Man I really don't want to do a competition over who has it worse.  But how can you possibly compare your three month experience with people who have been waiting for 9-10 months just for NOA2?

100% agree. No comparison.


In a way it is permission. I have hardly any vacation and if my fiancé had the same we wouldn't be able to get married for 6-12 months after we decided to get married, then we file for a visa? Or we can take the option the government provides of getting a visa first then get married, thus filing immediately. But I didn't know that option was a lesser one and because we didn't get married first our relationship is lesser and we deserve to wait. When things get rough, it shows how people really are. I don't really care about spousal visas because I didn't pick that and if all I'll see if insults towards the other path of getting married and living with your partner then I'm done.

Or spouses with no kids.

So the hierarchy would go:
Spouses with biological kids together longer than 3 years
Spouses with biological kids less than 3 years together
Spouses together longer than 3 years
Fiancés together longer than 3 years
Spouses together less than 3 years
Fiancés together less than 3 years

We can argue how many years would make a relationship more deserving for processing but that general order makes sense to me.









I don't know where the 3 years would come into it. or where you came up with that figure...

Fiances LAST...  and  Of course I have no problem with Married w/children being before me.

 

Married one year or married 10 years.....  STILL MARRIED.   Fiance 1 year or  Fiance 10 years.  STILL NOT MARRIED... 

 

You can have 3 kids with someone and marry them  right after the last kid is born... 

 

Marriage cert is proof of a commitment.

Married couples are started their life but fiance are jus gonna start their life after they marry. thats the only reason. Preference can be given to one who already started. coz the pain is more for married couple. They shouldnot end up their relationship while the CR1 is on process. the legitimate relationship is more powerful n committed one than fiance visa applicants.If fiances breaks up the relationship, they wil be still single n can get another fiance. but for married couples, if they ends up the relationship, their status wil be changed to divorced. I dont want this to happen to married couples when CR1 is on the process. If they live together , the interest n intimacy wil be increasing. It decreases the divorce case. they can stay , committed with the relationship. I jus dont want USCIS to be the root cause for couples getting divorce. Any more explanation u want?

EXACTLY....  and I am sure we could all give 1000 more reasons.....

 

We already proved that we are "together"   How many finances enter the US and never follow through with the marriage?   I'm sure its more than we could imagine.   It would make sense to me that the USCIS would make the UNmarried couple wait it out a little to see if the relationship is for real.  For all of us who already tied the knot.... we should be given the HIGHEST priority..  also the USC over F2A...  Its just the right thing to do.

Why should fiancé's have to wait for their loved ones over spouses? I believe both should go at the same speed. There could be lots of reasons why one would choose fiancé visa over spousal even if the time was the same. Both groups are in love and it's only the timing of the marriage that's different.

Please.....

 

Part of the process is proving a bonafide relationship... Being married means we already made  a commitment. (Not saying K-1s aren't committed.)

 

Alot of couples have already been married for years and have children. Why should BF/GF be processed and united before married couples?   Why should married couples be kept apart for so long?

they touched my case today at 6:30m and it went to initial review and i was really disappointed and thought we have to weight for 6months and by 12:00 pm i got an email saying my petition has been approveddancin5hr.gif smile.png biggrin.png .. iam so happy that we are a step closer now.. energy.gif energy.gif ... The USCIS doesn't run on tax dollars so I guess they don't have a high standard.  They do what they want. The biggest slap in the face is the OCT 2012 line they throw at us. 

 

I am really trying to understand how transferring files from state to state benefits anyone.... Wouldn't it make more sense to scan each file as it comes in and create a PDF version, use the electronic file to work with and store the original file until it goes to the NVC?  Then, anyone could access the file and adjudicate it.    That would save on postage or freight charges and all that time it takes to box files up and scan them in and out and whatever else they friggin do before it gets shipped...   Then , how about an automated adjudication tool?  hmmmm   just a thought.  We all know the background checks dont' take 6 months....   

