I just read this article about a Korean guy who is a professional video game player. It said he got an athlete visa from our government to come here and play.

This guy can get a visa to play video games in our country, but it takes forever to get a visa for our families? This is utter bullshit! Am I right?

The timeline entry page does not provide the option to state that the case was transferred to my local field office.

What concerns me is that it will now sit in Hartford for another 6 months.

At least it is moving I suppose...

because they are not transferring to any place other than NSC, TSC or CSC.   Spend some time going back over the March and April threads. You will see that you will get 2-4 messages stating you were being transferred to another office and a local office.   That is false.  Your hard copy will confirm the resting place of your file.


Perhaps we could sort and color code the May spreadsheet by NOA1 dates like the April one? I don't know who originally created the May spreadsheet, but I'll happily reorganize it as long as I have permission. 

I think there is a MAY spreadsheet already.     Maybe someone will post the link.

Transferred to local office....yay!!! :-)

Your file is NOT going to a local office.  Wait for your hard copy to find out which service center your were transferred to.

 

TSC, NSC or CSC.   Everyone gets the 3 or 4 emails stating their file is being transferred. 

 

My senator's office actually inquired for me and sent me the information while I was in Costa Rica.  The hard copy was at my house when I got home. It only took a few days. I was transferred on Nov. 27th

Nothing here either sad.png but I guess they can't transfer us to a local office since we are abroad.

No files goto local offices... Its one of three... NSC, TSC or CSC. Everyone gets the 3 emails ( sometimes 4)  My congressman sent me an email with the service center I was sent to. When you get the hard copy via snail mail, you will find out where you were transferred to. CSC is the fastest so far

For us May Filers, even if people are from the Phillippines, also remember, they have been filing April since last week. So we are next. Let's try not to judge from the Current events and say they are only Processing people from the Phillippnes. We waitied for so long all together, our time is coming.

NOBODY is judging what country.. They are just trying to figure out the trend. 

 

I'm April 12th and have not heard anyting about being transferred.   Since they aren't finished transferring April, it only makes sense to assume they are transferring filers from the Phillippines over the others ( for now) 

 

 

12% isn't more than any other country.

hahahaha even though the national average is 7.4 months, they insist they are working on Feb 12, 2013 TODAY not as of Sept 30th and I can't submit a service request.( even though I did make a good arguement) But she did say... Don't worry honey, you're getting close !! They are only 2 months behind ! ! !

 

I wanted to tell her I can read the computer screen to  but it wasn't worth the arguement.

The only good thing is... we all knew they weren't really working on OCT 2012. That date was so far out there... maybe they are doing something similar...  Going a little bit beyond to cover their butts once again..   We can only hope.

We're all in a rush to get our cases processed, but that is a really poor excuse for a lapse in judgment. If anything, she should have thought of the further delay to the expedite requests of those that have really been affected by the typhoon.

Dont attack her, like us, she is just desperate to make her case approve really fast. When she saw someone posted that he applied for his case to expedite because of thypoon happened in the philippines, she didnt think of immorality, ethics, she just think of her case, her husband, herself. But pls try to understand everyone here. We all want our case to be approve..the soonest. Anyway she didnt reply anymore so I think she knew she was wrong. Anyway even we are not from the place being affected with the thypoon..we are all griefing for what had happened to our fellow filipinos. And dont worry even if she apply to expedite her case, USCIS might be lazy but not stupid to give approval if the applicant is not from the place affected, peace everyone, just smile, december is our month...fingers crossed

Jeeze, maybe I should ask for an expedite.... Do you think the lazy USCIS  employees will realize my husband lives in Costa Rica,  Not the Phillipines??? 

 

If you aren't affected by a natural disaster, why would you even think of asking to be expedited because of it???

I'm a July filer myself, and I know I'll be pissed if I see a regular September or October I-130 approved.

