The extension letter extends your status for one year from the date on your green card. The two documents work together, so if your green card expires April 30, 2009, the NOA letter extends your status for one year - to April 30, 2010.

The one question I have is what time period does your evidence cover? Do you have samples of bills or statements from the beginning, the middle and the most recent period of your marriage? If not, you might want to do that - include a few more bank statements and a few more utility bills that are from earlier in your marriage as well as most recent. The variety of evidence looks good so as I said, that was the only potential issue I could see:-).

You will shortly receive a letter from CSC that is known as a NOA - Notice of Action - that is a receipt acknowledgement for your I-751. The letter is very important because it will include a sentence that says your permanent resident status is extended for one year and is good for work and travel purposes. This letter is your proof of that status. You can continue to work and you can travel. You need to carry the NOA and the expired green card together as proof of your status. The NOA usually comes a week to 10 days after your package is received but sometimes it is a bit later. A few weeks after that you will receive another letter called the ASC Appointment letter, also known as the biometrics letter. This will tell you where and when to go to have your fingerprints and your photograph taken. After that you just wait until you receive either notice that your green card is approved, or an RFE letter - "Request for Evidence" - which means they want more evidence from you about the proof of the validity of your marriage.

Why would an immigration officer tell him TSC is processing I-751s in 6 months when they are no longer processing them at all? And, if he saw it was at TSC and not transferred - in spite of receiving the notice of transfer - why hasn't it been transferred now? Why would an immigration officer say it was still at TSC if it was indeed 'lost' unless they knew it was there - or weren't telling the truth? Still a lot of unanswered questions.

I agree that the OP has every reason to be very, very, very annoyed. I hope your Congressman/Senator gets things sorted out for you asap.

If it was indeed left behind at TSC, then yes, you should definitely demand an expedite based on USCIS error.

What you were told doesn't make any sense. It sounds more like the mis-information from one of the call center people than from an actual immigration officer.

There are NO removal of conditions applications being processed in Texas let alone any at 6 months. There haven't been any for quite some time. The 'official' date was last Spring sometime - I don't remember if it was May or June, but TSC transferred all of the submitted I-751s to VSC at that time and USCIS published an official announcement that TSC and NSC were no longer processing I-751s and that such applications were now to be sent directly to VSC and CSC. That is why what you were told makes absolutely no sense. I would definitely contact your Senator - they can help you. When my I-751 file was approaching a year I contacted them and 3 days later had my approval.

Good luck in getting this sorted out. I am inclined to think that you still haven't talked to a real Immigration officer but one of the Call Center misinformation people, maybe even one pretending to be an USCIS officer - the information you got is so totally incorrect that I can't believe a real immigration official told you that.

Actually, 2008 transcripts are available depending on when you filed. I requested a copy of ours about a month after we received our refund and received them in the mail a week later (end of March). So, depending on how soon you get your refund will determine how soon the transcripts might be available. If you don't want to wait for the transcripts, send in the complete copy of what you submitted to the IRS for 2008 and the postal receipt. That should work. Good luck.

Glad you caught it and got it corrected. Yes, there have been other VJers who did the same and had their packages rejected and returned. The return instructions were not particularly clear so it took them some time to figure out the reason for the rejection was because the cheque was incorrectly addressed even though the amount was correct. Will his wife go with him to the interview and support his application that their marriage was a valid one even though they are having troubles now? That is the big question. If she is willing to support him and verify that their marriage was entered into the for right reasons even though it is going astray now then he should continue to the interview and let the adjudicator decide. If she won't support him at the interview, then he needs to decide if he is going to stay in the marriage or not. Unfortunately, if he goes to the interview on his own he is unlikely to be approved. If that is the case, he may wish to initiate divorce proceedings, send a letter to USCIS asking them to delay the interview as he is waiting for the finalization of the divorce and would be withdrawing the current application and re-submitting one with a waiver when his divorce is finalized. I don't know if they will accept that or not but it seems like his best option if she is not willing to go with him on the interview and verify the validity of their marriage. They should also be sure that USCIS is aware that things are not going well now but that it is not reflective of the original marriage and intent.

This is normal. When you file to remove conditions it is expected to take some time before the processing is completed. You are allowed to file 90 days before your green card expires but it is not expected that you would have your approval before the green card expires. So, USCIS sends an NOA acknowledgement letter that contains a statement that the letter extends the validity of your green card for one year and is valid for both work and travel purposes. You carry this letter along with your green card to prove you are a legal resident while you wait for the 10 year green card. So, the OP originally got an extension letter and then when his file was approved, he received an approval letter to be followed very quickly by the 10 year green card.

I also tried to make my package as user friendly as possible. I used ACCO fasteners at the top, had a detailed cover letter that itemized every document, then separated each 'category' with tabs at the bottom of an index page for each category also itemizing every document in the category. I also highlighted names, account numbers or things I wanted them to see quickly (ie. mortgage payment on joint bank statement, etc.). I felt I had done everything I could to make a positive decision easy for the adjudicator.

