Permanent Resident Card Production Delays

USCIS is announcing that applicants may experience up to an eight week delay in the delivery of their permanent resident card while we are in the process of upgrading our card production equipment. USCIS Field Offices will be issuing temporary evidence of permanent residence in the form of an I-551 stamp to applicants approved for permanent residence at the time of their interview. You will need to take your passport to your appointment. If you do not have a passport, you must bring a passport style photo and government issued photo identification to receive temporary evidence of permanent residence.


If the application is approved subsequent to your interview or by a Service Center or the National Benefit Center, the applicant should bring the above documents to an INFOPASS appointment to be issued temporary evidence of permanent residence in the form of an I-551 stamp.

You might want to go back to your local office and bring 2 passport sized photographs and ask for an I-94 to be placed in your expired passport with the extension. They are supposed to be able to do that. All the same, it would be a good idea to get your passport renewed, however, I understand that for some countries that is difficult to do. It is always a good idea to have a valid passport if you are in a foreign country, even as a permanent resident.

You may also wish to get in touch with your Senator's or Representative's office. They often have individuals on staff who work with immigration related cases. You will need to sign a permission statement before they can investigate for you. If you live within reasonable travelling distance of their office you can go to the office to sign. Otherwise, check on line for your Senator or Representative's website - they should have a printable authorization/permission letter on their website that you can sign and either fax to them or send to them through the mail. They should be able to launch an inquiry on your behalf to find out why your I-751 is taking so long and help get it moving again.

This isn't the first form or letter sent out by USCIS that is extremely poorly written. It seems like the letters are just thrown together and no one bothers to proof them to see if they make sense. Some of the forms are written in much the same way. I suspect that a lot of the confusion some of us have felt at some point along this journey would have been prevented if the written information had been clear, concise and accurate - in other words, well-written.

When you send in your application, you will receive an NOA receipt that will include the phrase that the NOA extends the status of the green card for one year and is good for work and travel purposes. Ideally, your 10 year card will be approved before the NOA expires.

You should receive your NOA within 10 days to two weeks. Most of them do come in earlier than that. If you have waited 30 days or your green card is about to expire you can make an infopass and ask for the I-551 stamp to be put in your passport. It is unlikely that they will give you the stamp earlier than that. Since your green card is expiring August 13 you might want to make an infopass appointment for the first week of August. It will be close enough to your card expiring that they will probably give it to you, plus that will allow time for your NOA to arrive. If it arrives before your Infopass appointment, then you can cancel your appointment. Good luck.

write your wills listing each other as spouse and heirs/executors; even though you filed your taxes separately it should still list you as 'married, filing separately' so include those earlier taxes as well; you can purchase life insurance benefits or if you have them through work show your spouse as beneficiary; include a notarized statement from your parents regarding all of you living together in the same household; if she has paid any bills regarding the property or household that include her name and address include those showing she is accepting liability for the property as well. Do you have a family cell phone plan with both your names/numbers? AAA memberships with both your names? Costco/Sams membership with both your names? Good luck.

Don't listen to that lawyer - it is considered an RFE and it is request for more evidence. It isn't them 'trying to buy more time. California is the fastest of the two service centers and has never been 'behind'. The RFE basically means that you didn't send in enough information originally for them to make a decision. Did you send in documents that cover the full time of your marriage? The list of what you sent back in response to the RFE sounds good. If they find that it is sufficient you will get your 10 year green card. If it isn't sufficient then you may get a request for another interview. I doubt that they will deny it. If you get an interview do bring in information about the delinquent credit cards as it shows you have a mutual debt and that is compelling evidence of a honest relationship (they aren't going to judge you for your financial situation - they just want to ensure that you are in an honest marriage).

They cannot stamp your passport to extend your green card if they don't have proof that you have already filed the I-751. That means it needs to have been received and entered into the system - they can check using your A number. You can file asap and hope that you get the NOA1 before you leave; you can make another infopass for after the I-751 has been filed closer to the time you leave and bring proof of your travel plans and hope they will give you the I-551 stamp, or you can make sure that your wife returns to the US before her green card actually expires

Right, you have to file during the window that opens 90 days prior to the conditional green card expiring AND the date the green card expires. You can't file after the green card expires, so make sure you do file in a timely way. When you file, you will receive an NOA receipt notice that will extend the validity of the green card for one year. Your processing of the 10 year card should be completed before the NOA expires. Just be sure you don't file late - the consequences are significant.

The majority of I-751 applicants have their applications approved without an interview. Usually they just interview if they have concerns about the validity of your marriage, although they do schedule interviews for statistical reasons (they need to conduct so many interviews a month) so even if your application if complete and fine, you can also get an interview. The likelihood is, however, that you will not have an interview.

If you are one of the ones who are interviewed they will send you a letter advising you of the time, date and location of the interview and what they want you to bring. It would definitely be after the biometrics appointment.

From looking at your timeline you received your green card approval on June 3, 2008. That means you can apply for your 10 year card 90 days before June 3, 2010. You have to apply no later than June 3, 2010 though - you are not allowed to file the I-751 late. You might want to read up on the information in the Guides at the top of the Removal of Conditions forum.

It is quite likely that the first biometric prints weren't good enough and the FBI sent them back. USCIS then sends you another notice for biometrics. When you go for the new appointment point out the error on the letter at the registration desk and they should be able to correct it for you.

