For Costa Rica,  you can search anyone in Costa Rica and find out their parents names etc.... married or divorced and if they have registered children.  Once you search a person, you can see the parents names. Then you can search them if you need to. You can even get their Cedula.

Wow, the attorney gave you incorrect info and wrong advice! You can't lie and say she was here for 2 months when records show she was here for 11!!  I believe the ban is 10 years and not 3 because she overstayed more than 6 months.  You will have to apply for a waiver (I-601).  Instead of the K-1, I'd just get married in Canada and file the I-130 along with the waiver...

up to 180 days is 3 year ban...... She has a 10 year ban.  You'll need an I-601.  That gets filed after they find her inadmisable during her interview.

 

Don't lie about an overstay.  They are super sensitive about overstays.   I suggest reading the guides and the many threads about waivers. 


Did they mention anything about a ban to your fiance at the border when she was stopped? I ask because, This topic is super scary to me because my situation is different but kinda similar too. I was stopped by CBP because they saw that I've been traveling to and from the US every six months for the past two years. Now I NEVER overstayed not even by a DAY but the CBP still said I had "immigrant intent" so they denied me with the same case number as your fiance. They never said I was banned or anything..they just made me sign a bunch of stuff, stamped my passport and interrogated me. They told me I needed a new visa and a waiver but everyone here said I shouldnt need a waiver since I was not banned. Any new thoughts? Dont want this to affect my K-1 standing. ;(

Yeah, it makes you feel like ####### doesn't it, knowing how our government treats its own citizens. Disgusts me to no end...

 

 

Nothing you say will make me change my mind. Sorry. It should not be this way and is a completely broken system. Citizens should not have to wait this long to see their loved ones. I'm not a petitioner of a fiance. I'm a petitioner of my lawfully wedded wife and I'm a citizen of the U.S. I won't be waiting 3-5 months. I'll be waiting for more likely 1 to 1.5 years with the way things are going. What do you say to that? You'd think there'd be some advantage to actually being a citizen, but there is none. 

 

 

Yeah, that's the dumbest thing in the world. If they're illegal they're illegal - pain and simple. Enough of this PC stuff. Yes, our country welcomes them with open arms because by being made legal they give politicians the votes they need to get re-elected and maintain power, as was the case with Obama and the DACA. It's just so wrong and flies in the face of what this country was founded on.

I agree with you  1000%.  and today is Sunday, I can't even get on the phone and make a ####### load of phone calls.  I am going to make tomorrow a very productive day. I'm going to shut my office door and make tons of phone calls and send out a few nasty-grams.   

 

Also,  don't forget..... making all the Illegals Legal gives all the lawyers a new Mercedes next year... That's why all the lawyers are for the Immigration Reform  .. Makes me sick.

Huh? You sent your petition in August and already got approved, and you're F2A? That's blazingly fast. Did you do a DCF or something?

 

How are we all supposed to think positively? Most of us are U.S. Citizens and we see that fiance petitions and F2A petitions are being processed faster than us. With all due respect, that's a very hard environment for a citizen to stay positive in. 

Yep, its like twisting the knife in our backs.....

 

I am sitting here trying to figure out how to speed up our process.... but there is nothing I can do....  the problem is,  I am a USC....

 

Seems our country favors the Greencards and illegals   #######?

Sent my I-130 on 07/21  ,  Chicago  Lockbox .  And received the NOA1 from NBC (Overland Park, Kansas) on 08/26 . The application is in Initial Review.

Was going through forums on this site and saw that some of March fillers been approved .

Anyone saw anything about April or May petitions ?

So on the USCIS website it says that my case was filed August 29, however I got my NOA1 email today Sept 4.

I'll wait until I see the date on the hard copy to figure out which date to put on my timeline for sure.

Oh and it says USCIS National Benefits Center but again I will wait to see if the address on the letter shows Kansas. Here's hoping that's a good thing.

try and look up your case on the USCIS website.  If you sent it on the 29th, your PD is probably September. Whatever date they log it in is your PD. My lawyer sent mine Fedex on April 10th and it was received April 12th. I never got an email or text even though I am signed up for both.

 

 

NBC is Missouri and Kansas. Look at the address at the bottom of your NOA1. It will tell you where you file went to.  My PD is April 12th. My file is in Missouri. I think they started the Kansas addresses in May.  I could be off a little though.

I am well aware of that. What surprised me is that I was able to access my case status so quickly after they received it.

when they receive it, it is assigned a case number... It is entered into the system.. It is the same system they use.   Some people are never able to access their cases online. When they call, they are told they are in the system .  They get approved and sent a hard copy of the NOA2.   I just hate reading other threads where people are so concerned with why they can't access their case online.   It doesn't really matter ... they don't update the status until you get approved anyway.    I am hoping the text feature works. It would be nice to get a happy text from the USCIS !

