I tried the new e-Request inputting my info for the I-129F, K3 visa.  It will be seven months since I filed for the K3 (Oct 10).  After filling in the info and pressing "send" I got an instant reply that I was within normal processing times.  So I guess the whole 5 month K3 national average processing times is incorrect!

there were a couple approvals on Saturday the other week. ( 2 April filers)     That approval is for an I-130 but it could be for something other than a spouse.  Or maybe for someone who is here in the states already.  Not to take away your thunder.... Sorry.  You can't go by picking random case numbers... There are too many I-130 types out there.

USCIS recently began transferring some casework from the National Benefits Center to the Nebraska, Texas and California Service Centers to balance overall operational workload. The affected casework includes the following form:

Effect on Customers

If your case was transferred, USCIS will send you a notice listing the transfer date and where your case will be processed. Your original receipt number will not change and this will not further delay the processing of your case.

I've got An I-797C form that it says my case is transferred to  the Nebraska service center in order to speed up the processing.

I just had my info pass appointment in Philadelphia. Only thing they really told me was that our case was "touched" on Oct 16th. I hope this means they are working on it? When I log into my account online it still says it hasn't been touched since March 28th. So basically a waste of time.

 

 

Did they tell you where your file actually is?  Philly or the MSC?

 

On Oct 16th, your file was probably moved from one pile to another.. 

It would be so nice to get some useful information from them......

It will take months if we don't start seeing 8-10 per day.  Everyone is watching and waiting.  I-130's are used for so many visas and USCIS knows they are back logged.  So I think asking them to hurry the I-130's will net no effect.  However the K3 or opening up visitors visas would let you be together here while you wait.  Its a catch 22 (no visits) once your married. 

I"m disgusted with our government for placing priority on Illegals and those who are already together.  It is a joke !  really, it turns my stomach.  I'm not sayiing those people don't deserve to be here  through a legal path, I'm just saying it sucks that we all chose the legal route and are getting the short end of the stick.

they probably sent out a broadcast email to all case workers to fin out what the oldest case was..... and October was it, so they decided to give everyone that information.... 

something like that... it is so sad that they think we are all stupid enough to believe them....

hi! so any approvals yet? A friend of mine got approved because her case was expedited and she did not tell me the reason why, i dont know if giving birth is one  of the reason to expedite a case.

Childbirth is not a expedite reason. Even a c-section is not a reason.

So you're saying that filing a K-3 gets USCIS to notice your I-130 and prompts them to process it faster, or something like that?

In my world?    Yep   I am sure there are thousands of people here who would think the opposite....  But I feel like if they end up combining them... especially since I already have 6 months in... MAYBE there is a chance that they just process it...  I could be totally off...  but that is what I am going with.


On October 17, 2013, we transferred this case I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN to another office for processing and sent you a notice explaining this action

does anyone know what is this action means,.....?

i will dare to do a calculation like this:

 

as per August 31, 2013, uscis is processing October 1, 2012. That means if you start counting it's 11 months from Oct 1, 2012 till August 31, 2013.

 

Now if we assume that today they are processing say March then from Oct 1 till March 1, it's like 5 months.

 

So, the next update will be effective as of September 30, in a month and the processing time may go: 11 - 5 = 6 months.

 

But today it's Oct 16, so it's like 2 more weeks from the next update of Sept 30, which means that on Sept 30 they will be processing February 2013. Not exactly March 1.

 

And October and November are our months, otherwise we may end up on this situation where we will have 8 months of waiting but the processing time they will show will be April, May or June: This situation: IMPORTANT: If your receipt notice date is earlier then the processing date shown, we suggest you call our USCIS Customer Service Office at 1-800-375-5283 for assistance.

looks like all the march filers are gone silent, and USCIS is approving people from june and july, wow! nothing against people who got approved but this just sucks!

Yep....  my lawyer told me that no letter or phone call can make the USCIS move faster...  We have to sit tight.  

 

Knowing the reason for the stall would help me understand ....   Not that it would make it any easier to be separated from my husband for stupid amounts of time.....

 

I guess we just have to believe our time is coming.  We are 6 months closer to an approval....  ( its very diffficult to be positive these days )

Whoever answered yes to your question gave you grossly inaccurate information.  The lockbox facility and the TSC are two entirely different facilities in two different cities.  The locbox facility in Lewisville is nothing more than an intake facility; the TSC itself is in Mesquite, TX.

