On the "check my status" website they are now saying the National average processing time for the 1-130 is 16.6 months! Can this be true?

Yesterday is was 9.5 months. 

Maybe since it took them so long to update that status, the processing will pick up and those number really don't mean anything. I don't know how they can call those numbers "current" 

 

I sent an email to my attorney asking what he has heard about the delays.  Since he is off on Friday and Saturday, I don't expect an answer til Sunday.   He will get back to me though. He's good like that.

One month ago I sent my documents, etc into my congressman to ask for help.  Two weeks ago I had still heard nothing so I called to get an update.  The guy wasn't there.  Still hadn't heard anything so last Friday I sent in another email saying I wanted to confirm he got my info.

 

Got an email today saying the congressman has my info and will contact me when they hear something from USCIS.

You can get the consent form emailed to you then print, complete and scan then email back to the office! No need to fax it. I received the consent form, completed, scanned and returned it the same day and also got a response from the Senator's office that very day. 


 


I would have scanned it but the security here at work wouldn't let me. Faxing was just as fast.  I am sure their fax machine turns the document into something electronic and sent to a general mailbox.

LoveMyTico we received the form for the consent thing coming from the senator. Which is better to fax it to his office or snail mail it? I am getting confused what to do now, my anxiety has been shooting up really bad.

fax it over..... I faxed mine and got a response a couple days later.  All three times.   Ask them to check the status every 30 days.... you have to email them to remind them, but they have your release on file.  It is pretty fast.

Ah, got ya.  I see.  Thats why I planned for after the holidays.  Closer to a date me and my wife can be sure of, plan more things out (I plan to be there with her for 2 weeks to a month, between plane, hotel, and food), and I also need to be here for my kids during christmas.  All my wife cares about is being together in the end...  This waiting has done nothing but make our feelings stronger.  I can't wait to get off the plane, and touch her.

I wish I could stay more than 9 days. I have kids here and I can't get that much time off at work.  I could do my job from home.. My job rolled out a policy where you can work from home. I was thinking I could work it out where I can work from his house if it can be set up... My husband doesn't have internet in his house.  I don't know if my company would let me work internationally though.... I have so many things going around in my head...HAHAHA  if the USCIS would do their job, I wouldn't have to think so much !!

I've been to CR Feb, March, May and August so far this year. I can't go too long without seeing him.  I was thrown off today because I thought Thanksgiving was always the 3rd Thursday of November.... this year it is the last Thursday.. So now I have to re-think my trip.  I wish I could go in Oct, but I have no more vacation days left. I was going to use the 2 thanksgiving days and then wait for my time to accrue . I get 4 hours every 2 weeks. That would mean I only have to eat one day of pay. 

 

Everything is CR pretty much shuts down the last 2 weeks in December.  I hate to get caught up in the holiday mess at the embassy..UGHHHHH

You are right. I heard from quite a few places/sources that the march filers should see approvals soon (in the coming weeks).

However I still wrote a letter to my senator today.

Just got off the phone with the nicest woman...  She gave me information...

 

1.)  If your going to call ANY Tier 2 Immigration Officers, don't call Monday, or Tuesdays.  It's very busy, and long wait times.  Call around Thursday-Friday.

 

2.)  Processing times for I-130 (CR-1) Applications and Petitions, is 6-8 months at the NBC.  But they are slowly starting to get through them quicker, and quicker.

 

3.)  As of now, if your wife is outside the U.S., and if you submitted sometime in March, your application should be processed in this next month or so.  For me it was May, and she said since my wife is not adjusting status, or in the U.S., it looks like around November, early December by her computer.

 

4.)  When questioned about getting transferred to a field office...  She said that she wasn't sure who relayed the information, it's not correct, but if your wife/husband is outside the U.S., it's staying right at the NBC, and getting processed there, but should go quicker once it's at that point.  If your spouse is here, it could possibly be transferred to a field office, but it's at their decision.  Shouldn't delay it too much, since they would try to keep it within processing times.  She was mainly referring to my case, and said she couldn't directly speak for other's applications and petitions.

 

My wife and I applied in May, and she is currently outside the U.S.

Was given a processing time of around November - December...  Then, it's off to the NVC stage if accepted, which seems like everything is in order anyways.

you just gave me some hope.  Sounds like you got to talk to a really nice rep.... for once.  

 

I was told the same thing about being transferred but people on this site still insist that they are transferring so I stopped mentioning it.    I am April 12th so do  you think it is too soon to hope for late October/early November?  I was just talking to my husband an hour ago planning my trip for the week of Thanksgiving.  NOW WHAT DO I DO?????  I hate to put out money for a ticket and have to fly back a few weeks later... Don't get me wrong,  any time I get to spend with him is fine...its the financial part that will kill me.   and to make things worse....  flying to Costa Rica in December is like paying double...    after waiting all this time, I would hate for the delay to be due to airline prices.

