K-1 Fiance(e) Visa Process & Procedures45 and been divorced 3 times already....could this be a problem filing a 1-129F for my Fiance?
My husband has been divorced twice. At my K-1 interview, the interviewer asked about both of these divorces and when they had occured, even though I had the divorce decrees with me and had handed them to him. He asked to see the originals - I had made copies for them - which I had and at the end of the interview he handed me back the originals, looking rather pointedly at them, and said "So, what do you want me to do?" I was quite taken aback but responded, "I want you to approve my application and give me the visa". He looked me straight in the eye and said "Are you sure you want to do this?" as if he was waiting for me to change my mind. I unhesitatingly said yes, and he sighed and said "alright". I have no idea what was running through his mind but got the feeling that he didin't like the fact that my then fiancee had been divorced twice. I was glad that I did have the details of both of those marriages to know why they failed (one lasted 2 years, the other one 22 years), but I was shaken by that question.

If you are serious about him, please have him arrange to visit you first, especially so your family can meet him and you can see how he behaves to your friends. If there are problems, then you will have someone to protect you. One of your comments did concern me - the statement that he has had some problems but is working them out. When you marry someone their problems become yours and you really need to decide if you want to deal with his problems too. Take your time. If this is real, it will last and a lifetime is a very long time - or should be. If it isn't real, then it is better to know now than later. Good luck.

joeyjoey is right - USCIS advises that you do not make any plans until after you receive the Visa. If she is asked about when the wedding is - which I doubt they will do - she can just say 'we couldn't make any plans until we knew we had the visa, but we will be married within the 90 days of my entry to the US' or something like that. Too many people have been badly burned financially by making plans and sending out announcements and invitations before hand then having to cancel. What you can do, if she wants an announcement, is to publish an 'engagement' announcement in the newspaper. Dates are not required for that and it provides good evidence as well.

If you are the US citizen petitioning for your fiancee, you will need to submit proof of your citizenship. If you have a valid US passport, that may be sufficient, but I know my then fiance had to provide a copy of his US birth certificate with his petition. You have to prove you are entitled to the benefit of petitioning for a non-US fiancee as only US citizens are allowed that option.

Just a correction to Rosyanne's post - you will receive an email when the status changes; you won't receive an email when it is just a touch. All that changes is the date on the account, and the only way to determine that is to check the account yourself. Check daily if it will make you feel better, but I agree with Jaylen - it will probably just frustrate you when it doesn't change. I just remembered the date of the last touch and then checked up once or twice a week. Then when I noticed a touch, I checked more regularly to see if there were others.

He should be fine. He entered legally, was inspected at the border by a guard who authorized his entry with his father (the license plate of the car will be in the computer) and is leaving before the de facto 6 month allowed stay. If he is concerned that there will be no record of how long he stayed, he can always check in with immigration on his way out and advise them that he wants it recorded that he did not overstay. All he probably needs to do, though, is to remember the dates he entered and the dates he left since he will be asked to provide them for the K-1 and later one for the AOS (adjustment of status). It is good to be concerned but you have nothing to worry about.

Yep, I agree. In spite of how you feel she treated you, you also treated her improperly. You can do a one upmanship by calling back and apologizing. Having worked in an environment where I had to tell people news they didn't want to hear, I appreciate how frustrating it is on both sides of the equation. I do know that the ones who called back after losing their tempers at me - or my news - earned my respect, my appreciation, and my compassion. I certainly tried to do the best that I could to satisfy their concerns. The whole K-1 process is a frustrating one - I know, I was there for 9 months - and it doesn't pay to alienate anyone during the process. Anger, swearing, rudeness, loud voices, threats, intimidation don't get you any farther than polliteness, patience and consideration. It never pays to shoot the messenger. Take your frustrations out on a dart board with USCIS in the bulls-eye - or here on this forum. USCIS is too busy and overworked to care.

Unless it has changed there is a requirement to bring a second letter of intent to marry from the US fiance(e). I know that I saw it and I know that we had it for my interview in Montreal in 2004. I think it is listed as one of the attachments to one of the forms, possibly the K-1 visa, rather than identified separately on the checklist. Read carefully.

