Well, apparently not! I just received the following e-mail this morning. My last 'touch' is today - last night it was March 12. It seems like the biometrics might be triggering the transfer:

Now, if TSC follows true to course, the notice of transfer that they said they sent me re: the above, won't arrive either - just like the NOA:-). I wonder if VSC will send out an NOA extending my greencard?

Well, I just got back from getting my biometrics (I had a few stops along the way back VBG). I was expecting the worse because of other dire experiences VJers had recently had at the Atlanta ASC but this was the easiest time yet! The biggest problem was getting there - massive traffic delays on I-75 due to construction so what should have been a 30 minute trip took 1 1/2 hour - most of it at 10 mph or less. I pulled into a nearly empty parking lot - expecting it to be packed to the gills - and went inside. They didn't allow me to bring my folder in so I had to return that to the car and just hand carry my identification, keys and diabetes medical kit (I don't go anywhere without it!). I filled out the forms and joined the 10 other people waiting. I sat next to a woman originally from Italy who was also getting biometrics for removal of conditions. She isn't VJer. Her lawyer submitted her I-751 5 months ago - and the first response they had received was the biometrics appointment letter that came last week. Her green card is expired already so I explained to her she could make an appointment with the Atlanta office and get the I-551 stamp in her passport. I also told her how she could look up her case status on line:-).

Well, interesting!

I have my biometrics tomorrow at 2 pm. I have been warned to expect a several hour process, however the ASC closes at 4 so I am not sure that means they expect to be finished at 4 or what. I wonder now if I will be transferred to VSC as well once the biometrics are done. I'll let everyone know what - if anything - happens.

Way to go, Anya! Yes, I wouldn't presume on the NOA extension letter coming any time soon given the current evidence, and would make an infopass appointment. If you explain why you would like to have the appointment on the same day, maybe they will accommodate you Other options might be having it late the day before or early the day after and staying overnight instead of repeating the drive. Not a great solution, but possible.

Still keep updating things on our list - it appears that others too have been transferred - although so far it looks like my file is still at Texas. Very interesting, indeed. We are both Atlanta files - your biometrics is 2 days prior to mine. Doesn't seem to have any rhyme or reason to this.

My notice was printed a week ago and the envelope dates stamped 3 days ago - so blame it on USPS. It will be there for you soon - hopefully tomorrow.

Biometrics sure seem to have changed since I did my last ones - in fact, all of the ones I have ever done . . . 4 sets. Then, I think the longest I had to wait was half an hour - and for the first ones I was in and out in 15 minutes. Ah well!

Whoo Hoo - mail truck was half an hour early! I have my biometrics too! Yipes, it is for Saturday April 19th at 2 PM. That changes our plans for Saturday - I have company visiting from Canada that week, and we were going to go to the Renaissance Festival - looks like that will have to be Sunday instead. Heheh could have been worse - it could have been scheduled when I was supposed to be driving her to the airport! Hmm - the notice date is April 3 - took a week to get here. But hey - it's here!

OOOO Shari, that is wonderful! Drat - the mail doesn't come yet for another hour!!!! (Ok - I did go and look just in case it came early and it hasn't. ) Sure hope it is there - that would be wonderful news - and save me a phone call to USCIS tomorrow asking them where the NOA is - I can live with having the biometrics instead for a while (hehehe).

OOO another one - and right around the exact same time as me - that is great news:-). I don't know if you will be able to get the stamp at the Application Support Center which is where they do the biometrics. You may want to make a back-up infopass appointment as well that you can cancel if you need to just to make sure you don't have to try and make one on a short basis after the biometrics and they don't have an appointment slot available. Well, you are the first one of us who hasn't been transferred who has received anything! So there is some hope. I sure would like to get a biometrics letter too - a number of us were all 'received' around the same time as you. We can always hope!

well the system at TSC is obviously broken. They tell us that they are sending out the NOAs along with the status update that acknowledges they have received the application but somewhere between the receipt of the applications and assignation of the CR-189 numbers there is a broken link - the action gets recorded as if it has happened, but remains undone and incomplete. Either no one is catching it, or they don't care - and either are possible - incompetency or apathy. Big Sigh! No news here either.

Yes, Anya, you are polite and tell them that this is an I-751 application, that you cannot wait 15 weeks as that is unacceptable. The NOA re-validates your green card and you will be out of status by that time, unable to work, unable to renew a Driver's License, and if stopped by the police, can be put in jail because you have no proof your status is valid. Lay it on thick! If they do not volunteer to transfer you, politely request to speak to an immigration officer. Repeat the same information - answer his/her questions first - then say that you need the NOA as this is an I-751 application and the NOA re-validates your green card for a year - without it you cannot prove your legal status in the US. You can give them the number from the back of your check but that number is for the I-751. The application changes to a CR 189 and you need the number attached to the CR-189 so you can register for on-line status checks. As well, with that number you can go to the local USCIS office and try to obtain the I-551 stamp in your passport. Be sure to have your A# available as they will ask for that. Definitely try again. Remind them that it has been over a month since you sent in your application - back in February and their own guidelines say to call them if you have not received the NOA. 15 weeks is unacceptable for this application. Good luck with the application. Your check was cashed the day after mine:-).

