Having trouble understanding what they want after it asks for current address. It then says the year I was 16 and right after that it for from date. Don't know what they want.

You must provide all addresses lived at since the age of 16, starting with the current and working back in time, including the 'to' and 'from' dates for each.

Hi everyone,

I am currently filling out the I-864 for my immigrant husband. We both live in Chile and I will move to the U.S. To live with my father in only a few weeks. I have two questions:

How should I include my father's income since mine will not meet requirements? should I include my father in our household in part 5 and complete the I-864a? or should I use my father as a joint sponsor?

In part 4, do I need to use the same address as my fathers if he is completing the I-864a? Or should I include my current address in chile?

Any advice on this would be extremely helpful, thanks!







Hello,

 

You as the sponsor need to fill out an I864 for sure.  Since you don't have any US income (it appears), you need a joint sponsor, whom you've identified will be your father.

 

Your father has to fill out an I-864 as well.  Question is, are you claimed on his taxes as a dependent?  If so, he also includes you as a household member as well as your husband and any other family members (his wife or other children).  If not, he doesn't have to include you in that total.

 

Your address should be your Chilean address if you're living there.

I would suggest choosing the form is in connection with an application for #2. status as a PR.

 

And I think it would be just fine to have your parents bring the signed form to you when they return from Mexico, and you fill it in as previously suggested.

 

I don't know about the rest, but I bet English would be best.

I'm just confirming these steps to make sure I'm not missing anything, or that I should be calling someone to confirm things. 

This is the last correspondence we had 

"Your case has been accepted and routed to the USCIS Nebraska Service Center for processing. Within 7-10 days by standard mail you will receive your official Receipt Notice (Form I-797) with your Receipt Number ******** With the official Receipt Notice (Form I-797) you may visit www.uscis.gov where you can check the status of your case using My Case Status . . ."

That means we are in NOA1 waiting to get to NOA2, correct? 
Is there anything I should be doing in the mean time? Should I have called someone??

You don't need to call for a case number until you're starting the NVC stage, and by then you'll likely have read up on things and know that it currently takes at least a few weeks after NOA2 before you bother calling for a case number :luv:


oh!  and be sure to change your timeline to say Montreal, not Armenia, hehe... it's a common error! :oops:

Hopefully the process will gain speed compared to last year's backlog of petitions and you'll get through it all in less than a year, but it's rather unpredictable.  Be prepared that you'll need to establish proof that you intend to resume living in the US - can search 'proof of domicile' in the search bar and read the threads and advice here on VJ, although you won't need that proof until you're at the NVC (National Visa Center) stage ie the 2nd stage.

 

First just worry about getting through USCIS with the I-130 petition.

My wife overseas is the beneficiary of my IR1/CR1 petition.  She is a practicing doctor who has not cleared any of the neccessary certifications (USMLE etc.) to practice in the US.

 

How would I go about answering the following questions on the DS260:

 

Are you a graduate of a foreign medical school seeking to perform medical services in the United States but have not yet passed the National Board of Medical Examiners examination or its equivalent? Yes No

 

Are you a health care worker seeking to perform such work in the United States but have not yet received certification from the Commission on Graduates of Foreign Nursing Schools Yes No

 

 

I am a little confused here since she would want to perform medical services here after a while and after she clears her exams when she is living with me.

 

Input would be appreciated.

I would say it's one or the other.

yes we are using the form 1040. However our lawyer insisted that we still use the adjusted gross income on all three years... there is a 1000 US dollar difference between the two. Still we have a debate on this, since NVC still insists we make adjustments on this part.... :(

 

And you should ask your lawyer to read the instructions on the form... :yes:  :lol:

we received an email from nvc for I864 AFFIDAVIT OF support part 13.a.1 is incorrect  We had it corrected with the help ofan accountant and received another letter saying the same single error.  but was adviced to bring the corrected form during interview.  What do you think NVC is asking since its the same correction being asked for that was already corrected

 

On years you filed taxes using the 1040, use the amount of total income.

On years you filed the 1040EZ, use the adjusted gross income.  

 

Perhaps one year you filed with a different 1040 but the accountant didn't think to place the corresponding income.

So you're talking about whether your uncle's wife would need to provide proof of citizenship if she files the I864a.... I know this as I've just answered another question for you in the other thread:) 

 

I don't actually see on the instructions or I864a form where it states clearly about citizenship, but obviously the 'sponsor' using that form has to have filed US taxes... and I do know that on the instructions for the I864 it clearly states proof is required for joint and substitute sponsors... on page 4, number 5 of the instructions.

