Hi Kathryn,

If I get an opportunity to cut the line ahead of a Haitian, another U.S. citizen, or even another VJ member, I am going to do it. And why not? We live in a capitalistic and competitive society where nice guys finish last. Getting anything, anything at all, means that someone else who wanted it is not going to get it. That's the way it is. I did not invent this world, but I have every intention of carving the best life possible for myself and Elena out of it.

I know I am no saint and am content to leave that honor to Mother Teresa. I am not really interested in sainthood anyway.


:) So, I am hearing you say here that it is ok to cut in line of someone else? Like you are accusing the Haitians who have applied for humanitarian visas of doing? That to succeed doing this is a good thing? So, obviously, if this is a good thing and acceptable, you will be happy to congratulate those who were better at jumping ahead of the line than you are because they are showing they can compete more effectively? Forgive me, but I don't believe you. :no: I believe that these rules apply only to you and if someone else treated you the way you say is fair for you to treat them, you would protest up one side of them and down the other. You can't have it both ways - if it is fair for you, it is fair for everyone else. If it isn't fair for anyone else, then it isn't fair for you either.

Something else to consider - it really isn't an either/or situation. There is enough for all. Your success doesn't have to mean someone else's 'failure', nor does someone else's success mean your failure. You really can afford to be generous and supportive in this process. It's not a competition.

Speaking as a moderator who has just read over this thread from beginning to end I find myself rather appalled by some of the heartless, selfish and inconsiderate comments made here about immigrants and other applicants here on Visa Journey. While we all wish this were a perfect world and everything we wanted came to us exactly when we wanted it, it is time to recognize that life is not like that. There are a lot of people in this world all who face their own journeys and challenges - and yours are no more important - or less important - than theirs. You are not 'entitled' to anything in immigration - regardless of what you think; having your foreign born partner immigrate to the US is not a right - it is a benefit you are requesting. The process is a long one and those of you who want instant gratification are in for some very hard times over the next few years of this multiple year process. You may even find that your demanding attitude will become a liability in your relationship - I've seen that happen a number of times here on VJ. Throwing insults at everyone who tries to point this out to you or who is taking a more compassionate approach that includes recognizing that there are others who are waiting as well as many other types of visas being processed is a sure way to make this whole situation harder on yourself, on your partner, on your family, on your colleagues - in fact, harder on everyone in your life - and it won't make anything go faster.

The next person who makes personal attacks or insults at another VJ member in this thread will be thread banned from this thread..

To add another perspective to the 2004 year for filing for K-1 . .the year before in 2003, we filed for a K-1 and it took over 6 months to get the NO2. We were eventually approved after 194 days. Those who filed 2 months before I did seemed to get approved in about 2 to 3 months. Some who filed after I did waited even longer than I did. This too was under Mr. Bush's presidency.

There is an ebb and flow in the processing of paperwork. It has been longer in the past as well as shorter. It has nothing to do with who is in the Presidential office and everything to do with the USCIS workloads at that particular time of year. Things traditionally seem to start going faster about now with the K-1 visas.

My anticipated processing time when I filed was listed at 90 days. Then, the estimated processing time changed to 120 days, and when we reached 120 days, it changed to 180 days. I noticed the following year they even stopped providing an estimated processing time. Generally, I think you can expect an NOA 2 sometime between 2 months to 7 months - and that is all considered to be within normal processing times - depending on the time of year.

It is a violation of TOS to make personal attacks on other VJ members. One such post has been removed along with a second post quoting the removed content. The acceptable part of the 2nd post has been returned to the thread below. You can disagree with the contents of a post but please don't be disagreeable while doing so.

Its simple logic. Either the adjudicator is approving petitions or he is on the phone or in the hall or otherwise "answering" to someone who is running down a Congressional inquiry on a file which he/she happens to have checked out. Congressionals are time sensitive and they have to be responded to.

There is certainly no way that barraging the USCIS with phone calls, congressional inquiries and emails and info-pass appointments will "speed things up" for everyone. If that makes me a "troll" so be it.

As painful as it may be, bring with you copies of your mother's obituary and death certificate. The Consulate may ask why you postponed your interview twice so you can present the certificate and obituary as evidence for the request.

My mother passed away the month my now husband and I became engaged. While she never had a chance to meet him, it made her happy to know that I had met someone and she felt she didn't have to 'worry' about me anymore :) . I'm sure your Mom was happy to know you had found that special someone in your life as well even if she didn't have the chance to meet her.

