First, Congratulations on your marriage :) .

Your husband will start the process of moving you and your son to the US by filing a form I-130 for each of you which is a petition to the US government requesting permission for you and your son to become immigrants. The first part of the process takes place in the US and the second part of the process will take place in Chile where you live. The visa you want is a CR-1 visa (spousal visa). There is a lot of good information at the top of this forum, as well as in the Guides at the top of every page. You will find reading the other posts in this forum very useful as the people posting in this forum are from many different countries and are going through the same process you are. They can help you and your husband with advice and information.

You may also want to visit the Latin America Regional forum http://www.visajourn...-the-caribbean/ as you will find other people who are coming from the same part of the world as you are there and you can write in your own language in that forum. They can also give you an idea of how long it takes to come from Chile to the US - it varies from country to country.

Things are not always black and white when it comes to the IRS. As this document below indicates there are indeed legally accepted times when someone married to a foreign spouse can file as unmarried. This is one situation; there may well be others:

Ideally, you need to arrange for the cat to travel in the cabin with whomever it travels - either you or your husband. Travelling in cargo is incredibly hard on cats and many cats can die on an extended cargo flight. Some airlines even refuse to take them and those that do also refuse to take them at certain times of year due to weather extremes (too hot or too cold - because there is always the possibility of an extended waiting time when the plane is on the ground and the animal is confined in the unheated/unairconditioned cargo hold). For the safety of the cat it needs to be on a flight travelling in the cabin in a carrier that will fit under the seat. A cat should NOT be tranquilized - it makes it difficult for them to adjust to the flight and can interfere with their ability to breathe during the flight.

The cat can travel with either of you, but in the cat's best interest, it should fly with the one who is best able to accommodate the cat in the cabin and during a flight on the shortest time en route as you can arrange. Custom delays may make the travel time longer for the cat so it may be better travelling with you. You also need to check with the airlines to see what is required for the cat - some restrict flights to only one or two animals per flight and there may be others on board, and as I said, some don't transport animals at all. Regardless, you should not be considering any other option except the cat travelling as one of your carry-on bags and fitting under the seat in front of you during the flight. It won't be happy but it will be a lot happier and safer than in the cargo hold.

The cat will need proof of recent rabies shots and for the cats best interest it should be up to date on its medical vaccinations. Some airlines have a type of passport they insist on an animal having and there are time limits during which the cat must have been medically inspected (no later than and no earlier than dates). I know a number of VJ members have brought their pets to the US so hopefully one of them will speak up and add to this discussion. I travelled with 6 cats two days by car and that was an experience all on its own.

The only times I have ever read about someone having to hand over their x-ray is when someone is coming in from a country that has many cases of active TB such as the Philippines. There is a medical expert available at disembarkation for some of these flights and they have sometimes requested seeing medical proof of negative TB. These cases are few and far between and I suspect there would have to be some sort of reason or suspicion to make this request. (The one case that comes to mind did involve a young woman who had TB when she entered - she was held and not allowed to enter the US. I don't know what her medical reports had said).

You will not require your x-ray to enter coming from the UK. There will be no reason to suspect you of having active TB since the country your flight originates from does not have active TB rampant in the community. This would be the only reason anyone would request your x-ray. Regardless, the actual printed out hard copy report that states you do not have TB is inside the medical results contained within that brown envelope that you are not to open. Carry that brown envelope with you - not in checked luggage - and you will hand it over to immigration when you activate (I know - that isn't the right word but it explains what happens) the visa in your passport. That is all that is required. The x-rays are your souvenir of your medical :) .

I actually handed my x-ray over to my new family doctor to keep on file for comparison purposes. It forms a baseline of what my lungs looked like when I arrived.

Don't panic about this - you will be fine. If your friend ever finds the CD he can then mail it to you - either before or after your flight to the US.

Probably because people doing such styupid tings is uncommon, even though I wonder why because I marvel at the stupidity required to print such important things with water soluble ink, and not include any warning, even I have both a lazer and ink sublimation printer that not only print with waterproof ink but the ink sublimation one prints with the quality of a professional photo. I don;t understand how they can do this, it's like they do it on purpose. What professional body uses inkjet in 2011?

Now you are going overboard. You can continue to enjoy your misery if that is what you want or you can start to move forward. You are not the only one that this has happened to, guaranteed. There is a solution. It is found by contacting the Consulate.

I would take the additional visa fee part to mean covering the costs of re-printing - not re-doing the visa. Realistically, I would be very surprised if it were even as high as $100 - still much cheaper than doing the process over again - especially when it ISN"T NECESSARY. :). Really - vent a little bit more, get it out of your system and then start working to make things right - like you did for the medical.

