Check the K-3 guides.  My lawyer is doing mine and he already has all the copies of everything. He just told me to come down and sign the I-129F petition. I know the K-3 moves through the NVC really fast. you just get a number and it gets shipped to the embassy.   It doesn't have to wait for all the fees to be paid  etc...

I filed an both an I-130 and K3 application.  It's been over six months (for both) and I've yet to receive an NOA2.

Obviously it's NOT a five month wait for a K3. 

But this is updated info. If they re-start the K-3's then you should be hearing something on it soon...

So do I need to send in the K-3 with all of the same evidence I did for the I-130? How much does it cost? I don't know much about it. Sorry.

The K-3 is free to file. I think there are guides on the K-3 at the top of the page.  Also, you can check out the K-3 threads.

Just got off the phone with the attorney... He said he was informed that the K-3 is an option again. It was pretty much dead there for a while because the I-130's were only taking 6 months but he says now he thinks filing the K-3 is worth it now.  The processing time for the K-3 is 5 months

Its like starting over  but its better than waiting 16 months

 

He didn't think it was worth it before but now he wants me to come sign the petition. and his paralegal sent me this message while I was talking to the lawyer..

 

John can give you more details; it looks like, they are restarting processing I-129F. 

 

 

Just thought I'd give you guys an update...  maybe because they get more money from the K-3  like the K-1...  Kinda funny how were were talking about this earlier !

Well they told me end of November. We are getting different response from them, don't know what to believe anymore. My wife gets so sad on phone as well and I have nothing to pass on to her other than telling her to wait. This pathetic process is taking a toll on many relations. 

I wonder if that is the purpose of the long wait... to see how many relationships can stand the test of time...... but then again, how do you explain the 19 day turn-arounds for the UNMARRIED folks?    You'd think they would make those folks wait to see if they really want to get married. We already made the commitment.  It puts such a strain on everything.  

 

I have been sick all weekend and the doctor today wants me to go for a CT scan tonight. They think its kidney stones..  I hate being alone. My husband feels bad that he can't do anything for me being so far away.   He only gets to hear me cry......  Poor guy !

Last time I called the tier 2 told me to wait till Nov 15 and I should hear something between nov 15 to early december. He also put in a service request for me and told me I should hear back in 3-5 business day (yea right!).

Last time I talked to tier 2 and the Ombudsman's office, I was told Halloween time.  I talked to them a day apart.  I'm April 12th. 

 

This waiting is old and I'm so over being all emotional on the phone with my poor husband who doesn't know what to say anymore.

The advantage is you have the right to work as soon as you enter the country.  You don't have to adjust status.  And that seemed like it was worth it, back when cases were taking 8 months to visa in hand.  Instead of 8+ months just to get NOA2.

I'd be fine with supporting my husband if he couldn't work right away.. As long as he could be here..

I had a conversation this morning with my husband about available visas.  I  had to explain that spousal visas are unlimited.. He then told me on the news in Costa Rica there was a news segmant about how the US is making it easier to apply for available visas online  and that they are available.....  we don't understand how they can streamline that process but have no problem keeping married couples and families apart because they can't find a way to process efficiently... 

 

 

The USCIS found  a way to eliminate the backlog for K1s by not processing the I-130's......oh.... and the greencard holders are getting their spouses here much faster too.....

 

Something better happen this week ..... this waiting is so difficult

There is a Feb Approval today !  The timeline is confusing but the post is today.  It was an approval from the NYC local office according to the signature on the posts.

To be honest, I don't care about the K3. Not even a little. I want the I-130 for our CR-1 approved in a timely fashion, and I think that's what we should all be campaigning for -- not the revival of this secondary form. The K-3 has the same limitations that made the K-1 undesirable for me and my husband (e.g., no immediate work authorization or residency status). It's not what we want, it's not what we filed for. I just want the form that we did file for -- that all of us in this community filed for -- to be processed in a reasonable timeframe.

I agree.... and all the bitchin' in the world won't bring back the K-3 in time to benefit any of us here anyway.  Its all a bunch of #######.  A politician passing a law for brownie points... then it fades away....    I just want the I-130 to be processed in a timely manner. We all paid a hefty fee, which at this point seems like it funded the processing of the K-1's.  How annoying....

I think your missing the whole point.  Why were they delayed then?  We are not meant to wait so long.  This was worked out for us by Congress 12 years ago.  When the USCIS did not care for people then.

My point is..... They do what they want...If a K3 takes 10 months when its only supposed to take 3-4 months...  Nobody cares to fix it.  And we can't do anything but sit tight and wait.

