What I can't, for the life of me, understand the logic that someone who is a fiancée gets preferential treatment (time-wise) over someone who has already made a legal commitment by marriage to their husband or wife.  Not against fiancées, please understand....I just don't get the thinking.

 

It's such a cruel way to treat families. I know this whole process isn't personal, but good grief, this separation is so very hard. And also couples living together outside of the U.S., married or not, get processed faster. It just seems to me to be totally backwards.

 

I am starting to despair that this will ever happen.

WELL SAID  AND SO VERY TRUE....  this wait is killing me. I have lost faith in the US... I get angry when I see all the illegal people in my town just going about their business... They get to be with their families, they get to work ( even though they aren't supposed to)  they get to do everything the USC's get to do  but my husband has to wait in his country becuase we are trying to do things legally.....  It seems this country rewards the lawbreakers and makes the people who are following the rules just suffer.  THEY DON'T CARE...

Sept 30 marks the end of fiscal year 2013. Lets hope the fools get some funding and work on our cases

They already got their funding when we all paid the filing fee.  They better get their butts in gear.  Every single person on VJ should be calling to complain ... just my opinion

To make things clear for everyone. I been requesting to expedite my case since April they declined it twice! I been after Senators to help me they never did till last two week only thing they said they will ask my local field office to transferred my file in for adjudication. I called USCIS two days ago about my file and I was told my file is still with NBC. Maybe the representative lied to me.  I don't know if my file was transferred to local field office or not since I didn't get any notification from USCIS.

It doesn't matter ... I am happy for you  ! !  Congrats !!  It was a true approval and now everyone has a glimmer of hope.

 

 

I hope everything goes super fast at the NVC for you !!!

The USCIS website states they are the 18,000 government employees and contractors of USCIS working at 250 offices across the world.

does that mean they are divided equally??....HAHAHHAHA  

 

I would assume the bulk is here... or do they consider the USCIS a different division since they don't take any federal money. They only use the fees collected..  and BTW... I would have paid $5000 if the papers would have been processed in 6 weeks.   I'm sure many others would do the same. 

 

 

Seriously, we should all get a refund if they go out of the normal processing time.  I know that will never happen, but it would be nice.  Kind of a flame under their asses

they are just a bunch of sheep... regular governemnt workers with 6 breaks a day and an hour lunch...  tons of vacation and sick days.  Water cooler conversation and BS sessions while our files collect dust in a closet somwewhere.    If it only takes 15 minutes per file to adjudicate ( average)  and they just hired 800 new employees, it technically shouldn't take too long... right???    hahahahhahaaa  yea right

I worry it's the letter informing us that it will now take up to 12 months for petition approval.  Lots of April filers have already received this letter.

My PD is April 12th.  I did not receive a letter stating a longer processing time....  and I hope I never do.... I just hope they start processing by the end of this month

They checked the status and said the file is just sitting and collecting dust at NBC. They asked for transfer and they going to expedite my case once it's here.

Finally my senator is helping me with my case. My Senator called my local field office and asked them to request my file to be transferred from NBC to them for processing. Hopefully in next few days they will be on it.

just curious... what if the file wasn't supposed to be transferred in the first place. Not all files are getting transferred. My lawyer told me they transfer them if they need extra work or if they are missing items.   Did they already get status for you?

I agree with you. But we should also remember that they have more applicant to deal with now then August 2012. DACA applications are also in queue so here we are standing in the same line and waiting longer than expected.

Another thing is USCIS don't have to compete for our service. They got it free. If you don't have to compete you will never give a good service. They know they dont' have to compete for your business and that's why they don't care.

 

I agree.. no competition=bad service.. Its a friggin MONOPLY    

 

although... they have to have standards. I mean, the adjudicators have metrics they need to keep up with. They have numbers to meet daily.  I hope hope hope this new Kansas facility will make the difference we are all hoping for.  VJ filers are just a speck  compared to the real workload... but I still say it is depressing to watch the K-1s fly outta here.  why are they approving the UNMARRIED when the married people already made the commitment ??   Its all so backwards. 