It is possible that the people who are discouraging others from filing for k-3 probably themselves  filed k-3 and are trying this trick to prevent the 129f applications from clogging the service centers.

if anyone wanted to go so badly in the US, then they should not have been married to do that. If that was the goal, then they took the wrong road... there are shorter ways to do that.... apply for a K1 visa for example.. and do all the rest of the paper work in the US, while in the same time being with your fiancee.

 

for march filers a K3 is pointless, because what if you go to the US with a K3 non-immigrant petition and then your immigrant petition i-130 is not approved?

this makes the K3 in most cases not approved before the i-130, because they will wait for confirmation for i-130.

the K3 is for special cases, anyone can apply but not everyone gets it. It's like applying for a touristic visa, while you have an immigrant petition pending, that tourist visa is only approved if you can fulfill specific criteria, but anyone can apply, but not everyone gets it.

etc, etc.

 

at USCIS all paper works after are officially certified, are scanned and are added to your electronic file, no matter what for it is, i-130 or i-129f etc, they all go together..nothing is separated or taking dust somewhere.. it is a continuous process with procedures from the first day they receive it to the last, the starting point is the same for everyone (their PD), while the finishing line is different (their NOA2) because our situations are different, and the approval time is different.

 

Hope everyone gets approved very soon, and if u think USCIS complicates your life, at least don't complicate it yourself.no0pb.gif

The K-3 is not for special cases...  Everyone has the option  to file. It does depend on the case loads at the service centers  whether it gets processing before the I-130 but nobody has a crystal ball.   I am able comment on the K-3 because I have personal experience. Did  you ever get an approved K-3?  VJ is a rumor mill as stated by another posted on another thread.   It's fun to watch people post their approvals and progress but its for entertainment purposes only. It just passes the time while we wait.   rofl.gif

I think you could try contacting the AILA or your Congressmans office and ask them to help bring the I-130 proccessing times within the 6 months they stated.  I mean this is something you can do.  add your voice to many and maybe they will hear us.

 

I have contacted my congressional office and other political figures  .  Since the government is shutdown, those offices aren't open.   As soon as I hear the shut down is over, I'll be on the phone with those people again.  I should be getting a text with my K-3 notice on Friday. Monday at the latest.  Then I can add a few questions to my list for the senators office.

all petitions are free to be completed by anyone, even i-130 was free for me, i didn't have to pay anyone. The 420 fee for i-130 is for the uscis processing service and for K3 there is no processing fee by uscis. i don't understand the services the lawyers provide, or it is very basic service.

as i read above even K3 have MSC#, if that's true...then how comes...

 

i won't file because i think in my case it is a waste of time same as sitting back and do nothing..

 

Your I-130 was not FREE..   They won't touch it without the $420 fee

if your lawyer isn't getting any more money from you then why did he get money for filing the i-130 for you? something he cannot deliver now on time....... and the K3 which requires same work for him now is free!!?

i'm just thinking why do i need to pay a lawyer if my petition gets same treatment as all others who filed it themselves or myself? all petitions are free to fill, as far as i know lawyers are other things..

The lawyer has no control over the USCIS and how fast they process....and anyone who hires a lawyer to get processed faster is barking up the wrong tree.  so the statement about him not delivering is silly.  he is doing what I hired him to do.

 

I didn't hire a lawyer in hopes to get better treatment,   I hired a lawyer because my case is NOT a straight forward case.  I wanted a professional to do my paperwork. I could have done the initial filing , but why if the price is the same flat fee?  And there is alot of preparation with the tail end of my case...Its much easier if he has everything  together. Plus, it is more paperwork if I add a lawyer later. 

 

The K-3 is free to file for anyone. If it is free, why WOULDN'T you file?

and not all petitions are free.... You had to pay the $420 for your I-130, just like everyone else

 

 Nobody is making a promise as far as processing times go... Everyone knows they are only posted estimates

so with that said, Doesn't it make sense to file a FREE petition that has an estimated 5 month processing time rather than sit back, relax and wait for a petition that is estimated at 16 months?  It makes sense to me....

I have a question maybe you you can help me with it.  My I-129f (for the K3) came back with a NBC (MSC)  number.  How do you know yours is going to TSC?  Maybe Mine did too after NBC got it they sent it there?  or maybe your lawyer knows how to get it placed there?

