You shouldn't need an attorney unless there appears to be a problem with approving the I-751. I also wouldn't make the Infopass for the day after your current stamp expires. I would make it at least a week before the current one expires so there would be an overlap. Have you already had your status extended once then if you filed in August 2008 - or did you mean August 2009. If it has taken this long you may wish to also get your Senator or Representative to work for you. They can contact USCIS and ask why there is no decision yet.

Why is required two passport photographs? In addition, where did you make the passport photographs?


They take one of the passport photos and attach it to a document they create that you can use to prove that you are legally in the US. They keep the other passport photo on file as a record of the action (perhaps creating a duplicate document, I don't know for sure). They then attach this document into the expired passport and it verifies that you are the same person.

You can get passport photographs made many places. Walmarts, many pharmacies, many Camera stores - all of these places can make passport photographs. They are not very expensive - anywhere from $8 to $15 depending on where you go.

My 1 year extension will expire in august and I scheduled an appointment with infopass. They advised me to return the next day after expiration. I noticed that my passport expired and I am not able to renew it. My understanding is that I can bring 2 passport photos and they will stamp I -94. Could you please advise me in regard with this situation?


Yes, you can do this. Bring the expired passport, the two passport photographs and they will create an I-94 for you and staple it into the expired passport. The I-94 will be valid and should cover you until the time your 10 year card is approved.

As the others have said, you will need to wait until you have been a permanent resident for 5 years (less 90 days) to file for citizenship now. You need to be still married to qualify under the 3 year option.

We are prepping to file and I had 2 quick questions. Her 90 day started 7/16 as she expires 10/16. How close to that 90 days do we need to be? Do I have a few weeks leeway? Cover letter for K-2

  • Copies of the green cards of mother and daughter.
  • Copy of the joint bank account statement.
  • A copy of our 2008 and 2009 joint US tax returns.
  • I-797C NOA and accompanying letter showing inquiry into separate green card expiration dates.
  • Copies of life insurance notices showing her mother as beneficiary.
  • Copy of our health insurance cards showing previous and current policies.
  • I-751 Petition to Remove Conditions on Residence form for daughter
  • Certified copy of Marriage Certificate showing my marriage to her mother (incl her maiden name).
  • Copy of current lease agreement for our residence in North Carolina.
  • Pictures of daughter and family members taken during the previous 2 years.



Does the daughter have a DL or State id? Include that. Is she in school and you are both listed as her parents or emergency contacts? Include those. Have you paid for any health co-pays or other expenses not covered by health insurance - include those. Does she have a cell phone on the family plan? Include that.

You can file any time during that 90 day window that opened up on the 16th.

Is the above list what you are submitting new or the combined list of what you already submitted plus what you are now submitting?

With the re-submission of evidence include a cover letter to explain why you did not have joint accounts and credit cards, as well as explaining that you have now done so although realize it may be late. State what expenses each of you habitually paid through your own individual accounts and then include bank statements that show those expenses paid by those accounts. Be sure the expenses cover the 4 years of your marriage as well, or at least back to when you submitted the AOS application because all information since will be new evidence and will show you have been living together in a married relationship ever since. Use a highlighter to show those expenses and highlight the account holder's name and mailing address on the statements. Were there any other household expenses that your wife paid or contributed to? Any one time maintenance expenses over the years? Show your wife also paying for her schooling as well as your contributions to her schooling so it shows you are both contributing. You could also write your wills, naming each other as your beneficiary and if desired, executor of the estate. You show joint car insurance - does she drive? Include her Driver's license. Has she paid for gas for the one car using her accounts? Again, you can highlight that expense on her accounts. What about phones? Do you have cell phones and a shared family plan or account? (and if not, why not - it's cheaper!) Definitely include the information/documentation about your pilgrimage, especially as it shows it required planning and involvement over several years - this is part of presenting yourself to the community as a married couple and your community requires proof of this relationship as well. Do you have pets together - you can get them microchipped and list both individuals as the contact person. Do you have joint investments such as a CD or IRA? You can list the other as the beneficiary even though the spouse is automatically the beneficiary - I made sure my husband was listed by name as I knew I could use this as an additional piece of evidence. Who has paid for the co-pays or non-covered expenses for medical exams, treatments, etc. . If these are from your account for her, include the statement from the provider/insurance as well as the bank statement showing where it was paid by you. If you have cards from your family to her for birthdays, her family to yours for birthdays, cards to both of you for anniversaries, you include copies of those and hopefuly you still have the envelopes as well. What about a joint safety deposit box? Even if each of you weren't listed on joint accounts together, was the other listed with the bank as being the spouse? Perhaps you can get a letter from the bank stating that fact (don't know if it is possible or not).

