If you have the two year conditional card you can't skip the Removal of Conditions step. Several VJers mistakenly received 10 year cards instead of the two year card and when they were permanent residents for 3 years filed for citizenship. Their citizenship applications were denied because they had never applied to remove conditions. They had to go back and file the I-751, and then were allowed to file for citizenship. You definitely need to file for removal of conditions. If you fail to do that, when the green card expires your wife will be illegally in the US. Filing for I-751 will include an extension of her green card status until it is approved.

Being married for 3 years is only one of the qualifying criteria for citizenship. The more important one is that you need to be a permanent resident for 3 years as well, although you can apply 90 days before your 3rd green card anniversary if you have been married 3 years at the time you file. You won't have your 3rd year as a permanent resident until October, 2010 so the earliest filing date will be sometime in July, 2010.

I can appreciate that it is frustrating to delay filing for citizenship. My AOS took nearly 2 years to approve and was approved 3 weeks prior to our second anniversary. By the time I was eligible for citizenship my husband and I had been married nearly 5 years.

I know of no way you can renew your green card while outside of the country with your wife living in the US. You don't just renew a 2 year card - you need to file to remove conditions as the 2 year card is only a conditional green card. You need to file the I-751 form and include proof that you and your wife have a valid marriage - things like joint income tax returns, shared bank accounts and credit cards, shared ownership or rental of property (houses, apartments and/or cars), children together, things like that. Since you got your travel document before you left you will be allowed back in the US even after being outside for 9 months - UNLESS your 2 year green card is expired. You need to return to the US AND file the I-751 before the 2 year green card expires. You can file as early as 90 days before it expires but you can't file after it expires. After you file the I-751 you will get a receipt that extends your green card one more year for work and travel purposes. You will also need to get your fingerprints taken in the US and possibly attend an interview together with your wife. If you succeed with this application then you receive a 10 year green card.

When does your green card expire? Is it longer than the 3 more months you need to stay in Dubai or does it expire before that?

We need more information from you. What type of green card do you have - a 2 year card or a 10 year card? Did you get your green card through marriage to your US wife or by another means? Are you working overseas for a US employer? How long do you intend to be out of the country? Did you get a re-entry permit before you left? Is your US wife with you or is she still in the US?

For a long time VSC was extremely slow. Then last Spring it started to transfer files to CSC and things began to move more quickly. By your file date you were probably on the border line of the files that got transferred and those that didn't. It could be that your file has been misplaced - or misfiled - and something needs to 'shake it loose'. That is what your Senator or House Representative can do. Good luck to you.

You might want to contact your Congressman or Senator and ask them to investigate the delay for you. You can find your Senator here:

You will need to provide a signed 'release' form authorizing them to investigate for you but they should be able to help. I contacted my Senator when my ROC was a year old and it was approved very shortly afterwards.

You should inform USCIS that she left you last December and you have no idea where she is (I am assuming from your post that you don't). You can perhaps give them some details (ie signed divorce but not filed, etc.) about the relationship as well. I think, unless she has left the country, there is very little you could do to restore her status at this stage if you wanted to try and rescue the relationship. She basically made her bed when she failed to file for removal of conditions and now must lie in it. If she left the country, she can send proof of the date she left to the US Consulate where she is and you 'may' be able to refile for another CR-1 if you are still married or another K-1 but any application will receive strong scrutiny and I think you would have a lot of serious 'baggage' to overcome. If she has not left the US, then she has probably burned her bridges. If she leaves voluntarily, she will incur a 10 year ban on re-entry. If she needs to be deported - which it sounds like from the letter you received from ICE - then it would be virtually impossible for you to do anything to get her back again, especially with the circumstances you have described.

Truly, I am sorry that things haven't worked out. If I may offer some advice, although you didn't ask for this, I think you would be much better off to cut the ties to her permanently and move on with your life instead of trying to cling to a faint hope that you may get back together in the future. I don't think there is anything you can do to 'minimize' the work - there just may not be anything that you can do.

