I asked my lawyer but I haven't gotten a response, figured I'd see if some of you could assist. I do appreciate it!! I have an attorney also... He told me 6 months.  Before you go running off to live with your spouse, read the NVC thread about what is required if you live abroad to establish domicile in the US.  If you can do all that, then go for it. IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports	Could use some assistance!	Look at my signature. I was just approved YESTERDAY. it hasn't even been 24 hours yet... 11 months and 6 days. When I filed the processing times were posted at 6 months.   If I learned one thing during this process.... its that they are all liars at the USCIS. Nobody really knows what is going on. There is no "set" processing time and you get different answers to your questions every time you call.   There is a huge backlog which they say is being taken care of  but if I were you, I'd pull up a comfy chair and grab a snack... you may be a while. Probably not 11 months like me, just don't put all your eggs in one basket.   Read read read this forum. you get better answers here than when you call the USCIS.   I hate to be Debbie Downer, I just want you to know that the posted processing times are all for show. Yup, I said it just like that !! and she said YUP.   They did tell me I can call back as often as I like on one of my previous calls... so that is my exact plan.  I have a redial button on my work phone so why not ???  I usually get through after only 3 or 4 redials.  If you call early, you don't even get a busy signal.    I always say good morning and Thank you  have a nice day.   They only answer phones.. My case was shipped on 3/24. It's like they use the pony express to ship the files...smh HA HA   Yep.. PONY EXPRESS at its best !!   Nah, they just tell you that in hopes that you won't call back !  LOL   this morning  I called   Me:  Hi can you check to see if my case was received? Them: Sure, what is your case number? Me:  MSC XXXXXXXXX Them: no, it wasn't received yet. Do you have the approval letter yet? Me: Yes ma'am, I was aproved on the 18th. IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports	NVC Filers - March 2014	good info, thanks,,, when I called aweek a go to see if I can just go with k3, they told me I need to send a request to NVC and ask to process my k3, did she mention anything like that,,,,thanks I didn't hear anything like that.  I wonder if you can email them instead of writing a letter and mailing it snail mail..  when  I was sending letters to get my case pushed through the USCIS, I mentioned in every letter that I prefer my K3 over the I-130. Senator's office kept telling me that the I-130 took precedence . My lawyer also told me we don't get to pick.  Now I have another reason to call NVC again today !    NVC just told me last week that K3's are priority. They get signed in first and shipped out as they are received. Our DS 261 is still not accepted, our package is open and on a review, and to wait 30 business day for IV fee to be available for paying... I told him about yellow triangle, but he sad that doesn't meter, just wait, maybe it'll be sooner, but he can't promise HA HA   I spoke to Mr. Waldo this morning too !   He was super nice ! IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports	NVC Filers - March 2014	I have an attorney ONLY because we need a waiver.  If we didn't need a waiver I wouldn't have an attorney. He did NOTHING the entire 11 months we waited for the USCIS to approve my file. I am the one who followed up and sent letters. His answer to immigration is  " let them do their jobs"  I am the one who informed him that we were approved. I have sent 3 emails asking him about the next payment and asking what do we need to move forward...  I have not heard ONE WORD and I was approved on March 18th.    I am trying to pay the man and I still haven't heard anything.    He charged us $5000.00 because of the waiver and because I am a repeat customer. He normally charges $7000 for the services he is supposed to be providing. My  husband paid $1300 when we filed. $2000 is due when we get approved by USCIS and the balance is due when he enters the US.  But things should change if the K3 makes it through. IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports	NVC Filers - March 2014	here is a little tidbit of K3 info incase anyone cares compliments of the very nice women who took my call from the NVC.   K-3 and adoption cases have priority when logging them in to the NVC. They get case numbers and then get sent to the emabssies or final destination. Mail and DHL arrive all day long at the NVC. Not just 10am and 2pm like FEDEX.  She told me they hear over the intercom all day long that there is a delivery of some sort because the doors have to be opened.  She told me to keep calling.   She said for an I-130, allow 30 days to get a case number.   I told her to throw my I-130 in a dusty corner ( she laughed)  She also wished me luck on my K3.  Such a nice lady. I wish they all could be that way.      and just incase y'all are wondering... I have my heart set on the K3  but I hang here because knowledge is power and if I get stuck going the I-130 route then I should have more knowledge than my lawyer.   