Right. You don't need the I-130. If you arrive as a K-1 and get married within the 90 days you don't need an I-130 - you file based on your status as a K-1 (approved I-129f petition). If for some reason you don't get married within the 90 days, then you would file an I-130 - a spousal petition - as you can no longer adjust status based on the K-1 status.

So - don't worry about the I-130 - look at the I-485 and what it requires. That is what you will need. Another word of caution - consider filing to adjust status sooner rather than later, preferably before your 90 days expires. The K-1 give you permission to enter the US, get married, and apply to remain in the US; it is the AOS, however, that gives you permission to stay in the US after your marriage. Your status in the US is only valid as long as the I-94 (good for 90 days) that will be stapled in your passport when you arrive until you file to adjust status.

May I remind everyone that Visa Journey is an experiential forum where we do our best to support those who are going through their own immigration journeys and coming up against unexpected challenges. If you have nothing constructive to add to the discussion, then it is better if you do not participate in this discussion. It is inappropriate to suggest someone leave Visa Journey because of the problem they have encountered, regardless of the origin of the problem.

Sure - first of all, it's on the head of the USCitizen to file a complete petition.
He didn't do that, he messed it up the first time, messed it up the 2nd time with the RFE submittal also.

Filing an appeal takes time, and does it really present the opportunity to clearly state, "Sorry, I messed up this petition, not submit everything I was supposed to, was some mistake, please try to re-adjudicate based on current casefile plus the things I send you" ??

The petition was denied at USCIS because of submittal error by the USCitizen, not by procedural error by USCIS. USCIS did their job. There is no adverse reality on the USCitizen for this denial, at this level, at USCIS.

Refiling, on the other hand, is a better track to take, IMO.
This gives the USCitizen an opportunity to make a complete petition file. Will it force the opening of the prior case? Absolutely !! IMO, then, and only then, will the submittal errors be compared by an adjudicator, and the adjudicator will see that the USCitizen plainly flubbed up the first time; not to conceal or hide anything, resulting in any misrepresentation, but (in a straightforward manner) he put together a complete file, one that will have a positive outcome. Please not think 'it was denied once, it will be denied again' as the USCitizen petitioner flubbed up the first petition - he has a unique chance NOW to submit a complete petition.

IMO, to file an appeal will be a waste of time and money - a new, complete petition is the right track to take.

If you object to someone else's signature then report it to the moderators and we will review it. If it is offensive or too large we will ask the owner to adjust the signature. If it is not offensive or too large and you object to it, then you have the option to block signatures. You do not have the option to attack someone because you disagree with their signature.

As a moderator I find the signature in question busy and full but not large enough to be a problem. Further discussion of this issue here is inappropriate and anyone continuing on this line of inquiry will be thread banned from participating in this thread for 2 weeks.

Thanks for the kind words Kathryn.
Rationally I know this part is almost over and that NOA-2's are imminent, but emotionally the roller coaster ride sucks.

Since beginning this process I've bought a new home and through the magic of the internet have gotten Fresy's opinons as to redorating and remodeling. Now that project is done and the house is all done - ready for her to put a woman's touch on it. The new place is nice but it won't be a home until the woman I love lives in it.

I hope everyone had a great Thanksgiving. Even though Fresy wasn't here today, we talked on the phone and throughout the day I've felt her presence here with me. My 9 year old son and I had turkey and all the fixings and he said the nicest thing during dinner...

Usually he and I put the Christmas tree up after dinner on Thanksgiving. Today he said "Dad, let's wait until Fresy comes to put up the tree". I said "Son, I'm not sure if Fresy will be here before Christmas". My kiddo is amazing. He said: "Dad, whenever she comes it will be Christmas and we'll put up the tree then".

I love that kid!

I know it is tough this year - but next year all of this waiting will be behind you and you will be happily married and living your life together enjoying your first Thanksgiving dinner as a married couple.

This waiting is definitely the hardest part - but it does pass, and the pain of the waiting fades away when you are finally together. So, perhaps it might help to know it is only a little bit more time to go and you can be thankful that you found each other even though you don't even live in the same country. You're getting there, and every day brings you closer to your dream of being together in the US. Hang on, you're almost there :).

We are going to get married by law as a small just us plus witnesses thing, start adjusting the status, and then a few months later have the big event with family and friends. I'm the first girl in my family to get married and he's the first one in his to get married so we are going to have a decent sized wedding since our family and friends are veryyyyy important to us and we want to show them a good time :) my dad is paying for it, but my budget is around 7,000. Fortunately I have a network of awesome talented friends, and my fiance and I are both creative, so we can do a LOT of stuff ourselves. I totally don't think wedding planning detracts at all from the visa process, in fact it keeps me sane during this long wait!