As for the 2nd question, the husband and wife wouldn't have to prove relationship, as it shows via their tax forms.  As I understand it, that evidence is only required when a petitioner/ original sponsor is using a household/ family member's income via an I864a, so they must prove relationship ties.  They just both need proof of US status as per the instructions.

So my uncle is going to be a joint sponsor, He makes all the money in the house hold so hes the primary sponsor filing I-864.  He files married joint filing on his taxes. I was thinking his wife has to provide a I-864a to prove how much she makes since its Married Joint Filing.  He doesn't want to involve his wife so hes telling me he can provide W2's for his tax returns. Would that be sufficient to leave his wife out of the whole picture even though he files joint taxes.

 

First of all, the primary sponsor is always the petitioner.  They must fill out an I864.

 

The joint sponsor, your uncle fills out an I864, and you're essentially correct that he can provide the transcripts (or complete tax return) and must include W2's if his wife is not filling out an I864a.

Well these documents were already sent and she already had an Interview, they asked her for a second joint sponsor and a written letter from me saying I don't make money. They never asked her for me to fill out a I-864. So i guess I will. My dad had made enough but because we had a baby and I was out of a job he considered us 3 instead of just my wife even though I gave citizenship to my daughter.  

 

As for my uncle, like I said on the fiiling joint tax return it shows him as the primary Social Security and the tax return for him and his wife is 400,000.  Even if it says 400,000 does his wife still need to file a I-864A even if the money is enough and she doesn't work but they just file jointly?

 

As already mentioned above, your joint sponsor's wife doesn't HAVE to fill out the 864a, but it is ideal.  If she doesn't, then the joint sponsor must at least include the W2 along with the transcripts.

Hi!

 

I met the love of my life who is a Canadian.  I am an American citizen.  I have been back and forth residing in Canada and the Unites States since 2008.  We married in 2012.  My husband has been the soul provider for us.  We now want to move to the US where my family is.  I have been doing some research about the process and I do not meet the requirements to sponsor him since I have not been working and do not have income.  Is there any way around this?  My father is willing to joint sponsor him but he is retired.  He get paid double what the requirement is for sponsoring someone but he does not file taxes and I read that they need a W2 to prove income.  Are there any other documents that they will accept as proof of income?  We have our own money and have enough saved up to support ourselves for 3 months once we are able to live in the US.  

 

Also, we were married in Canada and we will be filing from Canada.  How do I start the process?

If you have filed 'Married Filing Jointly' and are not using your spouse's information, then it's still wise to include a W2 so they can see what portion of the total is your own.

It's certainly helpful and an example of her EP (electronic processing) cover letter is included on the wiki.  Just change the words a bit to indicate they are original documents rather than copies of :)

Let me understand you clearly here.. in their forms, is their current individual income the same as... 

 

This is where you lose me.  Perhaps it's better for me to just say their current individual income is whatever they will make in 2014, his amount in his form, and her amount in her form.

This point is stated within the above statements, but I'd like to draw attention back to one thing, as it's my understanding that the tax transcripts don't show what the W2 does, ie who made what amount, they just show the total.

 

So, if you only use 'her' as the joint sponsor, and do not file an I864a for her husband, make certain that the W2 is included to differentiate what is made by whom, as I'm sure I've heard here of people getting a checklist for leaving out the W2 in this scenario.

 

We had our joint sponsor AND her husband fill in the 864 and 864a respectively.  (Even though she makes more than enough money, but it was suggested as the ideal situation here on VJ when I was preparing/learning, so we just went with that :) )

My wife is immigrating from Thailand, but we need advice for the affidavit of support.

 

Questions:

  • Can my wife be sponsored by my brother-in-law instead of me since I have been out of the country for 4 years and I am currently unemployed? Even if I get a job soon, it probably won't pay enough to met the mark since I am just starting out again.

as far as i know, the sponsor of an alien relative must be a US citizen, but doesnt have to be related to the petitioner. 

 

I hope everything works out just fine for yall, and they at least could expedite your case.  :thumbs:

 

The spouse who is the petitioner must ALWAYS fill out the I-864.  

 

The person you are referring to will be called the joint sponsor.