I wish I knew a cheap airline for Ottawa as well:-). We flew to Ottawa not this Christmas but the one before and the best flight we could find was on Northwest - with a changeover in Detroit. Delta did offer some direct flights but they were very expensive. Good luck! (That was out of Atlanta, btw).

I really stressed to both individuals I talked to that I had filed an I-751 and did not have the NOA and that the NOA was necessary because it extends my legal status in the US. I said that I know that the recorded message says 15 weeks but that was unacceptable as I would have no way to prove my status to my employer or renew my driver's license and could even end up in legal problems if I could not prove I was here legally. Both were very understanding of the situation.

When I was transferred, I was asked if I had a copy of the cheque and I said yes, and I have the number on the back of my cheque. I also explained that I know that the number doesn't work to check the status for the I-751, that the application is changed to a CR189 and that has a different number, that it is this number that is assigned with the biometrics, and that is the only number that will allow me to register on the USCIS status update site and search for my status update on my file. She responded yes, that was right. I asked if she had that number available and she said yes, and gave me that number. I had to provide my A# and verify name, address, date of birth at the beginning of our conversation.

It may be that they won't release that file number to any one but the applicant, I don't know. I stressed to her as well that without the NOA I have no way to prove my legal status in the US when my green card expires. She said that she could do follow up a month after my cheque had been cashed if I had not received the NOA by then.

When I got the biometrics number I was able to check my application status and it showed that they had accepted my case on March 11 which is the day after the cheque was cashed, so that is the date I will be using to determine when the month is up and I can call back. I don't know. I definitely have the TDB02 on the back of the check but the online status clearly states that my application is at the Texas Service Center - no changes there since that was posted on March 12. Who knows? It also says that they mailed me a notice - well, their pony express rider must be walking that notice from TSC to here is all I can say.

Oh that is good Peter. Yes, they gave me the cheque number first and I said that one doesn't work, did they have another number, the one that would be used for the biometrics, and that is when she gave me my real case number. It might be a policy that they only give that number out when really asked about it specifically. The good news is that you know your file has been accepted:-).

hehehehe, I know. I was being somewhat sarcastic there, actually!

I was actually quite impressed with how polite they were and how quickly they did get me what I asked today. They agreed that the NOAs should be out quickly and that I definitely needed it for the I-751. I guess I was willing to see it might be reasonable to allow a month after the cheque was cashed before I started to make 'noise'. I did tell her that the other Service Centers did not have the same problem as Texas did in getting NOAs out in a timely way, and she said, 'Yes, I know' so I felt good that she at least recognized that. Do I expect to see the NOA before the 10th? No, I don't but I sure would like to be pleasantly surprised.

Well, it is over a month since I mailed my application so I called the Customer Service line this morning. I got right through to Larry who was very polite and actually helpful. He said right away that he needed to transfer me to an immigration official as he couldn't answer my question. So, I spoke to a lady who didn't give her name and again she was helpful. She confirmed that the cheque was cashed on the 10th and said that generally it is a month after the cheque has been cashed that is important, not a month after mailing and if I still did not have my NOA by the 10th to call back and she would put through an inquiry. I asked about my case file number and she gave me the one from the cheque first. I said that one doesn't give me any information and I can't register it on the online status site. She actually smiled (I could hear it in her voice) and said, 'no, you're right - that is the number that we can use, this is the number for your biometrics file' -and she gave me that number. It is definitely a SRC number so the file is staying in Texas.

So, I went and registered the new number on the online status site and it shows that my file was last touched March 12. It also states that a notice was mailed - but I don't believe that and expect I am going to have to phone back on April 10th. At least I have my file number and could print out the information. It is strangely reassuring to know that that file number already exists as well - I know it is not lost in the black hole, even though it is in the black hole of TSC.

Well, my green card is still valid until mid May so I won't try and get the stamp until the end of April which I think should be long enough to prove to them that the NOA isn't coming and that I need the stamp - which I will - to renew my driver's license.

Tex'n'Brit, do you have access to your bank account on line? We were able to see when the check cleared our account and view both front and back on line. If not, you might want to check with your bank and see if it has been cashed yet. I suspect that it has.

I got my Driver's License in August 2004 and it expires on my birthday (June) 2008 about 4 weeks after green card expires. I don't know why it is only for 4 years but it is. Everything seems to be expiring this year - my military ID expires in August and my old passport was due to expire in April - although I got that renewed very quickly.

Well, I am going to need the NOA or the stamp in 2 months time to renew my driver's license so I sure hope I get one or the other. I really don't relish the thought of having to go to USCIS and try to convince them to give me the stamp if I don't have the NOA yet. Big Sigh. I guess it was just too much to hope that USCIS could speed up at least one of my applications. Let's see, we started this process in June, 2003; married in June 2004; applied for AOS July 2004; AOS approved end of May 2006; applied to remove conditions end of Feb 2008, conditions removed . . . . .? Going on 5 years and counting now.
