Roadblock!!! Tried to call the Vancouver consulate and eventually spoke to a human. He had never heard of a DCF. What he did say really worries us. He told us that once we have filed the I130, I will not be permitted to enter the US and the processing time could be as long as nine months. His suggestion was that I come in as a non immigrant and then apply for permanent status once there. I do not believe he was located in Vancouver and he said the only way to get into the Consulate is to have an appointment. OK. We have everything together other than the I864, so how (other than mailing this to Chicago) do we get this done?

This is in the DCF forum here on Visa Journey and is about doing a Direct Consular Filing in Canada Basically,it means your wife files the I-130 petition with a consulate in Canada rather than through the service center in the US. She is allowed to do this as she has been legally living in Canada for more than 6 months. This will save you some processing time but you will still have to expect a wait of a number of months.

The other dangerous advice you received is his suggestion that you enter the US as a visitor and then apply to adjust status to become a permanent resident while in the US. What he told you to do is illegal and is considered visa fraud! Do NOT do that! You are not allowed to use a visa issued for one purpose- a visitor - with the intent of using it for a different purpose- to adjust status. USCIS views this as an attempt to bypass the legal immigration route and depending on the circumstances can lead to deportation and a ban that can extend up to life. So - don't do that! The staff who answers phones for USCIS and in this case the Consulate are notorious for giving wrong information.

The other wrong information was telling you that when the I-130 is filed you are not allowed to enter the US. You can enter the US as a visitor although it will be up to the border authority each and every time you enter to decide whether or not they will allow you into the US. As an intending immigrant they are vested in making sure you don't try to bypass the proper immigration process - like coming in as a visitor and applying for a green card like the person on the phone told you to do! So, in order to visit the US during this process you need to maintain strong ties to Canada and have proof of those ties that you can present to the border as evidence. Those ties include property ownership, a residence in Canada, a job, ongoing financial liabilities in Canada and things like this. Planning to retire to Florida and having a house in Florida already does show immigrant intent so you will need to overcome that presumed immigrant intent 'for that visit'.

Yes, the only way for a non-American to visit the Consulate is with an appointment. A US citizen is allowed to visit the Consulate but if it is for immigration related purposes for a non-citizen they too need to go through the process. They can get access to consular services that are available to US citizens but they can't get walk-in immigration services.

There is a lot of information and reading you need to do right now before you really start the process. It is a time-consuming one, mainly because of the backlog for scheduling interviews at the Montreal Consulate - and yes, you do need an interview. You will also need an immigration medical that can only be done by one of the approved Panel physicians (located in Toronto, Montreal and Vancouver) as well as police record checks (Canada wide name search to show you have no criminal record) - and if you do have any sort of a record then you need to have a fingerprint check done. Your wife also needs to address the Affidavit of Support as she is sponsoring you as her husband to come and live in the United States.

The form involved is I-864 and you do need to read that over as well as the instructions to determine where your financial situations fit. What you will end up with by the end of this process is a green card which means you are a permanent resident of the US and allowed to work and live in the US. The card will need to be renewed every 10 years, although 3 years after getting permanent residence status you are allowed to apply for US citizenship as the spouse of a US citizen (Canada recognizes dual citizenship so it will have no impact on your Canadian citizenship).

If you wish to change your name and identification as a means to bypass the current information US immigration has on you - no, you cannot do this. Not only would that be considered immigration fraud which is illegal and would result in a permanent ban from you ever being allowed in to the US, it also wouldn't work. There are many security checks all the way through the immigration process. You have to provide legal documents and personal history - and it needs to be consistent. You can change your name if you wish, but you must disclose your previous names. If you fail to do so, that is considered misrepresentation and also results in a lifetime ban from entry to the US.

If your current relationship isn't working, then file for divorce and move on with your life. If you end up with a new relationship with another US citizen and the two of you wish to get married and live in the US together, then you would start the immigration process all over again from the beginning - but with the same name and passport and information. Will they ask questions about this current relationship? Yes - and you need to be prepared to answer them.