 

The joint sponsor also fills out the I-864 in your case.  Be sure to read the instructions carefully:

Ok I understand the Ir1 process up until it gets to the NVC. Who submits the documents to them?  The petitioner or benificiary?  Because it seems like everything needed for the IV package has to do with the benificiary, but if they're outside of the states how can they send it to them? And should the original documents be with the petitioner or benificiary? I'm the petitioner and so confused at this point.

You may already understand this point too, but just to be clear, when folks were saying you're pursuing a CR-1, that was a small error in terms, as you are pursuing the IR-1 (because you've been married for over 2 years).  

 

There is no difference in the process for you to worry about at all.  Simply stated, those who are married less than 2 years will have more paperwork to do in the future ;)

Sorry if this is a stupid question. 

 

My Canadian husband and I are living IN Canada. We're going to be moving to Utah once his visa is issued,  My most recent place of residence in the USA was Virginia. But that was a year ago. 

 

Where are we supposed to send our application?  (DCF isnt' available for us)

Also,  On the USCIS website. . . it gives 2 different ways to apply for a green card for your spouse. 

 

Inside the US or Outside obviously. . . .but for "outside" it says Direct Consular filing. . . and obviously we can't do that. So what do I do?

Have you figured it all out yet?  Just do what the USCIS site states for the I 130 instructions.  

Unfortunately we don't get the DCF option in Canada anymore, so we file to the US like most others.

As you get closer to the NVC stage, you'll have gathered up the proof required for re-establishing domicile.  Search this site for information on that.

 

Also, pls change your timeline to indicate Montreal rather than Armenia :luv:

Good morning my priority date was March 3 2014 - on july 9 Th I received notice that my case was transferred to california from nebaraska  is this a good thing or a bad thing? do i have to re wait 5 months now? this whole process is nerve wracking - also noone may know the question to this but my husband got into a minor car accident on august 17th of 2013 and he said that the police said he wont have an approval from the day he went to court which was april of 2014 so will we now be denied?

 

has anyone else from nebraska have been transferred

 

Could you please change your timeline as it states Armenia... and are you a CR1/IR1 applicant? or a K1? etc.  Our advice can be improved by understanding these details:)  

Generally California processes much more quickly than Nebraska, so that could be a good thing!

 

I agree with the above poster, a minor car accident isn't likely a criminal act, but if there are court documents/ proceedings you can obtain from his court attendance, that would likely be good to have available.

The GC payment happens after the interview.  I received the information on how to proceed someone at the interview.

The paperwork I received stated to pay the visa fee prior to entry to the US, but I've heard of some people here paying it afterwards.  The sooner you pay, the sooner the GC will arrive though:)

Not quite the same, but for me I had to wait for the medical results to be sent to the consulate since it was done the day before the interview, and about 3 business days after the medical results were received by them via courier, I got the final approval(email that stated the visa had been issued and being mailed). Similar to you on interview day, they had said all was fine pending them receiving that.

Finally got all our documents together and mailed off our K-1 Petition today!

I have been reading post that people are saying that it is costing them $30-40 to send certified & registered mail. I just got back from the post office and it was $10.45. Am hoping I did things right. Only thing I can see that would be a possibility for the difference in price is that my petition would not fit in a regular manila envelope, so I sent it in a Priority mail one. Priority mail being a flat rate instead of being weigh could do that I am thinking. I hope so... If that is the case, it is awesome! Another $20-30 saved just on how it is mailed.

Now the waiting starts. :)

You will now pay for you the fiancé visa application fee there in Philippines. Fee is U.S. $240 / P10,243. Send a little extra as it is bases on current exchange rate. Cash payment at any Bank of the Philippine Island (BPI) branch. Just go into the branch nearest to her and tell them you are paying for K-1 Visa application fee. They will know what to give her to fill out. If she is unsure on what to fill out ask the staff there to help her fill it out.

When filling out the online applicant or speaking to the USEM agent. You will need the receipt number on the receipt from BPI.

USEM will give her some dates to choose from. Once she selects a date. Appointment is set!! You can reschedule but they will push you further in the month or next month.

Your fiancé will need to prepare for her Medical at St. Luke's Medical Center Extension Clinic (SLEC)

If your fiancé passes her Medical They will give her a date to come back to SLEC and get her results and medical will CD of chest X-ray

On the interview date she will have a time most likely 6:00 - 6:30 AM to be at the Manila USEM. She needs to have all her required documents in hand, appointment letter, and passport. Again refer to K1/K2 Interview Preparation Instructions as for what is needed. Make sure she has all papers organized. It makes for a easier processing at the embassy and shows seriousness. Buy a organizer with tabs. Label the tabs for each requirement.