With the passage of the LIFE Act in December 2000 and the promulgation of implementing regulations in April 2001, both Congress and Legacy INS announced a policy that would, in theory, allow foreign spouses to join their U.S. citizen spouses in the United States quickly and avoid the long separation associated with increased I-130 processing times. USCIS has adopted a policy to adjudicate the K-3 petition (Form I-129F) and petition for alien relative (Form I-130) simultaneously. This practice effectively eliminates the benefits of the K-3 petition and frustrates the intent of the LIFE Act together. DOS takes the position that when the I-129F and the I-130 are approved together, the beneficiary becomes ineligible for a K-3 visa and therefore, proceeds with processing the immigrant visa application. Will USCIS reconsider its policy to adjudicate both petitions together and implement a policy to adjudicate K-3 petitions within 30 days in order to achieve the clear policy imperative announced by Congress with the creation of the K-3 visa?

Response

The K-3 visa was intended to reunite families separated due to a backlog in I-130 adjudications. However, I-130s are no longer backlogged and are currently being processed in under 6 months. Therefore, USCIS does not, at this time plan to implement a new policy on the K-3 visa petition process.

 

 

I case you dont know, it was set up as an option to get your spouse with you in 3-4 months (including the NVC time). 

 

My point is USCIS has by policy denied any USC from using the option provided by Congress to timely unite thier familys thru this proccess.  Because USCIS states that everything is working just fine now.  Six months or less?  We should get some traction with this Policy to push USCIS to get more people working on our Filings so they are completed in the stated time.

 

 

K-3's were taking 10 months in 2008.   The whole K-3 thing is a joke. They won't bring them back because they have to hire more people to process them. They already claim they lack resources and staff.

I have a question pertaining to income. 

 

Your income requirements go by your CURRENT income?  correct?   My last 3 years of tax returns show lower income but I started a new job April  2013 ( this year) and my income is way above the requirements plus I have child support and survivors social security benefits for my kids . 

I have read tons of threads about the income requirements .. Am I correct, or am I missing something?  And do they include child support and SS benefits  when calculating income?

There was an August approval   but it was for a Green Card holder applying for spouse.  One month total... GRRRRR   What happened to the priviledges of being an American Citizen in the United States?  Out the window I guess.   

 

After watching the approvals lately, it seems there is no order to anything. It could be due to how they split the files up among the facilities.. You'd think they would have more control over the process by now. 

 

Yesterady my lawyer sent me a check list of things to send to him  when the approval comes in. He wants me to be ready....  I already had everything ready a while ago. Nice to know he is on top of things though.

Expedites are usually few and far between... although I did read of a girl who expedited and got approved .. her reasons were that she couldn't afford rent and the immigration fees too...   So I was told it all depends on the person reviewing the expedite request.  Good day/bad day.....whether or not they took their meds ( haha )  or if they had a good weekend.     You just never know.

 

 

But I agree with a post above... If you get approved, please state the specifics for everyone. We are all so excited to see the approvals come through

They need to fill in the NOA2 date.


My case didn't have any special circumstances. I confirmed with USCIS that my case was approved at NBC. I am a US filer. Also to people who are saying there case never been updated after NOA1 same thing happened with my case. My case was only updated once the day I got approved.

my suggestion is to call the USCIS, ask for tier 2.  Tell them you were told a few weeks back that  your file was being transferred to NYC.. You are just calling to see if that actually happened yet !!   See what they say..  I called yesterday.. I posted my conversation on March and April..   Its worth a try !!

She was very nice. She said:

 

1. no, your file has not been transferred to Philadelphia.

2. They only send files to field offices in batches of 500 to the field offices that don't have a big backlog. 

3. My files has not been assigned

AND..... after looking through some screens,   

4. "I feel like you should get your decision around Halloween time....  "

 

so,  there it is  !!!    Lie number 1501.

 

I have to admit...its nice to hear but very hard to believe..

I told  a teeny tiny white lie to the tier 1 person.  I told her that I was told my file would be transferred.. but I was just going by the generic letter I received that said they CONTINUE to ship the files to field offices...  So I wasn't told "for sure" I just made it sound like that....  but she was nice enough and was happy to transfer me.

I just had an infopass.

 

NBC sent my file to the local field office today. They just got it today and there were 233 files all together that they got from NBC.

She told me to come back and check on the status in 2 to 3 weeks.

