Posted on AILA you can be pretty sure it is confirmed. This is Document No. 09012774 dated 1/27/09 and entitled "VSC Reports Sending 1-539s, I-751s and I-130s to CSC." AILA is the American Immigration Lawyers' Association and we have received information on internal processing actions like this from AILA before.

Either way I end up waiting - Atlanta is taking 9 months right now to do citizenship applications :-(. Actually, I am going to go to my Senator's office tomorrow and ask for their intervention. The fact that your application was approved nearly 10 days ago and we applied on exactly the same date and had biometrics one day apart proves they are not doing first come first serve. Enough is enough. It is going on 6 years since I started this visa journey and I have ended up in the slowest moving line in each and every stage of the process. Friends who hadn't even met when we got married received the removal of conditions a year ago now. I know life's not fair but just once I would llike to be on the right side of the equation with regards to immigration.

I would suggest not making another infopass and telling them that you didn't receive the NOA or lost it. They have a record of your last Infopass appointment and if you go back and lie about the circumstances of your NOA that would be considered lying to an immigration officer - a bad decision that brings even worse consequences.

I would expect US immigration officials overseas to be familiar with the NOA extension letter but certainly waiting to hear back from other Moroccans who have used the letter is a good plan of action. I hope you hear something good soon.

Moreover, I have some questions also:

1. Do I need to send copy of my passport? No.
2. Do I need to send passport size pictures? No, unless you live outside of the US -ie in the military. You will be given a biometrics appointment to take your fingerprints and your photograph.
3. Do I need to send bank statements since I recieved conditional GC(almost 23 months ago) or last 6 months should be good? You should include evidence that spans the whole time of your marriage from your AOS approval to now. Examples from each year (quarterly or each half year) should work.
4. We have 3 joint account, so shall I send 23 months statement from all the 3 accounts? Yes, this shows to degree to which you have intermingled your financial affairs. Again, examples spread over each year would be sufficient - beginning, middle, end, etc. - not from each month. Do the same for your utility bills examples as well.
5. How should I organise my document, do I just send them loose in an envelope or do I whole punch them and make a binder? Save your binder - it would just be discarded when USCIS got it. USCIS prefers things 2 hole punched at the top and secured with an ACCO fastener - this is the two pronged metal holder that folds down and is secured by a sliding bar. (you can get them at office supply stores). USCIS will take whatever you send them apart and put them in their own ACCO fastened folders so this makes it easier for them and you.If you don't want to use or can't find an ACCO fastener, use a thick binder clip at the top of the documents to hold them together and in order.

Yes, the I-797C Notice of Action (NOA) is the NOA 1 that people refer to. That is your 'extension letter' that states it extends your green card status for one year for work and travel purposes.

Don't worry about the case number that is on your NOA and on your cheque - that is an internal number for USCIS purposes only and isn't linked to any of the status case updates online. You will need to wait for your Biometrics (ASC appointment) letter. You will notice that has a different case number on it and that is the number that you should be able to use for following your online status. For most people it works right away but for a few it doesn't seem to be activated until after they do their biometrics.

As well, unless you can provide a compelling reason for the I-551 stamp (ie did not receive NOA letter), they are unlikely to give you the stamp if you already have your NOA letter. The letter and the expired green card together are supposed to be the same thing as the stamp. You get the stamp if you don't have the NOA letter or the letter is expired/expiring.

The biometrics appointment are super-easy and usually super quick - nothing to worry about there!

Yes, your fingerprints may be expired after a year. There have been a few others in the same situation where they were called for new biometrics around a year after their first although they are supposed to be good for 15 months. It could also indeed be that they have misplaced yours, especially because you did have that initial denial letter. Hopefully once they get them redone they will fast track your application and give you your approval. At least it is now assigned to an officer and that is good. I'll keep my fingers crossed for a quick approval now. I wouldn't worry too much about no touches update - they don't seem to be very consistent with that feature.

Jasminelily - sorry to hear about the identity theft. Good luck in getting that sorted out quickly - my husband had a run in with that last year and and had to cancel his account and get everything changed. The credit card company did take care of the charges though, so that is good.