I don't think you need to lawyer up. The lawyer wouldn't be able to do much more than write your cover letter for you and possibly suggest some other types of evidence to provide. You would still need to provide the documents yourself. You just need to create a preponderance of evidence that you would not normally be able to obtain unless you really were in a valid relationship. Include as much as you can either directly or indirectly related to the financial aspects of your lives and then add in evidence that documents your daily lives as a couple living together as a couple and in the community at large.

You may also include a final statement in your cover letter stating that you and your wife would be happy to meet with an immigration officer for an interview so they may see in person the validity of your marriage.

Actually, I think the Atlanta ASC doesn't allow walk-ins. On the notice you receive it says if you cannot make the appointment you need to return the letter advising them and they will reschedule another appointment. On ASCs that allow walk ins they generally mention that you can show up on a Wednesday or a Friday if your appointment date isn't good. There have been VJers here who have tried to do walk-ins for the Atlanta ASC and were turned away. Certainly you can try going early and doing a walk-in but I suspect that you won't be allowed to do your biometrics and will be required to come back on your appointment date.

For most straight-forward and uncomplicated immigration issues a lawyer isn't necessary. The OPs situation, however, is neither straight-forward nor uncomplicated. The OP is being sensible in seeking legal advice for a situation that is fraught with difficulties. This is a good example of when seeking a lawyer is a good idea, and not an unnecessary expense. There is nothing 'run of the mill' about the situation the OP has described.

I called the number on the bio letter and finally was able to talk to someone. He said he couldn't do anything for me over the phone and to just bring my son with me to my appointment(which is at 1pm) and they will let me know when I get there if they will take my son early or not. Depends on how busy they are I guess. Hopefully he will get his done same day. I'd hate to have to go back for 9am 4 days later. Atlanta traffic sucks early in the morning. Thanks for your help!


Others have got their children's biometrics done at the same time as their appointments without a problem even though the children are scheduled for a separate appointment. I doubt you will have a problem either - it makes sense that they will basically do you right after each other under the circumstances. Yeah, traffic is much better going through Atlanta around lunch time than for 9 am! Good luck.

Do you exit off I-75 at Highway 138 going home? If so, and you aren't too stressed from the traffic, would you like to get together for a coffee or something on your way back that day? For form I-751? Removal of Conditions? No - there is no requirement to provide vaccination information on the I-751 - only on the I-485 - adjustment of status. I had a blanket waiver on medical vaccinations on the K-1 due to having had several of the illnesses instead of the vaccinations. There is no further requirement for vaccination information. None was asked for and I provided none. You would find it useful to read over the exact form and the instructions, You will see that the Removal of Conditions is focused solely on proving that you have a valid marriage to a US citizen that wasn't entered into for fraudulent purposes.

To CR1Visa - is there a chance that your soon to be ex husband received your green card and is holding it from you? You will most likely need to have the green card to file for Removal of Conditions, which you should do shortly after your divorce is finalized. You don't need to wait - in fact, you shouldn't wait - until the 90 day window prior to the 2 year green card expiring. You could try filing with the notice and a statement that the card was lost in the mail but I don't know if it would work. You could include a copy of the I-90 with the application instead of waiting for the actual arrival of the replacement green card.

I just need to clarify what is the latest that me and my husband can submit the form to remove conditions?

I know that its 3 months prior to the expiration on the card, but I want to know an exact timeframe..

For example .. His green card expires on 02/24/2011..

So what would be the latest to submit the forms and what not.. (I need an average estimate date)

The latest to submit the I-751 and supporting documentation is the day that would allow USCIS to have accepted and received the application no later than February 24, 2011. If you arrange to deliver it on that date and it turns out you made an error - wrong cheque amount, unsigned form, etc. - you run the risk of the application not being accepted and you then miss the filing date when you re-submit. There does seem to be some 'leeway' and individuals who file late and can provide a very good and valid explanation for the late filing - as long as it is still within a reasonable time frame - may have their applications accepted late. It is not a good idea to let yourself consider this as a valid 'option' however, as there is no guarantee they will accept a late application. It is up to the officer who receives it whether or not he will accept it.