 

 

But its a good thing they spent all that time redesigning the USCIS webpage.. I was so worried that would never get done  ( SARCASM)

God does not approve petitions, the USCIS does. And the USCIS is currently severely backlogged. You're going on 8 months soon. Once you hit 8 months, call USCIS and ask to speak with a human tier 2. The tier 2 is an actual human immigration officer and not a script-reader.

I was told by a tier 2 person the other day that Tier 2 is only a call center also and they are not immigration officers.  They just happen to have authorization to view a few extra screens...

I filed at NBC on the 14th of march and I got noa1 on the 18th via email,then on the first November my status changed to name change update which I did not requested for,i called them same day to know why name update,they told me that it was an error.same on the 30th of november I requested for expedite,on Monday morning I got a mail through my box from them saying that they got my service request for a decision on my application,they stated that my petition is currently under review that I will get a decision or notice of further action shortly.so on Tuesday morning I checked my status online behold what I saw was post activity that on 4th of November they sent me a notice of action that they have approved my petition. I am walking with my head and two legs up.

CONGRATS ! ! !

I know this thread is not for comments  but I just wanted to point out that 7 transfers for VJ is huge when you stop and think about how small VJ is compared to the real picture (all the actual files at NBC)  I think it is good news.  If Feb gets transferred, then NBC can work on March, which looks like is already happening... Its all good !!!

Im not going to say it again. My case has been expedited. I don't know why people find it necessary to say otherwise. I did not ask you guys to to tell me whether my case was expedited or not I asked how long do the approvals take after the expedite. Also you don't understand our situation that lead to the expedite so please stop replying to my post unless you are going to answer my question.

GOODNESS...  no need to be nasty..   just reading what you originally posted.. it sounds like it was forwarded to the team that reviews the expedite requests....    Expedites are few and far between...  Good luck with that.  I see alot of requests taking 60 days for a decision.  There is a backlog for those too.  The senators can only place a rewquest for expedite.  they don't make the decision. there is a process and the senators offices are not above anyone.   People here are just trying to help you.

 

To answer your question in this post....  They ask for 60 days to review it.   What is your reason for expedite?  Maybe someone else has had a similar experience and can shed some light for you. The letter you attached is NOT an expedite approval. It is just giving you a status report of where your file is. It clearly states it is going for review.    If you are going to post on a forum asking questions, its not nice to be mean to those who want to help  you.

Did you get your NOA2? You just mention your NOA1 date

 

 If not, the Feb and March files are being transferred now and all the approvals aren't even done for them. April is still in LIMBO LAND.  I would think you have a couple more months for your NOA2 and then you can expect another 8 weeks for the NVC.  You'll probaby deliver by then.    I know they won't expedite for pregnancy and even if they did, an expedite takes about 30 days and it doesn't carry over to the NVC. 

 

I think you're pretty good right now.  Don't stress yourself out .  You have time

I wonder if they transferred any of jan feb march april petitions or all the recent ones

my best guess would be the older files that kind of got stuck at the NBC.  Since Mayand  forward went to Kansas....  Looks like they started with Feb/March.....  and since people are getting notices already, I also would guess they transferred them a wekk ago or so...  and didn't announce it then because they would have been flooded with calls

 

 

The volumes ares low at the service centers.... I hope they just get to them and get us out of this hell hole.   I hope the NVC hired more people ( sigh)

 

 

 

Also... I don't think the clock starts over... I think this is a really really good sign.   I have just about 6.5 weeks... I hope to be celebrating with my  husband on Thanksgiving. Maybe I'm dreaming  but  ......I need something to  hope for

Here I am again,please I need update on what this means. I checked my status online and got this information; On October 31, 2013, we transferred this case I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN to another office for processing and sent you a notice explaining this action. Please follow any instructions provided on the notice. We will notify you by mail when a decision is made. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283. Please does anyone know how long it will take before we get the NOA2 of my petition being approved? I'd be glad if I can get advise and comments from March filers who got their petitions transferred to Texas Service Centres or those who after being transferred got approved so I can know when to be expecting an approval. Whew! So freaking tired of waiting for just the petition to be approved, NVC stage is still another huddle and am stuck with this silly USCIS who are just jerksprotest6wz.gif

I am at 7.5 months.  When I called USCIS last week when they changed it the first time, they told me I could not do anything because they are working on Feb 12th. If my filing date was before that, they would do a service request.   But apparently I am S.O.L.  for two more months according to the rep...    I don't really read too much into what she said but they won't do a service request for sure going by the national average. They use Feb 12th..  ( of course they do.)  LOL 

 

I hope this means they plan on approving their a$$es off this week ..  ( sucks that the holiday season will slow it all down....)