I'm one of those people that have been planning my wedding since high school, however the plan I made back them is totally different for our wedding theme now. Ben and I both love steampunk, so our wedding will be steampunk/civil war theme as I also live in VA. I'm currently writing a novel based on the story behind our wedding theme, where instead of it being the north and south, its australia and america who were at war, and our wedding is the peace treaty :) The clothes will all be civil war era styled and the reception will be a Victorian era tea time. CHeap is good, what matters most is being married, but Ben and I love to express ourselves artistically in everything we do so we just couldn't have a generic basic wedding ;D


Now, This is delightful! I love SteamPunk - it is so incredibly creative and 'fun' - and you are making your wedding so uniquely your own in a way that means something to you - and you are having fun with it :yes: . Bravo!


When I was younger I thought I would love to have a reproduction Regency style wedding (as a War of 1812 re-enactor, it fit). However, by the time Joe and I met the re-enactment wedding just didn't fit anymore and we wanted something simple but meaningful for the two of us. I had planned to make my dress - not a wedding dress but something that felt right for me - and while looking for fabric in a discount fabric warehouse, totally unexpectedly came across 'my dress'. A designer had left some dresses at a fabric store that went out of business and when they were not able to locate her, the dresses and inventory ended up being bought by the warehouse. Out of curiosity, I looked at them and they really were lovely - and all one of a kind. Then, I found mine. It was so perfect that everyone who saw it said it looked like it had been designed for me. It also fit perfectly and was on sale at $75 (original price was over $880)! so, I bought it even though we had only just started the K-1 process.

When it came time for our wedding, everything else fell perfectly into place just like the dress. Through a mutual friend we had met socially a Judge who we both liked. A few weeks later, we asked if he would marry us and he said he was happy to do so. He didn't charge a fee for marrying people, but did ask them to make a donation to a charity of their choice in lieu.

We thought that getting married outside in some sort of a gazebo in a park setting would be really nice but were having trouble finding the right location. While visiting a heritage antebellum mansion site north of where we live, we toured their heritage gardens - and found the perfect spot - a lovely little garden arbor over the entrance to the gardens. We asked the site if they allowed weddings and explained that we wanted something very small with only a handful of people out in the garden and it would be outside of their regular operating hours. They said they didn't normally do that but would ask their Board. We gave them the details of our request, along with the name of the Judge who would be doing the ceremony - and the woman smiled. It turns out he was one of their long term supporters and benefactors. A week or so later, we got our permission as long as we were willing to make a donation to the site in exchange. We were obviously happy to do so and made a donation both to the site for the wedding and then increased the amount to cover the donation requested by the Judge. We figured that was appropriate.

So,on the hottest day of the year to date, in the shade of the garden arbor, with a good friend standing with me, her husband, her daughter and my father as witnesses we were married. I had made the bouquets we carried and my Dad, who was a hobby photographer, took the photos. We then walked to a little bakery cafe in the village with everyone waving and honking as we went by - and with no reservations, walked in to have a lovely after noon tea to celebrate. We then headed back to our house for dinner which Joe and I had already prepared before hand.

Our expenses were my dress, the marriage license, the donation to the historic site, afternoon tea for 7, a home cooked dinner for 6 and the flowers we carried. I made both bouquets with silk flowers from a local craft store, then to mine added two lovely beaded flowers a friend had made for me, and real lilies. My Dad took the real lilies back home with him to Canada and placed them on my Mom's grave and my bouquet is in a vase on display in the living room. It couldn't have been any nicer if we had spent a fortune - and we loved it.

If you wish to use your native language you must post in the Regional forums. The Immigration forums are for everyone's information and as English is the language in common for all, all posts are supposed to be in English only so everyone can participate.

Would the two posters above please provide English translations for their comments posted in Tagalog and restrict any further comments outside of the Regional forums to English only. Thank you.

I have removed your case number. I know you are hoping an officer will see it and take pity on you, but it is more likely someone who will want to cause you harm will see it and act instead. If such an individual is out there and reads your request, he/she can send you a PM and ask for your number.

You may wish to try contacting one of your Senators or Congressman and explain your situation to him/her and ask if there is anything they can do to help, even if only finding out the reason for the delay.

Good luck. I know good things are worth waiting for, but it is nicer for the wait to be sooner rather than later