I asked where my K-3 was being sent to. She told me Lewisville, TX. And then I asked if that was considered the TSC.... and she answered "YES"

 

I believe it has something to do with where you live. I live in the Philadelphia area.  We'll see what mine comes back as.  Who knows, it might be sent to Texas and then to MSC or the opposite.  I pray it gets sent to TX.  They have the shortest processing times.. for the K-3 and the waiver I need

I wouldn't say "OFFICIAL"   I'd say more like.... "good enough for me"    I'm not going to sit back and accept the slow I-130 processing times..  If my lawyer says he wants me to file the K-3... then I'm going to file the K-3. It is Free.. he's not getting any more money from me.  So,

true, but every petition requires services from different agencies like for example for a i-130 nowadays they can perform over 20+ background checks ...

 

even if it is at a different service center, it still increases the workload of that center, and meanwhile it's not that they are staying at that service center and drinking coffee all day if they don't get any K3 petitions..

 

there is a process and every application enters that process that same day it is received, it's not that new petitions will delay old ones.. rather than themselves and who is coming next...

 

i believe that when they received mine at March 11, it has entered the process on that day and i will just wait for when my i-130 gets approved.. and go with the flow.. if we were delayed it is because of a lot of petitions being sent before and on that very same day as ours.

It is their job to process the files  no matter how many are filed. I'm not going to NOT send in my file because I am afraid of increasing their workload....They pay people to do their planning for the depts.  If its poor planning  then OH WELL..... I'm filing my K-3.

 

Sitting back and relaxing is not what I do best.     and BTW, 16.6 months was the most reacent update... and my attorney got a notice this past Monday with the extended processing times for the I-130.  The K-3 is available for filing .  Why not?

but doing anything now when we are so close of getting approved, it is like increasing the workload for USCIS and more delays especially for the ones who are sending their petitions the next day of the receipt of your K3 visa petition..

 

if everyone does this, its like doubling the work for a uscis employee/agent... and then again twice going at NVC/embassy after K3 and latter 130 approved.. the 16.6 will only increase till it goes to 32 months..

According to the 16 month estimate posted by the USCIS, I am nowhere near getting approved.  I am actually closer to being approved with a K-3 since their posted processing time for that is 5 months.  I can sit here and hope I get an approval soon until my heart falls out of my chest or I can file a K-3 and have 2 different avenues to follow.

 

Also, I was told that  the K-3 and I-130's are processed at different service centers.. so My K-3 does NOT impact the processing at the NBC.

The only reason i did not file K3 was that it was taking 8-9 months for K3 approval. In APRIL K3 did not make any sense. because i thought i would be NOA2 by August. And my VJ time line at that April month was showing July add probable NOA2 approval date.

Does it still make any sense for April filers since we are already 6+ months in to timeline?.
 


Look at it like this...

 

K-3 processing time is posted at 5 months

I-130 processig time is posted on average 16 months.

 

If the USCIS is telling ereryone 6-12 months ( does that mean from the time we filed or the time when they read off that info?)

 

As an April Filer, I already have 6 months in... add 6 -12 months to that and I am at the 16 month timeframe

 

My K-3 will hit the USCIS on Friday.   If it gets processed  in the 5 month posted timeframe.. I'm ahead of the I-130..

IF... my I-130 gets approved within the 5 months K-3 times frame, I'm not losing anything.

 

At least I can call and put a service request in if my K-3 isn't approved.. but really, I'll take whatever file comes first.  If the K-3 takes longer than 5 months and the I-130 isn't approved yet. well I still have 2 avenues...


What are you trying to accomplish by this?

My case starts with MSCxxxxx.. letters. I don't know in which lockbox it is being sent by my wife..actulally,  i am living in pakistan and my wife living in USA and she's US citizen and she's is petitioner,her brother has filed this case. I mentioned chikago lockbox in my profile just to create my account on Visajourney site.. can you tell me the case letters starts with MSC... in which lockbox is now.. ? so i will be better able to track the case and to know how much time it to take for approval..

 

Chicago Lockbox is where they ALL get sent initailly....  MSC is National Nebefits Center.  You should change your info to NBC.  Nothing gets adjudicated in the lockbox.

I've been thinking of cooking a Christmas Dinner for her family in China too.  I dont think I've even seen a turkey there yet.

I saw the email thread from another attorney. They printed it out for me since I was asking so many questions yesterday

 The posted processing times for the K-3 is 5 months.  Maybe because not too many filers lately.  I don't care why.  I'm hoping one of them comes through soon....at this point, the worst thing that could happen is they cancel the K3 ... right? I was told they are processes at different service centers. 

 

American holidays are starting to flow into CR. My mother in law doesn't have an oven so my husband said we can order a pre-cooked turkey. Turkey is not a normal thing over there.