You can try but it is unlikely they will issue the stamp as the NOA is expected. The stamp is only issued if there is a clear need for it such as no proof or travelling to a country that has previously exhibited difficulties with the extension letter. They would probably say that the letter will be in soon and you can take care of the DL at that time. Still, it is worth a try. The worst they can do is say no, and you never know, you might find them sympathetic.

No. In fact, there is very seldom an interview for ROC. They do, sometimes, do interviews for statistical purposes which means there is nothing in the application that triggers a deeper look but that they need to do so many interviews and so add some straight forward cases to the questionable ones. So, if you do get an interview it is more likely that yours is one of the Statistical interviews than one that was scheduled because there were red flags or problems.

Just to reassure you, you didn't file late. You are allowed to file anytime during the 90 day window that leads up to the date your green card expires. You don't need to file on the 90th day - any time during those 90 days is fine, just as long as you file before your green card expires.

If you were both legally resident in Canada you could do a DCF - if they still allow that by then. DCF means you directly file the I-130 at the US Consulate in Canada (Montreal), the processing for her green card is done there, and then she enters as an IR-1. Since you would have been married for more than 2 years at the time, she would have a 10 year green card, not a conditional 2 year card.

Your wife can be included on your student application but you must provide proof of the relationship and both of you would need to complete the necessary immigration requirements (ie. if a medical is required, both of you must do it, etc.). You must also provide proof of how you intend to be supporting yourself and your wife while you are at school, and you would probably ne4ed to reapply on a yearly basis to keep your student visa valid. The problem comes when your wife is no longer considered a PR of the US because you are outside of the US for too long and her green card would be considered abandoned. She may then need to obtain a visa as well for Canada - I honestly don't know how the circumstances would work in that case.

If you postponed your graduate work until your wife has her US citizenship then you would not have to face the visa problems or any problems of returning to the US.

I concur with ELW's post. There have been instances on VJ in the past where K-1s have received a 10 year card before their 2nd wedding anniversary. Some of them tried to fix it at the time with mixed success. The recent developments have been as ELW says - when they applied for citizenship their applications were denied because they had failed to apply to remove conditions.

Issuing a 10 year card instead of a 2 year card doesn't change the legislation that states that everyone who has been married less than 2 years and applies for a green card based upon the status of their marriage to a US citizen receives a conditional 2 year status from which they need to apply to remove the condition by the expiry of the 2nd anniversary of becoming a permanent resident. While the green card might be wrong, it doesn't change the fact that your marriage was less than 2 years old when the green card was issued.

Definitely make an infopass and try to get it sorted out. Even then, consider filing the ROC application within the 90 day window prior to your 2nd green card anniversary.

It sounds like the Immigration Officer - if it is an Immigration Officer - is trying to decide whether you have submitted enough information for her to make a decision to approve you without an interview, whether to request more evidence or whether to schedule an interview.

Interesting questions, though - is she also calling your husband to get his answers to the same questions, ie. what time do you get up? I think with the second call and questions like this I would definitely make an infopass as well and confirm that it is USCIS making the calls. I would be tempted to tell such a caller that she is a stranger to me and all I have is her 'word' that she is who she is, that if she wants to ask these questions then to schedule an interview and you would be happy to answer them in person, but that you don't feel safe giving this information over the phone to strangers. You could say 'how do I know you are not someone calling up to find out when the house is empty so you can come by and rob us?'. It is the nature of these questions that make me suspicious - especially the what time do you get up, etc. There seems to be no rationale to ask that question in context of the I-751 except in a person to person interview with the both of you.

Have you received the NOA for the application from USCIS? Have you confirmed that it is USCIS who cashed the check? If not, then I would refuse to answer any more questions and definitely make an appointment with USCIS to confirm they have your application. I would also notify the police about these calls (if you haven't got the NOA, that is).

You appear to have received some good advice from USCIS. Yes, file the I-751 to adjust status asap. Include the letter of explanation. It almost definitely will be denied. However, you are still married to a US citizen. You are allowed to re-apply to adjust your status from being out of status back to an AOS applicant. Your wife would have to file the I-130 and you would file the I-485. When you get your new green card your out of status time would be 'forgiven' and you would be free to travel and visit your family. Because of the length of your marriage you would not receive a temporary green card but a 10 year card. It will mean you and your wife will need to work out your differences because you will need to be married during this time. It also means that you will not be able togo and visit your family for a while - possibly a year or more still, but it does mean that once you get the 10 year card you are able to travel, able to live and work in the US and able to interact with your son whether the marriage survives or not.

Definitely get a consultation with a lawyer - perhaps your lawyer friend knows of someone experienced in immigration who can help you, but the course USCIS outlined for you sounds pretty straight forward. Don't leave the country - you need to stay in the US to get the AOS processed again. Perhaps you can ask the lawyer whether you can even 'skip' the stage of filing the I-751 and go straight to refiling the I-485 with the I-130. It may be the preferred route to go in the end.

I will have to look at the form again but I thought you had to include a fingerprint card with I-751s filed from overseas. Perhaps someone else can correct me. You don't get another extension letter. If the letter is expiring she needs to get an I-551 stamp placed in her passport. I don't know if this can be done at a Consulate or if she needs to schedule a trip back to the US for this.
