Is your husband gonna be able to come to the US after the approval at the visa interview? or do you have to wait for the waiver before he can actually come to the US?

No, since he is in Costa Rica he has to wait it out until the waiver is approved.   The illegals get to stay in the US while thier waivers are processed... ( not sure why our government decided that was the way to deal with it ) 

 

 

That's why I am in such a hurry.   He went back to Costa Rica ( on his own... not deported)   almost 2 1/2 years ago.  The 11 month  USCIS wait was horrible  and now we are in a hurry to get through the NVC to get the final leg of this journey  under-way.

I think they are doing this in purpose!

I paid IV fees on 21-Apr and it still shows IN PROCESS. I can't access DS260 yet.

I think they are backlogged again and just decided to stop the process for sometime to allow them to catch up and then it will pick up again.

I hope I'm wrong

The same thought crossed my mind this morning. I swear its their way of controlling the workload.   

 

I have to say... it is much better than the exhausting wait at the USCIS. At least here you can log in and actually see something.  You don't feel like you're being lied to everytime you call and talk to tier 2.

 

The answers seem to be more consistent here.   Maybe the 30 day answer is not what we want to hear, but at least it doesn't go back and forth from 30 to 60 to 45 days.   

 

This whole process stinks... 

 

Not looking forward to the waiver process. Its back at the good ol' NSC.  I wonder what I have have to do  to try and get an expedite? Do I have to sell my soul to the devil?     I just hope since they changed the regular processing times back to 5 months... just maybe they will change the waivers back to 4 months instead of 8 months. ( or process the I-601 waivers before the I-601a waivers )    I will be lost without everyone on this thread....  :crying:  :cry:

Just wondering how long does it take after the case gets completed for NVC to transfer over the case to the local embassy? And the embassy to actually send a physical letter to the applicant for interview. I herd there's about month and a half gap between the interview notice and the actual notice. Is that right or is it a case by case basis?

depends on the embassy.

 

 

I plan on tracking the file to the embassy and then calling  them to schedule something if what I get is not good.  My phone plan includes free international calling to a landline.. ( sorry for them :rofl: )

hey guys wwe need ur help .. i have submitted a DS 261 form a day back .. now when we try to go throught to pay the Fee 88 $ it wont even let us to login and showing the error  below .. No, I meant May. 

The guy at the embassy told my husband they will work with us.. He said everything goes really fast once they get the papers. And since Costa Rica makes you pick up the instructions, he can get them and start on all his stuff and have it done.    He can go get the police cert the sam eday he goes to the embassy... and the doctor/lab/radiology are all near each other.  Maybe my husband can work it out to knock them out in a day or two ( of course depending on their openings )  

 

I have no problem flying last minute.

 

 

yes, I'm in a rush...    the lawyer's mistakes already caused a delay that I am really pissed about.  I have an appt with my lawyer this Sunday afternoon.  We will be discussing the waiver and what I need. I want it complete when I go for my interview so it can be filed as soon as I bring the waiver eligibility form to him.  I might even fedex it to him while Im still with my husband.

No, not all members are up to date. I try going through the non-case complete section about once a month, going to every member's page and seeing if there's updates. But, I've never had this long of a list before, so I haven't gone through it in awhile as it's daunting, haha.

 

Plus, I created the form only last month, so those that were added before that may not know about it, thus they haven't submitted updates.

 

Plus, some people just fall off the map and never return to VJ. In which case, after one month of not logging in, I remove them from the spreadsheet.

thats what I thought. The numbers might be a little better if they would come back and update us.   Its the same with the USCIS VJ timeline issue.  Alot of people drop off and never return.  

 

So glad you remove them after a month. That really helps !!   AWESOME ! ! ! ! ! ! !! !

 

AS it stands now.. it looks like they are now taking 3 weeks to process the packages and give a Case Closed ! !   Not good for me... I need a May interview so I can submit that stupid waiver  .  A May interview would still only  give me only a glimmer of hope to be approved by December.  I hate that I had to waste 11 months at the USCIS.  ughhhhhhh

no,  only the K visas need to adjust.  For the CR-1 you have to clear conditions because it is only a 2 year green card. IR-1 is for couples who are married 2+ years. That is an automatic 10 year Green card.