There was an approval on the 15th for a July filer. The approval was from NBC.
No, he was not a DCF nor an expedite. Just a regular filer.
So it sounds like the NBC is approving petitions now          

July though???  did someone just grab a random box and not check what dates were in there???    Last time I checked, April, May and June were before July

r060106 is correct, they meant six months from that particular notice so about six months from today. But who know what happens. Nothing is as certain as uncertainty when dealing with USCIS.

you could call today and get that same answer,...  and then call next month and get the same answer  ... get the trend?  its just another smoke screen to make you stop calling...

 

I called 3 months ago and got that same response, then the month after that.... same thing... they just reword it...

I could be worng, But I think this person was filing from the US..  Since they filed the AOS when they received the NOA1.  That's not a stand alone I-130..

Yes, although I might edit it more, so that ordinary people can better understand our situation - and who do not understand the strange terms of USCIS - it is good enough for promotion.  So, you and everybody should email cover letters with the email link to everyone that you can think of.  Post a link to it on Facebook, or wherever else you can.  We need to drive website visitors to the letter, as many as possible.  Spread the word.

 

Also, you can leave comments - we need more people to put comments in there.

 

To make our job easier, here is a sample cover letter that you can modify and email to influential people or organizations:

we, with i-130 petition for a spouse, do have the precedence according to the law, and don't have to wait for a visa number, but we do not have the precedence among ourselves. With so many I-130 petitions being processed, difficult to know who has the precedence..

you'd think they'd go by the date they receive the files and store them accordingly.. but obviously, it isn't the way it works.

I'm hanging out to wait to see the approvals posted....  Think about it though.....  what is stopping someone from posting a fake  timeline and posting fake dates? 

 

When I went through the K-3 process back in 2008, I was fortunate enough to be able to chat with a group of "REAL" people. and actually... I still talk to 3 of them on Facebook frequently.  Back then there was alot of BS going back and forth and alot of "Know-it-all's"  The point is, it really is case by case .  It is fun to wait for the approvals and casually read the posts, but use your common sense.  Do you really believe someone who just filed their petition a month ago?  I can share what I know happened to me back in 08 . 

 

That is why I filed the K-3. I read so much ####### on VJ about how its dead....  and for a while I believed it but I have to go by what my attorney says rather than VJ.  If it was dead, it woudln't be an option and they wouldn't bother posting processing times either .

Not a visajourney person, but I have read these threads to get information about the USCIS. I filed for an I-130 in May 2013 for my wife, and my receipt number starts with MSC. I am a U.S citizen and I have not filed any other forms. I felt it would only be fair to create an account and pass on this information.

 

I contacted my local congressman's office to see if they could help process my case faster, and this is the response they got from USCIS, which they then forwarded to me followed by their comments (in black):

 

"

After a review of our systems it was found that Case MSC 13 9-- -----, Form I-130 filed on behalf of ------ is currently pending. The estimated processing time for I-130 petitions is an additional six months from today?s date.  These delays are due to workload factors not related to your constituent?s case.  If your constituent does not receive a decision or other notice of action from USCIS by that date, please contact your USCIS congressional liaison again.

 

When you filed the I-130 for ---- in late May, posted estimated processing time for I-130s was most likely 5 months.  However, due to a surge in applications and a resulting delay in processing, USCIS was forced to transfer pending I-129F and I-130 applications from the Vermont Service Center to other offices around the country for adjudication.  New cases, such as yours, were routed to the MSC to await assignment to a field office or other service center for processing.  The MSC does not process I-130 applications and is simply the holding place for your application. 

 

The MSC is sending I-130 applications out to local offices or service centers in the order of receipt for adjudication, but it will most likely be another 6 months before ----- case is adjudicated due to the high workload that USCIS is experiencing.

I was also told from the congressional office that visajourney is not a reliable/credible source for information. I have no comment on this, but I'll leave for you guys to judge.

 

If I could give advice it would be to not read too much into any one case. I believe there was a May filer who was approved recently that several people got excited about, but their case was also expedited.

