You can enter the US at any POE. It will be the first place you arrive at US immigrations. Before you get to the US you will receive a small card on the plane called an I-94 - exit/entry visa. All non-immigrants have to complete an I-94 when they enter the US. The K-1 is a non-immigrant visa, but once you get married, you will then apply to become a permanent resident or 'immigrant' by applying to 'change your status' from a non-immigrant K-1 visa holder to a permanent resident based upon marriage to a US citizen. You will fill out the-94 on the plane then hand it in with your sealed envelope package when you get to US immigration. When Immigration processes your K-1 and the contents of your sealed envelope, they will also stamp the I-94 and then staple it into your passport with the date of your arrival and the date the-94 is valid until - which is the 90 days allowed by the K-1 visa. You will need to submit copies of the I-94 when you apply for your green card so make sure you keep it safe.

If you have no exit restrictions for which you need some sort of documentation, then there is no need for you to return to Pakistan. You can fly from UAE to the US. I don't know if there are direct flights from UAE to the US so you would be transferring at some overseas airport anyway so the country in which your flight originates really is a moot point. It (generally) doesn't matter from where you travel when you arrive in the US as long as you have your visa and the necessary documentation.

You would also benefit from going directly to the USCIS website (http://www.uscis.gov ) and clicking on the I-129f form, reading over the form and the instructions and reading over all of the links. The forms and the instructions also contain valuable information about what you need to do to start the process.

Good luck - and don't hesitate to ask any questions you may have here. It is a good idea, though, to have done some sort of initial research on your own as many of your questions may be readily answered in the paperwork you have to complete For other questions, you can post them here in the K-1 visa forum.

btw - it isn't a good idea to post the same question more than once or to start more than one thread on the same concern. Sometimes you just need to be a little bit patient and wait for the right people to read your question and then respond. On a day like today - Christmas Day - many of our members will be busy with family and religious activities and may not be on line right now to answer questions. Don't send the photographs. There are a number of sad stories here on VJ where individuals have sent photographs of their non-official weddings and have had their K-1 visa denied on the basis that 'if it looks like a wedding, it is a wedding'. If you are not officially married, then anything that looks like a marriage will raise big red flags and it may be harder for you to overcome than you are able to do. The individuals who have found themselves in this situation have then had to go and get married and submit a spousal visa petition instead, even though they were not married when the K-1 was denied.

You also need to check and make sure that the wedding ceremony you had does not count as an official wedding in any way shape or form in your country. If it can or does then you need to submit a spousal visa petition, not a K-1 petition.

If you have photographs that do not look like a wedding ceremony but an engagement ceremony based upon the traditional customs of your country, do include those only if they cannot be mistaken for any sort of a marriage or wedding ceremony. Include any invitations (translated) that you might have sent out for the engagement party (unless it also mentions marriage or wedding) and perhaps a list of the people who were present at your engagement ceremony.

I find it odd that my post was deleted for "violating the terms of service agreement" for telling the person who made this topic in the forum that she should (1) check other posts before posting, (2) check the USCIS website for processing times, and (3) also look around the visajourney website before posting a question about processing times for NOA1 to NOA2 to see if it hadn't already been answered on the same page. Apparently it is inappropriate to also tell her how unreasonable a 2 month turn around time for NOA1 to NOA2 is, though I still noted that it is possible for her to hear soon because she is from Haiti, and she just may be lucky after all.

So I'm sorry I don't want to falsely get her hopes up by saying, "Yes! You WILL hear back soon! You will see your fiance by June!" Perhaps I should be all sweet and lie like USCIS? Tell her everything is perfect and she will hear in two weeks?? And then in two more tell her "Oh, it should just two more" and continue the cycle for several months??

So I'm sorry my post "violated the guidelines."


It wasn't so much what you said, but how you said it. Your comments were rude and abrasive and were certainly not written in any way to be received as useful advice by the OP. If you had written to her the same way you wrote your comments above to me, your post would not have been removed.

I think you need to respond to the RFE with notarized letters from friends and family members (hers, if available) and a personal letter outlining your circumstances.  You are separated by a mere 50 miles - about an hour's drive even though you are in two different countries.  You obviously drive and you can explain that you fill up with gas before you go and have enough left after the visit to return on the same tankful.  US immigration does not require visas nor issue I-94s for Canadian citizens so you do not need to present anything at the border except your passport, which is not stamped.  The border should have a record of your crossing - they take photographs of all car licenses for security checks as they approach the barrier - but they probably will not have a readily available record.

 

Have you ever gone out for a meal in Highland?  To a movie theater or show?  To a bar?  Have you bought gas along the way?  You may not have thought to keep any of those receipts but do a long and hard search - especially in the car - and have her do the same at her house to see if you can come up with anything that shows you spent money in Highland within the required time period.  It isn't proof of meeting but it is proof that you were in the area where she was and it is unlikely you would be filing a fiancee petition for someone you haven't met when you only live an hour's drive apart.  I think the reviewing officer needs to have a geography lesson so he/she can appreciate that you won't have plane tickets or boarding passes and your proof of meeting is going to be a lot more ephemeral.  Canada is not a high fraud country; Canadians and Americans cross the border on a daily basis and cross border relationships are pretty common in border towns.

 

Include the bank statements.  They do show dates and that you paid American dollars on a Canadian account.  Your bank may be able to provide more information about where those charges were made. Ask to speak to someone in the bank's management and explain what you need.  They may be able to provide a letter that states these charges to your account were made in Highland, Michigan - thus providing evidence you were in the same area as your fiancee lives and that you were certainly able to meet in person - especially if she is the only reason you were in the area.  Provide several statements to show it wasn't just a one time visit.

Other reasons for getting turned down in addition to the above: the petitioner having filed for more than the allowed petitions/visas within a specified time period, the beneficiary having a specific health condition that can't be effectively cured/treated, the beneficiary having a poor moral character; not having met face to face within the last two years; not being able to satisfy the affidavit of support requirements; not convincing the interviewer that you have a true relationship (more significant in high fraud countries), etc. Usually, if there is a problem regarding evidence they will ask for further evidence (RFE). If there is an obvious barrier to a visa (criminality, immoral character, not having met within last 2 years, etc.) they will deny either the I-129f application or the K-1 depending on where the issue is identified. For what it is worth, the majority of I-129f petitions are granted and a good many of the K-1 visas are also granted, although some take longer to others due than delays involving background checks.