If I submitted document for checklist to ATTN:DR, and NVC received the package on Monday, how long does it take for them to open it, scan it and review it and then add it to the case?

They say 30 days but the spreadsheet shows about 2 weeks. They seem to be dragging this past week though.  There are alot of people who are due for Case Closed this week !

Yes my I-130 has been sitting in Vermont since 12/27/13 with no movement at all, while the K3 was processed and approved within 3 months. For this reason i'm cautiously optimistic. Even if they pull the I-130 and pair it up, that's shaving some time off the wait I think/hope?

Does that make sense or am I way off in my hope?

 

ok, you may have a good chance....

 

The K3's only stay at the NVC for a case number and then get shipped out to the embassy. If they don't have your I-130 to match with, then it will go.  Where was the K3 approved at? 

 

Call often and get your case number. Then call and verify that it shipped to the embassy.  You can go online and fill out the DS 160 once you have a case number.  Contact NoelAnne because she just went through the whole K3 process but they cancelled it because her I-130 was approved.  She was lucky because they just sent the I-130 to the embassy instead of making her go through the NVC.  She had her medical done and was ready for her interview.    She may pop on if she sees this post

I'm from Nigeria, you can't get notarized copy from a local bank, I got the certificate from the hospital where I was born.

Usually the hospital birth certs are just for a keepsake.  The official Birth cert has to have the registration numbers on it .

 

My husbands came from the registry in Costa Rica .  Its an antique for sure. The registration numbers are along the side . I hope they see them !!

No, i filed for the i-130 first then the i-129F which can be for married couples (in theory to make the separation time between my wife and I shorter while we wait).

It did get approved within 3 months which is much quicker than i anticipated, now i'm hoping that either:

1. the I-129F (K3 visa) makes it to the embassy quickly or

2. the I-130 application gets pulled out of line and paired with the already approved I-129f thus saving a few precious months of waiting.

 

Any advice/input from any/all members would be very much appreciated.

if that's the case.... you might make it through  but if they scan your I-130 and see it has a K3, they will match them up

        Hello,  this question is just cause I'm curious and clueless but why would you file for both?  One is for married the I-130 and the other is fiance am I correct?  So the I-130 would mean your married which would automatically cancel I-129f correct? (F) (F)

K-1 is the fiancé visa.  The K3 is for  married people but processed the same way as a K1.  It used to be faster. It was created because the I-130s used to take years.  The K3 is faster if they let it go through . When you get to the US, you have to adjust status ( just like the K-1s) and it costs about $1000 more.  You can't work for a few months while you wait for your work authorization.

 

We filed because the lawyer heard they were bringing them back....   I prayed for the K3 but it was cancelled. The kept saying the I-130 takes precedence blah blah blah   I wanted the K3 so bad because I used to stalk this thread  and I saw how long it was taking. We still have a waiver to file( 8 more months at the NSC)  so hanging out at the NVC for another 3 months was just a big waste of time.   But I am almost through and I only arrived April 1st.   So I guess we'll see.   Its been a long journey. 11 month and 6 days at the USCIS was so horrible.  It kills me to see people complain about this process when they only waited at the USCIS for 5 months.   Walk in my shoes and then start crying !!!

I had to call again...  Talked to Jack !!  He sounds young  but he was super nice ..

 

OK, so up til now I  didn't ask why my file got a case number the same day it was received..  He said that it was probably PURE luck because he never ever saw that happen. Somebody was probably sorting through the mail, matching K3s with I-130s and they entered mine by mistake or somebody was working on the wrong box.   Either way, I told him he can send a thank you note to that person. He said even if he could see who it was , they probably work a different shift. 

So, he said the K3 probably helped but he can't say for sure.  Also it won't negatively effect my case..

 

I was able to pay everything within days.  It went really fast. 

 

He also explained again that they will look at my first package and send out a checklist for the items that are incorrect on the lawyer's AOS.  Then a couple days later they will process my corrections.

 

He said the files get scanned when  received and placed on a shelf and they get processed in the order in which they were received.  And of course I had to add my comments about the USCIS being the total opposite. 

 

He gave me the 30 day talking to and said I am calling way to early. I told him we have a spreadsheet that says 2 weeks.   HA HA

I am in the same boat.NVC received my I30 case by april 16 .Now I have to wait 30 days for NVC case number.
I saw some people are getting NVC number after a week of NVC received case.How it is possible?
 