 

 I'll do my best with what I have. I am bringing a suitcase filled with American food items that I haven't seen over there.   Maybe I just never noticed, but it will save me a lot of time. I am so excited to cook for them.  Everything I cook, they love it but my Mother in law always adds rice.... even when I make spaghetti.  HAHA


 

K3 hoping that it would trigger some action on your petition? hmmmm wondering why now?

a very disastrous day today, not very productive... not even one good newsno0pb.gif today... 

On a good note... I just got back from my lawyers office .  My K-3 petition will be fedex'd tomorrow morning.  The package is about 4 inches thick.   I hope the K-3 gets processed quick.  I'm not holding a candle but all Ihave is trying to stay positive.  in 7weeks I'll be in Costa Rica with my husband. I am going to try and cook an American Thanksgiving Dinner for my family over there..    Something to look forward to heart.gif eb0dfafc.gif kicking.gif

doesn't submitting k3 mean you have to wait all over again? the process starts all over again?

I asked the same thing... My lawyer said they are two separate files.  I was worried that the I-130 would get pulled and matched with the K-3. He said they get processed separately. He was just saying it would be worth filing since they are re-starting the K-3 processing.  So, if the I-130 comes through first, then I'll take that.. If the K-3 comes first.. I'll go with that.

( LOL)  or do it the Costa Rican way....  just tell a white lie... say something like, last time when you called, you got cut off .. must have been the terrible connection... or tell them you were told that your case was being transferred to the local office, you are just checking to see if that actually happened and what you need to do....or tier 2 told you to call back in 15 days... and now you're calling back.  

 

 

btw, I have been having a difficult time getting through to my husband on his house phone in the last couple weeks.  Probably due to the rain. The cell is better reception but costs me money. the house phone is included in my plan.  

 

so the bad connection isn't really a lie...

when all the march filers will be approved.. ? i-130, 7 months have been over now..

Why do you keep asking the same question?    Nobody knows the answer. You can check the USCIS stats and the VJ stats.  

 

You can also call the USCIS and talk to a tier 2 and try to find out specific info about your case.  They are saying the ESTIMATED processing times are 9-12 months.  You can also view your own timeline and see the VJ estimate at the bottom.  Check the different threads and watch for approvals....

So I just had infopass around 30 min ago.

 

Officer told me that my file was last touched on aug 23. All the process has been done, such as background check. He said you are just waiting on approval (what are they waiting for?). Then he said your case is from india that's why it's taking longer. He told me applications from India, China, Mexico and Philippines are taking around 8-12 months due to high numbers of petition. 

 

I don't know how much of this is true, he did look over his computer for while and then told me all this, so this was my experience, I don't know if I should believe on this info or not.

That's odd to me. I thought they didn't separate them by countries.  I understand those countries are high fraud countries, but if everything is complete, then why can't they just be adjudicated in order?  Not that there  is an order these days......

Noa1 received on 4th march 2013... still waiting for the NOA2.... When the case will be approved?.how much time we have to wait... :-(

Did you file a K-3 after your I-130?  

 

  Im filing one today. My lawyer suggested filing it now since he has information that they are re-starting the K3 processing.....  He said a 5 month processing time... so I'm in...  Going down today to sign the petition so he can mail it all out .  It might be a shot in the dark.. but I don't care.   He must tthink there is something to it if he called to say he wants to file it. He told me it wasn't really worth it back in April because they weren't processing them then...I want all the "i's" dotted and the "T's" crossed.

Well, I think its a good idea to file the K3 since its free and if my lawyer contacted me (without a call from me asking 1000 questions) there must be something to it.  What can it hurt?  I was reading on a K3 thread that someone got his K3 joined up with the I-130 and he got an approval for the I-130 soon after...  I'm  not saying that is why I'm filing it, but it sure would be nice if that same thing happened to me. I want to keep all my options opened.....nice and wide 

 

 

The 16 month processing times are disgusting.

You mean 16-17 months total, or just for NOA2? I'm thinking of filing it myself, even though we're only one month into the process. 

 

 

How does your lawyer know they're processing K-3s again? I can't remember what you said. 

 

That's kind of encouraging. You're not submitting all the evidence you submitted for your I-130 again are you? 

it only for the approval...  NVC is another animal.... add 2 months

Check the K-3 guides.  My lawyer is doing mine and he already has all the copies of everything. He just told me to come down and sign the I-129F petition. I know the K-3 moves through the NVC really fast. you just get a number and it gets shipped to the embassy.   It doesn't have to wait for all the fees to be paid  etc...