 

 

 

I received the exact same form  letter a month and a half ago.  I am an April filer.  I was also told my file would NOT be transferred and that they aren't transferring cases to local offices anymore..  But after reading posts here and a recent approval ( April 29 PD)  she found out her case was transferred and was never notified.   VJ is not reliable... its mostly opinions....  I read alot of things that are just false information but I don't dare post anything about it.  I post about K-3's because I have experience with filing and getting approved for that petition.  As far as the more complicated things....  I agree....  someone called it a RUMOR MILL on another post.  

 

It is nice to see the approval posts but anything else is just for entertainment and to pass the time.

Okay, I might have some update... I called USCIS yesterday, spoke to tier-1 Customer Service Rep (CSR) and she did verify about Overland Park, KS and how Vermont Service Center reference is rhetorical / nonsense without any connection. Then I immediately asked to speak to tier-2 CSR hoping to get a timeline for i-130 to get adjudicated, she took my information and advised that one of them will call me back in 3-5 business days.

 

However, I got that call today (so in 24 hours, not bad) and here's what he answered me:

 

1) He too, verified what tier-1 CSR had conveyed yesterday.

 

2) Even tho return address on my receipt (NOA-1) is Overland Park, KS... my case is actually at National Benefit Center (NBC); which is at Lee's Summit, MO... which kinda makes sense because I did a side research and found out the this NBC was use to known as Missouri Service Center, ergo receipt number starting with "MSC" (source: http://immigration-l...g-times-uscis/)

 

3) Here's the daunting part, he estimates that currently it is taking 6-9 months for i-130 and better to consider closer to 9 months timeframe ohmy.png!

 

because / and

 

4) Even tho current shutdown is not affecting NBC yet, there is possibility it might diablo.gif

 

So, bottom line is... just to sit tight and keep a look out for any update.

 

 

2 things....I read somewhere on VJ that both facilities are considered NBC. Missouri and Kansas...  They are  only 30 minutes apart from each other. Maybe someone else can chime in on this but I could swear I read that.   I would go by the address printed on your notice. All over VJ it is said that any filers May and later are in Kansas.  I'm sure there are a few strays...

 

the other thing I question is ... 6-9 months ? is that from the date of filing or from the time you were told this information?  Like 6 months from today?   The senators office was sending letters to people stating " 6 months form the date of this notice"  even after being already 5 months in.

Just curious, what makes you think you'll get the NOA2 by November? If so, that's really fast coming from a May filer given the hugely long processing times of I-130s right now. I hope you get it!

some Feb, March and April still need to be adjudicated.  IDK,  I had 2 tier 2 reps tell me I should see something around Halloween. I'm not counting on that at all. I filed a  K-3 today ... Processing times are posted at 5 months for that. I'll take whatever one comes first.

I tried to check my USCIS account last night (not that I expect a change, but I try to check frequently) and then again just now. I was not able to sign on and the message was that there were too many unsuccessful attempts so my account was locked. I did not have any unsuccessful attempts. I have always been able to log on with no problem. There didn't seem to be any way to resolve the issue, so I tried to see if changing my password would work. I went through the personal security questions with no problem and got to the point of inserting a new password. When I did so, the message appeared that I could not change my password since my log-in information could not be found.

 

Anybody else have this problem? Anywhere I can go for technical help from them?

Yep,  It happened to me more than a few times.  And I know I am using the correct password...  You just have to keep trying. Wait a few hours and go back and try again.

 

I had an old sign on from 2008 with my old case numbers. Since I couldn't remember my user name and password, I created a new account and only had my current case number in it.   One day,  I went to sign in and it gave me that same error you got... I was thinking.. "WTH??? "  I finally got it by resettting my pssword and to my surprise, someone at the USCIS combined my two accounts and now all three case numbers are under the one account.  So I know someone was looking at our case  but I never saw an update on the USCIS website...

 

Keep trying, you'll get in.

Sometimes they do an update on the site on Sundays.

