It is very unusual that any moderator needs to take this course of action in the K-1 and other immigration related forums and I find this disturbing. I am issuing private warnings as well, but the public warning is that personal attacks, judgmental posts and off-topic type of comments are not acceptable on Visa Journey. Discuss the contents of the posts - do not engage in back and forth bickering with each other about attitude or rights of what to say or not to say or take personal jabs at other posters. If you have nothing constructive to add to the discussion, then do not participate - it is not up to another reader not to read your post - it is up to you to post appropriately.

I'm with you, as people should be able to rant here. I should know, as I have been one of the biggest ranters, comparing USCIS to George Orwell's 1984, the Soviet Union, Nazi Germany, North Korea, and Iran. Since a very calming person chilled me out (thank you Coconuts), I am trying hard to stay that way and so far succeeding.



well, you may have been ranting Sir and ive read all of them so far and aside from the fact that i enjoyed reading them, i cant deny the fact that you were trying to be helpful by encouraging members to do something aside from just complaining. You have said any possible way one should do or try to make things going or to get their cases be noticed & to get looked at.



I think you can complain and still be supercool! It's admittedly a frustrating process and part of the purpose of this forum is to seek support from others who are in the same situation. I personally get a lot out of reading these posts as I am also at my wits end sometimes during this long, painfull wait. Also I think it's especially hard right now for those of us that filed in the summer when the wait time was 100 days shorter and (maybe ingorantly) hoped we would go down the same path that has now been stretched beyond the horizon.

Supercool- you're still okay with me! I know we've been hearing it a lot lately but hang in there, some day soon in the future we'll be looking back on this. That's what keeps ME going.

Please try to be supportive of each other during this incredibly frustrating process. Vent if you wish but realize that sometimes when you vent about your circumstances you may inadvertently insult someone else in their circumstances.

Immigration is not for the faint of heart or for the impatient.. There are tens of thousands of applications submitted each year to the different service centers of USCIS.; They are not a workforce dedicated to only one type of application or petition, and based upon back logs and other factors there will be times in the year when certain petitions are the priority and other petitions have to wait. USCIS staff work hard but they don't decide what petitions they get to work on each day. The petitions are sent to them and they process them as fast as they can. They process many, many petitions each day and the delays that are experienced have more to do with too few resources and too much work. They aren't moving any slower or faster now than in the past - there are variables within every year and every processing cycle.; The biggest hassle is the lack of transparency - we have no way of knowing what is happening - and it is the not knowing, and the incredible importance of this decision in our lives, that makes this one of the most challenging experiences you will ever face.

So, please try to be considerate of each other and while you are frustrated about your own delay, know that there will be others who have it much worse than you. Those of you who have waited a short time, please know that you will spend many years into the future waiting for a decision of one sort or another from USCIS and the better you learn to deal with it now, the easier you will make it on yourselves - and on those who are also going through this process along with you.

I've been there too - my I-129f took nearly 7 months for approval back in 2003. When we applied we were told on our NOA1 to expect a 120 day wait, so yeah, I fully understand how you feel.

So thank you for being more considerate with each other whether you are venting or responding to someone's vent, whether you are still going through the process or you are lucky enough to be further along in the immigration journey.

The DMV cares because they -like other governmental agencies - have been indoctrinated about the 'evils' of illegal immigrants - and by law are now required to obtain proof of an applicant's legal immigrant status in the US. If the green card is expired, then, according to their logic, the legal status is also expired - unless the applicant has other documents (ie. the extension letter) stating otherwise.

The reason I originally proposed this question is that there were cases where the DMV did not recognize the extension letter as a valid USCIS document and were refusing to renew DL because they did not have acceptable proof of the immigrant's legal presence in the States. Baumdeor is not removing restrictions of her DL - she is renewing her whole Driver's License, and Georgia requires valid proof of legal immigrant status in order to do that. If she didn't receive her extension letter, she will need to get the stamp in her passport extending her permanent residency for a year in order to satisfy that State requirement to get her DL renewed.

(Just noticed that Baumdeor is not in Georgia - many other states now have the same restriction so I am assuming that is the difficulty she had where she lives).