If your sole intent on being involved with a US citizen is as a means to get to the US, then trying to hide that fact behind a new identity, will not make it happen. Immigration fraud is immigration fraud and will be uncovered during the security investigations. If your relationship is valid and you only want to be with your American partner - and it doesn't matter in what country that is - then there is no reason for a new identity and you will be able to gather the evidence and history that shows this is a valid relationship.

It was unsolicited advice and unrelated to the questions the OP asked. In addition, the language you used was very judgmental. The OP is already happily married and wanting to sponsor his wife to the US, so telling him to forget about his wife so he can get an education and then return to the Philippines and have some fun later is very inappropriate.

To the OP - you've received some good advice here from some of our more experienced members. I'm glad that you have found this site so useful - it is because so many of us have been where you are - trying to find the answers in a maze of government administrivia that confuses more than it enlightens.

I agree that you should take things one step at a time, however, do be aware of the future steps you will be facing to complete the immigration process. It doesn't end after your wife and child (daughter? hmm, I almost wrote that instead of child) arrive in the US. If your marriage is less than 2 years old when your wife arrives in the US (and it most likely will be) your wife will receive a 2 year conditional green card. The condition, basically, is that 90 days before that 2 year card expires you and your wife will have to submit another petition to immigration proving that your marriage is a real one and not a marriage of convenience to allow the immigrant to come to the US. So, start collecting documentation now for your wife's visa interview, and then when she arrives, keep collecting it for the next 2 years. It will make the Removal of Conditions process much easier.

Remember, you don't need to worry about that now, just be aware that this will be the next stage after your wife's arrival.:)

Follow up from both sides. Contact your representative or Senator with the tracking information and have them investigate whether USCIS did or did not mail the card as USPS shows it was not received.

Also contact your PostMaster and explain that USCIS says that the card was mailed even though USPS does not show it being picked up. The reason I suggest this is I have had the exact same thing happen. I ordered something in the mail. After several weeks it hadn't arrived. I checked the tracking number and it said USPS had issued the tracking number for the delivery and were awaiting pick up. I called USPS who said that they had never received the item and were waiting for it. I called the company who said that not only did USPS have it, but that they personally delivered it to the sorting station themselves and handed it in, and that they have had a lot of problems with USPS failing to record the proper transaction.

I got back to USPS and told them what the company had told me. USPS continued to claim they didn't have it and the company continued to claim that USPS did have it. Finally, the company re-shipped the item at no charge since I had never received it. A week later I received the reshipped item. Two weeks after that, the original shipped item - which USPS had indeed received - arrived. The tracking number still showed the same information from when I first checked it - that it was waiting for pick up. It had taken 6 weeks to arrive and was definitely not tracked in the system.

So, advise your postmaster that you want them to check and put in writing that the post office never received this document from USCIS. Then, with the help of your representative, take this statement that USPS never received the item to USCIS and submit with the I-90 requesting the replacement green card. Coming with your representative's assistance, it may indeed get you the green card.

The sad thing is that both of these scenarios happen far more often than is reasonable, yet neither side accepts any responsibility for their failures and the recipient is left dealing with the consequences.

Please DO NOT start new threads to ask essentially the same questions. You will not get different answers. People did offer useful advice in your other thread. Normally, I would merge the two threads together but I am just going to link this one with the other one as they are both very cumbersome with all of the questions. If you are having this much problem with the do it yourself approach, you may find it useful, even if it is more expensive, to hire an immigration lawyer to take care of the paperwork for you.

Yes, the I-551 stamp they placed in her passport at the POE (even if it was Toronto) is proof of her legal right to live and work in the US. She just needs to bring the passport and advise her interviewer that the green card is on its way. She can also apply in person for her SSN at the SSA instead of waiting for the card. At least she can see if it has been issued yet.

Anyone who not a Canadian wishing to live in Canada needs to be approved for Temporary or Permanent Residence and have legal immigration documentation issued by Canadian Immigration and Citizenship. Canada offers Temporary residence for student and work visas both of which have stringent requirements. Permanent residence is based upon a point system which is also pretty stringent. Visiting Canada is allowed, but you are not allowed to live in Canada as a visitor nor would you be allowed to access the US Consulate for immigration processes unless you are legally resident in Canada.