Congratsyes.gif  Finally USCIS is working now. Got our Noa2 last Tuesday ( September 24). I received a text and an email saying our case was already updated and when I checked - ITS APPROVED! - Thanks God! Now its will be another journey at NVC. (:

 

We received a letter from USCIS last September 6, saying our case was transferred from NBC (Lee Summit Missouri) to Local Atlanta USCIS center. wow after more than 9 months since noa1 (Dec.6,2012), we heared from them and our case was just sitting in Atlanta all the time. Writing my hubby's senator and Congressman really help us a lot about our case.

 

I booked him for an Infopass after we received that letter from USCIS which was September 26 to know further the status of our case. September 21st around 4p.m. Saturday, a lady called my husband saying she is from USCIS and asking some questions about our relationship. He was first hesitant knowing it was a Saturday and who will be working that day from USCIS. But he just stay calm and polite to answer all her questions because anyhow, she was not asking anything about money ( we really all know that there was a scam going on pretending to be from USCIS and asking money to speed up one's case). The lady was doing a telephone interview.yes.gif 

 

September 24 - Thanks To God! We got approved.

Sorry to hear about the delays, but usually it only takes a max of 6-7mo. from process to interview. unless you have some missing documents. 

 

Not these days... I am at 7.5 months with no transfer and no touch.  NOTHING so far.    I am not missing any document.  They are backlogged.  I would estimate more on the side of 12-15 months for the whole process.

Just so you know, the USCIS customer service operators are clueless. They are a call center.

The files are being sent to service centers not local offices.  Follow the March or April thread and you will see what is actually happening. There are 3 notices being sent . You have to actually  wait for the hard copy in snail mail to find out where your file was sent. There is a glich in the system.

 

 There is a spread sheet on the April thread that you can add your name to. We are keeping track of all the transfers to get an idea of where they are going and the approximate approval time from transfer to NOA2.

I checked the status of my husbands I-130 case this morning and after 7months i finally noticed a change, but i need to know what it means...

 

On November 15, 2013, we transferred your I130, IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN, to your local USCIS Office for further processing. The new office has jurisdiction over your case and will send you a decision as soon as processing is complete or you will be notified if further information or action is needed.

 

1. Is that normal for transfers?

2. Will this dely the prosses even more?

3. Is there something worng?

 

T.I.A hope someone has gone through this and can help me!

Yes the basic pay won't even cover half our rent. If there was another way I would not request an expedite.. All of this is submitted as out supporting documents.. Sweden is a great country and I'm in no rush to get out of here, of course I want to be with my husband when he has to leave, but what's another few months? And me and the kids could travel to visit. But financially we can't get it to work, no matter how much we twist and turn it all.. My husband is in construction and doesn't make that much in the states.. And living expenses in Sweden are 30-40% higher than in Washington state.. All I wanted to know was how the expedite process works after it's been submitted. However it's a legit reason or not is up to the uscis, but since both the uscis ombudsman and the senator thinks so, I think I believe I have a case.

 you can work PT  while waiting to be approved....    right?

Seems like the OP might not be in such a position, 420 days and then you do get something even if you have not been working.

I didn't think there was a law that stated you CAN'T work, you are able tot take 420 days and still have money coming in.  I'm sure there is some kind of help for housing if it ever came down to it.   Even if the expedite was approved, it would still take 2 months at ehe NVC and however long to wait for the interview at the embassy.

 

Does anyone know how fast the interviews get scheduled for Sweden?

