Removing Conditions on Residency General DiscussionHere we go
If for some reason the extension letter doesn't come or the green card is about to expire before it comes you can also make an INFOPASS appointment and get the I-551 stamp placed in his unexpired passport that also acts as proof. Good luck!

Removing Conditions on Residency General DiscussionScammers!
I expect there is the possibility that some start out as scammers but find that they do enjoy the company of their partner and a real relationship can develop, so while the intent to enter a false marriage might have been there, a true marriage does result. I also suspect if you want something bad enough you will do whatever it takes - you just have to be patient and smart enough to realize what it does take. I suspect the majority of relationships that make it this far, though, are valid.

Alas - still no updates since being touched on the 13th - nothing in the mail yet either , . . :-( But it is good news about Cookie and Jamieswith- I'm keeping my fingers crossed. Jamieswith applied the exact same day I did, had biometrics the day before me and their cheque cashed the day after me so we are basically neck and neck. Sure hope I hear something tomorrow. Hope you hear soon too!

Wishing you all the best

Wouldn't that be 'loverley' - to paraphrase Julie Andrews smile.gif and thanks!

Ant - thanks for all the Lizzies in the good luck well, and thanks for fingers and toes and all being crossed and everyone else's good wishes, too:-). I'll definitely let everyone know when I hear something.

Good luck, Jamieswith, on the citizenship application. I am still a little over a month away from being eligible to apply - end of February!

Removing Conditions on Residency General DiscussionWhat is an initial screening?
Wierd. That just doesn't make sense - your fee is correct your application is being processed your fee is being returned to you? Hmmm, maybe they are doing it for free. You didn't by any chance include two cheques? (I know, silly question, but hey that is the only thing that would make that sentence make sense). Maybe it is INFOPASS time.

Removing Conditions on Residency General DiscussionGREAT NEWS VERMONT ARE WORKING ON march 08 i 751 application
after biometrics you wait:-). If you need an interview you will receive a letter advising you of the date, time and location. It is more likely that you will just receive an approval - or an RFE if they want more evidence. The RFE will probably come around the same time you might expect an approval, unfortunately.

Removing Conditions on Residency General DiscussionGREAT NEWS VERMONT ARE WORKING ON march 08 i 751 application
There are still applicants from December and January waiting for approval. I filed last February and I am still waiting for my approval. I think you need to state that there is a spread of dates from December to early March that they are currently working on rather than saying they are working on March cases.

Removing Conditions on Residency General DiscussionRequest for more evidence - what else can we send them?
Wow - you had plenty of evidence. I wonder if they just happened to misplace some of it and aren't looking at everything you included.

Definitely include shipping the pets information. Include any loan information. Write your wills and include those. Include more notarized affidavits from several people who know you as a married couple and will attest to the fact. Include more recent mail addressed to both of you at the same address - Christmas cards are good examples. Credit card statements, yes. Highlight joint bank statements showing where house payments, loan payments, etc. come out of your joint account. Choose statements that show activity from both of you on the account. Write an explanatory cover letter that says the house and accounts are in your name because you have owned the house since 2002 - before your husband arrived and since the same account pays for the expenses there seemed no need to add his name to the accounts. Oh, if you microchip your pets you can include both of your names as contacts and include that information as well. Also, if you have any CDs or IRAs you can do the first jointly and the second listing the other as beneficiary. Do you have any pension or retirement plans that list the other as a beneficiary? What about a medical bill addressed to the house or a medical insurance statement for each of you addressed to your address? What about AAA Emergency Car Plan cards? What about a family cell phone plan with both your names and numbers?

You sent far more evidence than a lot of people who have been approved so I sure hope it isn't because you kept your maiden name and don't have kids - I kept my maiden name too and am to old to have kids - heck, I'm a step grandmother! My husband bought our house before we were married as well and all of the ongoing bills are in his name and paid online. I did include some of the maintenance work that was done on the house and paid by cheque by me so that might be something you could add if he paid things by check for the house - see if you have incidental bills he might have paid.

Oh, just a suggestion - make a checklist of all of the 'new' evidence' and a statement that you are adding this to the evidence already submitted, then make an itemized statement listing all of the previously submitted evidence. Be specific so if you included 10 bank statements, list out 10 bank statements with the dates. You want to 'overwhelm' them with the evidence and if they did misplace any your including the list of previously submitted evidence might cause them to check and find it.

Good luck! I really think they must have lost some of the evidence you originally submitted.

Removing Conditions on Residency General DiscussionInfopass question
Since he has submitted his application, he is not out of status even though the card/NOA has expired. His status is considered extended until he receives a decision. The i-551 stamp will be proof of his status - it isn't going to give him the status he already has. He is definitely not going to be deported by requesting the stamp after the NOA expiry date.

When you arrive for the infopass explain to the officer what has happened, Your husband will explain that his NOA has expired and he has still not received a decision on his I-7551 and needs proof that he has valid status and would like the I-551 stamp. They will look up the information based upon his A number, then stamp his passport and that is that - it is about the easiest process there is from USCIS.

Your husband still has legal status - he is just lacking proof of that status and he will get that at the Infopass tomorrow.

