"What is the processing time expected to be for stand-alone I-130s filed by an overseas petitioner? 

Response: The current processing time for stand-alone I-130s filed by an overseas petitioner is 
approximately 60 days from the date of receipt at NBC"
 
The document is dated May 10, 2013 so just when we filed.
 
As for LoveMyTico's comment, no we don't expect miracles to happen, but we are also not comfortable just sitting here doing nothing, not saying there's anything wrong with just waiting, just not our style. Ombudsman is next at 6 months, although I doubt that makes any difference either. Contacting a congress(wo)man and ombudsman office are really our only options of doing something, so we make do with what we have. If anyone else has any better ideas, would love to hear them.

 

I wasn't trying to be nasty.... Nobody is worse at waiting than me.  I will contact my senators office every month from now on.. and I will try and find other ways to get more info....  It might not do an damn thing.. but its better than sitting here doing nothing. 

 

 you have to realize that no matter what is posted about the processing times,  they are only estimates. They don't hold themselves to it, and they don't let anyone hold them to it either.   The goal for processing at the USCIS is 5 months. but the average is 9.5 months.   goes to show that they don't care.   If there were some kind of competition out there where you could pick your own adjudicating agency, then they would be processing their littles asses off.   But since its the only place we can send our papers, they get to make the calls.

I inquired twice for my case... both times I was told the processing times have increased to 9-12 months

  The posted times are only estimates...   you can file a complaint with the ombudsman.

You can print the transcripts in 3 seconds. Then fedex it tomorrow for Monday delivery. Don't waste any more time

They send them in batches. If you are lucky enough to get approved right before a batch is sent, then it goes right away. There is no set time for batches either. I had this conversation with NVC when I went through it. NVC told me they receive mail all day long. There us an announcement over the intercom system  every time mail comes in.  There is no set schedule.  Mine took 11 days to get from TSC to NVC

lets say your document was scanned September 10th and they then lost it....if you resend your document and they scan it on October 10th then they will review it based on your September 10th scan date. This is what a supervisor told me though so it may be different in your case.best option is to talk to a supervisor.

how can they review a package that they lost???

the baby will be a US citizen. You don't need to add him/her.  Just register the birth and get a passport for the baby.

Good day all...This is my short story I got married in philippines , can i file divorce even if our marriage held in the philippines, will it be granted here in USA?.



I was married in Costa RIca. I went back to Costa Rica to file for my divorce. The CR embassy here in the US told me I needed to file there because it would not be recognized there if I filed here. I am still waiting for the papers to be served to my husband.
I don't know the laws in the Phillipines. Call the US embassy there or send an email. Whenever I sent an email to the US embassy in CR, they sent me a fast reponse.
Good Luck. Its too bad it has to be such a pain in the A$$ ...

The national goal is 5 months and in my world, 5 months is more than enough time.

 

I was saying... it shouldn't  be too much to ask to get the I-130's processed in a 5 month timeframe if the K-1s can be cranked out in a month ot even less.

Could things go faster if I just went there and married him there what happens with the paper work already filed

Last year the K1's were getting approved in a month while the I-130's  were taking extremely long.. ( Mine took 11months and 6 days)   This year the I-130's are being approved in 5 months or less. They seem t be switching off ..  Anyway, even if you switch to an I-130, and get approved fairly quick, you still have to endure the NVC process which has a ridiculous backlog at the moment. Some filers have been there 5 months already and still counting.  The K1 will cost more money in the long run but I think since you already filed and are in the Queue, just sit tight.  The K1 doesn't have to go through the NVC.   Even if you have another 5 months of waiting for the K1, you will still be ahead. We all want to be together ASAP, you're not the only one.  This process is broken.

The files sit in a box until the officer picks it up to process it.  It should only take 15 minutes, Your file was most likely collecting dust in Texas. Now it is sitting in CSC waiting for an officer to pick it up.   You have a good month or so before you can expect someone to pick it up  if they start working on the transferred files right away.

I don't know the exact dates because my attorney was the one who sent everything.
Also, when i contacted the congress womans office they gave me totally different receipt dates that they got from USCIS. I was confused about that.

I sent another letter to the congress woman last night asking for an explanation of why the transferred files ( TO CSC) are getting approvals that have NOA1 dates after mine. I am about to call them right now.

We provided photos of us together with the family, places we visited together, proof of purchases we made together. AND we have been together for a long time. I traveled to CR 8 times since we got married and I was worried that wasn't enough.
What is your need for a proxy marriage anyway?