That is good to know - and yes, you're right, the trick is to find one with a brain, hehehe. One question, when was the actual expiry date for your wife's Driver's License? I notice they didn't renew it for a year based on when the green card expires (next week) but rather on the date that you applied, so it is actually for less than the year extension on the Green card.

Let's keep track of each other's process and see what our experiences are. I am heartened to read pars3211's experience as I intend to apply for my new license while my green card is still valid - as long as I get my extension letter in time. The ridiculous thing is that the green card being expired or not shouldn't make a difference if you have the extension letter. WalCruz, hopefully your extension letter will arrive before the greencard and DL expire so you can get them renewed.

Peggy, I think the trick is to bring both the green card before it is expired, along with the extension letter from having filed to remove conditions to get a one year's Driver's License. Hopefully, the 10 year card will be in before the year is up so you can renew your DL with a multi-year one. It looks like we will be on a similar time line for filing to remove conditions as well.

I am just trying to be pro-active so I can stop worrying about having to have an info pass without a DL to get there, or having to fight with Immigration to get the I-551 stamp because the State is 'supposed' to accept the letter. I hope that someone has had success at one of the offices and if so, then I can go to that office to renew my DL.

My green card expires the last week of May and I will be filing to remove conditions on my greencard the last week of February. My driver's license expires on my birthday in June. Has anyone here been successful in obtaining a renewal Georgia Driver's License with the expired green card and the extension letter? If yes, which office did you use? If no, which office did you use, and did you then request the I-551 stamp in your passport from USCIS? (Georgia lists the I-551 stamp but not the extension letter as valid immigration documentation).

I am concerned about not being able to drive if they do not accept the letter and the 10 year card takes its time getting approved. We are out in the suburbs and my husband is out of the house from 7 am to 7 pm so I would have no way to get groceries, go to work, or make appointments. My passport is currently being renewed as it expires in April, and I hope at least to have my new passport before my DL expires in case I am able to get the I-551 stamp.

Your list of inclusions looks good and definitely shows an ongoing  financial and personal relationship between the two of you that covers the period of your marriage.  You shouldn't have any problems.

 

I did go through your list and remove any personal information that was sensitive  due to security concerns or personal concerns such as full names, addresses, names of service providers, etc. as these are not necessary for anyone on this list to have in order to assess your submission, and since anyone can access Visa Journey even if they are not members, you don't want personally identifying information posted on line for security reasons.

Generally, when your situation is straight forward and you feel relatively comfortable handling forms and information, most of our members will say 'do it yourself'.  Having a charge, even while it is a misdemeanor, means your case may no longer be straight forward.  I think it is certainly a sensible idea to have a consultation with an experienced immigration lawyer (check well for both 'experienced' and 'immigration' - you want someone who is competent and has proven it).

 

USCIS is concerned that the immigrant does not become a burden on society.  They require proof that the sponsor - your wife - is financially capable of supporting you.  If you have a current ongoing source of income that will continue after you are in the US as a permanent resident (a job you still do - or you are independently wealthy:-) ), you may be able to self-sponsor.  USCIS does not look at 'potential'; they look at what is 'actually in place'.  Education generally isn't  a significant factor for a family based visa, although if your field of study is in something that might have potential terrorism opportunities (ie biology, physics, chemistry in any advanced degree) you may garner a closer look.    Since your education is in the US, however, that is less likely.

 

Misdemeanors are not as serious as criminal offenses, although domestic abuse is considered an act of moral turpitude which USCIS does not look upon kindly, so this is why I agree it is a good idea to consult with a lawyer who has more experience in your particular circumstances.

We sent in several hundred pages as well - something from every category they suggested except for children (we have none together) and letters of affidavits; we figured we had enough quality documentation that we didn't need those.  It does add up quickly.   It had been 4 years (took 22 months to process my AOS and the the following nearly 24 months of conditional status) since I applied for my green card so I figured if they wanted to make me wait 4 years before granting me permanent status, then they were darn well going to see documents from every one of those 4 years! 