Removing Conditions on Residency General DiscussionInfopass question
If your NOA expires in April, then probably about 4 weeks before it expires I would start to look at Infopass appointments. You will probably want to make the appointment for about 2 weeks prior to the NOA expiry to allow as much time as possible for the green card to be approved and arrive. I suspect since they are working on January and February cases now if you made an Infopass for now they may not give you the stamp and just tell you to wait and come back closer to your year's expiry date.

I had no trouble making an infopass appointment when i needed to get the stamp (no NOA) but this will allow you some time both to make the appointment and have enough time to set it when you want it.

Hopefully you will not need to make the appointment at all and will receive your greencard very soon now.

Removing Conditions on Residency General DiscussionWhere is my PERMANENT permanent green card?
QUOTE (ramc75 @ Jan 30 2009, 01:32 PM) <{POST_SNAPBACK}>
I agree with YuandDan Make an infopass appointment, They might be able to see what going on with your green card along with getting your passport stamped. In May we will be moving in to our seventh year of this, one thing I have come to realize is that the USCIS will do pretty much what it wants to do, in it own time and we are the sole passengers.

Wow ramc, someone else who has been in this as long as we have!! We started our K-1 journey in June, 2003 and you started yours July, 2003. I wonder if it is a coincidence that we are both at the Atlanta USCIS office? Good luck to you for an approval soon!

As long as you don't stay outside of the country more than 6 months or beyond the validity of your extension period, you should be ok. Good luck with the family situation.

Removing Conditions on Residency General DiscussionQuestion about bills and statements in the I-751 (how many months?)
You're lucky. Others have had RFEs requesting evidence that shows the whole span of their marriage and had to submit that evidence before approval - people with lots of good evidence already. Overkill? I want to make it as easy as possible for them to agree that we have a valid marriage.
Kathryn41FemaleCanada2009-01-31 13:22:00
Removing Conditions on Residency General DiscussionQuestion about bills and statements in the I-751 (how many months?)
They want to see evidence that covers the whole time frame of your marriage so while I would include the most recent bills I would also include some of the earlier ones as well. I sent in bills and statements from each quarter of the year so there were 4 of each type of bill or statement from each of our 4 years of our marriage. I did the same for all of our evidence, tried to include something for each quarter of the 4 years. It is harder to 'fake' continuity of a relationship and that helps make your evidence more effective.

Removing Conditions on Residency General Discussionremoval of CR2 status
It depends on when you received your green card. If you received it at the same time or within 90 days of your mother you can be included in on her application. If your green card was approved more than 90 days before or after your mother's you need to file your own separate application. If you are able to be included on your mother's application, you do need to include a separate biometrics fee to cover your fingerprint appointment. Good luck.
Kathryn41FemaleCanada2009-02-01 13:38:00
Removing Conditions on Residency General Discussionfingerprint card?
If you are not in the US (ie serving with a military spouse overseas) you would use the fingerprint card to send in your fingerprints. If you are within the US you do not need a fingerprint card because you will have a biometrics appointment. It is either one or the other, not both.
Kathryn41FemaleCanada2009-02-03 21:10:00
Removing Conditions on Residency General Discussionfingerprinting
Hopefully you will get an answer. Enjoy the biometrics - that is usually quick and easy. Hey, they have those comment cards as you leave - if you don't get an answer you can always make a comment complaining about failure to receive the NOA.

Congratulations - it is good to see another of the 2007 crowd finally get their approval.
Kathryn41FemaleCanada2009-02-03 16:37:00
Removing Conditions on Residency General DiscussionWhat's with the biometrics
They don't keep biometrics on file for longer than 15 months so with every new application you need to refile biometrics so they match the right person to the file. If each file takes longer than 15 months to process, then you even have to redo biometrics. It is more to ensure the identity of the person seeking that particular phase of immigration benefits rather than thinking your fingerprints and photos have changed. They will use the photo they take of you on your ten year card so they definitely need to redo those. I agree though, it does seem really redundant.

Removing Conditions on Residency General DiscussionWe got our I-751 appointment!!!
The biometrics appointments letters usually come within the month but getting the actual appointment within a month is also good.. Vermont has started to transfer its backlogged files now to California so it appears they are able to get to some of the basics for the new files faster. Good to know for new filers. Good luck.
Kathryn41FemaleCanada2009-02-03 21:07:00
Removing Conditions on Residency General DiscussionOk, I'm confused...
Their own regulations in the Field Adjudicator's manual states that they are supposed to send out reminder notices. Up until very recently no one ever received one. It seems like they are starting to follow their own regulations and send out notices, which is a good thing since there have been several recent situations where individuals realized near or after the expiry date of their green card that this application was due NOW.
Kathryn41FemaleCanada2009-02-05 18:22:00
Removing Conditions on Residency General DiscussionPreparing documents needed as evidence
joint account statement - include several statements from over the whole term of your marriage. For all of your joint documentation try to include examples that covers the whole of your marriage - perhaps one each quarter.

You will be filing in Vermont which, unfortunately, is the slowest center (if you are based in Florida). Right now, however, they are transferring 80,000 backlogged files to the California Service Center so hopefully that will speed them up substantially.

Good luck.