It sounds like you will probably be scheduled for an interview. Don't let that stress you too much. USCIS has to interview a certain number of cases for statistical purposes and it could just be that yours was one of the ones chosen. There are a few here who have also had interviews but there are not very many. The VJ interview that comes to mind most recently was very straight forward - 10 minutes and a quick look at the paperwork - and they were approved.

Put together additional evidence from this past year (since you filed) to show that your marriage is still valid and you are still living together. Go over your application and make sure you bring the originals of the documents you sent in with the application with you. Good luck - and let us know how it goes.

It sounds like they did 'flag' your name. I would write as suggested and explain what happened and request that they remove the flag from your name. You may even want to make an Infopass appointment and go in person to make that request.

I wouldn't include it in with the I-751 because it is a totally separate issue and you don't want to throw anything additional into the mix where it may get overlooked. As well, the I-751 may take some time to process whereas you probably want to get this taken care of as soon as you can. You can certainly include in your letter requesting that they remove the 'flag' from your name that you have applied for the I-751 Removal of Conditions in a timely way, as you are required to do.

Status updates are very sporadic. Some people get regular updates and touches - although generally not before the biometrics. Some go all the way through the process and even after their application is approved, still have status pending from when they first filed.

The good news is if you do get touches you know they are working on your file. The bad news is that is you get no touches or anything - it doesn't mean anything at all.

BertieMae has it right. Your expired green card and the NOA work together so, the NOA extends your green card for one year to August 2010. You need to carry both of them with you, although you can probably get away with carrying a copy of the extension letter and use the original for official purposes like travel or work validation or DL renewal, etc. Hopefully you will have received your 10 year card long before August 2010, though.

To the OP, I am sorry you are going through this. If you are still married and your I-751 is approved without an interview, then you can do what you wish. You will receive your 10 year card and continue on the life you have built for yourself here in the US, if that is your choice. If you are called for an interview and are still married, but your wife does not wish to attend, yes, go to the interview, bring with you evidence to show that you entered the marriage in good faith and let them know your current status, that the marriage is in difficulties. You may be allowed to remove conditions or you may not - it will be up to the interviewing immigration officer. If you get officially separated or divorced, then you need to bring those documents with you as well to the interview. I believe there has been discussion -although I don't know if it has been finalized yet - of allowing an applicant who gets divorced while waiting for the approval of the I-751 to have his existing application modified to request the waiver rather than withdrawing that application and submitting a new I-751 with the waiver of the joint filing condition.

Good luck to you. A lot is really going to depend on the timing of the I-751 application and the situation with your marriage. I am sorry things haven't worked out - I know how difficult it is to uproot yourself from your home country and your previous life to try and start a new life in a foreign country. If you wish to stay you have the various options as outlined above. If you wish to return home, that is certainly an option as well.

I don't know the answer to the question about your daughter - you might want to phone the 1-800 line and speak to an actual Immigration officer, not just the call center person who answers the phone.

Videotaping interviews is quite normal and nothing to be alarmed about. That is a fairly standard phrase to cover them if they do tape. There is a chance that they won't be taping as well - it doesn't really mean anything to worry about.

Bring the two passport photos - they may want ones that are more recent than the ones from the biometrics (or they may not, too - you may end up taking them home also smile.gif )

Bring the originals of everything you submitted with the original I-751 plus bring originals and copies of documents that cover the time from when you submitted the application to the time of the interview. You can offer the copies to them to keep in their files. Bring the other items that they mention - tax receipts, lease or mortgage, etc. - the originals if you have already submitted copies, or copies and the originals if you haven't. You can order in the most recent tax transcripts for 2008 by calling the IRS. Try to bring a variety of different types of documents showing how you are mingling together your financial, social and personal lives. The more the better.

I wouldn't be worried too much. USCIS is required to have a certain number of interviews for statistical purposes which means that there is nothing out of place about your file and you just have the luck of the draw. Or, there may be something minor - you didn't sign where you were supposed to or something like that and they will take care of it at the interview. This is a standard interview letter, not a special one, and is designed to cover a lot of different reasons for having an interview.

