Hi All,

 

So I sent the I-129F packet and got a NOA1 03/05/2014 who is in Vietnam.  The instructions on what I have to prepare from the K1 guide is very clear.  I know I need another letter stating I still want to marry my fiance dated closer to the interview date and all the fiancial and work documents needed for the Aff. of Support.  The instructions for that is very clear and straight forward.

 

My question is for my fiancee in Vietnam. I looked on the Embassy information but still am not very sure what it all means.  I see something about a Packet 3 and then a Packet 4, forms and instructions that will come with it.  So I'm guess that after we (cross our fingers no RFEs) get our NOA2, I will send my remaining information to my fiancee and she will have to prepare the rest herself with the instructions that come with those packets?  Are those forms in English or in Vietnamese?  After sending her her copy of the I-129 kit, any further supporting documents of ongoing relationship and the Aff. of Support, will I need to do anything else during this process or is the rest up to her in Vietnam? 

 

The parts we do as the petitioner is very easy and I did it without a lawyer.  But now that I look closer at the things that will be needed for my fiancee, I'm wondering if we can do it ourself? Is it very difficult? or should we invest in a Vietnamese lawyer?

 

Any advice would be greatly appreciated

Hi All, thanks for all the help so far.

I'm in the process of filling out the I-129F and want to make sure I fill out everything correctly.

My fiance is from Vietnam and the Vietnamese alphebet usese Roman letters, but has accent marks.  When filling out her information on both the I-129 and G-325, should I write her information like name and address out with or w/out the accent marks? 

 

Questions 31.a-33a says "if your fiance's native alphabet uses other than Roman Letters, write his or her name and address abroad in the native alphabet."  I'm pretty sure I just leave that area blank...correct?

Hi all,

Filing the I-129 for my fiance in Vietnam and have questions on the supporting documents I plan on turning in.  I just need to know what needs to be translated if any and if so do I need to do it somewhere official? or can I just do it myself?  We both communicate with each other in Vietnames and not in english.  Also some of the official documents for her are also in Vietnamese so please provide help with your experience.  Then things I have questions on that might need to be translated are:

 

1.  Emails

2.  Her birth certificate

3.  Her divorce papers from her last marriage

4.  A etter from her parents validating our relationship is true and that' we've meet eachother during my last trip to Vietnam

Hi all, my fiance and I are both Vietnames.  We're preparing the I-129 and wanted to print out all of our e-mails as supporting documents for our relationship.  Just a simple question.  We both write in Vietnames so our emails are such, do we have to get these emails translated to english? if so can I do it myself? 

 

Also I was just thinking of "print screen" option to show it was printed from my email address.  Is this ok? or should I just copy all of our emails to a word doc and print so it looks neater?  any tips?

1.  On the new I-129F form, theres two address areas for my fiance's information, question 3.a-.i asks for mailing address and question 29.a-f asks for "fiance's address abroad.  Her mailing and physical address is the same so I'm guessing I can use the same address for both righ?

 

2.  She lives in Vietnam and this is how she emailed me her address:

-  Most might not be able to answer this but how would i tranlate this?  I know the first line is the street name, and last line is the city, but how do I transfer/translate "Khom 3 Phuong 4" onto the form?  Is that the appartment #?  Please help if you know Vietnamese address. 

 

3.  Finally, I found the k-1 visa guide and it's been really helpful but doesn't have a sample of the new I-129F form, just the old one that's expired.  Does anyone know if there is a new sample floating anywhere around this site?

Would you recommend translating like putting "street" after the street name and changing "Khom and Phong" into group and ward? or would you recommend just leaving it the way it is?  "Soc Trang" is the city, but should i put "Thanh Pho Soc Trang" or Soc Trang City. 

 

I was leaning towards leaving it without changing into English because even when I go to the Post Office to send things, I just write it out like that and some how USPS is able to get the item to them.

Hi All,

Almost ready to send in my I-129F packet, YAHH!!  Just wanted to clarify my understanding is correct on copies. 

 

The initial packet I send in needs to be the oroginal forms with original signatures on the forms.  Proof of supporting evidence can be photo copies and I should keep original.  I should make a copy of the entire packet to send to my fiance so she has it for when they call her for her interview. 

