Hello guys!

Long time lurker, new member, and first time poster here. I have questions regarding my same sex adjustment of status case -- please don't get mad if I posted at wrong thread but I couldn't find a more appropriate one to post at.

Here's my story. I've been in a relationship with my partner since 2007. We are both "closeted" so we kept our relationship in private. None of our family members and friends know. Because of the understandable non-traditional nature of our relationship we tried and kept our relationship as "downlow" as we could. He, a natural born US citizen, lives in the east coast, and I, on the other hand, on an expired H4 visa (and no criminal background and not in deportation proceeding) lives in the west coast. Our geographical distance worked to our advantage as it made our relationship easy to hide. For 6 years, either of us visit/fly to see each other for up to a week or more, about every 2 months. In some cases 3-5 weeks apart. We made it a point to see each other as often as we could and we've been to about a dozen trips just the two of us together -- Hawaii, Miami, Chicago, etc.

Also for the past 6 years, we talk on the phone almost everyday -- from about 10mins to more than 1 hour each time. When DOMA was struck down we both decided to get civilly married in private: just us two and a commissioned employee at a city hall in California. Now we are in the process of gathering evidence for adjustment of status.

Here's all the things we have:
Airline tickets to see each other
Hotel/car reservations for our trips
Years of phone records
Photographs of just him and me from our different trips
Photographs from a couple concert events we went to together

Due to the nature of our relationship, neither of us have photos with either of our families. We know each other's immediate family members by name but he never really met my family aside from "hellos" when he come to pick me up at the house. I haven't met his family at all.

Also because we live apart we don't have joint bills and bank accounts and co-mingled funds. We both plan to live together in the future and share bills and have them under each other's name -- but that probably won't happen anytime soon as I plan to go back to school here in the west coast once I get my paperworks done -- and he cannot leave his job in the east coast at this point.

So with this situation, what's our chance of being successful in the immigration AOS process?

Any insights will be appreciated.

Very fortunate to have our case both expedited at stage 1 and stage 3..Still we had to suffer through all the anxiety that comes with the paperwork and not knowing the timeline..

 

Our case was given final approval today at the US Embassy in Manila.

 

I'm sure better times are ahead for all of you,,It's crazy how long they make you wait.

At first I applied for an expedite as part on the humanitarian relief our USA was providing to Filipino's..10 days went by with no word..A day after that,  my father was diagnosed to have stage 4 lung/brain cancer and so I called and spoke to a tier 2 operator about getting my wife over to meet him before it was too late..My wife and dad had grown close through skype but had never met in person..He was very empathetic to my situation so I felt I would get my request approved..Yesterday I checked my case status and there it was..POST DECISION ACTIVITY CIRCLE in blue..

 

It's been a rough few months, so it was extra special getting great news like that. I feel for all of you..Hopefully the I-130 process continues to pick up the pace..

Approved on Dec 9th through a requested expedite..our case is now headed to either the state department or the visa board..

I just started researching the k-3 process..As a September filer , I'm starting to think seriously about filing a I-129..I know there's talk of the I-130 process going back to a 6 month or less timeframe, but none of us really know that to be true..We could be in for a long long wait of 12 months or longer before getting our loved one/one's to the good ol US of A.

 

 my #1 priority is getting my wife to the usa ..the conditions really dont matter to me as far as permanent residence status or green card status....we can deal with that once she's here..

If I lived anywhere close, I'd go to the overland park uscis offices and try asking questions of people coming in and out..I dont know exactly how that could be done without getting arrested for stalking (lol), but with some common sense and persistence, I-130 answers must be waiting there to be unearthed.

Well, supposedly the Overland Park Division 8 area dedicated to processing stand-alone I-130s has been operational for at least one week.  I know not all petitioners are on VJ, but don't you think they would have approved some this week?  I know BOS_LHR runs stats a lot...have we seen any I-130s approvals from this week (that would have been at the Overland Park facility)???

 

Even if it is true that they are now dedicated to processing stand-alone I-130's...wouldn't they have to do background securtiy checks that takes at least weeks?

thanks dwheels..i researched and found out in Manila an appointment cofirmation printout is as good as an appointment letter..

 

Now it all comes down to if our medical has made it to the embassy in time for our interview..fingers crossed!

Ok we have just made an interview date for March 12th for our cr-1 visa...but we havnt yet received an appointment letter..

 

Our case had been expedited and on the CEAC status update it read the following ..

 

Your case is ready for your interview when scheduled at the U.S. Consular section. If you have already scheduled an appointment for an interview, please prepare your documents as directed in your appointment letter and appear at the consulate on the appointed date and time. Otherwise, please wait until you have received interview scheduling instructions.

 

Also our medical was completed on Friday and our appointment is 6 days later..We're supposed to give at least 7 days for the paperwork to clear at the embassy

 

The reason I went ahead and selected March 12th was because the next available date would have been May 20th..

 

Do we need that appointment letter or is the appointment cofirmation enough? Can we get by with only 6 days from medical to the interview?

 

Any good advice i can get here will be much appreciated..It's confusing as always..

Are my 2010-11-12 irs tax transcripts enough for my benificiary  to bring to the embassy interview or do i need the actual 1040's and W-2's?

 

I'm going over the documents required for the Manila embassy and I'm confused (like always).

 

It says to bring the national police clearance form (NBI)..But I sent it to the NVC ..Do we need to acquire another original copy or will the NVC ship ours to Manila? Same question goes for other paperwork the was sent to the NVC..

an appointment letter emailed to me yet..Our CR-1 case was expedited to this stage

 

The reason I did that was because the next date available was May 20th..I asked the operator if my case would be allowed at the embassy with just a appointment cofirmation letter..She said you have to go there and find out..Which I took as there's a chance this would work even without a regular appointment letter..The operator told me that if they didnt let us interview, we would just have to reschedule.  So it seems there's not much to lose..Also maybe we finally get emailed the letter before the 12th

 

Any thoughts would be greatly appreciated
