You also need to carry the expired green card. The green card and the NOA letter together make up the necessary proof that you are legally entitled to work and to travel, and it is the date on the green card that is used to determine the 'year'.

Taking off my moderator's hat, I did not include my US born step daughter on my I-751, even though I included evidence in the form of letters from her and her children to me in the body of the application. I was approved without a problem. The instructions are not clear and this question arises regularly. It is important to remember that the forms and the instructions form one complete unit- you don't read one without the other and make a decision about what is or isn't so. USCIS does this with all of their forms, not just the I-751. You have to read and combine the information from both the actual form and the separate instructions to get an understanding of what is actually being requested.

You will first receive a receipt - called an NOA - that will acknowledge receiving your application. This receipt will also include a very important statement - that it 'extends the validity of your greencard for both work and travel purposes'. This NOA is also known as the extension letter. You will need to carry the letter (make a copy for your files first) and your expiring/expired green card together because the letter means your green card is now good for another year. Together, the letter and your card are proof that you are legally in the US and allowed to work in the US, and if you travel, are allowed to return to the US. They will hold you over until you receive your actual 10 year card.

It is hard to say how long it will take to get your new card, but you filed at the California Service Center and that is the fastest service center. You should receive it in between 3 to 6 months. Good luck.

Also make sure that the cheque is issued to the US Department of Homeland Security - there have been cheques returned because they were made out to USCIS or to DHS. Yes, send back the whole package - same form - with the correct cheque.

Just out of curiousity - to whom did you make out the cheque? There was an application in a similar situation to yours earlier this year that was sent back and said the cheque was wrong even though the amount was correct. It turned out they had written the cheque to USCIS instead of US Department of Homeland Security. Could this be the problem with yours as well? It certainly should have been accepted for both mother and child as their green cards were approved within 90 days of each other.

The number that you can't use to look up information is the number that would have been on the back of your cheque and the NOA receipt if you had received one. I didn't receive one either and my I-551 stamp looks the same. The Officer is the name of the person who put the stamp into your passport. The illegible part reads 'Upon endorsement serves as a temporary I-551 evidencing permanent residence for one year." Below the bottom of mine it also includes "I-751 filed on and then the date they received it.

Jamieswith is right - the number on the receipt is an internal use number only and never works to check online status. The number that is on the biometrics appointment letter is the one you need to use. You can set it up to send you email notifications of changes in status as well. The application type will be listed as a CR189, not an I-751 as well. That is correct so don't worry.

My 485 file was touched shortly after I submitted my I-751 - no touches since then. I assume they either matched up information or else permanently 'filed' the I-495 since the next stage was now in progress. Perhaps that is what they have done for your files as well - either scenario.

You look like you are filing at the California Service Center. They are currently averaging around 4 to 6 months - with a few even faster than that - to approve removal of conditions. The majority of people do not have an interview - even those whose AOS was approved without an interview. Interviews are assigned when the evidence is suspect or lacking or raises questions - or a few are also interviewed for statistical purposes, which means their evidence is fine but USCIS has to interview a certain percentage of files for statistical purposes.

You will still have to gather all of the documents yourself. All the lawyer will really do is fill out a very easy form, put the documents you find and copy in order, add a big binder clip and mail it -all for a big fee and taking longer than it would take to do it all yourself. Take a look at the I-751 form, read over the instructions, fill out a 'test' form on your own to see what it feels like (if you find it easy or difficult) and then decide if you really want to spend that much money in addition to the form. The majority of us here did not use a lawyer to file the I-751, me included (although I'm still waiting for approval :-) ). My recommendation? I think you can probably do this one on your own without too much difficulty.

Your evidence does look good. You could add affidavits if you wish. As well, even if your spouse doesn't drive, you should look into getting a State identification card for her that would also list the same address.

I am assuming the letters from your landlord are in relationship to your joint tenancy in your apartment? You may want to highlight the line item on a bank statement showing the cashed rent cheque from your joint account - just additional evidence. You really should be fine though- you've got lots of material.

hmm, someone else just posted the exact same situation within the last week - the timing is about the same as well. Don't know what is going on but if you are concerned you could probably make an info pass and find out - or just do the second biometrics. The information line is likely to be of little use so I don't recommend calling. And yes, fingerprints are supposed to be good for 15 months . . . maybe they aren't clear enough, although they usually state so when fingerprints have been rejected and you need to redo them.