 

 

I submitted full quarterly statements for each year from each of the joint accounts - and we have several. I included full quarterly statements for each year from each jointly held credit card. I included tax transcripts for each year - and in one year we had even been audited by the IRS, so I sent in the audit request and decision addressed to both of us (who knew being audited by the IRS could be a benefit!  Oh - it did go in our favour).  I submitted our wills. I submitted quarterly statements from joint bills paid.  Since I was not on the house title at that time, I highlighted the mortgage payments that came out of our joint checking account each month.  I included proof of household bills and maintenance contracts (eg HVAC, lawn, termite protection, etc.) that I had signed for our property. I included joint proof of insurance and vehicle registrations for both cars - for each year, along with each of our driver's licenses showing us at the same address.  I included each year's health insurance card, plus samples of medical and dental bills/receipts showing coverage for me under his employment related health insurance.  I included his listing me as emergency contact with his employer. I included veterinary records showing joint ownership of our cats; documents listing each other as beneficiaries on each of our various pension plans; flight itineraries showing us travelling together to attend each others family occasions paid for by the same credit card - and supported by photographs showing us at the event with each others families.  I also included examples of my ongoing correspondence between my step-daughter and grand-children calling me Nana Kathryn.  I hope they read each and every single page - I highlighted all of the titles, dates and any relevant information to help them 'find' the supporting information easily - because I felt if they needed 'proof', well by golly, they were going to get proof!  I did include a 'table of contents' listing every thing and broken down into the appropriate categories - financial, household, vehicles, insurance, family, travel, etc.

 

That being said, i would cut down your 'volume' in certain areas such as the bank accounts and credit card statements to show quarterly submissions instead of monthly submissions.  Get your proof in a variety of different areas with samples taken quarterly from your years together, rather than using lots of the same documents.

There should be no problem travelling outside of the US after biometrics for Naturalization either, except that you may miss the interview date.  Naturalization is by far and away the fastest part of the whole immigration process, so depending on when you are travelling and for how long you are travelling you need to have someone who can receive your mail and advise you if you receive an interview date.

The I-551 stamp IS the EXACT same thing as a Green Card.  The official name for the Green Card is Form I-551.  The person you spoke to at the DMV doesn't know what they are talking about.  Definitely ask to see a supervisor.  You may wish to print off this document from the SSA showing what an I-551 form is and what it means in a passport.  https://secure.ssa.g...lnx/0110211025

and bring it with you.  Item 3. clearly defines the I-551 stamp in a passport as being the same thing as the I-551 card.

 

 

You could also let the DMV know that generally someone has either an I-94 meaning they are a non-immigrant or an I-551 meaning they are an immigrant.  They don't have both. An expired I-94 may have the I-551 stamped on it, but it is the I-551 that is valid, not the I-94.  One cannot be a non-immigrant and an immigrant at the same time.

Since you are trying to remove conditions on your marriage, it is vital that you include information that covers the whole span of your marriage - from when you first got married right up to the current date.  One month's worth of documents definitely does not prove that you have a valid marriage - you should provide at least 4 examples of every type of document you sent for each year of your marriage, basically proof from every 'quarter'.  This is the time when 'more' is definitely better because they want to see the continuity of the marriage along with the intermingling of personal, financial and social obligations and commitments.

I would send in several of each of the above covering more than a one month period.  Go  back to when you  set up the account jointly and include a statement from then, then the most recent statement showing you are still using the account.  The same for the utilities and car insurance. What about health insurance?  What about 2013 income tax return - you should have had it filed by now so can include that.  Do you have a  joint credit card?  Any investments together?  Listed as beneficiaries on each others pension information or retirement savings accounts?  You mentioned you had surgery- what about hospital bills showing coverage through joint health insurance?  What about including the joint bank statement showing where you both paid for your share or co-pays for your surgery - in fact, use a highlighter to highlight that amount.  Do you pay your rent by checks?  Again, show a joint bank statement  highlighting that check.  If you both work, then highlight where on the statement both of your employment earnings are deposited.  Who signs the check for the rent?  If you sign it one month and he signs it the next month then get copies of both checks from the bank and send those in, showing you are sharing financial responsibilities.  What about renter's insurance?  You could include that.  If you have any pets you can get a statement from the vet showing the pet in both names.  What about a family plan for phones?  Copies of both of your driver's licenses showing the same address.  You could write your wills listing each other as beneficiary and/or executor/trustee.  Definitely include the marriage certificate (I suspect you did) and perhaps any photos you have from the wedding, even if it was a quiet and civil service.