 

Expedites don't carry over. NVC is a different animal.

12 months yes and the benefit system is based on your salary and iv been staying at home with my firstborn, single parents can get help but in not a single mother and am married and have joined custody, so that's the catch. Nothing that says that both can't live abroad, a few years back those cases got expedited automatically.

so your saying, the law states you are not allowed to work if your child is under 1 year?    Or you can work, you just choose not to?

I thought Sweden had a pretty good benefits system, long maternity pay etc?

Im confused?  is there some kind of law that forbids one parent from working after the birth of a child?    That makes ZERO sense to me.    What if its a single parent? 

 

And even if they get approved tomorrow, The NVC takes approx 60 days, and the expedite doesn't carry over. They would have to request another one.  And then the interview after NVC.. Depending on how fast Sweden schedules.. It could be a while. 

 

Doesn't the petitioner have to be set up in the US anyway?   So that could be a road block too since he lives there with her.

Personal Experience:  

1.  At the time you submitted your expedite then they should have asked you for a email. 

2.  They process the expedite request in 3 days. 

3.  About the 3rd or 4th day mark they will send you a email asking for you to submit documents if/or needed. 

4.  In 7 days from when you submitted you will recieve a generic snail mail letter saying they recieved your expedite. 

 

Now this is where is gets quiet and your no longer provided any more information.  They will not send you a email or letter saying approved or denied.  You can call and talk to a tier 1 (does not have access to it) or a tier 2 (does not have the most up to date information).  The best way to find out on your status of the expedite is to get your congressman or senator to do a status check on your expedite (which gives you the most up to date information).  That should only take about 3 or 4 days depending on the workload at the congressman/senators office.    If your approved on your expedite request then overall adjustment on your I-130 estimated time should be 25-60 days from the time all documents are submitted (even though they tell you 30 days) but they do not process them in order recieved.   This is just my personal experience and I'm sure other peoples have been different. 

THEY DO send a denial letter..


And pregnancy is not a reason to expedite.   You should have heard something by now

Merry Christmas !  I hope the USCIS has Christmas on their minds when they are adjudicating files. We are all waiting to be our spouses while they get to go home and be with their familes everyday.

my question is... Why have you waited so long to contact anyone?  Go straight to the Ombudsman's office and demand that  you get an approval ..   They will be able to help you since you are out of the processing times.  Also, put in a service request and also request an expedite. 

 

I can't believe you waited this long without getting people involved

I talked with tier 2 and i told her that look like my expidite case approved and can please you give me more updates.

She told me that I am sorry, you involved your congresman in this case. So now, we can not give you any more information.

All updates will go to the congressman.

Yup, that is a lie.....  call again and try to get someone else.. tell them you were told to call back today !!     They absolutely can give you updates.. You are the petitioner.    Make sure you write down their employee number when they answer your call.  If they tell you that garbage again,  complain to the OMBUDSMAN'S office that they withheld info on your case.   That's what I would do

IR-1 / CR-1 Spouse Visa Case Filing and Progress ReportsUSCIS answered about my i-130 expedite request and i am speechless.

i requested on 11/29/2013.

I involved my congressman on this case.

They told my congressman that they are checking my backgroud and they will update me soon

when they finished checking my background.

i do not understand WHY uscis checking my background (history) for my expidite request.

Whats that mean????

What they check in my background?

sounds like they gave you a GENERIC answer....  Thats what they tell you when you are in initial review ..  They are checking your background.    Hopefully they approve you.. Try calling a tier 2 and tell them you heard your expedite was approved  just to get info from them..

wait for the hard copy. I heard of  a few operators tell people they were transferred to a local office but they really don't know what they are talking about. They are reading a screen.  The hard copy will be the notice you will go with.

April 10 and onward NOA1 have been receiving their NOA2. What could be the reasons behind this? They did not misplace my packet, did they? I'm the USC and actually a dual citizen (Philippine). Is my case supposed to take longer than the rest?

I'm April 12th and transferred to TSC and still nothing.