Are you looking for a time fairy to appear and give you an exact time? Everyone is different. Lots of us spent 7, 8 and 9 months waiting for the petitions to be approved. It depends on the service center and how many others have filed and whether or not you get caught up in a background check PLUS MANY other things. It is never cut and dry. If you want exact answers you need to look in to your crystal ball. We are all here to support each other. When you get replies, it is because people want to help. They offer information they think you might find helpful. No need to bash them for not giving you the exact answer you want to hear. There is no time frame for anything when you are dealing with immigration

We got married on March 9th in Costa Rica, My husbands passport was about to expire on April 4th so right after I flew back home, he made an appt to renew his passport. He got the new one a few days before we filed. Our attorney just wanted a copy of the entire original passport ( all pages) and then just the photo page on the new one to show it has been renewed. Of course he will have to bring the new one to the interview. We took care of it before we filed because I didn't want any reasons for an RFE. It is very easy to renew a passport in CR.

I sent copies of everything.   and copies of  translations for everything that is in spanish. My divorce decree, marriage cert and his birth cert were all translated.  I only sent copies  because the originals are a pain to replace.    The NVC might request originals, and if that is the case, I will forward them.

I think considering how long everything is taking if anyone's thing is on the way to be shipped to NVC,  I would ship my copies of AOS and IV package prior to being requested to i can take a head start and get in line. Yes, without cover page but that is just me!!! I would put my USCIS # on the cover page until you get your case #!!!

you're papers will probably get lost with the thousands of mail packages received everyday at the NVC and then you'll either have to wait an extra 60 days for them to figure out where your mail actually goes or they will say they lost them and you will have to obtain all new originals ( need I say another needless delay) .  Go ahead and take the chance if that is what you want to do and you really  think you'll be ahead of the game   but please do keep everyone posted..

 

And just think of how many others do the same thing and just think of the huge file room full of lost mail without the correct coversheet and NVC case number.     And how many people do you think they assign to figure out where those lost papers go?    With the huge backlog of people who follow the directions.... I'd say not many.

This process has been deteriorating my health!!! ALL OF THE SUDDEN PANIC ATTACK AND STRESS ( I failed my stress exams) Now I have a cardiac exam awake. I was the sport girl, in shape and now I am having all kinds of crqazy stuff!!! So I sent an expedite request telling them how much stress this process is causing me. USCIS listened and now lets pray NVC do because I need my husband here

We all want our spouses here. This process causes everyone alot of stress.   Weight gain, weight loss, stress, anxiety..  you name it, we all have it ...

my 83 year old mother has been in the hospital for 2 weeks with  drug resistant E coli in her blood.  Its touch and go. She is attached to an IV pole.

  I got laid off on July 1st... Unemployment doesn't even cover my mortgage.  I submitted an expedite for the waiver I just filed....  I doubt it will  get approved.   I need my husband here.  we have been apart for just about 3 years.

Your interview took 459 days from your I-130 NOA1 date.

Laurel: Good morning everyone.

Laurel: The big update at the moment is that the NVC is finally admitting that it is overwhelmed. The agency is now sending notices to everyone stating that their response time is 60 days from the date they receive any document, inquiry, or form. While this newly announced response time is frustrating, it hopefully indicates that the NVC will be more careful about reviewing files before sending requests for evidence (RFE). The American Immigration Lawyers Association (AILA) is in the midst of putting together an assessment of attorney complaints regarding the NVC. The NVC has had a long history of sending RFEs for documents that were already submitted and do not describe what, if any, problem there was with the already-submitted documents, BUT recently the frequency with which this occurs has skyrocketted. AILA does not put together assessments of attorney complaints unless there is a spike in problems, so AILA's actions indicate unusual, widespread problems at the NVC.

Laurel: The best advice for people going through NVC processing is to expect for it to take several months and not to be surprised if you get an RFE for a document that was already submitted. In the past NVC processing would normally take one to three months. You should now expect for it to take three to seven months. This may present problems for people from countries that require a police certificate as it is possible that your police certificate will expire while your case is pending at the NVC and you will have to get another

NVC received our civil document package on July 8th. I spoke with a knucklehead at NVC yesterday and was told that it would take 60 days or more to  review my documents. I asked what was there process. He said that files are worked randomly. I was like hell naw. I have been in touch with Senator Barbara Miluski's office for a while and was told to fill out paperwork to give them permission to help me with my case. I faxed them the docs yesterday.  I pray they can help. I am getting this process done now. 

unfortunately the Senator's office can't make the NVC route though the mail and search for your packages. If there is mail showing in the system for your case, you will have to wait in line like everyone else. They process the mail by the date it was received.  They receive 1000's of pieces of mail a day.

Thanks! I did try calling them and like I said no case received yet. Just hoping to get a case number soon so I can get my AOS documents ready. And the reason it was approved in 23 days was because I requested an expedite based on humanitarian conditions. Wish I could do that for NVC :(

if your tax return has 1099 income, then YES, but you could ask a supervisor if they can let you bring it to the interview  but I doubt that will work

 

just printout another AOS barcode coversheet and mail that 1099 ASAP.   Last week preferably
