Yes, what receipt number are you using? If it is the NOA extending the status of your green card that case number is only an internal number and you won't be able to access any information using that through the Online Status update. You need to wait for the Biometrics Appointment letter. It will have a different number and that one is accessible through the USCIS status update. You should get the biometrics letter approximately a month after your receipt.

I am still waiting for approval but we didn't submit any lease or mortgage documents either since the mortgage and house deed are in my husbands name - he bought the house before we were married. Make sure you provide a lot of other evidence of living together at the same address and co-mingling your financial resources. In your cover letter you might want to state right up front why you are not including any lease information (month by month rental, etc.). If you are renting perhaps you can get a letter from your landlord or rental company stating that you are both living at such and such address.

Interviews are usually if there is a question raised by the evidence - or lack of evidence - or by a random selection for statistical purposes only (they have to conduct a certain number of interviews every year). Chances are you probably will not have an interview.

What receipt number are you using? If it is the one from the NOA it won't work. That is an internal number only. You need to use the number that was on the Biometrics Appointment letter. Try that one.

I am in exactly the same situation, so in the covering letter I just made the statement that I was not including a joint mortgage or house ownership as my husband had bought the house before our marriage, had an excellent 30 year fixed rate that we didn't want to change, and that Georgia is a joint-ownership state so there was no legal reason to add my name to the lease. I just included a lot of other information about how we have mingled our finances and our lives. I have just submitted myself so haven't had the chance for an RFE yet, but I think addressing the situation up front with a reasonable explanation is the best approach to avoid one for that reason.

You are being processed in California. Right now California is processing applications as quickly as 2 months and as long as 6 or 7 months. 4 to 5 months since filing date seems to be pretty average. You can check the CSC Status list in this forum and you will see when the people who are getting approved right now filed and that will give you a good idea of what to expect. Good luck.

If you don't get the card, make an INFOPASS appointment and have him get the I-551 stamp in his passport before he goes to Turkey. You don't want to send something so sensitive as a green card to him out of the country. What will he do if it doesn't arrive and goes missing? With proof of his travel arrangements and the failure of the card to arrive he should be able to get the stamp in his passport which will ensure he will be allowed back into the country.

While I don't expect this will happen it would be a good exercise to take a look at the envelope in which the card was mailed. No, it is sent regular mail and no one has to sign for it. The reason I say it would be good to look at the envelope is that back when I was renewing my AP while waiting for my AOS to be approved, I received the AP and am astonished that I did. The address ink on the envelope was so badly smeared (while being printed by USCIS) that it was barely legible. I have to give high praise to my postman who figured out where it belonged and dellivered it. The name was obliterated, the street number and the first half of the street name was barely legible if you looked very closely through the smears but the second half of the street name was illegible. The city was illegible but the zip code could also be made out if you looked very hard and very closely. By all rights that envelope should not have made it through but it did. I wonder how many of the returned mail USCIS gets is actually because they screwed up the address labels while printing them in the first place.

No, you can start getting these documents now. The idea is to get them as close to the time you file so they cover more of your marriage but a few weeks or months is not going to make a difference so start to work on them now. In fact, if you wanted to apply at the very first opportunity you would need to get them prior to that 90 day window opening up. The 90 day window is for them receiving the application, not necessarily putting the package together so you can definitely work on it before hand.

Absolutely she can do both. Canada recognizes dual citizenship so she would be both a Canadian and an American. While the oath says you renounce previous citizenships Canada doesn't recognize that - the only way to renounce Canadian citizenship is through filing an official form with Canadian Immigration and Citizenship, and the US doesn't require us to do that. Basically, the US just turns a blind eye to other citizenships held by its citizens treating them and expecting them to behave like US citizens. She would need to use a US passport to return to the US but she can use her Canadian passport travelling outside of the US, and Canada will always consider her to be a citizen. Welcome to the club! Between the end of January and early May TSC did not send out any NOA notifications. They were aware of the problem and were supposed to correct it, but when they started to send out notifications again they did not go back and fill in the missing ones. All of the files submitted to TSC have been transferred to VSC since TSC isn't - and hasn't been for about a year and a bit - doing I-751s. VSC did send out a few NOAs upon request to a few applicants but the majority of us, myself included, never received one. I too phoned and requested a copy of my receipt notice and one was promised to me within 30 days but it never arrived and it has been months now.