 

Your job is to convince USCIS that you are a bonafide couple so you need to include as much documentation as it takes. While USCIS may not want to be overwhelmed with a copy of every single bank statement, they also want to have enough information provided that shows beyond a reasonable doubt that you are indeed a couple who is living together, sharing resources, expenses and responsibilities .   It is relatively easy to fake one month of common documentation.  It is a lot harder to fake several months -  or years  - of common documentation.  It is a good idea, if you have it, to show several different examples of shared expenses, resources or responsibilities stretching over time because married people do accumulate this type of documentation. That is a lot harder to fake, so helps reassure the adjudicator that you are indeed a bona fide couple.

Please remember that it is not a good idea to post personally sensitive information such as your full names, your spouses' full names, address, emails and USCIS case numbers. While only members can post on Visa Journey, anyone can read the posts and it is too easy for personal information to be misused. No one else needs to know your personally sensitive information so please use initials or aliases or other characters to indicate numbers for your own safety.

If someone inadvertently does post personally sensitive information like this, please report the post using the report button and either Captain Ewok or I will edit out the information, or a Moderator can remove the whole post. Thanks for looking out for each other. There are already enough concerns during the immigration process that no one needs to worry about identity theft as well.

greenivy, congratulations on your quick approval.  Over my years here I have seen a few cases like this - and during my own visa journey there were a few instances.  Upon investigation, it turns out that when USCIS is training new staff they will often just grab a petition/application from the most recent applications received that haven't yet made it to an adjudicator's desk.  They aren't trying to circumvent the waiting time, just that those are the applications that are just coming up from the mail room and are readily available.  It looks like they are training new adjudicators right now so there are going to be a number of petitions/applications processed quickly, and as we have a large membership here on Visa Journey, it is not surprising that some of these quick approvals will go to our members.

 

Is it fair?  Nope.  Is it frustrating?  Absolutely.  Is there anything you can do about it other than wish the beneficiary of this largess congratulations?  Not likely.  Many people - including me - have complained to USCIS about this over the years, and yet, it still happens.

Actually, the easiest way to get it to either my or Captain Ewok's attention is by using the report button.  That sends it to a 'Report forum' where all of the moderators can see it, and if I am away for a few days and can't attend to it right away, a member of the mod team can at least respond and let you know that there will be a bit of a wait.  That also keeps a nice 'paper trail' so things don't get lost in the shuffle as the report stays open until the issue is addressed.  It really isn't a problem smile.png .

I have removed all of the personally identifying  information from the misdirected mail sent by NVC.  As their misdirecting of this mail is a serious breach of security - and not the first one - I am leaving the general information visible but no names, numbers or anything else that can be used to identify the individuals or the case.  If this turns out to be insufficient I can certainly remove the whole thing.

 

Please do return the original to the sender with the statement that it was sent to you in an envelope addressed to you and that you did not receive the proper contents of the envelope that was addressed to you.  My guess is it went to the individual who should have received this notification.

 

As an aside, years ago when I was going through this process, I received my notification of receipt of my AOS petition in an envelope addressed to me, but in that same envelope was another notification of receipt of a petition addressed to someone totally different.  I wasn't a member of Visa Journey then but what I did instead of sending it back to the sender is I re-addressed it to the original recipient and told them it had been included in my envelope with my notice as well, then mailed it directly to them.  In retrospect, I should probably have returned it to USCIS but figured that might take a lot of time for them to get around to re-mailing it and knowing how important it was to me to get this response, I didn't want them to have to wait any longer than necessary.

 

So, these types of mistakes happen far more often than is comfortable.

 

Also, when you call the 1-800 number and get conflicting information, please remember that you are not talking with an actual immigration officer unless your call has been forwarded by the person answering the phone. The person answering the phone is a low paid, call center employee who has been given a script with answers to the most common questions and the advice to try and fend off all but the most critical calls with a variety of scripted 'excuses'.  Please do not trust the information that is given to you by the ' misinformation' line.  Check it out with our far more knowledgeable members here first before acting on it.

Case numbers have been removed from the original post and the quoting post.  It is never a good idea to post sensitive personal information such as case numbers, full names, addresses, birth dates, etc. as this puts you at risk for identity theft.  While you need to be a member to post on Visa Journey, you don't need to be a member to read Visa Journey so posting sensitive personal information makes that information publicly available.