I am not sure why you're approval does Not show up on IGORs approved list.
I am guessing that you need to go to your profile page in VJ member area and full the "immigration" info.

We could have called them it's just that my husband is really busy and doesn't have that much vacant time and he asked me to just email the senators. lol Do you think we are in trouble because we sent out a few emails to different senators? But it's no assurance though that they will respond to it. lol

they can't inquire without a signed release from you , so just respond to one !!   no biggie... Actually, I think the petitioner is the one who has to sign the release... Same as how it can't be be beneficiary getting info from the USCIS

Hello guys! I think they merged several threads into one. I am not sure some of you remember me from the previous forum/thread. 

 

Anyway, I have good news. My petition was approved on Friday, September 13th (just last week) after 8 months of submission! My PD is January 13th so they took just about 8 months to approve! And that's after I contacted my congressman in May and again in September and I also contacted my Senator's office about 12 days ago. I am not sure if that had anything to do with it but now it's approved and will be at NVC.

We sent out 5 emails to different senators and hoping they will find time to answer that email. To those people who already sent out the letter to there senators, did you snail mailed it or you just emailed it to them?

seriously,  you can just call them, tell them you want them to inquire about your file and they will send you a release form  by email that you can sign and scan or fax back.  Then they can contact the USCIS by email.   It is very easy.   Writing letters is alot of work.  My first inquiry took less than a week for an answer and the second one took less than 3 days.   If you are working with one congressional office, they will tell you that making more than one inquiry ( with more than one office) will slow your file down.... That was told to me by the second congressional office I contacted. So, I am waiting until October for mynext inquiry. She told me they are told not to make multiple inquiries for cases.  

 

The senators are only a middleman....  They really can't get any more info than you get by talking to tier 2.  Read through some of the threads... People posted their response letters.   First time I was told that my file is pending at the MSC and  processing times are 12 months, second time I was told processing times are 6 months from the date of the response.. It is just a rewording game.

Got my infopass done. The guy was completely unaware of what's going on.. I told him I can't check my case status online and he was like 'really?'

Then he created a service ticket for me and told me that somebody will contact me within a few days.

I asked him if he thought I was out of my processing time? He said the processing time is about 6 months. I said yea I know about that and told him that different officers have told me different processing times and I hope you are right. I couldn't take it anymore and left

I dont know how to deal with this anymore. It's like your being tortured before you get to be with your spouse. People keep on saying to be patient and just wait, it is easily said than done! I dont even wanna continue the process anymore, it's plainly stupid! Fiance are given more priority eventhough they are not committed yet, no offense to the k-1 people though.

 

 

Yea, I don't understand the reasoning behind approving the K-1s first.  It is really frustrating to see all the approvals for them and nothing for the I-130s....

Hubby called in today and was asking regarding the letter that we were suppose to received yesterday and sad to say the person told hubby that it might take a month for us to receive that letter now. I dont know, I just dont believe them anymore. This is just getting really miserable! I'm already losing hope with this visa process and not just that I'm already being skeptical with the information they are giving.

For anything they do, they ask you to wait 30-60 days for a decision or a letter.   Even with the expedites.  It doesn't suprise me.... It is so sad that we are all made to wait to be together.

i applied my i 130 in June and my priority date is 10 June 2013 on (27-DEC-2013) i checked my case status changed on uscis.gov that it has been transferred to a local office and then after 3 days i received a hard copy stating that they were experiencing delays at National benefits center and has moved my case to Nebraska service center and if i do not get an update on my case in 60 days i should call on the given number

 

so any June filers here ???? or any one else who can guide me if its a good sign to have been transferred to a local office (nebraska service center)

 

any sort of advice would be high appreciated

Sooo, after repeatedly telling my husband to tell the attorney to place a service request and the attorney not obliging and also my husband's reluctance to place one, I have decided to place it myself. Most probably tomorrow I may get an all-night access to a PC. As suggested, I will use Skype to make the call. What I need to know is what to do after dialling the customer service number. Can anyone guide me step by step on how to get my call transferred to a tier 2?

only the petitoner can make a service request. They won't even entertain the request unless your husband is on the other line( or the attorney)