Basically, we have all just gone and had our passports stamped with the I-551 stamp and the USCIS centers were already well aware of the problems with the non-existent NOAs. I travelled to and from Canada 2 weeks ago with the I-551 stamp in my passport. Upon return to the US border the border guard asked our status (I was with my USC husband). We replied US Citizen and Canadian Citizen with US permanent residency. He asked to see my greencard and I said "I have the passport stamp instead". He looked at the stamp, handed back our identifications and said we were good to go - no problems.

Yes, the 1-800 line won't give you any useful information - it is not manned by USCIS immigration staff but only by low paid call center personnel. They have a script in front of them and can't give you any more information than is on the script. It is known more accurately as the 'mis-information line'.

So, no, you are fine with the stamp in your passport - that acts as your green card until you get your new 10 year card. Carry your expired greencard with you and a copy of your biometrics as back up but I doubt you would need it. US immigration personnel accept the stamp without a problem.

There are quite a number of us who originally filed at TSC between January and May of this year who never received the NOA at all due to some sort of glitch at TSC. When they fixed the glitch they still didn't re-issue the missing NOAs. Basically, what you do is make an Infopass appointment at your local USCIS office (you can do this at their website www.uscis.gov - on the right hand side 'Schedule an appointment"), bring your expired or soon to expire green card and your unexpired passport - or an expired passport plus 2 passport sized photographs - and they will either put the I-551 stamp good for a year in your unexpired passport, or make a new I-94 good for a year and staple that into your expired passport. These act as proof of your permanent residency until your application is adjudicated and you receive your 10 year green card. Hope that helps!

Congratulations, and yes, I fully appreciate your statement about 4 years. My husband and I have been married for over 4 years now and it looks like it will be going on 5 years before our I-751 is approved. It would have been nice anywhere in this process to have been on the shorter end of the time frame rather than the longer end but that doesn't look like it is happening. We started our visa journey in June 2003 - and by the best estimates still have between 2 to 2 1/2 years to go before it's finished.

And we haven't had an RFE or an interview along the way - hate to think how additionally frustrating that would be.

I have heard that Texas passed legislation that it will only accept photo id so that is why the passport stamp and the NOA notice are not accepted - they are too easy to fake. So, USCIS in Texas HAS to be aware of this problem.


I haven't tried this but it might be worth a try - someone else posted this suggestion. Make an Infopass appointment, bring 2 passport photos with you and ask them if they will provide you with an I-94 inclluding your photograph and dated for the year's extension just so you can get a driver's license renewed. This is really a problem of State and Federal legislation being at odds and neither side willing to accept responsibility for the problems they are causing - legal immigrants (and their employers) are being caught in the middle. So, this is a viable solution if you can get USCIS to go along with it. (See if you can get some sort of written statement from the DMV that they will not accept the passport stamp and the NOA to take with you to USCIS).

If all else fails - remember this is an election year and you are married to a voter AND may be a voter yourself soon - also you have employers and friends who are voters - remind DMV and USCIS of that through contacting the media about this problem. Let your Senator and Representatives know that they are alienating legitimate voters by their failure to observe proper immigration procedures. Unfortunately, sometimes you need to use all the leverage you have to get that squeaky wheel to move. Good Luck.

If you mailed it to TSC it has been forwarded to VSC. They have unofficially been doing that since last year, although some of the earlier transfers went to California. It was made official in May of this year that TSC is no longer doing any I-751s and they are all being transferred to VSC with directions for future applicants to send their packages directly to VSC. Call the Social Security office directly. A few months ago we purchased access rights to an information database that allows you to search for information about different people. To try it out I put in my Social Security Number. It said it was an invalid number! I tried again and got the same response. I have had this number for 4 years now and had no problems with taxes or anything else. Panicking, I called the Social Security Office and explained what had happened. The woman checked for me and said that their records show it is a valid number and identified me as its holder.
She had no explanation for why the software access couldn't locate it. I wonder if that is what has happened for you - that the credit card company is using an information database that has inaccurate information.