 

The question here is I am required to send in original signatures for the initail packet, but she CAN have copies of the I-129f and g-325a along w/ her additional supporting proof when she goes in for the latter interview?  She doesn't also need originals of I-129F and G325a?

 

Also, the guide states once I'm done preparing the packet, to make two copies, so the original I will send in, I'll send her a copy of the entire packet for her interview along with proof of ongoing relationship for her interview, does the last copy need to go someone? or just to have in case of lost documents etc.?

Finally!! I completed the I-129F and all supplemental forms.  So now I'm ready to actually put the kit together to mail off.  Just wanted to know how you guys would recommend putting the actual kit together.  Did you put it in a folder? Did you put stickies and postage all over?  I know it should look presentable but should I put in extra attempt to make it look "prettier and user friendly" or just keep it as simple as possible, neat? 

 

Just looking for advice from anyone who has done it and successful.  This is an anxious time for me and my fiancee, just want to cross all the T's and dot those I's.

Hi all,

Getting ready to send off my i-129f kit.  I have a written letter of support from my fiancee's parents and my fiancee's divorce certificate from her first marriage, both written in Vietnamese.  I translated them myself because I'm fluent in Vietnamese.  Per the instructions on both the I-129F form and the guide on VJ, it just states each translation has to be accompanied by the following statement:

 

Certification by Translator:



I     typed name    , certify that I am fluent (conversant) in the English and                     
languages, and that the above/attached document is an accurate translation of the
document attached entitled                       .

I took this as I can translate it myself as long as I attached this statement saying I'm fluent in English and Vietnamese.  Now I'm not so sure based on other topics posts.  Can anybody shed some light for me?  Did anybody translate documents themselves and was that ok or did you have to actually get it "certified" and maybe notorized by a translation business of some sort?

Hi All,

First thank you to all that have replied to my many posts, you've all been great help making this complicted process a little eaiser for me and my fiance. 

A little background, my friend who is her cousin introduced us in August and we just knew.  I went back to visit in December, and I'm now filing the K-1 visa process, when you know you know right? :)

I have completed the final packet, think i'm ready to send off, made 2 copies of the ENTIRE packet and just wanted some of you guys to look over what i'm sending in to see I'm missing anything.  I know signatures and dates are very important and I'm positive I've looked over the package enough time that Im not missing any signatures or dates.

 

Listed below is page by page of the packet:

1. Form G-1145 e-Notification of Application

2. I-129F Cover Letter with table of content

3. Payment with personal check (I put the check in a zip-lock bag and stapled it to a page and titled page Payment with Personal Check)

4. Form I-129F and supplement type page of how we met

5. G-325a for both self and fiancee, both have additional page with passport style photos with names on the back

6. My Certificate of Naturalization, copy of front and back (not sure why cause back is black, but following the instruction to the "t" is my goal)

7. Fiance Letter of Intent for both myself and fiancee

8.  My Divorce Certificate (both FL-180 and FL-190, I'm from Cali)

9.  My fiance's Divorce Certificate. We're Vietnamese, I signed a statement that I translated her original certificate myself, my translated version of her certificate, and her actual divorce certificate.

10. Proof of having met in person:

      -  Boarding passes - baggage ticket stub - copy of visa front and back stamped - itinerary of flight - hotel receipts of entire trip (3 different hotels) - photos from trip (i picked 7 pictures with friends and family i really liked) - Letter of support from both of her parents and a letter of support from her cousin who is my friend who introduced us - Receipt of engagement ring and from our engagement party - Receipt of a day tour we took

11. Proof of Ongoing Relationship

      -  Phone bills showing calls with eachother (i'm nervous with this because we didn't talk hours at a time, from August till December when I went back to meet her, I was finishing up my last semester of my masters program so we mostly e-mailed when possible) - Chat logs from Skype (after I visit, I set up Skpye for her and we've talked since almost every day for hours) - About 40 pages of e-mails we sent back and forth to eachother.

 

I know this was a long post and thank you for reading it all.  If I have everything in order, I plan on sending the package immediately on Tuesday.  Any suggestions from experience members are very much wanted.  Thanks again for your time.

Hi again all.  I'm getting ready to file my I-129f and one thing still bothers me.  A Timeline.  Is it required? Is it needed? and is it even really helpful because I'd be the one typing something up and would they even consider that strong evidence?  I've searched previous posts and still coming up with mix opinions on requirements and actual helpfulness of it.

