We were just approved and my name isn't on the house either. We had lots of other evidence that showed the co-mingling of our financial assets and personal lives.

The extension only extends the green card from the expiry date on the green card - not the date on the extension letter, so having a secoond extension letter still only extends the green card date by one year. You need to carry the NOA and the green card together. So, if you are nearing the expiry of the one year extension on your green card, make an Infopass appointment and have them put the I-551 stamp into your passport to extend your status further. In that case, your status will be extended for the year from the date on the I-551 stamp and not the original green card date.

Try and find out. It depends on how many appointments they have open. I was able to book an appointment several weeks in advance and you might want to try to schedule an appointment for sometime in April - try about 4 weeks prior to your travel or the expiry of your extension - whatever comes earliest. Bring your proof of travel arrangements with you as an added support for your request. You could try and see if they have any appointments now that far in advance but I suspect not. You might want to wait a few weeks before making your infopass. Do go through the steps right now though and see what is involved. You don't actually have to select an actual date right now if they are too soon.

You can make an infopass appointment by going to the http://www.uscis.gov website. On the far right side lower down there is an option to 'schedule an appointment'. You click on that and select one of the options available (I think it is something like haven't received green card or something similar). The appointment will be at your local USCIS office. You bring your unexpired passport and your green card to the appointment. If your passport is expired, still bring it but also bring 2 passport size photographs. They will look up your file by your A#, stamp your unexpired passport with the I-551 stamp extending your status for another year - or if your passport is expired, will issue an I-94 good for one year with one of the photographs you bring, and put that into your expired passport.

They haven't released the criteria that is used to decide what files will be transferred or kept at VSC. They do say that they will continue to process incoming applications at VSC. If we had an idea of how many I-751s are approved each year we would have an idea of what percentage of the total 80,000 applications would be and an idea of how many files VSC might have backlogged. We don't know if this is 6 months worth or 2 months worth or a year's worth of backlog. That is what makes it frustrating. I too worried that my file while it was in the window for approval might be transferred - again! It would be very inefficient if files that were originally submitted to TSC and then transferred to VSC are transferred for a third time to CSC. Will they do that? I have no idea.

If your file is transferred you will almost definitely receive a notice of transfer via email update and status update on their website. Those of us who were originally transferred from TSC to VSC received this notice - although some didn't receive it in a very timely way.

They are specifically transferring 80,000 I-751s at the rate of 10,000 a week along with a specific number of I-765s and I-539s. So, 80,000 I-751s from the backlog at VSC is being transferred to CSC starting last week. This information is from AILA Doc. No. 09012774 released January 27, 2009

Give it a try. Lots of people have done walk-in visits successfully - more successfully than not successfully. Bring the appointment letter, let them know that the weather forecast for Friday is lousy and ask if she could do it tomorrow instead. They may say no, but they will likely say yes.

I agree. Your letter may take a year to get to someone's desk. You would be much more successful with an infopass - in fact, your wife may even be able to do the biometrics while at the Infopass - it has been known to happen.

When she submits her I-751 to USCIS she will receive a receipt back called an NOA - Notice of Action. This will inform her that they have received her application and will process it and contact her if they need further information. It will also include a paragraph that says that the receipt notice itself acts as a one year extension of her conditional green card status and is good for work and travel purposes. She carries the receipt with her expired greencard and the two of them together are her proof of legal status in the US. (Make a copy of the receipt to keep at home as well).

If she hasn't received the receipt notice and it is getting close to the time of her travel, she can also make an Infopass appointment at your closest USCIS office, bring the expired or soon to expire green card, her unexpired passport and proof of travel arrangements. She will ask them to put an I-551 stamp in her passport that acts like a green card and is good for one year. They will check that she has indeed filed the I-751 by using her A number from her green card before issuing the stamp.

So, there are two options available.

No you don't send in passport photos unless you are living outside of the US (ie. at a military base overseas, etc.). After you submit your application, you will receive two documents back: first will be an NOA receipt notice that also extends your conditional resident status for one year and can be used for work and travel purposes; second will be a biometrics letter (ASC notification) advising you to go to your local ASC or USCIS office and have your fingerprints retaken and your photo retaken. Both of those usually come within the first month but the Biometrics letter may be later than that. Good luck.