Maybe u'll have better luck on Monday morning

As an update to this...
 

 

It looks like we're still OK. USCIS will remain open. This is due in part to the fact that our visa fees are funding the operation.

 

 

 

deltagal said the NOA2 was from Lee's Summit, doesn't know if the case was transferred to a local office. Not sure about Jmack yet, but I will report back if I do find out anything.

He said his petition was addressed from Overland Park Kansas,  as far as we have seen that is the FIRST approval from that new office.  It supposedly just opened this week,  so hopefully that was only the first of many NOA2's coming within the next few weeks.

Its NOT an approval from Overland Park. He was confirming the address on his NOA1.   So far... no approvals from Kansas.

I called USCIS today, got hold of Tier-2 after 1.5 hour wait.

She told me that my application is still at NBC, and the wait time for these kind of applications is 8 months; I have seen same time-frame reported by other VJrians. e.g., Serpent Dragon ZX, he is also a May-filer; so there is no need for me to keep calling USCIS till I get the same answer twice, because others have received the same answer.

 

Serpent Dragon ZX is a May filer, but he put the post of his conversation with USCIS in March forum, here is it:

Just got off the phone with the nicest woman...  She gave me information...

 

1.)  If your going to call ANY Tier 2 Immigration Officers, don't call Monday, or Tuesdays.  It's very busy, and long wait times.  Call around Thursday-Friday.

 

2.)  Processing times for I-130 (CR-1) Applications and Petitions, is 6-8 months at the NBC.  But they are slowly starting to get through them quicker, and quicker.

 

3.)  As of now, if your wife is outside the U.S., and if you submitted sometime in March, your application should be processed in this next month or so.  For me it was May, and she said since my wife is not adjusting status, or in the U.S., it looks like around November, early December by her computer.

 

4.)  When questioned about getting transferred to a field office...  She said that she wasn't sure who relayed the information, it's not correct, but if your wife/husband is outside the U.S., it's staying right at the NBC, and getting processed there, but should go quicker once it's at that point.  If your spouse is here, it could possibly be transferred to a field office, but it's at their decision.  Shouldn't delay it too much, since they would try to keep it within processing times.  She was mainly referring to my case, and said she couldn't directly speak for other's applications and petitions.

 

My wife and I applied in May, and she is currently outside the U.S.

Was given a processing time of around November - December...  Then, it's off to the NVC stage if accepted, which seems like everything is in order anyways.

While this is soooo nice to read,  don't get too excited because nothing is written in stone.  I am convinced that every Tier 2 tells a new story.  I am positive that if there was a phone call to the same number a minute later, there would  be a totally different story.  

Read and take it in, but think outside the box and prepare for a long haul.   Just sayin..

 

I'm not trying to be negetive... I'm just saying that nothing they say is 100% true. The only thing you know for sure is that your file is PENDING.... after that.... its all luck

only problem with them is they wait for the notifications

vj shortcuts will save you as much as a month if you pull all triggers correctly wink.png

I was lucky to get a quick approval and then suffered the dreaded nrc rerouting , so once again so many factors beyond out control.. just be ready to pull all the triggers in the next steps and follow the nvc shortcuts.  even with the new delays it is possible to get through nvc in less than two month.  nvc is reeling from the daca mess from august 2012.  hopefully they will get caught up.  the information I have seen is yes, nvc is swamped, but they also have reacted to this situation by increasing their staffing.

I have an attorney so I believe they will be the ones paying the bill as it comes in from the NVC.  Hopefully they will be on their toes...  I will plan on being a thorn in their side too but  I have a good relationship with my lawyer... He is really good at getting things done.