I would say make the Infopass appointment instead of the service request. The service request requires you to wait 30 days while the infopass appointment is right away. You can select the option you are outside of processing time or has other problems - haven't received the ASC biometrics letter - choose any of them that will allow you to make an appointment, because when you go you will be able to discuss the full issue.

You need the appointment letter - it is the only way they can associate the results with your file information. The letter also states what type of biometrics you get so they can't determine if you need all fingers and photo or just thumb and photo without the appointment letter. It is very unlikely that you would get less than 2 weeks notice of the biometrics date (although it has happened). Keep proof of your travel dates and if on the off chance the appointment is for when you are away, then go with the appointment letter after you return and bring that proof of travel with you and you should still be able to do the biometrics.

Ideally, you don't want to leave before you do your biometrics because all of the work on your application stops until they can complete the security check from the biometrics fingerprints. As well, you will need to have someone here to receive the biometrics letter to let you know of the appointment time and to notify them that you need to reschedule if the appointment is for when you are still away. You definitely don't want to miss the biometrics appointment and not contact them about missing the appointment because they may consider you to have abandoned your application and close the file!

It is very unlikely that you will be able to receive the I-551 stamp if you have received the NOA 1 Receipt letter that extends your green card for one year. I have heard of very few people having problems using the NOA letter and their expired green card (they are used together) while travelling.

It will draw their attention to the fact that you did send them specific documents and if there is something specific they have misplaced, they can then ask for it again - or look around and find the rest of your misplaced file! Include information from this year too - it was a year since you filed so you will now have more evidence - 3 years worth that you can use. Send documents that cover all three years of your marriage, including tax returns for each year, joint bank accounts (several statements from each year), write your wills and list each other as spouse and make each other your heirs, include any bills that you do pay together, joint credit cards, health insurance, being listed as spouse at each other's employment, car registration, copies of both of your driver's licenses showing the same address; envelopes and cards mailed to you at your address, the statement from your in-laws that you live with them. Send several examples of each that covers right back to when you got married up until now and you will probably find you have a lot more evidence than you think. Good luck.

Be sure to bring your passport as well, though, as it is always a good idea to carry your passport when you are in a foreign country. I sent a full statement from different quarters for the three years involved, and also highlighted on the full statements where the mortgage payments, utility payments, car loan payments and insurance payments came out of the joint account.

As long as you file sometime during the 90 day window before the Green Card expires you are fine. The longer you leave it, though, the greater risk you run if there is a problem with the application and they return it to you for re-submission so you don't want to cut it too close. As well, it would be best to ensure you submit it early enough so that you will get the NOA 1 receipt letter extending the validity of the 2 year green card before it expires, just in case you run into any problems with someone questioning status.

If you can't make the scheduled biometrics appointment and you have the appointment letter you can try going in early and do a walk-in appointment. Not all facilities allow this though. You can also send back the appointment letter advising them that you are not available on that date and asking them to reschedule (make a copy of the appointment letter before you return it though). Give them a date after which you would be available.

I had to re-schedule a biometrics appointment for my AOS. The original appointment was December 26th - I received a rescheduled appointment for February 7th.

I separated my documents into exhibits for easy reading, and I inserted a blank page separating the exhibits with a "tab" on the bottom for each Exhibit letter. (I used normal printing labels to make tabs).

I hope this help you as a guide for your cover letter.


I did the much the same. The cover letter was a joint letter from my husband and me. I also included a Table of Contents listing each section and then the documents contained in each section. Instead of a blank sheet separating the tabbed sections, I listed the documents contained within that tabbed section on the page with the tab.

I wrote my A number name and the type of application on the upper right hand corner of every page. If it concerns you about writing on original documents, then use a pencil there - it can be erased. I too figured that if they misplaced - or dropped - parts of the file it would be easier to re-unite it with the rest of the file if every page was identified.