 

There is a hope..

your post made me pick up the phone and call. The tier 1 person was so dang sweet. She offered to transfer me to tier 2.  I told her I was told by the congressional office that my file was going to be transferred and I was just wondering if that happened yet. and I asked if the form containing my cell number and email address was in fact in my file.. She said she can't see that information but would be very happy to transfer me to a person who can see all that information.. I was shocked... usually they are so dang nasty ....so now the 107 minute wait for the call back !

Yes I was.  I applied with a sponsorship from my school where I work.  But now that I'm married it should only take 4 months or so to get approved.  Or if I wait until Jan '15 (two years after we married) I can apply for citizenship.

I read somwhere that CR is not allowing dual citizenship... I don't think I would give up my USC status.. but thats me.  Have you heard that?

I didn't put in my esposo's BC because here on VJ it said it wasn't necessary.  Now I'm all freaking worried we'll get an RFE for it.  Ugh.

 

Since we filed from abroad it *shouldn't* get sent to a local office, but who freaking knows.  *sigh*

I sent my esposo's because I had to have it translated anyway.  It was old as dirt.. Its ready to turn into dust.  LOL.

 

Go get it translated and hang on to it. Then if it is an REF... then you can send it right away.  The NVC needs the original anyway with the translation.  Send a copy for the RFE and you'll have the original for later.

 

let me know how much it costs to get  things translated over there. The police cert needs to be translated too for the NVC.  The Police cert doesn't take long to get  but getting it translated could be a problem. My husband knows a high school teacher who can speak english fluently.  I hope that will work.

I did not submit my wifes birth certificate. Do you think that will be an RFE?

I have an infopass appointment today.

Yesterday there was a conversation on the April thread about whether or not to include the birth cert for the beneficiary....   I am assuming it is better to add it...  I did because my lawyer put the package together.  He does it with all of his clients. I guess his experience is that it is better to include it instead of lose time with an RFE.

I'll be honest.  I wish I was happy for them.  But I just can't be.  How is it possible there are still people waiting from Jan/Feb/Mar/etc and someone who applied in September gets approved?

I think if I were that September filer, I'd just come by and fill in my timeline...  I would definitely NOT post on a thread.  Mostly because Iwould feel bad for all the others who have been waiting 6 months +..

 

I did read a few posts that said they got a notice that they were transferred to the CSC.   So not only does the CSC process the K-1s in a ridiculous timeframe... now they are approving I-130s.. and out of order to boot !    Gotta love our Government !!

I wish that was true but unfortunately there are a huge number of FEB filers waiting for NOA2.
there was some one in these VJ forums tracking bunch of MSCxxxx numbers to check the approvals from Jan and Feb and according to his trackings FEB is still a huge backlog.


 



Actually,  VJ is sooooo small of a percentage of the actual number of filers.  You can see the last time each person has last accessed thier profile... I would bet alot of Feb filers never came back to update their timelines..

I hope something happens this week. I am sure these political represenatatives were not able to do anything with my case but I was in line. 
So, I would suggest calling USCIS and asking if the file has been transferred. Maybe, we March filer's petitions are getting sent to local office in batches hence your's maybe in that batch.

I'm a little confused by what you mean by "processing times are 6 months from the date of this notice" Can you clarify? Sorry for the confusion. lol 

The form letter coming from the senators offices states 6 months from the date of the notice.   Instead of just saying 12 months, they re-word it in hopes that will satisfy us !

SUCH #######...

 

Three things we all know and are tired of hearing from the Tier 2 and congressional offices

 

1. There is a backlog at the USCIS  ( uhhh,  really?)

2. The normal processing time is 9-12 months... ( that's funny,  that isn't what I was told when I filed back in April)

3. Processing times are 6 months from the date of this notice.  ( Feb, March, April May and beyond?  REALLY?????)

I hope the approvals start coming...

Its a bunch of ####### because I got that same response 2 weeks ago.  How can they send the same response to everyone?  Last month, this month or next month.  Are they all going to be 6 months form the date of the notice?  What if a Feb filer inquires?  Do they have to wait 6 more months?   And if  a Sept filers inquires, Will they get the same answer?  ALL stupid

On the "check my status" website they are now saying the National average processing time for the 1-130 is 16.6 months! Can this be true?

Yesterday is was 9.5 months. 

Maybe since it took them so long to update that status, the processing will pick up and those number really don't mean anything. I don't know how they can call those numbers "current" 

 

I sent an email to my attorney asking what he has heard about the delays.  Since he is off on Friday and Saturday, I don't expect an answer til Sunday.   He will get back to me though. He's good like that.
