Your wife will need to be a joint account holder at the bank before you can add her name to the checks. She needs to go in person with you to the bank and put a signature sample on file with the bank. With her name on the check it means that she can write a check as well and she can't write a check unless she is also listed on the account. If you want to get her added before she arrives to the US you will need to talk to your bank to find out if they will do that and if so, what they will require. I do know that she can initially be added to a joint account without a SSN at the Bank of America (we did that - all I used was my passport and my Canadian Driver's License) but the bank does require her SSN as soon as she gets it. If your bank won't add her to your account then you won't be able to add her name to your cheques. You may be able to add her as a joint holder to your credit card account before she arrives in the US and use that for evidence that you have shared financial assets and responsibilities. My husband added me to our American Express account while we were stating waiting for our K-1 visa and before we were even married.

I would proceed based on the assumption that you have abandoned your green card. Basically - you have - and you yourself know this.. I would proceed with the DCF process and be up front - tell the Consulate that you had a green card and left 3 years ago, which effectively cancelled the green card. Tell them that you now wish to return to the US and know you need to re-apply for a new green card. Send in a copy of your green card and use the same alien numbers that you originally had, but keep the card until you are asked to surrender it - either before via mail or at the interview.

Definitely DO NOT try to cross into the US and pretend that you never left. To do so would be misrepresentation and that has serious consequences. There are too many opportunities to be caught in a lie and you don't want that to happen. For instance, if you filed taxes - as your US partner would have had to do regardless of where he lived - the address on the return with the IRS will be out of the country - not just for one year but for 3 years. There is too great of a chance that your abandonment will be discovered - even if it was not until you had to renew your green card. A finding of misrepresentation can be made at any time now or in the future and would lead not only to deportation but most likely a permanent ban. For the amount of time it takes to go through the correct process, recognizing that you moved away from the US for 3 years and now wish to return, it is not worth the ramifications of being found out if you pretend you never left.

You can certainly have all the rest of the information available and ready to go when requested. DCFs generally tend to be processed fairly quickly.

LotofPatience - mend your attitude. Personal attacks and aggressive posts such as you have been making are a violation of the Terms of Service for Visa Journey. As well, you are giving out inaccurate information. I have removed a number of your posts that are categorically wrong as well as a post by another poster that suggests the OP commits Visa Fraud.

The OP stated from the beginning that they were intending to pursue the CR-1 visa and asking if it was legal to visit the US during the process. Yes - it is legal but it depends upon the border guard at the POE if they will allow you into the country or not.

YOU introduced the subject of coming to the US and applying for AOS while on a visitor's visa after entering WITH INTENT. You introduced the topic of Visa Fraud and offered this as an option to the OP. This is also a violation of the Terms of Service for Visa Journey.

The OP never made any such statement of intent. You have since attacked others who entered the US on either a visitors visa or on the Visa Waiver Programme WITHOUT INTENT and accused them of visa fraud because they took advantage of the legal option to adjust status from within the US if there was no intent upon entry to remain in the US. You are also incorrect about appealing a denial of an AOS from a VWP applicant - if it is denied, there is no right of appeal under immigration law and that individual must leave the US and pursue a CR-1 visa.

Please take the time to become more familiar with the real legalities involved and do not put words into people's posts and then attack them for the concept that you introduced.

Unfortunately, the signatures have to be originals. Submitting a copy of a signature will only delay the process even more until you are able to get a signature. You can fax the document to her or she can download it and complete it herself, then you/she will have to arrange the physical delivery of the original signed form to you so it can be submitted to USCIS.

You may wish to have her complete several copies and mail them back to you all separately so that there is the good chance of at least one getting through. In spite of the expense, you may wish to use a courier service as they may be more reliable than the mail.

Welcome to Visa Journey.

First, I've moved your post from the Citizenship forum to the CR-1 forum as it is asking about how to come to the US, not about how to become a US citizen (which happens much later in the immigration process :) ).

Second, the process you are going to go through is for a CR/IR-1 visa which means a visa for a spouse. CR-1 is the visa you get if you have been married less than 2 years when it is approved and IR-1 is the visa you get if you have been married more than 2 years when you are approved. Both process exactly the same way. You will find Guides attached at the top of this forum as well as at the top of Visa Journey itself. You can read those for more information, and then ask questions here for things you don't understand or would like clarified.

Basically, your husband starts the process. He files an I-130 petition requesting permission for a family member to apply to become a permanent resident. He files it at the filing address appropriate for where he lives in the US (that information is with the form and its instructions). There are a number of other documents that he needs to send in with that form. Once it is received by USCIS he will receive a receipt notice (we refer to it as NOA1 - Notice of Action 1). When the I-130 petition is approved he will receive another NOA along with a request to submit more forms, more money and more evidence. The instructions will come to him in the mail. Part of this process will include him providing information about his financial status (he needs to earn at least 125% of the poverty line for a family of your size) known as an Affidavit of Support, along with the paperwork requesting permanent residence status for you. Once that is received and processed the whole file is sent to the American Consulate in Montreal (yep - Montreal is the only Consulate that processes spousal visas).. They will schedule you for an interview in Montreal. In the meantime you will need to get an immigration medical done by an approved doctor as well as a Canada wide security check from the RCMP or your local police. At the interview the immigration officer will go over all of the information, and hopefully, grant you the CR-1/IR-1 visa. It will be physically attached into your passport. When you cross the border into the US your visa and passport will be stamped and you will be an official permanent resident. Your green card will come in the mail shortly afterwards. You can find all of the forms you need at the USCIS website: http://www.uscis.gov . VIsa Journey will be very useful in letting you make sure you have all of the forms you need.

