Also know your Social Security Number.

The biometrics is one of the easiest parts of the process. Bring your appointment letter, your identification (passport or Driver's License) and your green card to the listed address. Present the letter and identification and green card to the security guard. He/she will give you an information questionnaire to fill out. This is the basic information about yourself but you will also need to write down your A number (on your green card) and your social security number.

You line up and then hand in the form at a counter. The person at the counter checks over the form, then gives you a number, stamps your appointment letter and hands it back to you. You go and wait in a waiting area until your number is called.

When your number is called you go into a booth like area. Your fingerprints are taken digitally - that is, the technician will have you place your whole hand and then each finger individually against a glass screen. A computer will capture the image. She may retry several times to get the best image. Then you will have your picture taken in the same booth.

That's it! You're done :) . The whole thing should take less than half an hour including the wait.

I will add my agreements to Bob's as well. You can jump through all of the legal hoops now and pay the necessary fees to change your name in time to apply for Removal of Conditoins - or you can wait until you apply for US citizenship next year. The Citizenship application gives you the option to change your name without any additional fees and your certificate would be issued in your new name. By far and away it is the easiest and cheapest way to change your name.

Yes, schedule an infopass at your local USCIS office. You can do that by going to the USCIS website ( http://www.uscis.gov ) and selecting Make an Appointment/Infopass from the lower left hand corner.

Bring along the proof of your travel dates and your expired green card. They will access his file through the A number, verify that you have submitted the I-751 (you can bring along a copy of the cancelled cheque as well, if you like) and stamp his passport with the I-551 stamp for a specified period of time, usually one year.

The NOA normally arrives within 2 to 3 weeks of submission but there have been cases where it was delayed and last year at about this time where none were sent out at all. I never received an NOA for my ROC application so had to get my passport stamped as well.

Make your appointment for at least a week before your scheduled flight just in case you do receive the NOA, in which case you can cancel the Infopass. Good luck.

USCIS will also provide an I-551 stamp on an I-94 document if an individual does not have a valid passport and place that into an expired passport. The applicant needs to bring in two passport sized photographs to an Infopass requesting the I-551 stamp, so if you decide to go with the current passport and they only stamp it to the passport's expiry date, if you don't have the green card by then you can go back in and get an extension of your proof of legal status in the US.

I'm sorry you are having problems. The expiration of your green card is the final date by which you can apply to remove conditions - you can't apply later unless you can provide a very good explanation/reason AND USCIS agrees to accept it. Even with that there is only a few weeks 'grace' period. So, you need to file the I-751 to keep your status in the US legal.

Being the parent of an American citizen offers no immigration protection either. If your status expires in the US, even if you have American citizen children, you are expected either to leave the country voluntarily or be deported if you don't leave voluntarily. You need to file for the removal of conditions to keep your status valid in the US. If the marriage breaks down you can file for divorce, and if you can get the divorce completed quickly, pull the filed Removal of Conditions document and re-submit the I-751 with the waiver. Your first order of business is to keep your status in the US legal by filing the I-751. The second order of business is to sort out the situation of your marriage - either counseling and seeing if it can be saved, or ending it officially. Your status in the US is going to be dependent upon the status of your marriage eventually but filing now will buy you time to address the marriage issue.

There is no IF-6 listed but there is an IR-6 which is spouse of a US citizen. I wonder if someone made a typo in your letter and it is supposed to be IR-6? That would make sense.

I agree - the OP does not need insensitive and callous comments. He has sought medical advice and is seeking further medical advice. There are some conditions where air travel is not recommended during pregnancy and the OP's wife's condition may well be one of those. Her doctor is the best one to make that determination.

A further consideration - while women have been having babies for millennia - until very recently the number one cause of death for women was in childbirth or from complications of childbirth. Women still die in childbirth even with our modern medical advantages. One of my friends did - she hemorrhaged - and they couldn't stop it. The OP is absolutely right to make the health of his wife his number one priority, even if it means he will have to start the immigration process all over again if there is no way to manage the ROC under the current circumstances.