So, first, contact Social Security directly. Explain what is happening and ask them to verify their records. If, as I suspect, your number is valid, then ask them if there is any way they can provide a number where the credit company can call or access to get accurate information and then refer that to the credit card provider. You can go in and remove the 'work with authorization' limitation from your card and get a new card issued as well. It will have the same number.

It sounds very much like your husband is suffering Post Traumatic Stress Syndrome - he has probably had to see and do things that have shocked him to the very core of his being and life no longer has much meaning for him. This isn't personal for you or your daughter - he is feeling betrayed by the world at large and questioning the meaning of life itself. He needs psychological help. This is one of those 'for worse' times in a marriage where you really will need to shoulder the burden for the three of you until he can heal. See if you can talk with his commanding officer and arrange for him to get some treatment. He definitely isn't the man you married right now - and I bet you he would love to have that man back himself. You just happen to be the convenient scapegoat for his rage and anger because you are there, but he needs help - and so do you. You shouldn't have to be dealing with this all on your own. Contact the base, call around, find somewhere you can get him help and you can get help as well. Whether the marriage survives or not, you need to do this for all of you. I am so sorry you are going through this. Good luck.

Unofficially, TSC has been transferring its files to VSC for about a year now and starting officially in May/June all files formerly sent to TSC have been transferred to VSC and applicants are supposed to file directly to VSC. As well, all Nebraska files are now transferred to CSC and all applicants are requested to file directly to CSC.

It is good news for Nebraska filers because CSC is currently taking 3 to 4 months to process I-751s while VSC is taking 11 to 15 months to process the same. Life sucks if you get transferred to VSC and life is great if you get transferred to CSC.

No, Passport Canada does not always phone Guarantors. There is another feature on the passport application called references. When I got my 2nd last passport, 2 of my references were called. This time, when my Dad was my Guarantor, none of my references were called. My US Chiropractor also agreed to be my Guarantor and when it looked like my signed application coming back from my Dad was lost in the mail (don't use USPS for important stuff like this even certified - use a courier), he completed the application form for me and signed my photos. He thought it was kind of cool to be asked, VBG.

Regarding the "In Lieu of Gurantor" form, yes, people do use it. As Commissioner of Oaths, I signed a number of them. If you use this form, they are not going to contact the Notary - they are going to contact your references for confirmation so you won't have to worry about that. Make sure your references do know you and can identify you physically. Most of the questions asked are along the lines of 'how long is her hair' 'what colour are her eyes"; "how tall is she", etc.

I was a Commissioner of Oaths as part of my job as Assistant to the Member of Parliament for our Riding. I ran his local Constituency Office and was required several times a day to use my Commission. The biggest part of the job was certifying documents as true copies as many government agencies, including Immigration, required certified copies or originals.

My most unusual or interesting experience? We were assisting a Canadian mother with the retrieval of her US born daughter (the mother had full legal custody and they resided in Canada), who had been kidnapped by the US father and taken without permission to the US one Christmas, and who then went into hiding with the girl. Under the Hague Convention for International Child Abduction she obtained a US law firm who successfully tracked down the child and took her into protective custody while the father was arrested for abduction. There was a hearing in a US court, but because the mother and her witnesses were not able to travel to the States to attend the Court hearing, they 'attended' over the phone at our office. Before they gave their testimony to the Judge I had to administer the "Do you promise to tell the whole truth and nothing but the truth' oath. As there was no question that the US father had abducted the child, the court ordered her return to Canada. The US Child Protection Agency (can't remember the correct name now) turned over the girl to the mother who flew down with a representative of the RCMP Bureau for Missing Children and they returned to Canada. I was very proud of our ability to help out in this situation - it was very messy and there were lots of other side issues involved which were handled in other courts of law.