He has done NOTHING for the last 12 months and I emailed him 3 times asking how he wants his next payment.... Cash in person or can I fedex a check... but haven't heard a peep.  If we didn't need an I-601 waiver, he'd be eating my dust....   If your case is straight forward, there is no need for a lawyer. Please?   There was no problem with the information being given it was the delivery.    Please don't continue the bullying.  We all know how everyone feels.  LET IT GO...   THETIMEISNOW deserves to be here without the fear of asking another question and being bashed for it. ( as everyone else does too) I don't have time to catch up totally in the morning when I have over 100 notifications for this thread... I don't have that kind of time. We all should be able to post a question without feeling like someone is annoyed.  This process is long and confusing and maybe it doesn't make sense sometimes.  We don't want to make people feel like they can't ask a question.   You never know what information that person has to offer. IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports	NVC Filers - March 2014	I got case number for my I-129F after two weeks NVC got it. However, that number never worked on the CEAC website and they never sent my I-129F to the embassy. We tried very hard to tell them we wanted to get the K3, but they said it wasn't up to us, that they would make a decision over that. Our conclusion is that they closed it because our I-130 and I-129F got approved at the same time and NVC probably got them both at the same time, so they decided to processed our I-130 instead of the I-129F.   My guess is that people who actually see some movement on the I-129F, like NVC sending it to the embassy and emails about it, is because their petitions I-130 and I129F got approved on different dates; therefore, both petitions get to the NVC on separated boxes and then they both are processed. That's just my guess... THis is what I hope happens once my files are received..   K-3 gets a number and sent off to the embassy. I-130 gets thrown  in a dust pile and forgotten for a month or so. Just long enough for us to attend an interview and fiel our waiver.    But of course since I just said that...I won't have it my way.    so if the case number works on the CEAC then I might have a good chance? When your petitions get approved you have to decide what path. You already started the CR1/IR1 ball rolling so to the embassy you decided.   That's why they get closed. If you wanted K3 you should not be doing anything at NVC and let it sit. Sorry. NoelAnne is only following the K3. Sh eis afraid they will cancel it mid-stream. IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports	NVC Filers - March 2014	Can you or the attorney not instruct the NVC to close the i-130   You could also stop the process for the i-130 by not paying the bills I have told my attorney I prefer the K3 and he just tells me we don't get to choose.   And yes, if you don't pay the bills for the I-130 then it just sits there.   When I did a K3 back in 2008, I ended up withdrawing it.  never withdrew the I-130 because I didn't pursue it..  FAST FORWARD to Nov 26th 2013  the day before my current case was transferred to TSC.... they REVOKED the decision on my other case..  I thought it was invalid after one year... apparently not.  it was sitting there and had to be revoked ( because it was approved)  so my current case could move forward.   I have already begged for my K3 to be sent to the embassy. They take you guys all the way up to the minute than cancel it all.   I guess Big Government really doesn't want to make more money. Cuz look at all the K3's in the works and the extra revenue it would generate. OMG maybe help to hirer more people. (Sorry was dreaming )   Just been following so many K3's here and this is happening over and over. And the couple who did get through it was just days before NVC was done with I-130. Like big deal.   Really sorry B&T_P. this case was different because they already started the I-130 process and paid a fee.  They only inquired about going the K3 route. They didn't start anything. They already paid one fee at the NVC.  They were trying to go with the K3 instead..   Its good that you don't have a case numebr for the I130 yet if you want the K3.    Hold out for a little longer   I just called to see if the horse and buggy delivered my case to the NVC.   The Bruja who answered told me again I have to wait 8 weeks...  I can't stand this process. IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports	NVC Filers - March 2014	I already called NVC twice today: The first time I was told I-129F is on hold because of I-130. The second time I was told that the it is not the case and the I-129F will be sent to the embassy. When I asked the lady on the second time what the firtst rep told me, she said that she could've made it up. I asked to talk to a supervisor and the supervisor confirmed that the I-129F IS NOT on hold because of the I-130 and that I will be sent to tembassy for further processing after undegoing necessary admin processing. Who to believe now? NVC expedite told me (in an email) that it takes 2 to 4 weeks to send a K3 to the embassy. So, I'm on the third week now, 10 more days to go and we shall see total #######.... its like USCIS all over again.    