 

Also, alot of people don't come back and fill in their timelines.  It makes Igor's list very inaccurate.  Fun to look at but not very reliable.

I filed in January and still have not received an approval. All the stories I am hearing on this board about March and April filers getting approved soon seems like wishful thinking..sorry to say. I hope we all get approved sooner than later but I believe the budget cuts is the main reason for this delay. Officers probably are working shorter hours and not enough staff to process petitions.

THE USCIS is mostly funded by FEES COLLECTED. We all paid a fee for services we are not receiveing in a timely matter. Sorry but I am all about customer service.  If you are charging a fee for a service,  that service better be completed.  If they are bogged down by an overload of cases, they already cashed the check... HIRE MORE PEOPLE  ! ! ! !      The fact that they don't hire enough people to do the job.... that might fly for a little while  but not now.    I hope the opening of the new facility gets situated and they start working....  The K-1s are flying out the door at the CSC. So depressing.

giving them the benefit of the doubt,  maybe today is the day they all move to the Kansas office...  Maybe today is the day they all get situated and tomorrow they will start cranking out the cases...

I wrote to my congressman and he (well the aide) finally wrote back and I have to send in a release of information sheet.  Gotta say, I'm taking my time with it though.  I'm almost 100% sure he'll give me that same "12 month processing time" BS.  

You'll get the same template everyone gets with the 12 month schpeel. But if I were you, I'd still inquire about it because it can't hurt anything.  Who knows.... your fille might be one of the next in line to be processed and it might get put back on top... maybe not   but you never know, The advocate I talked to told me you do not lose your place in line and you do not get put on the bottom.  It doesn't work like that.

No update here. It seems like everything is froze in MSC. Nothing is moving. I am sure you can file for I 129F but if you are married it will be denied. Just guessing I am not sure.


The I-129F is a K-3. For married people. It used to be faster, but now they are processed together and the K-3 is usually cancelled. I heard that filing both kind of slows it down. Only from what I read on here.

i got a CC and still have a package that is pending review at the NVC.  the operators told me that if the case is sent to the embassy before they review the pending package, they will mail the package back to me

That is what they told me when there was that bogus package they said was still pending   EVEN though I told them over and over it was nothing....  I can't believe they check listed you and they STILL didn't look at what they asked for....  OMG smh..   They cause their own backlog...

Just an update on our case. Embassy emailed back on Monday to confirm that they have recieved my Greek police certificate (phew!) and I had the medical done on Tuesday. My arm is still killing from the damn tetanus shot!

Now only thing left is to gather together our evidence for the interview.. I'll be a nervous wreck it it gets done.. 20 days to go!

Yep,  its a huge relief knowing its almost done... 19 days til our interview !!!    My husband is on his way right now to get his police certificate.  Then he has to drop it off for a friend to translate it.  I was told it  needs to b translated and I was told it does not need to be translated...  Its a "one liner" and is not a big deal but I wish they would get their story straight.

So I just talked to my lawyer.  He said the embassy will absolutely accept our new AOS during the interview.  So I can stop stressing over that.

Husband got a call from the embassy to come and pick up the package.  Since he can't make it Thursday, he has to go Monday.    Not a big deal anyway... he already did his medical  and the doctor told him to treat the envelope like his baby.  LOL    Police certificate will be done tomorrow.  And my friend said she would translate it for me.  Embassy said it doesn't have to be an official translation. ( thank God)  I just hope they don't handwrite anything crazy to bring to the interview..... 

 

Lawyer said the USCIS is getting tired of everyone asking for an expedite for the waivers... He said he will request one for us BUT he just wanted to let me know they are not happy these days !!