The NOA extends the status of your green card one year from the expiry date on your green card. You carry the green card and the NOA letter together and together they form the document that validates your legal status in the US. For example, if your green card expires February 26, 2009, then your NOA letter extends your status to February 26, 2010.

Yes, the expired card is no use on its own - it needs to have the NOA extension letter with it showing that the status is extended for one year. If they refuse to accept that you could try to get the I-551 stamp placed in your wife's unexpired passport, but it is uncertain USCIS will give the stamp while you have a perfectly good extension letter. Try sending in the extension letter and the card together. If you don't have the extension letter, make an infopass appointment at your local USCIS office and get the I-551 stamp.

It could be that there was a problem with the first set of fingerprints and they need to have you redo them. The letter should say if that is the case but perhaps they sent the wrong letter. You might want to call the 1-800 line and ask about the matter. Ask to be escalated to an immigration officer because you need to know some specifics about a second scheduled biometrics appointment. Ask them to clarify the file numbers - give both numbers from both biometrics. They may also have mixed up files. If worse comes to worse, try to make the second appointment just in case it is a re-do.

I got an official I-797C, Notice of Action approval letter in the mail as well advising me of my new Classification Status, that my request to remove conditions had been approved and to expect my new permanent resident card within 60 days, then information about what to do if there is an error or if I don't receive the card. It was signed by the Director of the Atlanta Office USCIS but it was sent in an official USCIS envelope with the VSC St. Albans, VT. return address. But then, I never received the NOA extension letter so maybe they are making up for it. I'm still waiting for the green card though.

Yes, that is correct. Make sure you get your application submitted earlier in the 90 day window rather than later so that they have time to send you the NOA extension receipt notice. If, for some reason, the NOA is late arriving, your wife can also make an infopass and get an I-551 stamp placed in her passport which will also extend her status and becomes her 'green card' until she is approved.

This is sounding more and more contrived - and beginning to sound less and less like a hypothetical situation. The answer has been given. If the marriage is still valid and the couple are together, then conditional residency can be converted into permanent residency as well as converted into citizenship. Moral and interpersonal problems in the relationship are not up for USCIS' judgment as long as the couple are together and can prove the bona fides of the marriage.

It sounds suspiciously like one of the couple here wants USCIS to do some dirty work that they themselves don't want to either own up to or take responsibility for - like ending a marriage that isn't working. It also sounds like the couple involved would benefit from a course of marriage counseling.

Wow - talk about a teeter-totter! I guess it could have been worse - the car could have died on the Canadian side of the border and you wouldn't have been able to purchase a new vehicle without worrying about importing it, plus no way to get insurance for the US. Good luck at getting your passport - I am sure they will get it to you quickly - and you never know you might have another bad news, good news to add:

bad: VSC is taking 12 months to process I-751s
good: got transferred to CSC and got approved next month

Last year about this same time it was very common for applicants to TSC not to receive their extension letter. Quite a number of us had to go to our local USCIS offices and request the I-551 stamp placed in our passports. I was one of them. It is easy to do. You make an infopass online at the http://www.uscis.gov website under 'Schedule An Appointment". On the day of your appointment (try to make it just a week or two before your green card expires so you still have time to get the extension letter) bring your green card and you can bring your biometrics letter along with your unexpired passport. If your passport is expired, bring it along with two passport style photographs. They will look up your status using your A number, stamp your passport with the I-551 stamp or stamp an I-94 with your photograph and I believe the I-551 stamp good for one year and staple it into your expired passport. The stamp is considered a temporary green card as well and is good for work and travel. You should receive your 10 year card before the stamp expires.

I believe you can, but you need to have made arrangements before you left the US and obtained a Returning Residents Permit or something like that - I might not have the exact name. I don't believe you are able to apply for it from outside of the country but it may be worth a call to the US Consulate to find out. It would allow you to remain out of the US up to 2 years as long as you retain a residential address in the US and they know about it. The absence will, however, affect your residency requirements for citizenship.

You can also call the 1-800 number and ask for a status update using your biometrics number. The call center staff may be able to access information on their computers that you can't on yours. It is worth a try. Have your A number available as well as your biometrics number just in case they use that to look up the status of your situation.