 

I posted a previous question to have others review my kit and some people brought up having a Timeline.  I checked both Vietnam's Embassy Information and Reviews and didn't see anything requiring a Timeline.  Nor did I see anything additional needed by the embassy for the I-129f kit besides what was in the instructions. 

 

If you have any input, please let me know.  If you used one or if you didn't use one and then was one asked for?  If you've dealt with Vietnam's embassy, that would even be greater help.  Thanks!!

Hi Everyone,

 

Basically we're at the step where my fiance received her instructions form the Vietnam Consulate and now has to go online to fill out a DS 160.  She has a laptop and internet access, only issue is she's never owned a laptop before LOL.  She's very limited on her computer skills. she only knows how to really turn on the laptop and go to skype when we chat.

 

I've revied the online application and its way above her skills ability to complete accurately.  From just navigating the site to uploading the visa photo (required by vietnam).  Can I just fill out the application online for her? and then some the completed confirmation page to her via email to print? cause as far as I can see, the whole applciation is done online and she just has to print out the last page.  Please any help or insight would be greatly apprecaited.  We're so close but not sure what to do from this point.  Thank you.

I'd choose the address where she can most reliably receive mail. It does not need to be her houshold book's registered address.

Unfortunately the office is from CSC, which I've been seeing has a minimum of 4 weeks to get to NVC. This sucks since the other centers are averaging 2 wks :(

 

Anyone from California Service Center that got approved NOA2 in October got their paperwork to NVC yet?

Oh btw everyone...when you're doing your actual timeline, NOA1 should be listed as the receipt date by uscis. That is your place in line.

 

Been through this twice, which is why I sent my application express mail.  So when you're seeing other's 'case approved in 8 days', etc..but the date they sent it in is like 2 weeks from their listed NOA1, well you know unless they're overseas, USCIS would have received the mail within 3 business days from their 'sent' date.

A. If a U.S. citizen has ever ?filed petitions for two or more fiancés/fiancées and the previously approved petitions were filed within 2 years,? a new K-1 application can be denied. [I.N.A 214(d) (2) (A)] This restriction may be removed through a waiver, which can be requested through a written explanation, submitted along with the I-129F form. Hello everyone.

 

I am filling out my 2nd I-129F application. The first one was filed a year ago today.

 

I keep reading posts and interpretations that I will need a multiple filer waiver, however has anyone actually read the Part 3, Item 3 explanation of who needs a multiple filer waiver?  Here it is:

 

  "If your beneficiary is your fiance and: (a) this is the third (or more) form I-129F petition you have filed; or (b) this is the third (or more) Form I-129F petition you have filed and your first Form I-129F petition was approved within the last 2 years, then your petition cannot be approved unless a waiver of the multiple filing restriction is granted."

 

However under the instructions page it says:

 

   2. What filing limitations does IMBRA place on K-1 Non immigrant Petitioners?

       You must apply for a filing limitations waiver if any of the following apply:

      a. you have previously filed K-1 petitions for two or more beneficiaries; or

      b. You previously had a K-1 petition approved and less than 2 years have passed since the filing date of such previously approved petition.

 

So can someone please clarify this as I do not want to go the Multiple filer route because I do have 1 previous domestic violence related conviction that was expunged and the plea of nolo contendere previously entered was set aside, and a plea of not guilty was ordered entered and the case  was dismissed.  This was over 14 years ago. I don't want to risk a denial based on that. I had no trouble with the law after that one incident and have even worked for City government, received several college degrees, since then.

 

So questions are:  

1) With the above 2 different definitions on Multiple Filer (the first being on the application itself which is a new I-129F Form since 2013 and the other Multiple Filer definition on the instructions which probably hasn't changed, do I have to file Multiple Filer for my case?  

 

2) If I do have to file a Multiple Filer for my case, with my past domestic violence related conviction and present circumstances of good conduct, etc, what is the likelihood that I will get a waiver? (someone with a similar case, can you please let me know what happened with yours)

great to know of your case progress. while you're waiting for your NOA2, I highly suggest looking at the list of documents that are required for your interview. you may want to start gathering/requesting some of them soon.

I got my message saying that the application was accepted today but that it was forwarded to California Service Center for processing. Im not very happy due to the fact that the TSC has the fastest approval times. All we can do is keep our fingers crossed and hope for the best.