Don't put alot of faith into the text and email system. On the site it states it is a pilot program. I haven't gotten ONE text or email.  Even back in 2008...  The system is not reliable.  I have heard of alot of people never getting a text  etc... and then when they sign in to check status  it showed their approval.   Just sayin....

Even though the email and text we got from USCIS said to wait till we have NOA1 hard copy before we check our case online, i couldn't help myself and i just did... congrats to us, we are now showing as intital review!

I think a false checklist would not have any checks in front of the items and would not mention the first checklist. I would call. Who knows what they are doing over there. Maybe the first one was a false check list and you responded unnecessarily which caused them to review your response and cause the delay. They told me they go by the last submitted document because its a contract

the operators are just that..."operators"   they don't have anything to do with your case. They are only relaying what they interpret on the screen. One person might view something one way, and another might view something totally different.  They are trying to give good info... Don't call if you don't want to hear what they have to say.  Wait til you get your CC letter.  Those operators aren't the ones who are reviewing your files.  and remember, things change constantly over there.  They might be telling the truth.....

 

be thankful you can call the NVC everyday if you want.  The USCIS is a horrible place to be stuck. Calling them is like talking to the wall.

the person reviewing our case was not aware that the police certificate is not required at the NVC stage but they check listed us anyway. Had to have a supervisor remove that. NVC didn't like my husbands original birth cert so they made us get a certified copy from the registry in Costa Rica.  The translations were fine. You no longer need certified translations. It can be informal.

 

The birth certificate checklist cost us a month at the NVC otherwise we would have been out of there in 30 days.

 

 

You will need a joint sponsor. They will want to see income from 2013. You cannot use foreign income. You will also have to write a letter explaining why you didn't file taxes. I am not a tax expert but I am thinking you still should have filed your taxes even though you were living abroad. That may become an issue . Maybe someone else will chime in who knows about taxes and filing from abroad.

OMG 60 days for just that? Goodness! Sooooo frustrating!

I've seen RECENTLY some people getting a checklist for the AOS multiple times. Its a contract so they won't budge on it.  Some people have been stuck at the NVC since APRIL. 

They review mail by date received not by initial or checklist.  Maybe they are trying to change that  but who knows.  Try following the October NVC thread.  They are all at the NVC and there are some veterans who follow the post. They are excellent at answering questions.

faisal you have to realize that often the agents that you talk to on the phone will say all sorts of things. My sincere advice is to contact a senator or congressman, though sometimes I do question how helpful they are. It is worth a try, some are more helpful than others. Unfortunately we found that after the last service request saying that security checks were done and pending adjudication, then the email from the service center, we contacted the congressman, and believe it or not a few days later we got a response from the congressman that security checks were pending and to wait 90 days!!

We were shocked and my husband phoned them, and called them out on it, sent them the emails. They apparently called back an hour later saying they had spoken to the service center and we should hear back in 30 days. Makes me wonder if they did anything in the first place.

We have all waited long enough and if security checks are done, our petitions should go to the top of the pile and be adjudicated asap without any delay.

It is getting ridiculous, I hit 10 months next week since NOA1.

You also need to understand it is mostly about numbers.  If they give you a stupid RFE, it takes your file out of the pipeline and it doesn't count in their monthly reports.  They are known to do this.  I think the NVC does the same.  

 

Security checks and RFE's take your file out of the normal processing time and a service request is useless. 

 

I feel for all of you who are still waiting. I remember getting really antsy at the 9 month mark.

Emailing the service centers gets a generic answer too. More so than the senator inquiry. Been there, done that about 10 times. I think the I130s Are slowing down due to the DACA renewals. I'm seeing transfers all over the place. I would love to know where DACA files are processed. The DACA applications slowed my I130 down. Took 11 months. Really was frustrating.

Day 4 here since we've been "assigned to an officer".

don't get upset if you end up waiting a month or two.  Assigned to an officer may mean a certain officer is assigned a certain section of a huge filing room.   After I was assigned to an officer per my Senator's inquiry, It took 4 months for my approval.... and the security checks came 3 months  after it was assigned.  A friend of mine works in DC with Visa Fraud. She explained to me just yesterday how they search tons of databases for a "HIT"   They look at everything.  Even I was shocked.    And they are not even close to interested in rushing.   If they get a tiny "hit"  then they do another more in depth search

I see your point , but we got this :USCIS records indicate your case was undergoing an extended background check. The background check is now complete and the case is assigned to an officer " thus I believe it was true what they stated because noa2 came 3 days later. 

