't be there for him.

K-3 Spouse Visa Process & ProceduresK-3 Weekend Party!!!
I couldn't take it anymore. I need to see him. I miss his family so much.
I was trying to hold out to see if the k-3 would get approved. Then maybe I would have waited if I got an interview... BUT no such luck. Even if we get approved tomorrow, its still a six week wait for an interview. I think I would die. I'll just fly back again... I pretty much go every 6-8 weeks anyway.

I love the excitement of flying to Costa Rica. I can't wait to see his face. Then a few days before its time to leave I get really depressed. And his family always asks me why I don't stay longer. I wish I could. Life there is so different. They are all so laid back. They lead a simple life.... so then I come back to my job, my stressful life and of course the ex-husband drama. Of course I miss my kids while I'm there. I chat with them on AOL and I use Skype to text everyone. and they call me on his cell phone.

If you go to Costa Rica, I suggest going in December or January. It is summer time then. The kids are out of school. There is more to do because its not raining everyday. And during the rainy season its like no other rain. It pours EVERYDAY. You have to carry an umbrella everywhere you go.

I can't wait to go in 2 weeks. OMG I just need to see his face. wub.gif wub.gif wub.gif innocent.gif

Yes, it is pathetic. I paid ALOT of money for the EX to be in front of HUSBAND. I am still paying the divorce lawyer off. He got most of my inheritance because he moved the money into his account and I had no access to it. He paid all his debts with my money.

Its ok because the money I paid for my divorce was well worth it. Now I just want to know who I pay to get him off my back and out of my life. We have one daughter to raise together. He needs to learn to not be so angry and he needs to realize he's not the boss of me. HA HA !!
Maybe he's mad because I don't pay any mind to him and I don't care what he does in his life

Anyway, I have to go call my beautiful husband and say GOOD MORNING. He's waiting for my call.

K-3 Spouse Visa Process & ProceduresK-3 Weekend Party!!!
OK, I'm reading the posts about the ex-husbands.... I know about this ####### all too well.

I have an ex husband that is SO bitter. He can't even look at me if we are in the same room. I am the one who left him. He can't seem to get over it. He is an angry man. He went into another relationship about a week after we broke up. Stayed with that girl for about 3 years. Shortly after my daughter had her brain surgery, he left that girl and married this other girl out of the blue. ( she is more manly than he is ) He talks SH*T to me all the time. He tells me I am a terrible mother, he tells me I need a shrink... blah blah blah... BUt I am the one who doesn't have a problem with him. I was over him the minute he walked out the door ( 2004) He is the one who can't seem to leave me alone.
I had to call the police on him a few times. The last time, the officer had to call him and tell him he can't call me names in e-mail or otherwise because he can be charged with harrassment by communication. He still conintues to bother me. Every week its something new. He tries to tell me I can't fly to Cosat Rica, He tries to say he pays my mortgage with the support he pays. ( which is less than half of my mortgage payment by the way) HE even asked for a detailed monthly report of every dollar he gives me per month. HA HA He is soooooo crazy. He is the controlling type ( the reason I divorced him in the first place) He still wants to control everything I do.
He doesn't like sharing our daughter. I think he had this master plan to try and take my daughter from me. When I married my husband he had a fit. I think he was trying to say I was a single mom and he was married. AHHHH I'm just so tired of dealing with him. every week he has a new issue he has to harrass me about.
The end of December, he got laid off from his job. Now he is trying to reduce his child support. I have to take a day off from work on Feb 24th to go fight with him in from of a hearing officer.

My ex will only communicate with me through e-mail. He is so nasty ( even in writing) He has an English degree, so he uses really big words to try and intimidate me. I saved every one. I think I have around 4000 e-mails from him. Funny thing is.... His e-mails prove that he is the crazy one. I used to get all nuts when he started on me. I always felt like I had to explain myself.... I tell my husband he is causing problems.. He asks me why I put up with him. I don't start anything and I try and ignore him because I don't want problems with immigration or the courts etc...

It is really a shame that I have to deal with him even though I am divorced. I am so over him. Its him that can't let things go. I have had several people tell me that he still loves me, otherwise he wouldn't be so bitter. I don't think that is the case but people insist. ( even mutual friends we had)

My ex doesn't understand that he is the one damaging our daughter by all the hateful things he says about me. It sucks that she has to know he has so much anger towards me. My daughter has told me that she only wants to live with me and doesn't want to stay with him and she can't stand his new wife. He has convinced himself that she is better off with him ( that is just the kind of person he is) He gets something in his head and convinces himself he is the only person who is right. Nobody else can have a say and his opinions are facts.

I'm sure I will go to work this morning and find another one of his famous e-mails. Every week it is something new. He questions my daughter and tries to find something to bug me about. I have learned that his words are only words. In one ear and out the other. I know I am a great mom. He is just an angry person. I just don't understand why he needs to control me when he has a new wife to control...

It is really hard to deal with a person who is constantly putting you down and nagging and accusing you of made up things. It sucks having to be on your toes 100% of the time because somebody might turn things around and make you look bad. I am tired of looking over my shoulder every minute to make sure my ex-husband isn't watching. When my husband is here I will start to fight back. I definately don't need to take his abuse.