Yes, get a copy of the police report and any other documents that show she paid the fine. Make several copies as you will need to re-submit them as well if she decides to file for Naturalization. While originals are requested there, if you have already filed the originals you can refer to them already being in the file. Write up a short paragraph detailing the incident and then attach the documents that you have. It shouldn't be a problem.

Last year I was able to request and receive tax transcripts for our 2008 returns 3 weeks after our returns were filed and accepted electronically. We filed early February. I expect that the closer it gets to April 15, however, the longer it might take to get the transcripts due to the increasing work load.

It is surprising that they didn't accept your petition the few days that it was late - it is up to the discretion of the ruling officer to make that decision or not. Yes, it would have been a good idea to include a statement that the petition was filed initially on time but returned for incorrect fee and that the return made the re-submission late, but hind-site is always 20/20.

You would benefit from a consultation with a good immigration lawyer, but I believe that you will have the opportunity at a Court Hearing for your deportation to address the Judge and explain the circumstances. He has the power to overrule the decision to terminate your permanent residency for late filing, and I think the evidence that you have - showing you did submit in a timely way and that because of the error of not including the biometrics fee, that it was returned to you and then re-submitted late should go in your favour.

© Requirements of Timely Petition and Interview for Removal of Condition.-

(1) In general.-In order for the conditional basis established under subsection (a) for an alien spouse or an alien son or daughter to be removed-

(A) the alien spouse and the petitioning spouse (if not deceased) jointly must submit to the Attorney General, during the period described in subsection (d)(2), a petition which requests the removal of such conditional basis and which states, under penalty of perjury, the facts and information described in subsection (d)(1), and

(B) in accordance with subsection (d)(3), the alien spouse and the petitioning spouse (if not deceased) must appear for a personal interview before an officer or employee of the Service respecting the facts and information described in subsection (d)(1).

(2) Termination of permanent resident status for failure to file petition or have personal interview.-

(A) In general.-In the case of an alien with permanent resident status on a conditional basis under subsection (a), if-

(i) no petition is filed with respect to the alien in accordance with the provisions of paragraph (1)(A), or

(ii) unless there is good cause shown, the alien spouse and petitioning spouse fail to appear at the interview described in paragraph (1)(B), the Attorney General shall terminate the permanent resident status of the alien as of the second anniversary of the alien's lawful admission for permanent residence

(B) Hearing in removal proceeding.-In any removal proceeding with respect to an alien whose permanent resident status is terminated under subparagraph (A), the burden of proof shall be on the alien to establish compliance with the conditions of paragraphs (1)(A) and (1)(B).



2) Period for filing petition.-

(A) 90-day period before second anniversary.-Except as provided in subparagraph (B), the petition under subsection ©(1)(A) must be filed during the 90-day period before the second anniversary of the alien's obtaining the status of lawful admission for permanent residence.

(B) Date petitions for good cause.-Such a petition may be considered if filed after such date, but only if the alien establishes to the satisfaction of the Attorney General good cause and extenuating circumstances for failure to file the petition during the period described in subparagraph (A).

© Filing of petitions during removal.-In the case of an alien who is the subject of removal hearings as a result of failure to file a petition on a timely basis in accordance with subparagraph (A), the Attorney General may stay such removal proceedings against an alien pending the filing of the petition under subparagraph (B).

Select several examples of each from the different stages of your marriage since USCIS wants to see a continuity so maybe 3 or bank statements each year, several credit card statements from each year, etc. Birth certificates of two children are also really good evidence :) of a continuing marriage. Mine took 6 days to arrive after I received the notice of its production. No, the Service Center doesn't produce the cards - I believed they are issued from a central location but I am not sure. Regardless, it is not the Service Center who produces the cards. No, you don't have to do anything in between removing conditions and filing for naturalization except stay married and living together if you are using the 3 year option, and not leaving the US for more than 6 months to ensure you meet the continued residency requirement.