As marriedtomrg mentioned, why put yourself through that stress? The sooner you file (within the 90 day window) the sooner you can relax about filing and the sooner you will receive your 10 year green card. You can actually be gathering together the documentary evidence of your marriage now so when it is time to file it will just be a matter of selecting what is the best evidence that proves your marriage is valid from a pile of possible options.

And thanks Kathryn41 as well! One question that I have about Naturalization is when does the three or even five year waiting start? From the date on my Conditional 2 year Permanent Resident Card or on my ten year Green Card?

Also, we have considered marriage counseling and plan on going to speak with someone withing the next month or so. I really hope that it is exactly what we need.


The three year/five year qualifying time for Naturalization starts from the date you got your first, 2 year conditional green card.

Good luck to you - I hope you are able to work through whatever challenges you are facing right now and move on with your marriage. It sounds like you really are just going through some problems right now but that the relationship itself is certainly real. I hope you can work things out.

Just Bob has explained it quite succinctly. To answer your other question regarding Naturalization - you can only qualify for the 3 year Naturalization option if you are still married and living together with your husband when you file, when you have your interview and when you receive your oath. Once you divorce - whether you have been married 2 years, 3 years or 4 years, you need to wait until you have been a green card holder for 5 years before you are eligible to apply for Naturalization. The 3 year option only applies if you are still married by the time you take your oath.

The majority of ROC interviews we have heard about here on VJ are ones where there is nothing wrong with the application nor is the marriage suspect, rather the interviews are necessary for USCIS statistical purposes - each office must have a certain percentage of interviews conducted as a 'sampling' (I guess). The odds are that you are two of the lucky individuals helping USCIS meet its statistical requirements.

It does suck that you have to travel so far and spend so much money for what will probably be a non-issue event. Regardless, prepare your evidence and bring lots of extra with you, including documents that have come in since you submitted the I-751. Bring everything you can possibly think of needing, especially as you are having to travel that distance, so that on the off-chance it isn't a 'statistical' interview, you will have all of the evidence you need at hand,

Hi Friends,
We jointly applied for renewal of my Conditional Green Card through I-751 and USCIS, Vermont Service Center received my application on Sept. 9th 2010
As per my status, USCIS sent me the notice of action describing how they will process my case via I-797 which also mention that my green card has been extended for One year
But I did not receive that letter at my residential address and My Conditional Green Card will expire this Nov. the 13th 2010.
After Nov 13th my Job will not keep me at Job, since I won't be having any status here in US.
The First and only letter which I received at my home was the Biometry letter and that too I finished on Oct. 15th at 12.00 PM at Sugarland TX,
Please can anyone tell me how I can get that Extension letter before Nov. 10th 2010 so that I cannot loose my Job and Travel to any other Country?


Hi Kalpen,

Not to worry. Even though you didn't receive the letter, your green card status has been extended for another year. You just lack the documentation proving that. What you need to do is to make an Infopass appointment at your local USCIS office. Take your passport, your green card and your biometrics letter with you. They will look up your file using your A number to verify your status, then will stamp your passport with the I-551 stamp (the 'green card' stamp). This will extend your green card for one year from the date of the appointment. The stamp in your passport will be sufficient to reassure your employer, although he does not technically have the right to determine what documents you submit as proof of your eligibility to work. Still, it will be easier on all concerned if you can show him the I-551 even though you are not obliged to.

If your passport has expired, then also bring with you 2 passport style photographs and USCIS will make an I-94 which will have the I-551 stamp on it and you can carry that in the expired passport as proof of your status.

I never received my NOA letter either and found it was not a problem at all getting the I-551 stamp in my passport. Remember, your status has already been extended when they accepted your I-751 package. You just need to have documentary proof.

You can apply for citizenship now. The citizenship application will force them to make a decision on the Removal of Conditions application.

The only concern I would have with leaving the country while you are waiting for a decision is not whether you can return with the I-551 stamp. The stamp is definitely valid and would allow you re-entry to the US. The concern is if they reach a negative decision while you are out of the country then you would not be able to return to the US and would have few options available about appealing the decision. If you are in the US and get a negative decision, then you do have options to challenge the decision.

You may wish to get your Senator' s office involved as well if you haven't yet. Once you give them authorization to investigate on your behalf they may be able to get you some more information about why the decision is taking so long - and perhaps even 'shake a decision loose' from them.

Definitely consider applying for citizenship, though. You don't need the 10 year green card to do so as long as you do meet the 3 year qualifications - and it sounds like you do.

Yeah, I wouldn't be too surprised. It's like when we call customer service numbers & get 4 different answers from different people.