I am not quite sure I understand what you are asking . . . but to clarify there are now three options that you can use - there used only to be two:

a)You can have a Canadian citizen who is over the age of 18, who has known you more than 2 years, and who has a valid Canadian passport so that they can check their own records to verify the information to be your guarantor (use the NEW passport application);

b)You can have a Canadian or US professional who belongs to one of the recognized professional classes whose credentials they can verify through a professional organization and who has known you more than 2 years to be your guarantor (use the OLD passport application form);

c)Use the form PPT132 Statutory Declaration in lieu of Guarantor - I haven't found Commissioner of Oaths in the US (I used to be one) but you can find Notary Publics all over the place, including your bank and UPS stores to quote two. This person has to administer the oath, witness your signature and then stamp and seal the document with their official seal and signature. This person can be either a US or a Canadian citizen. This option may slow down the process somewhat and you may find that they contact your references for further verification. Since you have already had a passport once, though, it shouldn't cause any real delay as it might if you had never had a passport previously.

Good luck on your submission tomorrow - remember to make sure you send it priority mail with delivery confirmation and, if you want, return receipt:-).

Just a clarification - it is the US that is stamping down on having passports. As long as you can prove your Canadian citizenship at the border they will let you into Canada - you can use your birth certificate or your passport or expired passport. You will need to have a valid passport and immigration documents, however, to re-enter the US effective June 2009 for land and water borders and currently require them now for airports. A lot of people confuse the increased border security proposal as being both ways - but it isn't - it is an American initiative only. Entering Canada will be the same as ever it was for a Canadian citizen - that has not changed. It is a good idea, however, to have a valid Canadian passport whenever you are not residing in Canada.

And Ant, yes, if your I-751 is going to be at Vermont, you can expect a minimum of a year for it to be processed and possibly longer. And even if you do apply for US citizenship a year from now without your I-751 approved, they are saying citizenship applications are also taking about 14 to 18 months. That is a long time to be without a passport. and the ability to return to the US if you ever had to leave for an emergency. Renew your Canadian passport as soon as you financially can and you will save yourself a load of potential future worry.

Additional evidence to include would be your 2007 tax returns and your wills if you have them done - and you can do them quickly if you don't. Include copies of any letters or correspondence addressed to the two of you at the same address; any magazine subscriptions, the same; do you have a family plan for phones where you each have a cell phone number? Include some credit card statements showing both of you using the credit card account, plus more bank statements showing both your names on the statements that include 2005, 2006, 2007 and 2008 to show the whole time of the marriage. In the covering letter address the issue of re-financing the mortgage before the marriage and that it is not a financially realistic plan to re-finance now with your wife's information. You may be able to add her to the deed of the house, however if you are in a joint property state she automatically becomes joint property owner on marriage. Your cover letter could address that as well explaining it is a waste of money to do additional paper work to prove something that already exists by law. What about health coverage? Is she included on any joint plan with you? If so, include the paperwork proof and copies of claims.

I am surprised at their request but I suspect a lot of the information you submitted is now 'out of date' (due to their inefficiency) and you can update it with more recent information. It does sound like you didn't send a lot of evidence that covers the whole period of your marriage as well. It could also be that they are trying to 'buy' time since they are so backlogged they are grabbing at any straws to make it look like they are actually getting work done and trying to justify the delays by saying the applications required RFE's.

Only if you are with a military spouse or government official currently stationed outside of the US. If you reside in the US you do not need to provide any passport photographs. After you submit your application you will receive a biometrics appointment letter advising you of when and where to go to have your fingerprints and photograph taken.

This information is clearly stated on the instructions of the I-751 application form as well as in the guides pinned to the top of this forum.

I believe you need some other type of government issued ID as well as the greencard - if he has a driver's license he should be fine. Check over the biometrics letter carefully to see what is required. If he does need ID and his passport is his only ID then you will need to reschedule - if you have other ID he will be fine.