You would do well to take what Zyggy says extremely seriously rather than dismiss it. You have told him twice that he is wrong - in effect, you are telling the border guards that they are wrong and let me assure you - on the border, they are never wrong. They are GOD. Their word is absolute. You can try to play word games all you wish but while you are busy denying the experience and knowledge of everyone here, you may wish to spend some time researching Canadian immigration laws. That may well be your only recourse if you continue to pursue your planned course of action of getting married in the US, having your Carribean holiday, then trying to return to the US as the spouse of an American citizen lacking any type of visa. If you are lucky, all you will have to deal with is the embarassment and expense of trying to return to Canada from the Carribean. If you are unlucky you may face some unsavoury days or weeks in a detention center. If you are barred from re-entering the US there is no appeal. You cannot cite case law and statutes to change the reality. That is when you knowledge of Canadian immigration laws will help - so that your husband can move to Canada so you can live as a married couple since you will not be allowed to be in the US. Why so resistant? Why not just follow the law? Take your Carribean cruise after you have received your Advance Parole - you are only postponing the honeymoon about 3 months. What is 3 months compared to a lifetime together as husband and wife?

Don't stress yourself out too much trying to 2nd guess what you might have or might not have missed. Sometimes, even when you hurry, it does go just the way it is supposed to. Now, when you are more relaxed, get blank copies of the forms that you submitted and go over them, filling them out in pencil or whatever, with exactly the same information you sent in, then match them up to the attachments. You can review all of the materials you have and determine if you did indeed miss something, or if you are just worrying because it is so important:-). Worrying is normal and we all do it, but this way you may be able to re-assure yourself that you didn't miss something after all. If you find that you did miss something, well then you will know what it is and you can prepare it for the RFE when it comes. It will slow it down a few weeks, but it won't derail the process and once you submit the necessary items, will get back on track again. Good luck!

Can you ask your parents if they ever received a citizenship document for you with its own citizenship number, or if you are included on one of their citizenship documents as a minor child when they became citizens. If your name is on a document somewhere - and your parents would have had to submit proof that you were a US citizen in order to obtain your first passport - then see if you can get the number and name of that document from them. Ask them how they were able to obtain your first passport - what application and supporting documents did they use for you.

Your senator's office almost certainly has call display. They would also have started a file based on your earlier call. While he should definitely have asked your name even if he did have call display, it is quite likely he will be able to match your request up with your file without much difficulty from the call display information. He could also have been on another line when you called back and was therefore 'unavailable'. Hope he gets back to you soon.

I would ignore this comment. I have no intention of 'speaking for' Martindart, but it seems to me that he/she is implying that you maintained contact with your friend in Singapore even while you were married to your wife because you had the eventual intent of bringing that person to the US, that your marriage to the US citizen wasn't sincere because you maintained an attachment to this person. The implication is snarky and mean-spirited. If I have mis-interpreted Martindart's comment, I apologize, but I suspect that I have not. As I said at first, the wisest course of action would be to ignore it - and Martindart. Marriages do break down and there are lots of cases of 'childhood' or 'colege' sweethearts meeting up years later and resuming a relationship interrupted by sincere marriages to other people. Good luck in whatever course of action you choose to pursue.

From my understanding, you are currently married and things are not going that well. You are a recent US citizen through marriage. You are asking IF you get divorced, and decided to renew a relationship with someone you once knew who currently lives in Singapore are you able to sponsor her on a K-1, or would your citizenship be at risk because of the divorce?

I believe once you get your citizenship you have to do something pretty horrendous in a criminal way to get it revoked, or have it proved that you committed some type of fraud or mis-represenbation in getting your citizenship. Since nothing in your post indicates either situation, your citizenship should be safe.

IF you do decide to divorce and wish to pursue a relationship with someone you knew previously in Singapore, you should be able to submit a K-1. They may ask questions if your divorce falls right on the heels of your citizenship, so you may wish to take a bit of time - a year or so - before actually filing for the K-1. This will also give you time to complete all of the divorce proceedings, as well as have a chance to renew the former relationship. Alsom, it is a good idea after any relationship fails that you allow yourself some breathing/healing room so a year is a good 'cooling off' length of time for you to re-establish yourself as a single person. Kind of both:-). By the time I had completed everything I needed to do in order to move and actually got here it was another 6 weeks. We had decided we didn't want a big fancy wedding but something simple and meaningful outdoors somewhere. It took some time to find the location, and then to review the dates that were possible. The anniversary date was one of the available Saturdays and we thought that it just seemed appropriate somehow. It was also just a few days short of the 1st anniversary of my mother's death as well,. SHe had been so happy for us, so we felt that this was also a way we could 'include' her in our wedding. My Dad took the flowers from my wedding bouquet back home and laid them on her grave on the anniversary of her death 4 days later.

Oh, it was also the day before my own birthday - so i joke each year if he forgets our anniversary I get a really good birthday present!