I'd say get the Senator involved but my rep told me the I-130 takes precedence and not to expect the K3 to go anywhere.  I still think it is case by case and I am still holding out for the K3.      2-4 weeks is stupid too.  Unless they hired Horses at DHL.     Last time I did the K3, it only took a week for the file to get shipped out after it was received by the NVC and I was able to track it by DHL to the embassy. It took 2 days.   It also depends on how many they have to ship to that particular embassy.  For the countries what have tons of petitions, that could be the reason they are holding out.  For a small country like Costa Rica, I doubt there are many to send at one time.   I guess alot of things come into play.  I'm praying for you. I'm trying to talk to a supervisor to try to have them either send the I-129F to the embassy or at least move up the I-130. I called like 10 times and every other time I'm told the I-129F is undergoing admin. processing, and the other times I'm told it is on hold because of the I-130.   Get your SHI! together NVC!!!!!!!!! the guy I talked to told me if the K3 gets there first , they will send it out to the embassy.  Its so strange that they are holding it for the I-130.   It all depends on who is receiving the files I guess.   He did tell me that if they search the system and see you have another file with your name on it, they will combine them.  Maybe those losers are searching for your I-130... do you have a case number for the I-130?   Maybe when you talk to the supervisor... you can ask them to just forward the friggin K3 .  this system is so stupid.  Why even bother having the K3 if you don't foloow the procedure anyway? How long did it take to get your case number and for the embassy to receive your file?      I can't stand when NVC blurts out some stupid ridiculous timeframe for receiving files via DHL.    I was told 8 weeks just to receive the file from TSC.  I just want to reach through the phone and strangle them. For K3   Love my Tico, can I use it, can I stop now temporary the cr-1 did you already start the process with the I-130?  I am not positive, but once you start that pprocess you cannot proceed with the K3.  its strange that they sent the letter from embassy. it goes to show they don't communicate with each other.   Are you able to call the embassy and speak to them directly? Or send an email?  In my experience, the NVC customer service people are not well informed about what happens with the K3. They are programmed to tell you that the K3 closes once they log in the I-130 and find out there is another file with your name on it.     Each Embassy is different.  Call the embassy and explain your situation and ask if you are still able to proceed. Worst case is that you wasted money paying the I-130 fees and then you have to pay the Visa fee for the K3.   Not a big deal in my opinion if it means you can pursue the K3 and be together faster.     I'm a little disappointed to see that your K3 took so long to make it to the NVC.  In my world, when you receive a notice that your file shipped out, then the file should be shipped and the NVC should receive it in 2 days via DHL.  Add another few days to scan it in.   But then again, thats my world  LOL LOL LOL LOL   Yesterday I spoke to an NVC rep. He said the cases are sent in batches ( which I already knew) and it is up the the service center how often they send the batches. It could be weekly, bi-weekly or even less frequently.. He told me they are shipped DHL (but you'd think it was horse and buggy since it takes so dang long.)   He told me if the K-3 gets to the NVC FIRST, then it will be forwarded to the embassy but if the I-130 gets there first they will close the K-3 .  Obviously that is not completely true since your case still made it to the embassy.   I can only HOPE all goes the way I want.  I sent a message to the embassy in San Jose Costa Rica just to feel them out and see if they would respond. I only asked a few questions... To my surprise, it only took them a day to get back to me.  I am glad to see they are on the ball. ! !   Let us know what you find out. Yesterday I was reading on the Costa Rica medical info page that if you don't have an immunization record, the doctor will discuss with you what  you will need.  Now that is for Costa Rica. The immunization rules have changed since 2008. They never asked for it back then but now it seems like they need all of that.  Thank god my mother-in-law has all of that info for my husband to take with him. IR-1 / CR-1 Spouse Visa Case Filing and Progress Reports	NVC Filers - March 2014	yes it is normal,,, mine also has expiration date,,,have you started the process yet?? It was just shipped to the NVC yesterday  I am praying it gets a case number and ships right down to Costa Rica .... My husband wants to make his medical appts  on the same day since he lives so far from the city.  Costa Rica will call him to come pick up the package. Once it is received by the embassy I'm going to call to see if they will email everything so we can get started. I don't want my husband to go pick up the package then have to drive back down to the city for appts .  Gas is so expensive over there ....     I can't wait to get this thing moving     some where on VJ there is a post about how to track your case with DHL to the embassy.
