You can also call the 1-800 number and ask for a status update using your biometrics number. The call center staff may be able to access information on their computers that you can't on yours. It is worth a try. Have your A number available as well as your biometrics number just in case they use that to look up the status of your situation.

You should be alright. Make sure you have the bulk of the work done before you leave so that you just have to fill in the last minute details (copies of your travel itinerary of your recent trip, for example) and get it in the mail asap just in case there is a problem and the file is returned to you making its re-submission late. You don't want to miss your filing date. You absolutely have to be back in the country prior to your green card expiring though regardless of overseas emergencies so make sure you don't cut things too close to the wire.

the lawyer may want your paperwork 6 months before your card expires but he can't submit it until 90 days before your card expires. I think it is the lawyer who is adding the time for him to do the work. You really don't need a lawyer to do this step, btw - it is very easy and you will have to do 90% of the work even with the lawyer since you have to gather together all of the documents and give them to him. All he will do is copy them, fill out the basic information on the form and send it off to USCIS. You can do that just as easily as him and save yourself some money. Don't apply until 90 days before your card expires though or your application will be returned to you.

If you are able to make an INFOPASS appointment before this weekend have him go to his local USCIS office, bring his passport and the approval notice, advise them that he needs to leave the US this weekend and get an I-551 stamp in his passport. It will allow him to continue to work and to travel while waiting for his green card to arrive. My green card took about 2 weeks to arrive.

Glad you were able to get the biometrics done early.

I had ridge break, match warning and pass also show up while having my most recent biometrics (don't recall about earlier ones) and asked. He said not to worry, that was just to tell him what to do to capture the best fingerprint and that they wouldn't let me go unless the fingerprints were good. They must have been good because I received my green card (my 10 year card as my biometrics was for removal of conditions) without having to be re-fingerprinted. I suspect yours are fine as well. You may or may not find your case status touched after biometrics. Usually, you are, but that isn't always the case.

Yes, they ask for an original or court certified copy. I have turned in photocopies up until now but had to turn in the original with the I-751. Then, I had to order another original because the N400 also wants an original. You think they could check their own files once in a while!

Yep - a violation of the Shipping Act - water vessels of a certain size are supposed to carry specific items, one of which is a life jacket. I wasn't carrying flares or a bailing can either but they didn't seem as concerned about those. Since there was no specified fine I had to go to court in front of a judge, who actually said 'This is ridiculous!'. I was fined $10. The local newspaper even wrote up the story (there were 3 of us in court that day on the same charge), so I also included a photocopy of the newspaper account with my different applications, since the court document basically states that they no longer have any record of the event.

A Senator has staff whose responsibility is to deal with issues constituents have with the federal government. They have special liaison contacts they work with who can find out more information about situations than you can on your own. A good staff person is willing to do the work and often by their enquiry can shake loose something that is stuck. Not all Senators have good staff who are willing to do the work, though. It is reasonable to request your Senator's office to put through an inquiry as to why there has been no decision yet when you were told there would be one within the specified time period. You will need to fill out an authorization form and send it to your Senator since they need your signed permission to request personal information about you. My Senator has a blank copy of the form on his website so all I had to do was print it off, fill in the details, sign it and then I faxed it to his local office. I then called to follow up and make sure they had received it. In my case, my Senator's staff put through an inquiry as to why my I-751 was taking so long to approve. I had my approval 3 days later. It may have been coincidence but I don't think so. Definitely consider contacting your Senator's office and asking them to investigate for you. It is part of their job to represent you in dealings with the government and that is what you are asking them to do. Goodluck

Part of the AWA is to ensure that the foreign spouse is in full possession of facts that might impact his/her decision regarding the marriage. The Removal of Conditions applications works differently than all of the other immigration applications. The case number that is written on the back of your cheque and which will be on top of your NOA extension letter isn't the case number that is linked to your on-line status file. It is an internal number for USCIS use only. So, you can't check your status with that number. Shortly after you receive your NOA you will also receive an ASC Biometrics appointment letter. You will notice that it has a different case status number than the NOA and than is on the back of your cheque. This is the number that you can plug in to the USCIS status update and check your case status.

So, don't worry, what you are experiencing is the norm and you will just need to wait for your biometrics letter to check on-line for updates. It usually arrives within a month of the NOA, sometimes faster, seldom slower.

We wrote a cover letter for our I-751. In it I addressed items I wanted to highlight and 'explain', such as we had no joint lease or mortgage since my husband bought the house before our marriage and we had a fixed 30 year mortgage rate we didn't want to change, nor was there a need to add my name on the deed as under Georgia law, I was already considered co-owner. We had nearly 4 years worth of documentation to include so I addressed that as well, then included an itemized table of contents. I would certainly include a statement that you have been together 12 years even if you have only been married since 2006 - that helps to lend credibility to the relationship.

You don't have to be present when the notary notarizes the affidavit of support but the person 'writing' the letter does. We didn't use affidavits as we had a substantial amount of other evidence so I can't help you more there. Good luck.

It is time for you to contact your Senator's office. Your application is well outside of the usual processing time, even for the Vermont Processing Center. You will probably be able to find your Senator's name on line through Google - type in US Senators and your State, then you should find listed your Senators. You can then check their websites. You will need to fill out an Authorization form - you may be able to print one off from the website - fill in the information and sign it, then return it to your Senator's office. They will then be able to inquire for you. While they can't influence any decisions they may be able to 'shake loose' your application from where it is stuck. A lawyer won't really be of much use to you at this stage; it is better to use your elected representative - it is what they are there to do - represent you and your interest with the federal government. Good luck. I hope you get your 10 year card soon. Keep going back to USCIS for the I-551 stamp as well - they should be willing to give it to you for longer than 3 months!

Yes, you should be receiving your I-751 approval before a trip in the fall - sometime within the next few months. If, by any chance, you haven't received an approval and you are getting close to the expiry of your extension you would make an Infopass appointment at your local USCIS office and they will put an I-551 stamp in your unexpired passport. The stamp is usually good for a year, although there have been a few cases where the stamps are issued for 6 months and 3 months validity. Hopefully you won't have to worry about that and will receive your approval soon. VSC has been taking about 11 to 12 months to process applications and I expect that will continue for a few months yet. Files from June and on were transferred to California but it looks like May files are still at VSC.