While I can see a huge benefit of the USCIS folks spending some time here to understand the other side of waiting for the process, I also think it could have some drawbacks if this is in fact true. Because if you are trashing USCIS about your interactions with them, and have posted extensively about your case particulars, it would not be a far fetch of the imagination for you to encounter some ill feelings from the people you have trashed. No one likes to get their feelings hurt even government employees.

Based on the caseloads at some consulates and USCIS posts, we all should hope they are not spending too much time here because it would be taking time away from working on cases.


There were a fair number of posts about this situation. Here is the thread where it was first discussed - http://www.visajourn..._1#entry3473054 start at post # 17 and then read through - you will see a number of people who are told by the Assistant Director at the Consulate who interviews them that he knows who they are from VJ and that he reads VJ. Post #54 is also quite interesting, as is #61, #76, etc.

Then, one of the Canadian VJers wrote this open letter to the Montreal Consulate and posted it in the Canada forum, knowing that the staff (the individual named is the one who identified VJers by name at their interviews) read VJ : http://www.visajourn...1#entry3657775

(Actually, reading the regional forums for the individuals who are going through those Consulates does add additional information that the Consular officials can use to help adjudicate a case. Personally, I think being identified with VJ by a Consular official adds credibility to your situation as it is unlikely someone pursuing a fraudulent visa would become involved in a day to day forum about their visa process.)

It is extremely unlikely a US woman marrying a non-US man who chooses to keep her maiden name instead of taking his name would generate any type of an RFE. There are many cultures where a woman does not take her husband's name upon marrying as well as many women who choose not to take her husband's name. It has no bearing upon the validity of a marriage. It doesn't make the marriage any more or less real. It is solely a matter of personal choice.

While I am the immigrant I chose not to take my husband's last name and it has never been an issue anywhere in this whole process. No one official has ever 'questioned' the validity of our relationship because I chose to keep my own name, not at the AOS, not at the Removal of Conditions and not at Naturalization. If a wife taking a husband's name is an indication of a 'real' marriage, then surely it would be even more important that the immigrant wife take her American husband's name. The thing is, it isn't important at all and is totally irrelevant to whether or not a couple has a real marriage.

If the US citizen wife wishes to keep her own name then there is no need for her to change any of her identification except to change her status from single to married. If she does wish to take her husband's name, then just as if she were marrying another American she would change her identification to reflect her new name. It is as simple as that and really is not an immigration issue.

But wouldn't it affect the intent of visitor visa which is visiting the country and not marrying a USC? Since, we will plan to get married within a week of her arrival. It will be obvious that she came to US to get married even though there is no overstay and CR1 visa will be the route.


Why would it affect the intent of a visitor's visa? She is still a visitor. A visitor can be married to a US citizen and can marry a US citizen while visiting the US. She can hold both the intent of being a visitor and getting married to a US citizen at the same time. The intent that Immigration has a problem with isn't getting married to a US citizen while on a visitor's visa - it is intending to remain in the US after getting married to the US citizen. That means she would be using a visa meant for one purpose - to visit - as a means to bypass the proper immigration process for her real intent - to immigrate. Your fiancee is not intending to immigrate on this visit so she is not violating any of the terms of her visitor's visa. There is nothing in the visitor's visa to say someone cannot get married while in the US. It is only a problem if she intends to remain in the US on that visit and apply to adjust her status from visitor to permanent resident. She is still a visitor and will leave the US when her visit is over to pursue the correct visa to enter the US as an immigrant.

They will not frown on a marriage that took place while your fiancee is visiting - as long as she doesn't try to stay in the US on that same visit and adjust status from within the US. She is entering as a visitor with the intent of leaving again afterwards. While she is visiting, you two will be getting married which will allow you to start the proper immigration paperwork for her to come to the US to live with you. She should plan to travel with lots of evidence of her ties to her home country to show that she is not intending to stay on this visit - letter from her employer stating time expected to be away and date of expected return to work, financial responsibility for where she lives (lease, mortgage, utilities bills, etc.) and a return ticket. Once you have filed the CR-1 application she should also carry a copy of that with her to show that you are indeed following the appropriate immigration process. She should be able to visit you however, it will be up to the border guard on each and every visit whether she will be allowed into the country or not. The more 'evidence' she can present to calm their concerns that she might stay in the US, the easier it will be for them to say 'enjoy your visit'.

It appears that the OP is requesting information about the Affidavit of Support as they are pursuing a spousal visa. I'm also moving this to the CR-1 forum as the K-3 visa is no longer a viable option.
