The hardest part of the IR-1/CR-1 process for most Canadian/American couples resident in Canada is proving that the US spouse is domiciled in the US. She/he must submit evidence that proves their residency in the US or proves that they are in the process of re-establishing US residency.  Often it means that the couple is separated while the US partner returns to the US and the Canadian partner waits until the visa is approved.

 

 

All marriages go through shaky times.  If you are separated or know you are separating then it would be fraud to continue on the visa process knowing that you will not be married to your partner in the near future.  If you have not decided to separate permanently, then you can continue with the process with the hopes that any differences you have will be resolved by the time the visa is granted.

 

One thing to remember - it is not easy living in the US as a newcomer.  Even if you have a job and source of income right away, you will still find yourself very dependent on your American spouse who, as an American, is granted greater rights and opportunities than you as a non-American are.  If your marriage is rocky and falls apart after you do move to the US, you may find that the new life you thought you would enjoy in the US is out of reach.   If you think your marriage may not make it, then please consider that you are probably much better off staying in Canada.

Yes,  your husband can sponsor you to the US.  He should file his US tax returns even if he doesn't owe anything or pay any taxes as US citizens are supposed to file returns regardless of where they live.  As he has no income, it won't cause him any problems.  The main issues you will face are: 1) finding a joint sponsor who will complete and sign the Financial affidavit of support that is a requirement of immigrating to the US since your husband does not have US income to do this on his own, and b) proving or re-establishing US domicile.  The process otherwise is the same CR-1/IR-1 process that would be used if he were still physically resident in the US.  There is a great link in the Canada Regional Forum about how to prove domicile - as well as a lot of other Canadian-American couples, many of whom have gone through the experience you are now considering.  Here is a link to the forum - the domicile topic is the first thread pinned at the top:  http://www.visajourn...orum/93-canada/

First, since it is a dangerous idea to post personally identifying information on this very public website, it is a good idea to hide or remove names, case numbers, addresses or any such personally sensitive information from a document before you post it here. Just taping over a piece of paper is often sufficient.  I have removed your attachment because it did contain such information.

 

That being said, when I read over the letter I saw that it is a basic form letter.  They are not requesting you to send in more 'undifferentiated' type of evidence listed on the list.  The important part of the letter is that very last paragraph immediately below the list of the type of evidence that may be submitted in support of an I-130.  This tells you what they want:

 

"A review of form I-130 indicates that the photographs of yourself and the beneficiary were not submitted with Form I-130, therefore, please submit two passport style color photographs of yourself and the beneficiary taken within 30 days of the date of this notice".

 

So, basically, all they are requesting are the two photographs which are one of the required attachments to go with the I-130.  Yes, it is very possible for them to have lost or misplaced the photographs, so just arrange for each of you to get these done (again), make a photocopy of the request letter, then return the photographs with the request letter to the contact information provided with the address.  They are looking at your file right now and it is just set aside until they receive your photographs.  Once they have those, they will continue with the processing of your file.

 

Good luck:-) and try not to worry.  I suspect everything is going to be just fine once they get the photographs.

If you and she have not already filed for her green card, she is already at risk of deportation.  Her marriage to you allows her to adjust her status from her now expired visitor visa to become a permanent resident - but is she is not married to you, or if the marriage does not appear to be a valid marriage, then she would not be granted a green card.

 

Most petitions to become permanent residents from a non-family based visa (which means the visa used to enter the country, not necessarily the sponsorship) require a personal interview before an immigration adjudicator with both parties present.  This is to ensure that the couple is indeed a couple and eligible to adjust status based upon marriage to a US citizen.

 

If your wife has left your family home and is talking about divorce and you have not yet started any of the immigration paperwork it will be an uphill battle to get her approval.    If you have started the immigration paperwork and it is withdrawn due to  divorce then she will not receive a green card and is deportable once that decision is made.  Whether or not she will be deported will actually depend more on her and her circumstances - is she law-abiding, etc. or is she drawing the attention of government authorities to her presence. 

 

If you have started the paperwork and are still together, then her approval will depend a lot upon the interview and whatever evidence you are able to submit that you are a valid couple who married for love and not for a green card.  If it is approved, then she will get a 2 year conditional green card and must apply within the 90 day window before that card expires to have the conditional status removed in order to receive a 10 year card, providing evidence of the validity of your marriage during those 2 years.  If it is not approved, then she is required to leave the US and if she does not, becomes deportable.  Again, whether or not she is deported will depend upon her circumstances.

 

I know you didn't ask for relationship advice but I did want to say that if you love her and you believe she loves you and your marriage is going through the usual struggles first year cross-cultural relationships go through, then you would both probably benefit from seeking some sort of professional marriage counseling and then decide whether or not to pursue her green card.  If she does want out of the marriage or it appears that she got married only to stay in the US then please give serious consideration to letting her go and save yourself the time and the money (the AOS petition is not cheap!) and do not proceed with any immigration paperwork, even though you love her.

Your brother should notify the Social Security Administration that he is now a US citizen so they can up date their records. If he has sponsored his wife while he was a green card holder, he also needs to notify USCIS using the case number for his sponsorship petition that he is now a citizen. There is a long waiting period for spouses of green card holders but his wife is eligible for immediate processing now that he is a citizen. I don't know the exact procedure to notify them but perhaps someone else will.

I have type 1 diabetes and was concerned that this would cause a problem on my K-1 medical. The doctor explained that while it is noted on the medical it is not one of the conditions that would cause problems such as a sexually transmitted disease or one that is communicable to a large group of people such as tuberculosis. A bout with depression 10 years ago should not raise any alarms. Mention it to the doctor because you can't lie on immigration forms, but don't worry about it.