Passport Control guy proceeded to tell me that it will take at least 6 months to get the new green card. But, I am assuming they add an extension the current greencard anyway, right?


Passport control guy isn't aware that you are filing from a 2 year card that requires a specific removal of conditions form. Passport control guy thinks you are filing to renew a 10 year green card which is a totally different process and the one that is used after you remove your conditions and become a permanent resident - and don't go on to become a citizen. It doesn't have a 90 day window. You can file early and you can file late with the I-90. You have to file during the 90 day window with the I-751.

File in December if that is your plan. As long as USCIS receives the application during that 90 day window prior to the green card expiring you'll be fine. You will receive back a NOA receipt which is a letter acknowledging receipt of the application and including 2 sentences stating that your green card status is extended for one year and is valid for both work and travel. You carry the letter (or a copy of it should be fine) with your green card and they act together as one document.

If, for some reason, you don't receive your NOA, (I didn't), you can make an Infopass appointment and get the I-551 stamp put in your passport that will also extend your status for 1 year. You should receive your approval and 10 year card within that year, although in some cases it can take longer. If, by the time you are eligible to apply for citizenship and want to apply for citizenship but still haven't received the 10 year card approval, you can file for Naturalization anyway, and that will 'force' them to adjudicate the ROC application first.

Just Bob indicated that one of the red flags that does get a second look is submitting an extreme amount of evidence. That being said, the quality of the evidence is ultimately what is important. I too submitted a huge amount of evidence for my ROC mainly as a type of protest :lol: . USCIS took 23 months to approve my green card and approved it 3 weeks prior to our 2nd wedding anniversary, thus necessitating us to go through the ROC 2 years later. So, when it came time to remove conditions we had been married for nearly 4 years - and I sent them evidence for each of those 4 years. I sent four bank account statements from each account and 4 credit card statements from each account (quarterly) for all four years. I sent health statements and bills for each year; car loan payments (also quarterly) for all 4 years; car registration for each year; car maintenance and repair bills in my name for each year; veterinary records for all 5(originally 6) of our cats plus their micro chip registration in both our our names; copies of IRAs and CDs with each other listed as beneficiary or listed as joint owners - for all four years - well, you get the idea. If it had been one year it would not have been that much of a pile; 2 years it would have been very good evidence - but they made me wait four years and so I figured if they had to make me wait four years then they needed to read my evidence covering all four years as well. My ROC was approved without a problem.

So, the evidence you have is good. Think creatively about how you can add to it.

Are you listed as his next of kin on his medicaid information? Is he listed as your emergency contact with your school registration? Do you have a family cell phone plan? Do you take any magazine subscriptions at the same address? Do either of you have any pensions or retirement income where the other is listed as a beneficiary or spouse? You could write your wills and include copies of those in the package. Do you have pets that have a record with a veterinarian showing you as joint owners? Do you have a family membership in places like Costco, Netflix or any such thing? Do you have any correspondence addressed to the two of you from friends or family (include the envelopes as well as the letters) (eg I included copies of letters from my husband's adult daughter and her children addressed to both of us - 1 from each year :lol: ). Affidavits from friends, family and even neighbours in your rental complex are also good.

Keep trying several times a day including early in the morning and around or shortly after midnight when they 'release' the next appointment dates. I am not sure how far in advance they schedule so that is why it may become necessary to go to the office instead and see if you can get an 'emergency' infopass appointment.

Now, you could also try calling the 1-800 line and see if you can get the call escalated to an actual immigration officer instead of the first line person who answers the phone (a call center employee working off of a script). If you can't get the call escalated, see if they are able to find out if there has been a biometrics appointment made yet or a letter issued. You can try explaining to them your problem - make it sound really complicated and detailed - and it might end up being referred to the next level as it won't fit their 'scripted' responses. The second level individual may be able to provide you with your 'biometrics' case number as well so you will have the means to check online while you are away to see if there is any further update on your status.

I would still go the post office route and the infopass route all the same - you want as many failsafes in place as you can arrange.

No, I was transferred to VSC on April 18, not March 18 - and received the notification on April 21. It was an online update that showed up after my biometrics (April 19th). I have never received even the first NOA, let alone a new one. Sorry for the confusion!



Ok - I have to correct this - I went back and reviewed the documents involved - I was transferred on March 18 - not April 18. Yes, I did not have any update to my online files at USCIS to tell me about the transfer until April 21 - probably generated after my biometrics. Sorry for the double confusion - was entertaining company from out of town when I added the information and obviously not paying close enough attention to the details.