If you are just getting ready to file for your removal of conditions how far are you into the 90 day window? If you are near the beginning you have time to get your passport renewed. Send it by courier - costs a bit more but is worth the guaranteed arrival - to the Passport Office and they will courier it back to you. Mine took less than 2 weeks from couriering it up to getting the new one back. I would get on it now if I were you, then you have a new passport for the stamp.

Hopefully, you won't need it and your mailman will deliver the NOA correctly.

Many states tie the length of validity of Driver's License to the length of validity of the immigration document. My DL expires the same day as the I-551 stamp in my passport. I need to present new immigration documents to get a renewal of that license and it will only be for as long as the immigration document is valid. I expect the OP is in the same situation.

The only other thing I can suggest is to keep calling for an Infopass appointment every day and see if one of the dates that comes up is earlier than the current one in which case you can take that date and cancel the other appointment. It sucks. The good news is that once they receive the new evidence you sent in you will receive approval very quickly. You may find that you will get the green card about the same time as the extension expires. Being up in the air about this all though, is very frustrating and I can appreciate your concern.

You are a little light on evidence. Definitely dig up the items you mention - you want to show evidence that covers the whole time of your marriage. Without joint bank accounts you will need to show some other means of how you are financially sharing the responsibilities of your life together. Do you have a cell phone family plan? What about writing your wills showing each as the beneficiary of the other? Do you still have the travel itinerary, boarding passes, luggage tickets, etc. for your trip to Peru? What about showing household or family expenses each paid for individually but having the statements delivered to the same address? Driver's licenses? joint AAA membership? Affidavits from friends and family who can swear to the validity of your marriage would be a good idea as well.

Why only 1 tax return?

If you end up waiting a year after filing the I-751 and become eligible to apply for citizenship, yes, you can apply for citizenship even if there isn't a decision on your 10 year card yet. Basically, the N-400 application will force USCIS to make a decision on the I-751 so they can proceed with the citizenship application. There are a number of VJers who are taking that exact route, in fact, since VSC is so abominably slow.

The fee is $465 plus $80 for biometrics - and yes, you do have to get biometrics done again, regardless of how many times they have already taken your fingerprints. I believe New York submits their petitions to the Vermont Service Center (VSC). How fast they will be processing applications by May is hard to predict but right now they are averaging between 11 and 13 months. They are just approving applications submitted in January and February 2008 - and there are still a few December 2007 applicants waiting for their approvals.

There is some great advice pinned at the top of this thread and you can read over the different types of evidence people going through the process now have submitted to give you a good idea of the type of evidence you have that you can use. Hope this helps.

Currently, VSC - which is where your application will be if your local office is Texas - is taking 11 to 13 months to approve most applications. They are currently working on applications filed last January and February - although there are still a few December filings waiting for approval.

As Kez/JWolf mentioned the number on your extension letter doesn't work for getting online case status updates - it is an internal use number for USCIS only. The number on your biometrics should work (you will see it is a different case number). There is at least one other VJer, however, whose biometrics number doesn't work so she has to phone into the 1-800 number - they are able to check status for her even though she can't see it for herself. So, if the biometrics number also doesn't work, call in and see if they can give you updates, or get the account activated so you can see the updates for yourself.

Good luck - and settle in for a bit of a wait.

Congratulations! It is good to know they are finally moving again, albeit slowly. (We applied around the same time and our green cards expire the same time). You can apply for citizenship 90 days prior to the third anniversary of your greencard date. I am not sure but I believe you might need to add on any days that you were outside of the US in the past 3 years so if you were out of the country for 5 days, you can apply 85 days prior to that date, but I don't know for sure and someone, I do know, will correct me if I'm wrong.

I would make an infopass appointment and check into it. California is moving quickly so perhaps the Infopass might just 'trigger' the biometrics, or you might find out a letter was sent and you didn't get it, in which case you might be able to get it done at the same time. If it were VSC I would say wait; since it is CSC I say make that appointment. Good luck.