You may wish to ask this question in the Regional Forum for the Middle East/North Africa. I don't know if it is different for your Consulate or not, but I believe the doctor should have all of the forms he needs and you do not have to bring any. I know that for my medical I did have to bring my file number and my passport for identification. I also brought the instruction sheet I had received that advised me about getting the medical in case they needed that. I did bring my own personal medical records showing what vaccinations I had received or childhood illnesses I had had so the doctor could use that information to fill out his form. You may wish to bring any documents you have about your immunizations with you. Hopefully, someone more familiar with your Consulate's requirements will respond, but I am pretty sure you do not need to bring any forms.

I can post our experiences crossing the border while engaged: I lived in Ontario and would drive to Detroit to fly to Atlanta. My fiance would fly to Detroit and I would drive to the airport and pick him up then we would both cross the border together both into Canada and back into the US for his return flight. I was always asked where I was going and responded I was going to the airport to catch or meet a flight to/from Atlanta. I was never asked "is your trip for business or pleasure' but 'what is the purpose of your trip'. I stated I was visiting my fiance for the weekend or week or however long I was going and will be returning Sunday night (or picking him up at the airport). I then offered proof of my flight to and from Atlanta. Most times I was waved through but twice I was sent to secondary. I had a package that had my most up to date paychecks, bills, insurance papers, vet bills for the cats, outstanding health claim, proof of employment, etc., whatever I could bring to show ongoing financial ties and commitments in Canada. I also included a complete copy of the K-1 application. In both times I was allowed to proceed. Another time I was pulled into secondary was when I was going to meet my fiance and pick him up at the airport. I didn't have my full package with me, however, the information was in their computer from the previous times and they cautioned me that even for going to the airport to pick him up I should be prepared to prove my intentions. They told me to stop in at the US immigration side of the border with my fiance before heading back into Canada to 'prove' I was telling the truth, which you can believe we did. My fiance always answered the Canadian immigration authorities honestly saying he was coming to visit me and when asked what our relationship was, he replied that we were engaged. He never had problems with the Canadian border.

I'll end with a cute story. When I finally moved to the States and activated my K-1 visa, my then fiance flew into Detroit, rented a van in which to transport my cats and some of the things not going with the movers, and then drove into Canada. At the border he was asked where he was going and the purpose of his visit. He told them he was going to pick up his fiancee and we were then moving me down to the States and getting married. The border guard got a big smile, waved him through and told him "Go on, Brother! Go, on! Far be it from me to interfere with another man's misery!"

Actually, CR1 - Conditional Resident - means that you are already considered a permanent resident of the US with 'conditions' in place because you were approved before you and your spouse were married for 2 years. You and your spouse will need to file to remove the conditions 1 year 9 months to 2 years after your CR1 approval date. Once you enter the US you can start to work as soon as you apply for your social security number. Your green card should arrive in the mail atyour US address once you enter the US. So, again congratulations and much happiness as you start your new life in the US.

I have found it difficult for anyone to help in regards to help my wife and I merge our finances. The bank wants her to be there in person, the apartment complex needs her to be there in person.... Obviously that isn't going to happen until she gets here..


Bank of America allowed my now husband then fiance to add my name to his accounts and to issue a credit card for me on his account while I was still in Canada. I didn't have a SSN until several weeks after I moved to the States, 6 months after my name was added to the account. Statements were, of course, mailed to his US address.

The immigrant is allowed to 'import' their personal and household belongings duty free as long as they have owned them for more than a year at the time of import. The list itemizes what is being imported and includes serial numbers of electronics and such. If you are not importing your personal or household belongings you don't need an inventory sheet to show US Customs.

People receive a notification on their on-line status that they were mailed an RFE. I don't know if they also get an email or not. You can register at www.uscis.gov, list your file number (on your NOA1) and you can then follow along on when your file is looked at ('touched') or if something happens to your file, like an RFE. unfortunately, you have to wait until you receive the actual paper document before you know what the RFE is for.

Be very careful about this. Your wife and daughter are not allowed to enter the US on visitors' visas and then apply to adjust status to remain in the country. That is considered visa fraud and will lead to serious repercussions - banning and the possibility of never being allowed to live in the US legally.

The proper path is to apply for the I-130 to obtain the IR-1 visa - an immigrant visa- for your wife and daughter. This will involve processing outside of the US at the Consulate, and when completed, they will be issued their 'green cards'. Another option involves filing the I-130 and the I-129f to request a K-3 visa which will allow your wife and daughter to enter the US AND then apply to adjust status (AOS I-485) from within the country - legally. What you are proposing is illegal.

Inspection means that your wife and child legally present themselves at the US border, their documentation is inspected by a border official, and they are given permission to enter the US. This will involve receiving an I-94 entrance/exit visa that is stapled in their passports and includes the date by which they must leave the country.

If your wife and child were already present in the US on a dual intent visa - or if your wife had entered the US unmarried and with no plans of marriage - then met you and got married in the US - she would then be allowed to adjust her status from within the US without having to leave the country. Entering the country already married without the proper immigration visas (K-3 or CR-1/IR-1) and trying to stay in the country, however, is not a legal option.

Basically, yes.

If your green card application (AOS or CR-I) is approved and you have been married for less than two years, the green card will be a conditional green card valid for 2 years. Starting 90 days before the expiry date on the green card you file an I-751 application to remove the conditions. The condition is that the card is valid for 2 years and that by the end of the 2 year time period you need to provide evidence that your marriage is a valid relationship and not in place for immigration purposes. The two years 'start' from the date of the green card, not the date of the marriage.

If you have been married for more than two year when the green card is approved, the green card will be 'unconditional' and valid for 10 years and there will be no need to file to remove conditions.