 

I am glad to see you are done with uscis and nvc as well. I hope your hubby is going to be home with you soon, Good luck with waiver. :)

when we got a response for our SR similar to yours (being assigned to an officer blah blah blah 30 days.. blah ) the noa2 came 3 business days later! so I hope it is a good sign and you will get your approval today or tomorrow!! 

 

 

"being assigned to an officer"  doesn't mean much.  They Senator's office told me my case was assigned to an officer DEC 2013.  My approval didn't happen until March 18th 2014.   I always imagined my file sitting in a box next to someone's desk, collecting dust... and people bringing new files over to this officer and putting them on top of mine...  after waiting so long, you start to come up with different scenarios in your head  LOL

 

 

and when they told me my case was assigned to an officer, they gave me a 2 week time frame....  which came and went..   then I got the security check cr@p and then I got that we were out of security checks and it should be another 2 weeks... and then 2 more weeks went by.   The wait was horrible.  

 

The day we were approved was the same day the USCIS website changed the processing time to 5 months. The day before it said May 2nd.  We were April 12th and nobody wanted to do a service request for me.  It was really ridiculous.     They we lucky that they approved our case that day because I would have been on the phone all day trying to get answers.  I had really had it by that point.  I am still angry about it   and its been 6 months.  LOL

im not so sure on this.....our case was "pulled for derogatory information on me" and investigated apparently for 2 months till everything cleared...or that's what we were told at our 1st info pass appt.  In order for "degoratory information" to surface they would have had to investigated me, found some "interesting, mismatched info" and conduct further investigations.  We're quiet curious in knowing what it was but would have to put forth a request for this information to be disclosed under the freedom of info act, which we aren't at this point because we do not wish further delays on our petition.

 

So, in our case, yes, they conducted background checks on me, the beneficiary.

Were you ever in the US before?  I asked my lawyer the other day and he said they do not do security checks on the beneficiary in their home country.   If you were in the US, they may be checking name matches  ETC...

Does anyone know when they say still pending beneficiary security check to clear. Are they actually doing security check in the beneficiary country as they do in America for the petitioner, because I know some countries take forever to respond back to anything. 

My lawyer told me they do NOT do security checks on the beneficiary in their home country. I don't know how true that is. He told me it costs too much money.

 

When you get the NVC stage, you are required to get a police certificate for the beneficiary. 

 

So when they tell you they are checking the beneficiary, it is most likely checked in the database here. Its another sneaky way to buy time and take your file out of normal processing queues.

 

Senators' office told me once they put your file in security checks, it takes the file out of the normal processing queue so making a service request for being out of normal processing time will not apply.

File service request 2 days before and call talk to tier2 officer yesterday. I am planning to call every 2 days :) Hope they will listen.

Tier2 officer did not tell any thing.

make sure when you ask for a service request that the operator files it at the correct service center. Ask for the confirmation number so you can call and check on it. Twice the operator sent a service request to the wrong service center for my case and then they make you wait another 30 days. The confirmation number should have the service center letters as the last 3 characters. Also, try sending an email to the directors of the service center. adjust your email settings to receive read receipts. Sometimes you can tell if they actually open your emails. You can also file  a service request online.   I went through this nightmare last year.  I feel your pain.  

 

When you make an inquiry with a Senator or congressman, your file doesn't get physically pulled. The Senator's office has a direct line to a special department the specifically deals with inquiries. They have more access to your information in the database and they can see the exact progress.  I was in constant contact with my Senators' office during the last part of my process for my I-130. It was twice a week at the very end.

I just joined have been trolling the site for info for a few weeks now, so I decided to join. It totally seems like a support group for us going through this process. I didn't see a thread for this yet so I thought I would start one.

 

Just got the NOA1 in the mail today. I know the wait can be long form this point How is everyone else doing?

 

Also the dates on the NOA1 seem off. The received and priority dates are March 13th, the day I put the package in the mail. The Notice date is March 17th which was a Sunday, didn't know the Gov. worked on Sundays. But the 17th was St. Patty's day so maybe there will be some luck with it..

March 17th was Monday and it's not a National Holiday. It is a normal working day for the US.  

 

You probably won't have a wait as long as those of us who filed a year ago.  I just waited 11 months and 6 days for my NOA2.  Hopefully the USCIS got the backlog down a bit.  Follow this site to keep up with he trends. That helped me a lot because you'll get nothing but lies from the USCIS.  

 

Where did you get your NOA1 from? Which service center?