Once at the embassy, she will fall in line. They will take her appointment letter, check passport and assign her a number. At the embassy they don't allow any electronic devices.

You are not allowed to enter the U.S. Embassy/Consulate while carrying any of the following items:

battery-operated or electronic devices such as mobile phones, digital diaries, digital watches, pagers, cameras, audio/video cassettes, compact discs, MP3s, floppy disks, laptops, or portable music players
large shoulder bags/purses - only bags that can be carried by hand will be permitted
bags such as travel bags, backpacks, briefcases, suitcases, leather, cloth bags, and zip folders - you can only carry plastic bags containing application-related papers
food items (refreshments are available for purchase in the waiting area)
sealed envelopes or packages
cigarettes, cigars, match boxes, lighters
sharp objects such as scissors, pen knives or nail files
weapons or explosive materials of any kind


If she needs her cell phone they will ask her to check it in at the security section. They will give her a card so she can retrieve at the end of interview.

They will give her a form to fill out on how to deliver the passport with visa. Either it's deliver to her home address or she can go pick it up at a 2GO location.

Once inside, she will need to look on the board for her number to be called. She will go to the window and ask for her paperwork. Then she will be finger printed. They will tell her to wait again. Once her number flashes again, she will have her first interview with Filipino consulate. They will ask her a few questions and check and process her documents. (MAKE SURE SHE HAS ALL REQUIRED DOCUMENTS). If all is in order she answered all questions to satisfaction. She will then wait again for her number to flash again on the board. Then she will have her final interviewer US consulate. Consulate will process her paperwork and ask a few questions. If all is in order she will be told to wait again for her number to flash. Then she will go to the 2GO window where they will take her passport. They will give her a receipt (make sure to ask if they do not give one).

That's it for the USEM interview. You can now breathe a little easier.

Now if there is a problem. They will give a 221g form and state what the issue is. Now you will need to get them whatever they want in order to proceed. Now this is pull a long process when your in Admin Review. Look on VJ for Admin Review stories.

It will take 5 - 10 days for 2GO to receive visa and passport from USEM.

Once you have received your passport with visa. Now its time for CFO (Commission on Filipinos Overseas). Now CFO seminar can be done in the beginning before obtaining the visa and passport. You will need to return to get the CFO sticker and Stamp in the passport after receiving the visa passport upon approval and delivery.

CFO is to inform fipinos about the country they are traveling to. The Good, Bad and Ugly. They will ask her some questions and issue her CFO sticker and seminar certificate.

Original and photocopy of Passport;
Original and photocopy of visa;
Original and photocopy of Immigrant Data Summary for US bound/ Confirmation of Permanent Residence for Canada bound/ Certification of Eligibility (for Japan-bound);
Original CFO guidance and counseling certificate;
Duly completed emigrant registration form; and
Payment of the authorized registration fee.

You will pay a fee totaling PhP 650.00. The PhP 250.00 is paid as counseling fee at SMEF-COW or PRISM while the PhP 400.00 is for registration at the CFO.



If you fiancee is under 25 yrs. She will need a written consent letter from her parents or a parent will need to be there with her to give consent of there child's marriage.

> If you are between the ages of 21-24, CFO may require you to submit a letter of parental advice to marry.

> If you are between the ages of 18-20, CFO may require you to submit a letter of parental consent to marry.

Marriage applicants who are age 18 to 21 must have parental consent in writing, those age 21 to 25 must have written parental advice (a written indication that the parents are aware of the couple's intent to marry). The revised Family Code of the Philippines, which took effect on August 4, 1988, prohibits marriage for individuals below the age of 18.

The quote above is from the section where they are talking about getting married in the Philippines. However, the CFO has been known to require parental advice or parental consent from K-1ers.

It's all on the Consular's discretion whether they require consent from a parent or guardian.

You will need to pay a NAIA International Departure Fee: PHP 550 mandatory at NAIA.

Also when you book your flight. Check to see if all airport taxes are include in the price of the ticket. If not, your fiancee will need to pay the " Filipino Travel Tax " of P1,620.

took up a short course in Interior Design. And time flies fast if I'm keeping myself busy w/doing something I love. :D and if time comes I move to US.. I plan to look for a job that is in the field of Design, if its destined to be:D anyhow, just keep yourself busy w/sumthin'.. So u wont be able to think much of the long petition wait.. patience is a virtue.. You'll then realize that time really is fast :D