Joint bank accounts aren't necessary if you have lots of other good evidence of joining together your financial, social and family lives. If all you have are the three documents that you have listed I am pretty sure you will get an RFE for more evidence. They also want documents that cover the whole period of your married life - not just from a single moment in your married life either recently or early on. They want to see 'continuity' over several years.

Other things you can include are copies of both of your driver's licenses (or State ID if she has no DL) showing the same address; a notarized statement from your parents that you live with them at the same address; any joint membership cards; copies of your wills listing each other as spouses; listing each other as emergency contacts at work; listing each other as beneficiaries on pension plans, IRAs, CDs, etc. Showing family cell phone plan with both names and numbers; showing joint car ownership or registration; showing joint travel itineraries supported by boarding passes, photographs of both of you at family events like weddings, holidays, with each other's families, etc. things like this.

Seriously try and be creative to find other evidence that shows you are living together as a married couple. The I-751 form itself provides a good list of documents. You don't want to fool around with USCIS - you want to convince them that there is no doubt about the validity of your relationship. It isn't necessarily what you think is good evidence - it is what they think that matters. They are trying to separate the fraud marriages from the real ones so the more evidence you can provide the greater your ability will be to convince them of your validity.

Im gonna try to get in and get a copy of our vehicle registration.. Ill throw some bills together, only problem is we jsut moved and most of it isnt switched over.. I guess either way if they want more they will send an RFE..

also I thought we filed jointly last year but when I went to do my taxes this year it said married filing separately..


:blush: hehee - sorry! Well, even though you have separate accounts are there items that she pays from her accounts and you pay from yours? You can include statements of both (showing the same mailing address) and highlight those items which indicate you are both contributing to the financial stability of the household. Be sure to include items from all of the years of your marriage as well, not just recent ones, so documents from before your move are also valid. Do you have copies of that lease? Did you alternate paying the rent? You can show things like that.

Yes, if they send you an RFE at least you will have time to collect additional documents in the meantime. Good luck.

ok - just saw your list - looking better! Try to make sure you have evidence (bills, etc.) that are not just recent but go back to when you were first married as well. You want to cover both years - or more if you have been married longer than just over 2 years.

Have you travelled together? Do you have flight itineraries or boarding passes showing you sitting together going to visit family or on holidays? What about a family cell phone plan? Medical bills for her and your son from his pre-natal care and birth that were paid by your insurance (and who made the copays? You? Find those receipts too).

Use utility bills that both of you pay even if it is individually - for example, you pay the gas bill and he pays the phone bill; you pay the electricity bill and he pays the internet bill, things like that. The addresses should show up for the same location.

Do you have any joint accounts? Joint bank accounts listing purchases each of you have made or deposits each of you have made to the same account work. If you don't have joint accounts, but are still paying bills together, then submit account statements from your account and his account and highlight mutually beneficial expenses (ie. rent, utility bills, etc.). Both statements should also show the same address. Include statements that cover the whole period of your marriage. What about a joint credit card? What about joint car registration as well as joint ownership? Driver's licenses for both of you showing the same address (or a State ID and Driver's License if one of you doesn't drive); copies of medical bills for him that you have paid on your health insurance? What about pension plans or retirement funds showing the other as the beneficiary or spouse? A joint safety deposit box in both of your names? anything from work showing him as your emergency contact?

If you are currently working out of state have him pull some of this stuff together from home. Think creatively! Is there a newsletter welcoming you or him to a new church, a new community, a club you might belong to? If you have pets you can get them microchipped and have both of you listed as contacts in case they go missing.

Tax returns are excellent documents since it is a requirement for PR status to file a tax return. Tax returns showing either you filed married jointly or married, separately work. They include the tax payer identification information and status. Tax transcripts are free of charge from the IRS.

Since you have a child it is also a good idea that you have your wills written. You can list each other as spouse and executors of the estate for each other.