The infopass appointment is the right first step to take. Hopefully that will also be the only step you need to take and they will realize their error. You can also go to your Senator's website and print off from there an authorization form. They will need a signed authorization form from you in order to do the follow up on your case. Fill out the form and send it back to them either by mail or by fax. You may want to wait and see what the outcome of your Infopass is since it is on Tuesday. If you are not satisfied after that, then definitely deliver the authorization form to your Senator and ask for his assistance. Provide copies of the two documents to him as well.

Good luck. I am sure this will all get sorted out satisfactorily but in the meantime I know how horrible it must feel.

Definitely make the infopass appointment, bring along the denial letter and the receipted Biometrics letter and have them re-open your file without you paying again. You have proof that the reason for denial is bogus - it doesn't exist - so the file should not be closed, thus it should be treated as if it never were closed to begin with.

Also contact your Senator's office, fill in their authorization form and advise them of what has happened and what you are planning on doing. Provide them with copies of the biometrics letter and the denial letter. Ask them to investigate.

One way or another you should be able to get your case re-opened without having to pay again. Good luck.

Yes - it does sound like clarification is required. The earliest you can send the I-751 package is 90 days before the green card expires. Count the day that the green card expires as 1, then count back 90 days to find your earliest filing date. That doesn't mean you HAVE to send it exactly on the 90 days prior to expiry. You can still send it in on any of those 90 days. You just need to make sure that USCIS has received and accepted the package by the time the green card expires so generally even sending it out the week before the green card expires is acceptable, although perhaps not necessarily wise. You do have some flexibility.

Actually, according to the Adjudicator's Manual they seem to allow a 30 day grace period. If you submit the application late you are allowed to explain (better have a good explanation, though) and it is up to the adjudicator whether or not to accept your application. If you are one day late and it is postmarked prior to the expiry of the window they seem to accept the package according to the experiences of others on this site. There have also been a few who were several days late and didn't send in an explanation and their applications were accepted. True, they have the right to refuse a late application but it appears, based on experience, that one day late isn't going to end up with you getting deported.

Haole, the process is intimidating enough without going out on a limb to make it even more nerve-wracking. The post was about mailing early, not late.

First off, welcome to JV keobq - this is a good group of people to be with on one's visa journey.

I sent my I-751 to TSC last February 28th and it was transferred to Vermont SC in March, 2008. I had biometrics in April, then my file wasn't touched until September, and then again on January 13th. Last Friday, when I had no further action and files all around me were getting approved (and I was feeling especially frustrated), I contacted my Senator's office - Johnny Isakson. He has a staff person who specializes in immigration files. They put through an inquiry on the status of my file and it seems to have shaken it loose from whatever desk it was on holding down papers.

You might want to take a look at the VSC Status Update thread in this forum - it has columns showing the dates people submitted their applications to VSC, when they received their NOAs (if they did - we didn't), when they had Biometrics and when they were approved. I googled my Senator's name, went to his web-site, and found there an online form to fill out that authorized him to investigate on my behalf. I printed it out, filled it in then faxed it to his Constituency office. I then called his office later that day to verify that they had received it - they had.

I fully intend to stay around and help as long as my experience is still relevant - I've a lot of friends here, and I remember what it felt like when we were just starting out on this journey. Of course, on to Naturalization now:-) - just waiting for last year's tax transcript to come in from the IRS.

Ideally all of this will be a moot consideration because you get notice of your approval and receive your 10 year card before you go.

Still, you haven't received your approval yet so the card hasn't been ordered. If you still haven't received approval by the time of your trip, go and enjoy yourself. Your letter is still valid. If the card is approved and issued while you are away, you can always explain on your return that the card had not been approved and issued before you left and you still haven't received the card - which you haven't even if it has been mailed - because you haven't be in the US to receive it. Your extension letter will still be valid until its expiry date. Once you get your new card you stop using the letter.

Trying to predict when cards get approved is a sure way to drive yourself crazy! You have the added consideration of your pregnancy right now so travel when you are able to. Go to your event and if you know the card has been or is about to be issued, then you can come back, get the card, and if you are still able to travel, do so. If the card hasn't been approved by the time you leave, then still go and enjoy yourself. If you want to or need to cut your trip off early, you can deal with it at the time. Regardless, you know after the baby comes you'll have the card and will be able to travel and show him/her off to friends and family back in Canada.
