Your file is at the Vermont Service Center (VSC). THey are taking about 11 to 13 months to process applications so in all honesty I don't think you will have your green card much before April. This is normal for VSC. If you check the VSC status list dates you will see that they have only just started to approve applications submitted in February. THey are still working on applications submitted in December and January as well. The cases that you see being approved quickly are the ones that are sent to the California Service Center. They are approving cases in 4 to 6 months.

If you will be out of the country when your green card extension expires, make an INFOPASS appointment at the USCIS website: http://www.USCIS.gov . The Schedule an Appointment option is on the right hand side. You will go in person to the USCIS office near you and bring the proof of your travel plus your unexpired passport and your expired green card. Ask them to put the I-551 stamp in your passport. That will allow you to travel and return to the US.

If you haven't received your NOA two or three weeks before the green card expires, make an infopass appointment and get the I-551 stamp placed in your unexpired passport. There were a few weeks last February and March where almost no one received NOAs and we had to do that. There appear to be a few glitches still in the system. You should have received the NOA prior to the biometrics letter. Regardless, you can at least check your status on line by using the case number on the biometrics letter - that is the valid case number, not the one on the Noa. Good luck.

yes- about 11 months with exceptions either way, although the exceptions tend to be more often longer than 11 months than less than 11 months.

TSC hasn't been doing I-751s for at least a year now. They 'officially' closed down for I-751 in May/June but everything at least 6 months prior to that was transferred - initially to California and then to Vermont.

The other thing that could be slowing down work on family based applications now that the election is over and the priority doesn't need to be on citizenship applications is that employment based visas opened up October 1 and they are now getting all of the applications from employers for new or renewing workers. Employment based applications seem to take priority over family based applications, so once again I suspect I-751s have been moved to the back of the line.

Generally, they are looking for information about this past year - their most up to date information was from last December, so send them the 2007 taxes and examples of statements, mail, photographs, trips, etc. for 2008 even if they are from the same accounts. They are just checking to make sure the marriage is still valid since you filed. Generally, approval seems to come very quickly after the requested evidence is submitted. Good luck!

I'm with you Daniel. I got transferred with my AOS just as it got to the head of the line after a 14 month wait, then was transferred and had to go to the back of the line and had another 9 month wait for approval. Yep - 3 weeks before our 2nd anniversary and now this. I don't know whether to laugh or cry, but right now I feel like crying. It is probably good news for everyone except those who have been waiting 11 months already.

Removing Conditions on Residency General DiscussionVSC I-1751 Status List
They're transferring files starting first week of February with 10,000 files each week for 8 weeks, and yes it is because VSC is so 'funkin' ' slow they have a massive backlog of waiting applications. They will still be doing the incoming applications, however; it is just the backlog being transferred.

Removing Conditions on Residency General DiscussionVSC I-1751 Status List
Ok - sent off my inquiry to my Senator's office today and talked with them on the phone. Explained about the long wait and now the potential transfer. We'll see if that shakes something loose. A friend used the same Senator's office last year to inquire about their I-751 submitted to Texas and getting no action (and a MUCH shorter waiting time than this!) - within 2 days of the Senator's office contacting USCIS they had a response, so while my file may be waiting on someone's desk, I am trying not to get transferred to CSC but get approved instead. I'll let you know what happens.

I filed my inquiry with my Senator's office on Friday, January 30th; they submitted it Monday, February 2 and I received my approval notice Thursday, February 5th. My official snail mail letter says it was approved Wednesday, February 4th. It may be coincidental but it sure doesn't look like it.

I sent a completed Authorization form that I printed off of Senator Johnny Isakson's website that gave him permission to inquire on my behalf. The form included my A number and a description of my problem, as well as contact information and the signed authorization. I also included a copy of the notice from the USCIS online status inquiry page showing that the application had been filed and the application number. I included the information on the form that applicants who had filed the same time I had had received their approval nearly 2 weeks earlier and after a year, I was tired of waiting. I faxed it to Senator Isakson's Atlanta office, and then called to verify they had received it. Senator Isakson has an assistant who works especially on Immigration cases named Charles who was very helpful.

I do hope you receive your approval very, very soon! I agree that it is ridiculous.