Contact the realtor if you can't find a copy of the lease and ask for another. There may be a copy charge but it is worth it if you can't find your copy. Include that check list as well.

I am sure there are other things as well but those are ones that come immediately to mind. Work on this together - have your husband help as well as it is in both of your interests (as well as being a joint application) that the Conditions are Removed successfully.

I know. It is frustrating to see people who applied the same time as we did but to California getting approved and knowing we probably have another year's wait. I can imagine how frustrating those of you who have been waiting since last year must feel! It sounds like CSC could be doing all of the petitions and it would still be faster than waiting for VSC.

Yeah, but what about me? We started this whole process with an I-129F 5 years ago - took over 6 months to get that approved then 3 more months for the K-1, then 22 months for the AOS (3 weeks short of our 2nd anniversary!) and now 3 months here with the likelihood of another year? Geeze - if I had believed the posted time frames all the way through this process, I should be voting as a citizen in this upcoming election rather than 9 months away from applying for citizenship. It would have been nice if even ONE of our applications had been processed in a timely way . . . .we started this journey June 16, 2003.

(feeling somewhat disgruntled today as I am also sick with a cold - grrr, hate colds! Wish all of the USCIS 'chief's had them instead of me!)

Congratulations on getting an NOA- it gives hope that some of the rest of us without one may get one still:-). Yes, the letter along with your expired green card is sufficient to travel on, along with your passport, of course. If you have the letter you do not need the stamp - in fact, they would probably not give you the stamp.

Removing Conditions on Residency General DiscussionQuestion about timing of a possible interview

Scroll down to section (g) Adjudication of The Joint Petition, subsection ( c ) "Interview Necessary". Read also the following section 2 "Assigning Fraud Levels". It shows you what they are looking for and some of the common problems that may determine whether or not an interview is necessary. Of particular interest is this quote on entering information into the computer that will then select the names of those to be interviewed:


Once the fraud level is determined, the adjudicator enters the case in the MFAS data base. The district office assigns a percentage to each fraud level. All fraud level A cases are interviewed. The responsible officer (usually the ADDE) in the district offices may choose to interview between 30% to 100% of all fraud level B cases; and between 10% and 50% of all fraud level C cases. After the case is entered in MFAS, the adjudicator enters the fraud level and the computer determines if the case will be sent for interview depending on the percentage of cases the district office wants to interview.
(Please note that fraud level C means that there is nothing wrong with the application and it can be approved completely on its own merits)


The majority of I-751 filers do not have an interview. Of the ones I have heard about here on VJ they all seem to be of the variety that fits into the 'statistical review' part of the process - that is they need to interview a specific percentage of applicants to gain a statistical overview of the process. These interviews have been painless and very quick.

Hope this helps. The chances are that you will not be required to have an interview for Removal of Conditions.

Removing Conditions on Residency General DiscussionCR1 visa/green card/removing conditions
If you have been married 2 years when she uses the CR-1 to enter then she would not receive a two year conditional card but a 10 year PR card and would not have to remove conditions. If you have been married less than 2 years when she enters the US on the CR-1, then the date that she enters is the start of her two year conditional residency. She would need to file to remove conditions during the window that opens up 90 days before the 2nd anniversary of her entering the US but no later than the 2nd anniversary date of her entry. The date she becomes a permanent resident will be printed right on the card itself.

You must be excited! Congratulations and hope she has an easy POE.

Yes, that will do fine. You just want the basic tax transcripts for 2007 and 2008. When I ordered them it was from a menu driven list that allowed me to choose what I wanted and the years I wanted. I had to select each year individually.

She needs to file before her card expires. USCIS can deny the Removal of Conditions if it is submitted late without a good reason. She definitely doesn't want to give them that option. It is better that she files the application on time with less or incomplete evidence (but enough so they don't deny it outright) and get an RFE for additional evidence than to miss the filing deadline.