Kathryn it's not possible either to contact the consulate, they only have a really expensive phoneine where you ring and themn they give you a code for an email that bounces back a message saying "we'll respond in 3-5 days" well I can't last that long. I literally can't.

Regardless of what happens 3 to 5 days are going to pass anyway whether you do something or do nothing.

You have a choice. You can continue to wail and complain that things are hopeless and that there is nothing you can do so you don't even try - - in which case, I can guarantee you will not be completing your visa journey.

OR - you can do something constructive to resolve the problem. Instead of thinking of all of the things that you can't do - think of the things that you can do. If you can't phone them, then email them. Go in person and sit on their door step and ask an officer if he will take in a letter explaining your problem.

Even if the number is expensive it is probably cheaper than any of the other options you are considering. If it takes 3 to 5 days those 3 to 5 days are going to pass regardless. You might as well get the process started and then the time will pass and you will get an appointment to get the visa replaced. Sure, it may add some extra time but that is time invested in your future. You can choose to invest your time in your future living here in the US with your husband - or you can invest your time in doing nothing and staying separated.

Your other option if your flight is scheduled in the next few days is to proceed to the airport and let them decide if they will allow you to board with the visa and the damage that it has. If they do, then you have no problem. If they don't, then you are just back to where you are right now - in need of making an expensive phone call to get an email code so you can send in an explanation of what happened and ask for an appointment to bring in the damaged visa, your passport and whatever else is necessary.

This is for the Ghaunzou Consulate but in response to a question about an immigrant visa being damaged (in this case during canceling an old passport)they respond:

Note: if, when canceling your old passport, your national passport authority has inadvertently damaged the U.S. immigrant visa, that visa is no longer valid and cannot be used for travel to the U.S. In such event, please bring your passport and visa package to the Consulate any day, Monday through Wednesday, at 2:00 p.m., with an explanation letter in both Chinese and English. Although it should be no problem to reissuue your visa, payment of an additional visa application fee may be required.

So, if one Consulate has a process in order to re-issue a damaged immigrant visa, you can be assured others do as well. As it notes here, you need to include an explanation of how the damage happened and you may be required to pay an additional fee. You do not have to re-do the whole process.

The links are to NON-IMMIGRANT visas - you don't have a non-immigrant visa. You have an immigrant visa. An L-1 visa is a type of employment visa and an L-2 is for a dependent of an L-1. The second link discusses non-immigrant visas only.

Contact the consulate. You may need to bring in passport type photographs. Be sure to tell them the type of visa that you were issued. The process for a non-immigrant visa is vastly different and much shorter than for an immigrant visa. Good luck.

There have been cases before yours where something has happened to a visa - one person even washed his passport with the visa in it by accident. It will invalidate the visa that is in the passport only - it does not invalidate the process. You do not have to do it all over again from the beginning. You just need to contact the Consulate - explain that the visa has had water spilled on it and what can you do about it. Ask if you can come in and if they can officially cancel that visa and re-issue one that isn't damaged. The documentation has been damaged only - not the approval for the process that resulted in the visa.

You've come this far, you have climbed over many hurdles - not one is going to steal your victory away from underneath you at the last minute. You are fine. You are upset because this does mean so much to you and it is so easy to be afraid of losing what is important. Think how well you handled the medical situation. You can handle this just as effectively.

So, take a big breath, contact the Consulate, explain what has happened and ask them when you can bring back the passport to have the damaged visa replaced.

You'll be fine. Honest. :)

From what you describe it sounds like you will need to use a co-sponsor (your parents) as your US based income does not meet the minimum income requirements. It sucks, but immigration does require you to have US sourced income. Your parents would fill out the I-864 and provide all of the documentation requested to verify income requirements and you would also fill out the I-864.

I'm going to move your post from the Canada Regional Forum to the CR-1/IR-1 forum as this is the visa you and your wife are pursuing and there will be other members there who can give you more specific details on how to use a co-sponsor.

Why not go to the post office and notify them of the error? Ask to speak to the Postmaster or Postmistress and explain your situation. They will know what employee has that route to deliver. Ask them to instruct that employee (or the sorting department if that is also appropriate) not to list it as undeliverable but ask them if they will 'hold' any mail sent to that address and then notify you so you can go in and pick it up with proper identification. I am not sure if your Post office will do this but some of the smaller Post Offices tend to be more sympathetic to situations like this and may be willing to work 'with you' on this matter. It is at least worth a try. In the meantime, be sure to change your address to the correct address with USCIS.