Received the official notice in the mail today of approval - actual date of approval according to the NOA is February 4th, not 5th. I'll wait and see what the actual card says before I update the status list.

I would recommend contacting your Senator's office as well. They will require a signed permission form from you so if you are able to visit his office that is great - if not, they can do it by fax. Give them a call and enlist their support in getting some action on your case. Good luck.

Keep trying - try in the middle of the night even - you need to find the time when they release the appointments for the next days schedule. Here is a link to the USCIS website listing what offices are closed. As you can see there is nothing listed for your office so it should be open. I think it is just a matter of trying every hour on the hour until you get an appointment. You definitely don't want to leave the country without proof of your legal status so you will be allowed to return. You need either your green card or the I-551 stamp. If need be, prepare to drive to the next USCIS office if that is the only one where you can get an appointment. Good luck.

They are interested in seeing not just that you have comingled assets but that these extend throughout the period of your marriage, so what we did is we sent bank statements from each quarter for each of our accounts, with one from each year being the full statement, and the others just being the summary of the statements that still showed both of our names. The bank letter is good but you may wish to support it with examples of statements as well. You can also use statements to show information you would like to hghlight - ie, that both of your paycheques are automatically deposited to the same account, that the mortgage payment for the house comes out of the same joint account, etc. I highlighted those items on the statements we sent as well. Collect evidence of your good faith marriage now. File for divorce and when the divorce is final you can file to remove the conditions on your greencard requesting a waiver from the joint filing condition. You can file when the divorce if final instead of waiting until 2011. While it is nice that your husband is willing to file jointly with you to remove conditions, it is basically a lie that you are together and you will be unable to produce evidence to show that the marriage continues from the time you received your green card until you have to file to remove conditions. You would be questioned about the status of your marriage and that may cause problems at the time. The most honest approach since the marriage is over is to file for divorce and proceed with the waiver. Your husband can still provide you with a letter stating that the marriage was in good faith but just did not make it and you can include that in with your evidence. Good luck.

There seem to be a number of recent approvals where people are still waiting for the actual card to arrive. I don't know if there is a problem with the card production facility or not but you might want to read some of the other threads about waiting for green cards. Good luck. I hope it arrives soon.

They will return the whole package to you, at which time you can insert the form and resend it to them. Don't send the form separately as they will probably not match up the two packages and your actual form would be returned - or you would receive RFEs for missing evidence - or else deny it straight out for lack of evidence. It will only be a few days before you should get your first package back. I am assuming you made a copy of what you submitted, so if worse comes to worse and you haven't received it back before you need to leave, make another copy and submit your copied evidence with the form. Is your husband planning on travelling with you on the 22nd? Will he be back before July 3rd, because if he is travelling out of the country and will not be back before his green card expires you may need to make new plans. He should not be out of the country without the NOA extension letter which you should receive in about a week to ten days after your application is accepted.

Anita, it is still quite early for you to start getting concerned. There are still a lot of applicants from last year who haven't received their 10 year green card approval yet. You might want to look at this thread - it has a list of the dates people applied, when they received their NOAs, did their biometrics, and when - if - they have been approved. While there have been some approvals from January 2009 there haven't been a lot, so you really don't need to worry yet. Just keep being patient.

No, you don't need to send in passport sized photographs of yourself. Once you submit your application, you will receive first the NOA1 and shortly after that a Biometrics appointment letter. They will take your fingerprints AND your photograph at your biometrics appointment. You only send in passport sized photographs if you are applying from outside of the US (ie at a military station overseas), so you don't need to worry about that.

1. Yes, you can use I-751 Joint Petition to Remove Conditions of Residency for the title of the letter
2. Both my husband and I signed the cover letter since we both had to sign the I-751 form and it is a joint petition. While it is to remove the conditions on your residency, the two of you are submitting together the proof of your marriage, so it seems reasonable that both of you would sign the cover letter as well.

In the meantime, you might want to get the I-551 stamp placed in your passport. It may take a while to get the replacement greencard, and with the stamp you should be able to travel and complete that trip home to see your parents. You can get the stamp at an infopass. You're fine with the extension letter. It is unlikely that USCIS will give you the stamp if you already have the letter unless you can provide some pretty convincing evidence that the letter is not acceptable.