Okay guys something I'm a little worried about.  My esposo went and picked up his interview packet from the US embassy (no mail in this country) and it had things checked as in "bring this", marked out as in "not needed" and then at the bottom hand written it said to bring "proof of relationship", "proof of domicile", and "a list of all entries/exits into the USA".

 

The reason I'm worried is because for proof of relationship and proof of re-domicile I've already sent in TONS of stuff.  Could this hand written list mean they think it's not enough???  

 

Here's my genuine relationship stuff:

 

 

-Copy of lease we currently share, plus translated copy

-Copy of [my- lease from USA, authorizing [husband] as an occupant

-Copy of various receipts of joint payment of rent throughout the years

-Copy of bank statements showing [my] paycheck being deposited into [husband]

account

-Copy of various letters and postcards exchanged

-Copy of wedding invitation, plus translated copy

-Copy of wedding program

-Pictures of the relationship and marriage

 

And here's my re-domicile stuff:

 

? Absentee ballot request marked ?US citizen, plan to return?
? Credit Union statements showing permanent US address
?  investment fund statement showing permanent US address                                      

? retirement fund statement showing permanent US address
? state drivers license showing permanent US address

? Lease agreement for our house

? Quote from auto insurance company regarding my request
? Quote from health insurance company regarding my request

? Bill of sale for car purchased in the USA

? Email about inquiry of renewing my teaching license

? Email correspondence with international shipper giving quote

 

And now I also have my letter of resignation saying I'm moving back to the USA.  It's hard for me to believe this isn't enough evidence.  But why else would they hand write that stuff in?

I just called the embassy and he told me our file just got there yesterday  ( YEA RIGHT)  so he said they will call my husband when he can come to the embassy.  I asked if the police certificate needs to be translated and he said "YES"   anything that comes from the NVC is fine the way it is but since my husband is going to get the police cert this week, it has to be translated  BUT not officially...just by someone who speaks English and Spanish .  NVC says it doesn't have to be translated if its in the native language of the embassy...   SOOOO #######???    I guess I can have a friend translate it really fast if he sends it to me.. My husband doesn't know anyone who speaks fluent English over there...I am sure my husband will get a different answer if he calls or asks when they call him...  I swear it never ends....

I hope not !!  I already booked my flight.  I am fine with the 15th.  I haven't heard anything.

 

SO incase anyone has noticed,,, I have been a quiet lately...  Well....  I will give you the short version...

 

Last Tuesday I was laid off from my job and I was al little freaked out until my daughter saved the day and said she would sponsor my husband. She filled out an AOS and gave me her transcripts for the last 3 years. We have a copy of her birth cert and SS card.  She makes plenty for 2 people.  dwheels and saylin gave me excellent advice.  I just hope the interview goes well and they accept the new AOS.  Our lawyer told me we should be fine. I just hope a copy of her birth cert is enough because she can't find the original. 

 

Has this happened to anyone else?  What was the outcome?   Any help would be appreciated !!!!! :cry:

I would like to appoint myself and Saylin and maybe 10 more soldiers to be overseer-er of immigration affairs. USCIS, NVC and we would have agents onsite at embassy. This is cray cray. ughhh Sorry you guys. I try to make it flow easy but nothing about this is easy at all.
 

if only it were that easy!!!!      If they had a facility in Philly, I'd be at the door with my resume and all of my immigration experience to work there so I could help others.    That really should be a job requirement..  #1 you must have prior PERSONAL experience dealing with the immigration process !!!!

Yeah I even thought that maybe they open mail on Wednesdays and that's why they don't attend callers.  But evidently, not.

 

They'll be hearing from me again next week for sure!

 

Also, I wouldn't trust them to call your husband when the file arrives.  Just FYI.  But I'm sure you already knew that ;)

I don't believe anything they say.  I believe the file is there. Why would it show "in transit"  and then "ready"?   To me, "in transit" means it was shipped and is with the shipper... "ready" means it reached its destination.  DUHHHH   I think lying must be a job requirement for all of them.