Good Morning VJ family, Just an update. I called and spoke to a tier 2 this morning. I was informed that my expedite was approved and my petition is now waiting for the expedite group.

how long did it take for them to approve your expedite?   I'm just curious because alot of people have requested them and haven't heard anything.  They usually tell you to wait 60 days for an decision...( which to me isn't an expedite at all... but thats just my opinion)

well with the new center opening you will not end up waiting until 2014

my feeling is that you all will see a FLOOD of approvals beginning the end of this month.. I believe the files are being used to train at the new center which is why everything from may to now seems dead

uscis is in total reaction mode bcause of lovely mr president and daca..there was no preparation for the absolute avalanche of petitions that happened last year.

the customer service directorate is there and actually does help.. I really do understand how hard this is to hear, it is just about having the right dilemma and the right knowledge and those uscis cs directorate people jump on it.

My worry is the the NVC won't be able to handle the flood of approvals... The NVC is already too slow, if they get bombarded with more files, the wait will go from 8 weeks to 16 weeks.  So what is the difference?    This whole process is a joke.  And I'm not trying to be negetive...  its just the reality of this situation.   Unless they were smart enough to hire more people for the NVC....

i don't get excited.

it didn't cost a thing to ask through the congressman office so we did, just to compare to the info coming from VJ forum.

 

i don't understand people's impatience. i don't find waiting difficult. i can understand that this paperwork take time, 

people do not realize how many files go to USCIS, tons, tons, tons.

 

all the calls, appointments don't speed up the process. they just make officers "angry", constantly they have to answer people's questions, instead of working.

I find waiting VERY difficult because I want to be with my husband and get on with my life.   I'm sure there are tons of other people who feel the same.    Good for you that you don't mind waiting....     Please don't comment about impatience....   Paperwork does take time but  the system is broken and everyone is very frustrated !  I am sure everyone here wouldn't mind waiting if they were given updates and the USCIS stuck to the 5 month goal.    It is what it is...

Don't get too excited  ClockWatch2.gif ... I already made 2 congressional inquiries

 

The first one told me the processing time is 12 months ( that was last month)

The second one told me the processing times were 6 months from the date of the notice ( last week)  I am an april filer.

They just look for different ways to word their lies and BS.

 

I had a 30 minute conversation with the office.  I asked a million questions... She was very understanding and was willing to give all the information she had.  But she never said they were working on cases filed 6 months ago.  That would put them with the March filers.    There haven't been any approvals this week. 

 

She did tell me that the K-3s are taking longer to process than the I-130s.    She said they don't have enough people to keep up with the files and that they receive 3000 per day.    She told me if my case was at the Philadelphia office, the inquiry answer would have come that from that office.  So its safe to say, my file is still at the NBC in Missouri.  She knew NOTHING about the Kansas facility opening.  She also told me the NVC takes about 8 weeks to get through. Waivers are taking more like 8 months rather than the 4 months posted on the USCIS website.    The senators offices don't really know much more than you can read on here.  And each congressional office is different. It depends on the relationship that person has with the USCIS rep they communicate with.    I am sure they are getting bombarded with inquiries since they are so far behind.   You gotta love the form letter they send out.... Its really a slap in the face.....

The document is dated May 10, 2013 so just when we filed.
 
As for LoveMyTico's comment, no we don't expect miracles to happen, but we are also not comfortable just sitting here doing nothing, not saying there's anything wrong with just waiting, just not our style. Ombudsman is next at 6 months, although I doubt that makes any difference either. Contacting a congress(wo)man and ombudsman office are really our only options of doing something, so we make do with what we have. If anyone else has any better ideas, would love to hear them.

 

I wasn't trying to be nasty.... Nobody is worse at waiting than me.  I will contact my senators office every month from now on.. and I will try and find other ways to get more info....  It might not do an damn thing.. but its better than sitting here doing nothing. 

 

 you have to realize that no matter what is posted about the processing times,  they are only estimates. They don't hold themselves to it, and they don't let anyone hold them to it either.   The goal for processing at the USCIS is 5 months. but the average is 9.5 months.   goes to show that they don't care.   If there were some kind of competition out there where you could pick your own adjudicating agency, then they would be processing their littles asses off.   But since its the only place we can send our papers, they get to make the calls.