Not sure how they are assigning our cases and who is hired to "adjudicate" them, but if they run things like the State of NJ, it is not good. A long time ago, I worked for a company that was contracted out, by the State, to process low-income healthcare applications. You were given a two-week course on how to process the applications. Then, you moved on to the actual processing. The company got so behind in the applications, the State gave them quotas. This caused each person to have to process a certain number each day. The problem with that? To easily each that quota ppl would see that someone was missing something, generate a letter and throw the file in a "MISSING" bucket. Where it would go back to the file room, until the info was received. To express it a little more in detail: ppl would get a letter saying they are missing their Permanent Resident card. The problem was they sent a copy of it, but not the back of it. The processors would not care and just keep putting them back in the "MISSING" bucket, so they could get a higher case processing count. Those ppl were praised. I had a low count bc i kept calling ppl and told them what was missing and had them fax it to me.
Anyway, if these same types of ppl are processing our cases, it is not surprising that they are not hesitant to send out RFE's bc they just want to get a case off their desk.

I believe it !!  but it just makes more sense ( to us  LOL) to just finish processing each file rather than having to go back....  They still have to go back to each file when the infomation comes in.. That takes time too...   UGHHHHHHHHHHHHHH

funny how some tier 1 & 2 operators  go on and on about  how they can't give any advice about what you should do  but others are the complete opposite.     Why would you need a friggin lawyer for a marriage certificate they ALREADY have????????   I swear it is something new everyday !!  

 

An April filer just got an RFE  today for the Birth cert of the beneficiary. TSC...  I swear the TSC is out to delay EVERYTHING.   The most retarded RFE's

So got the RFE today- they said "the copy of the marriage certificate you submitted does not indicate your marriage was actually registered with a civil authority in the state of Colorado.  Therefore, please submit a complete and legible copy of a marriage certificate establishing that your marriage was registered with a civil authority"

 

What does that mean?  I already sent a certified copy, do I just send another one?

in my county in PA, they issue a marriage cert with a raised seal.  Get two copies from your county courthouse.  ( we can order them online now on the county website.. Im pretty sure)   Take a pencil and color over the raised seal and copy it.  Keep the other for NVC.  If you haven't already done that.....   and I am sure you have...  I just know what our county issues.

Monday is my first day working out in the stix.  Sorry for them but I have more imortant things to do then work. you guys are going to drive yourselves nuts looking at the case numbers.    VJ is such a tiny percentage of cases at the USCIS. Looking at the last 3 numbers is like looking for a needle in a haystack.   I would think you'd have to look at the last 6 numbers. Think about how many cases the USCIS receives daily and not all of them are I-130's, and not all I-130's are the same type.   They distribute the cases to different service centers.   There are so many things that come into play.  Expedites etc....

Yeah the email was certainly bittersweet.  I'm excited because I'm like "FINALLY!!" and it means that *hopefully* once I turn the stuff in we'll be moving.  But it's so frustrating because it took so long for them to send it out, and because I have one to begin with.  I freaking toiled over that stupid petition.  I stressed myself out for DAYS making sure every single thing was complete and in order and there was no way I'd get an RFE.  And now I'm getting one.  *sigh*
 
I do wonder if it's for my husband's birth certificate which I didn't include.  Since on VJ it doesn't mention it.  I feel like that should be changed to say "you are not required to put in a BC, but you should just in case"



For your sake, I hope it is for the Birth Cert. That is something you can ship out the next day. Maybe they are asking for something that you already sent. I heard of a few recent RFE's asking for updated photos and for not putting N/A in the blank spaces... GOOD LUCK... Keep us updated. I hope you had a nice New Years over there. I was dying to fly down for the New Year but my wallet fought back and won.

I am just at a lost of words with the Texas Service Center!!!  A loss for words.  What is the updated spreadsheet looking like?

 

Who all is at TEXAS Service Center?

I am at the TSC.  Transferred 11/27

I found out yesterday through a congressional inquiry that my case is assigned to an officer.   Who knows when that happened.. Someone who has the same exact filing date, same transfer date and service center  just got an RFE email yesterday and this morning another filer got approved and they were transferred 2 days after we were.   We are all April filers

 

It seems like TSC was on a vacation for a couple weeks since nothing was happening over there. Yesterday is seems like they woke up.   

 

 

This whole process is BS

Email this morning, it says RFE issued today- Dec 31. Happy new year.

Well, its about time.. Its almost like TSC took a vacation and they just started up again yesterday.

 

I want to say CONGRATS  but thats not really what I  mean. Yay you finally got it but ####### at the same time.   You should have had this RFE a month and a half ago.   I am so curious to see what the "F" they took so long to ask for...    


What the heck is up with all of these May approvals

I can't even go over to that thread and look... protest6wz.gif  Where were they transferred to?   I'm guessing CSC because they seemed to push out the March and April files they received.