The way I read this, I think they want you to send in a written request like a letter saying (for example only) something like " I respectfully request that you waive the requirement for my fiance and I to have met in person during the last two years due to medical hardship. The medical reason is ***************. I am enclosing evidence from my doctors, from (any other evidence you have), etc. in support of my request. If there is a specific hardship waiver form you wish me to use would you please send me a form or direct me to where I can obtain one; otherwise, please consider this letter my formal request for a hardship waiver of this particular condition. Thank you for your consideration of my request."

Now, this is just my suggestion. I don't know if there is a specific waiver form for this or not since I suspect there would not be very many requests for exemption from this condition; there may not be an actual form and a letter requesting the waiver may very well be what they expect. Perhaps zyggy has some more clarification on this, but from the wording in your RFE that is what I got .

So, send in both the request for the waiver and all of the evidence you have in support of your request. Good luck!

If your problem would be living expenses and having to live off of your savings, you should definitely be looking to the future when your fiancee is in the US and you are married. She will need to apply to adjust her status in the US shortly after you are married and you will need to provide an affidavit of support that will show you have an income that is at least 125% of the poverty level, supported with income tax returns for the current year. If you do not meet this criteria then you will require a co-sponsor. If you cannot guarantee a co-sponsor you may want to weigh the benefits of short-term gratification - being with her while the K-1 processes - versus the long-term benefit - getting permission for her to live permanently in the US with you as your spouse. If you can address the income - and income tax requirement - situation, then go for it. If not, then grin and bear the separation knowing that it will only be temporary. Why not take a look now at what the AOS application requires to ensure you are not compromising that by moving temporarily to Nicaraqua?

Using a tourist visa to visit the US, then falling in love and deciding to marry and adjust status from within the US is not illegal; Using a tourist visa to 'visit' the US but really having the intent to marry and remain in the US to adjust status is illegal - it is called visa fraud because you have misrepresented yourself - in other words, lied to immigration about your intent. If you are pregnant, then it will be extremely difficult to prove that your 'husband' had no intent to marry you when he entered the US as a tourist and the likelihood of facing a denial of the AOS based on visa fraud - plus being banned from entering the US again - is very real. Another option in addition to the K-1 that is legal is to enter the US as a tourist, get married, then leave the country while a K-3 visa (or a CR1 visa) is processed through the Embassy abroad. It would mean separating for a while after the marriage but it may be a means whereby he can be here for the birth of your child if the K-1 process looks too long. Think through the time lines and consequences very carefully. You want to make sure that you are able to arrange for a whole life time together, not just for next March.

You mentioned having traditional parents. I am assuming you mean that they want a traditional wedding and such. The problem with the K-1 visa is that you have no control over when it is issued - you can wait 3 months or you can wait a year until it is issued. That is just for permission for your fiance to enter the US. He has 6 monoths in which he can take advantage of that visa for a one time entry into the US. The main condition is that you HAVE to get married within 90 days of his arrival to the US or he has to leave the country. There is no extension on that 90 days. If you want to plan a big traditional wedding, you can't start before you have the visa in hand, and 90 days doesn't give you much time to plan. If your parents want a traditional wedding plan for it now while he is currently in the US, then apply for the Adjustment of Status while he is in the US. The only difficulty with that is that he is not able to leave the US once he is married until he receives either his green card or his AP (advanced parole) so he would not be able to return to Canada until then even to visit family. Others are right, you do have options but you need to understand that you may not be able to do or get everything that you want on any one option.

Only certain employment based I-129s are allowed to pay $1000 extra and get expedited processing. I suspect USCIS knows better than to offer it because virtually everyone would request it - and they know they wouldn't be able to meet the demand.

We blacked out things like account numbers and non-relevant information and then also highlighted the relevant information. My USC spouse is especially concerned about personal information going somewhere outside of his control and is very reluctant to let such information get into third party hands. I don't think it will cause a problem but maybe a compromise is available - blacking out the account number and the amounts against the non-relevant information. If they don't like it they can send you a RFE. Technically, you do have things to hide - personal account information that they don't need to have. All they need to see is that there is evidence to prove that you have met in person, so purchases such like hotel rooms, transportation, etc. for times your passports show you were in the same place at the same time should be fine. They don't need to see what you paid for utilities bill or gas for the car or other non-relevant purchases and they don't need your account number - your name and address should be fine.

I too have sent post by certified, registered and priority with receipt acknowledgement from USPS - and more than once the recipient has received the item at least a day before the tracking information updates. One time it was 3 days after the item was received before they acknowledged it had been delivered. I have never had anything get lost or misplaced or not delivered, so hang in there; I am sure you will hear soon.