Dusy, If it has been 8 months and you still haven't received a biometrics appointment you may wish to make an Infopass appointment at your local USCIS office and find out what is going on in person. They may be able to do the biometrics at that appointment or to give you an appointment time. You can make an appointment by going to the USCIS website at http://www.uscis.gov then in the right hand column select 'Schedule an Appointment'. Then, follow the instructions provided.

8 months does seem like it is too long so you do need to find out what is happening. Good luck.

The I-751 is about proving you have a valid marriage. Read over the guides first. Read over the I-751 form and the instructions. Go through your files and gather together all of the evidence that is suggested. Make sure you have documents that show you have co-mingled your financial and personal lives that cover the whole time period of your marriage. If your adolescent received his/her greencard within 90 days of you getting yours you can include him on your form as well just adding additional biometrics fee. If he/she received the greencard more than 90 days from when you did they need to file a separate application and fee.

You will need to have original documents detailing your arrest and court appearance and the dismissal of the charges. These will need to be sent in as well, along with a written explanation of what happened and why. Without knowing more about the circumstances it is hard to say what impact, if any, this will have on your application.

Quite honestly, I found the application very straight forward. Even if you hired a lawyer you would still be doing 90% of the work - gathering documents, etc. - so I think you should be able to manage it on your own if you do your preparations before hand. You would be able to file 90 days prior to when your green card expires.

For the bank statements, I send one complete statement of all pages for each year, plus 3 partial statements just showing the front page with the identification stuff from each year as well. I made sure that the complete statement also showed the mortgage payment coming out of the joint account (I highlighted the figure, in fact) as added evidence.

The NOA number is never listed on the case update system for the I-751. The receipt number is an internal use number only. You will have to wait until you receive your biometrics letter. You will notice it has a different number than your receipt number. That is the number you can use to check your status online and to register for email updates.

Sending 'unique' items is certainly a good idea and in your favour. I tried to do that as well, although I didn't have a lot of 'cute' ones to send. One thing I did send is a letter envelope addressed to "Papa Joe and Nana Kathryn" with our address - Joe's daughter couldn't remember my last name (I kept it when we married) so addressed it just like that from their whole family. Fortunately, the post office delivered it. I also included a sweet photo of Joe asleep on the couch in our house with his legs stretched in front of him and on his legs curled up also asleep was one of my cats that I brought with me from Canada (and included the cats' microchip registration information with both of us listed as well). Another photo showed me and our grandchildren all dressed up in Civil War clothing at a re-enactment we attended together - they were helping me finish getting dressed (VBG). I also included a letter we sent together to one of our neighbours advising them that we would take their cat into the Humane Society if it kept coming on our property and trying to attack our cats through the window if they didn't contact us about finding a solution. Then there was a rhyming letter addressed to both of us from Joe's sister advising us that 'we' had all chipped in together to buy Joe's Mom a year's worth of beauty parlour visits for Christmas - with all of our names and relationship worked into the rhyme. The only other 'telling' thing that was unique wasn't funny but effective - our income tax returns for my first year here were audited by the IRS, so we included the audit notification letter to us, a copy of our joint response cover letter and their notice to the two of us that our 'audit' passed.

Look on this interview as the opportunity to show in person that you do have a valid and loving marriage. They will be paying attention to how the two of you interact and react together. Make sure you know the practical daily things about each other - the basics like parents names, siblings names, where he works, what he does, etc. It is a little bit concerning that he continues to use his Box office address after marriage and that is probably one of the other red flags that they have in addition to the financial situation, however if he is prepared to explain his decision reasonably then it should be alright. He might want to change that address, though, to the same address that you both share. My husband got a separate Box office number when he realized his ex was going through and censoring his mail or returning it to sender if she didn't want him to have something (hehehe you can see why they divorced!) but when we got married he closed down that box office account and had everything changed to our home address.

Have a notarized statement from your family with whom you lived detailing the living arrangements and verifying you were living with them from beginning date to end date.

What about health coverage? Insurance plans? Driver's licenses showing old address and new address? Ask your bank for a print out of when you added your spouse's name to the account or when the account became joint and the names on the account. What about credit cards? joint memberships (ie AAA, Sam's club, Costco, etc.)? Did you have your own cell phone plan listing both names or were both names included on a joint family plan with someone else? You can also write your wills and include those. Time to start thinking creatively:-). Good luck.

I never received an NOA letter throughout the whole I-751 process. I did get my passport stamped with the I-551 stamp and even used it for travel while I waited for my I-751 to be processed. I was approved with no problem even though I never had an NOA letter. Your friend doesn't need to worry. The stamp is her proof that she is here legally - and it probably also states the date she applied for I-751 on it (mine did). She can use the case number on her biometrics letter to track her status online.

Right. The I-751 - unlike all other applications - has two case numbers. The first one - the one on the NOA and on the back of the cheque is an internal numbers for the use of USCIS only. It doesn't work on case status updates nor will it get you any information. The biometrics letter will have a second case number. That is the number that you can look up for case status updates, can get updates over the phone and can get emailed updates. So, just wait a little bit longer until you receive the biometrics letter.