I am not understanding that in this month lot of aprovals then why NVC is not fasting their process....

Happy to be accepted into this phase of the journey.

Here's my timeline (not sure how to put some of this info on my profile timeline)

1-130 NOA1 on 12/27/13 (Vermont Service Center)

I-129F NOA1 on 1/9/14 (Texas Service Center)

I-129F NOA2 on 4/16/14

I-129 shipped to NVC 4/18/14

 

Can't believe there are 271 pages on here! Just a general question. Are people finding that the 1-129f moves through NVC faster than the I-130? i'm really hopeful my I-129 goes all the way to the embassy before they get to my i-130.

Your K3 will be cancelled.  Plan on going the I-130 route.   There was one that got through to the embassy but it was cancelled and transferred to an I -130.  Mine was cancelled a day or two after it got to the NVC. Look at my signature.   I prayed for the K3... Its fine though..   I was mad at first but I made up the time.

It is really hard to give you an answer - for it really just depends.  My petition took 25 days from TSC to NVC.  Another person had 6 days from TSC to NVC.  There does not appear to be any "standard" shipping time.

I really feel like they are controlling the workflow by only allowing a certain number of fees to be paid and assigning case numbers at all different times   etc...

 

Some people wait longer than others.  I guess it depends on the daily files they receive. 

 

The mail received goes in a que sort of. NVC told me they process mail by date received.  So they will process my original package with my AOS and IV in it and then 3 days later probably get to the correction.  

 

I would be pulling my hair out if I were still waiting for a case number.  I am from the April 2013 class.   I have done my time.. I want out ...

Talked to Kelly this morning at the NVC.

She told me that they review the DS260 first. And it takes 30 days for them to review it..  Then they review the AOS and IV.

 

Obviously an inaccurate answer . I really hate the 30 day line they give.  

 

I was really just checking to see if they did anything with my case since I called yesterday morning.   I know I'm jumping the gun a little.

 

After waiting 11 months at the USCIS, I just want the NVC part to be over. :protest:

NVC told me they can't review the DS260 without reviewing the AOS and IV first....

well thank  you !!!      I'm still mad at him. I haven't heard a peep from him or the paralegal.   They haven't even asked for paperwork or anything.   Nice work, huh?  I think I'm just going to ask him to flip the $2000 I just paid for NVC processing and use it for the Waiver and just be done.  I don't want to piss him off because he has all my paperwork.

My husband just text'd me and told me he called the embassy regarding the police certificate.  They insisted he wait until our case is complete because so many people try to get ahead and get everything done before they receive the instructions. When their papers get to the embassy they are wrong.  The man told him once the papers get to the embassy everything goes really fast.   My husband is happy now !

 

And as far as the vaccinations go... my husband needed three that weren't on his vaccination record but are on the immigration list.

1. Varicella ( chicken pox)

2. Tetanus

3. I forget the third

 They didn't give the flu shot.

He never had the chicken pox as a child so they gave the varicella to him. He is 34 years old. The Tetanus is normal. I think the US gives it every 5 years now instead of every 10. 

 

It doesn't matter where you get the vaccinations, as long as you can prove you had them. If you are all up to date then just hand over the records.  I would bet most people would need a tetanus if they haven't had one within the last 5 or 6 years.   I have no idea what the civil doctor would charge. My husband's were covered under his insurance at his family doctor

How long till I get case complete, my IV was entered into the system on the 9th, that's the only thing left to be reviewed,AOS already reviewed and accepted, including ds-260

But remember I had to send the corrected AOS because I trusted the lawyer ... GRRR...  but that was received only 3 days after the first package.    Best case... they look at the original package today and tomorrow..issue my checklist and then pick up the correction on Thursday or Friday.. I'd be fine with a CC before the end of April...  

 

I know I'm getting a checklist.... mostly for the incorrect income amount that the lawyer INSISTED was fine to use and the lack of his stupid signature...   I sent the AOS correction myself  with another transcript and copy of the 1040.  Had to correct my husbands name and address too. 

 

Crossing fingers and toes that the lawyer sent all the correct civil documents  and I don't get a checklist for that too.   You'd think since they are immigration lawyers  that they would know what is required...smh   Goes to show that you can't trust anyone but yourself.