QUOTE (emt103c @ Mar 2 2009, 03:44 PM) <{POST_SNAPBACK}>
We only filed an I-212. The 212 is for deportation. My husband was denied entry at the border because he was travelling with me (a USC) and we had previously filed for a fiance visa. . . and they saw that as immigrant intent. When they denied him entry, they also gave him an expedited removal which counts as the same thing as a deportation.

hmmmm and it took 6 months for them to process that waiver in the US?? Did they ask you for any additional info and did you use a lawyer?

Yes, mine was approved.

Can I ask why you needed to file the waiver? Was there any criminal charges or multiple entries or was it only one entry and deportation??

Aha! cool,

Okay, last 212 we saw go through Atlanta took 12 months. . .I think that all offices have sped up since then though. Mine took six months through Buffalo. . .If I were you, I would try the expedite, as long as you can get some proof together. Let us know how it goes.

Was your I-212 approved? My 212 and 601 will go to Honduras to be adjudicated. heard that the foreign adjudicators are less strict.

I am in the process of submitting the I-212 and the I-601. I went to our interview in Costa Rica on April 24th with my husband. The embassy is requiring me ( the USC) to come back to Costa Rica and attend 2 more interviews in which they will accept our waivers and then create a recommendation for the proccesing in Honduras. Each waiver costs $545.00 to file. I do have an attorney because we knew they would be required. My husband was deported almost 2 years ago for unlawful entry in the US. No criminal record besides the deportation. The processing of the waivers takes about a year ( so we are told) The sooner I can get back to costa Rica the sooner his clock will start ticking. Money is soooo tight right now. I am hoping to get back to CR by the end of July.

I suggest a good immigration attorney. Ask questions before you pick one. Find one that has experience with waivers.

Good Luck. My heart is broken too. But the only thing I can do is wait.....

BTW.... my husbnd will eventually get here... its just a little bit longer..... you can PM me if you want more info...

we went for our interview in CR 4-24-09. We weren't denied the visa, we were told he is not allowed to be admitted to the US due to his unlawful entry in the US in 2005. He is able to file waivers... SOOOOOOO
Our attorney is preparing the waivers and I have to fly back to CR to attend 2 more interviews where I submit the waivers. The Interviewing officer has to prepare a recommendation for the adjudicators in Honduras ( where the waivers get processed for Costa Rica) We are possibly looking at another year of processing. The attorney told us its more like 6 months. Either way.... the clock doesn't start ticking until I can get back to Costa Rica to attend the interviews,. Every embassy is different.... The waivers cost $545.00 each for a total of $1090.00.

sorry, i'm confused. why do you need 2 waivers? another year?? ughhhh, sorry! sad.gif

We need 2 waivers I-212 is the waiver asking to be allowed to enter the US again and the I-601 is the hardship waiver. All waivers get processed in Honduras for Costa Rica. The embassy is very busy . The officer told us the wait is about a year. My attorney said it is more like 6 months.... I'm leaning toward what the embassy told us since it took so freakin long for the USCIS to even look at our petitions.

Now that the holiday is over, I will be hounding my attorney so we can get the paperwork complete so I can fly back down there and get the clock started. This whole process is so annoying.

Oh wow, just looked at your timeline, both our noa2s took 219 days.

The USCIS is ridiculous..... When we filed, the USCIS was soooo backed up. It was taking them forever to approve petitions. But of course, as soon as we got our approvals.... they picked up the pace and now its more like 3 months.... and now we face the processing of the waivers.... its depressing.

Devil's advocate here. Why would you marry someone that obviously has no problem breaking the law and no problem lying about everything? Not to mention, someone who has every reason to use a USC to get back to America??? huh.gif

I second that !!! whistling.gif

If anyone has advice and has been in similar situation as us please help! I'm very sorry if I'm posting in wrong place
I am new to this. I received the website from a friend of mine who married a Turkish man. She said this site helped her tremendously so I hope it will do the same for me. I am still researching to figure out all the forms and visas and such. I am an American women and will marry my Brazilian fiance here in Brazil. We are still in the beginning stages collecting various documents. My divorce decree, letter of being single, etc. He was in the US previously entering illegally and living for 6 years. He was issued a drivers license. He also was arrested in 2008 for driving with an expired drivers license. He left on his own he was not deported. He returned to Brazil because of his elderly mother and has been here for almost 1 year. In January 2009 he tried to get a visa to return to the US and was denied. He Say's he was told he was denied because the interviewer didn't believe his application." No one told him he was banned for 10 years.
He thinks the reason he was denied is not because they know he was there illegally but because he lied and said he never applied for a visa before. Which he did in 1999 and was also denied then, he believes because he had no binding ties in Brazil. Presumably he was probably at risk of trying to stay in the US. I am wondering what we should do? Is there a way to find out if he was banned for 10 years without causing ourselves more pain? I'm worried he does have a 10 year ban and that is why he was denied. But we have a friend who also was in the US living with his whole family illegally for 7 years they all left and came back to Brazil on their own not deported. The children were in school, had drivers license etc and they were recently given tourist visas. Hope this makes sense because I'm totally confused myself. Any help will be appreciated.

Overstaying 360 days or more is an automatic 10 year ban. Deported or not. He will need an I-212 Waiver to return.