 

I was just going through all of our documents to bring to the interview.  OMG  boarding passes and photos and receipts for packages I sent.  I need a truck to haul it to the interview.  I am also bringing my original birth certificate, and copies of my divorce decrees. You just never know !!  Also the embassy told me to make sure Husband brings expired and current passports.  I have 2X2 photos of husband. I just need to go get mine done.

I'm not sure if this is something I should be worried about or not.  My CEAC says "ready" and processing site says "San Jose".  Yet when I call the embassy they say they don't have the case and it won't get there til next week.  This slightly worries me because our interview is July 1.

 

I haven't called to see when NVC shipped out the case yet.  I assumed that since it said "ready" that it was at the embassy.  Silly me for trusting the government website.

Well, after reading your post...  I had to call myself.   She said they don't receive the files for the next month until the last week of the month...  ( I don't believe them one bit)   she says it takes a long time to be mailed from the US..  (  I'm thinking  maybe back in 1940..LOL)  anyway, she took my husband's name & number and she said she would call him when it got there... She said we already received instructions from the Visa Center and he should go get the police certificate now.      also said not to worry... we won't lose the appointment date...

 

 

 

I was told my file went out on the 13th. ( Friday the 13th of all days..... right?)    I can't find anything going to Costa Rica for that date.... HELPPPPPPPPPPPPPPPPP

@Lovemytico did they make your husband get the chicken pox vaccine?  The doctor made my husband get one!  My husband told the doctor he had chicken pox already and therefore didn't need one but the doctor insisted.  I think he just wanted to make more money.  The whole visit cost $150!!

He just told me he had to get one.... and he forgot the name. He said they charged him the same.. xrays  are on a CD...

A while ago I made him go to his family doctor and show them the list and compare it to his vaccination record. Chicken pox was one he needed but he never had the chicken pox.  Also had to get the flu shot and  tetanus .  But his insurance covered the shots . I didn't talk to him yet only whatsapp messages until he gets home.

Yeah I thought so too.  But whatever.  We'll call tomorrow, they should have it in the system by then.  We're lucky enough that we live WALKING DISTANCE from the embassy so my esposo can pop over whenever.

I guess the lady he talked to told him they changed our date.  Sounded like there was a guard who couldn't come in on the 3rd?  Who knows.  I'm happy they made ours earlier instead of later!

 

He also said the lady asked him a whole bunch of questions.  He said the lady said that our case probably wouldn't be there until the end of June.  We'll call again tomorrow!

the end of JUNE????   They are full of #######....  just another statement to avoid phone calls.....

What did he say?

 

My esposo called and he said they said they don't have it yet.  Hmm.  I might try calling real quick, I have a planning period at school.

 

Also, he said they changed our interview date to JULY 1!

 

THAT'S IN TWO WEEKS AHHHHH

He tried to call but he is in the waiting room at the doctor's office on the second floor.. There is no signal. He's gonna call when he gets back to his car.   He is over by the Clinica Biblica.  How did you find out the interview has changed? Did they tell him over the phone?  OH MY GOD I hope they don't change ours. I already booked my flight!!  I guess it would be ok to change it to a day before or the Thursday after the orginal date.  But not another week !!!

Also, having my esposo call the US embassy today.  Between 9-11am! :rofl:

I have literally been checking the staus all morning and it said IN TRANSIT  .. then I went to the ladies room, came back to my desk, looked at your message and checked my status again ... it NOW says   READY !!!!!  YAYYYYY!!!!!!!     I guess I'll have my husband call and see if he can swing by on his way home !   It is only 8:40am  in Costa Rica. I guess they opened their mail from last Wednesday !!!

The last package I see leaving for Costa Rica left the 9th and arrived in Costa Rica the 11th.

Me too... that's all I come up with....  is it odd that NVC told me my package left on the 13th???   my status still says  in transit !!    GRRRRR
