I intend to visit my fiancee in the Philippines in late January/ early February if my fiancee isn't already here by then. Our NOA2 is expected in January/February so it would appear very unlikely she could be here in America by then. There's no problem with the USC going to visit the beneficiary before petition is approved is there? It would seem as if it would be recommended since the more evidence you have of meeting in person, the easier your interview at the embassy would be.


That's fine, no problem. will also be visiting my fiance in the Philippines early February.. and expecting our NOA2 around that time as well :D

Perhaps you've done a lot more reading on the I864 than I have, but as a Canadian also awaiting approval (we applied with an I-130 for CR1/IR1, and then followed up with the I-129F hoping a possible K3 could get me to my husband faster), I have a few thoughts.

   

If you're applying for a K3, you won't need the I-864 until you're in the US and apply for Adjustment of Status, so isn't that a long ways away?  Or at least my understanding is you'll only need the I-134 affidavit to (if you can) apply for the K3.

My other understanding is that we, the beneficiaries, don't fill out the I864, although I also have assets that he will refer to/and I'll provide the documents.  So would it be correct to say that your wife is the sponsor and she fills out the I864 for both you and your daughter?

 

Forgive me for just tossing these thoughts out there and not answering your original question about taxation issues, but perhaps someone else is wondering the same things I am.  Considering the complexity of immigration issues, dissecting each case helps us all learn a bit more.

  I would believe that the reference to not making travel plans is regarding the post interview time frame only, and not to make your plans to immigrate until the approval is final.

  Visiting the US during immigration is possible, and since you've read the threads, I don't need to repeat the importance of having some strong documents for ties to Canada.

  On my recent trip to see my US husband, I had the paperwork for ties to Canada, and was surprised to find the Border officer ask me if I had any of the Immigration paperwork/ proof with me.... I laughed and said it never occurred to me, and that all the forums talk about ties to Canada.  I had no trouble getting through to the US, but just a tip that they could request proof that the immigration process is underway also.

I applied for both the CR1/IR1 and the K3, although perhaps the K3 could slow things down (as suggested by others since it may take time for Immigration to send the I-129F to meet up with the I-130 petition).  I do not know for certain that it's completely obsolete, but it doesn't sound promising from what I've read here on VJ.

 

Trips across the border while awaiting the CR1/IR1 are possible, as stated above, and be sure to have documents proving ties to Canada - many threads discuss this.  I took my last pay stub, recent annual professional license renewal receipt, bills, house title, and a note from my employer.  No one viewed them but we did chat about my immigration.  I received the full 6 months stamp on entering.  And I had a return airfare ticket as well, rather than an open ended one.

I'm not clear on details, but I suppose if you were to obtain a working visa, and then adjust status while working in the US, at least you could be together.

If it's anything like Canada, there are certain occupations for which working visas are achievable faster than other lines of work. 

 

Unfortunately, I don't know the system nor the timelines for such visas in the US, but perhaps it's an option.

We filed our 129f on receipt of the i797 for the 130,  we're June filers. The 130 is in Overland Park and the 129 is in Lees Summit. Have heard nothing since NOA1s. Will be interesting to see if the 129 is approved first. Either way, at this stage we'll take the quickest route, even if the K3 costs more. We just want to be together!! 

 

Our situation is nearly identical, although we're July filers. 

 

The I-130 is in Overland Park, the I-129F in Lee Summit.

Hello Everybody,

 

I am getting a little nervous about submitting my AOS documents. I quit my job last year and moved to Canada thinking we were going to make it our home. However we both agreed the states would be a better fit.

 

I moved back to LA in June and had a job from July to November but was laid off. I just started another job and am getting ready to submit our papers for the I-864. I have my date of hire as 12/31/13 and might not have a pay stub yet or only 1 when I submit.

 

My income is not enough for the poverty guidelines but my assets make it right there just over.. I am worried the officer might want a joint sponsor. I have my 2010,11,12  tax returns which show me well over the limit. for those years. Also my 2013 work and assets are well over also.

 

But it says current income and I am making less money now.

 

I dont want to use my father as  a joint sponsor. I read that I can use my spouse, the intending immigrant and her assets to help satisfy the income requirement? Is this right? Has anyone done this? Just curious what other people have done to navigate this hurdle. If I include my wifes savings I should be well over.

Hi boardercrosser, we're in a similar situation.  I'm the beneficiary, and we had also started out with my husband coming to Canada and getting his PR here before deciding to head south instead.  He also moved back to the US just before we filed, to get a job and set up our future 'home'. 

 

His income is not enough/ he doesn't currently have a job (only 2 months in late 2013), nor did he have income in ~ half of 2011, and all of 2012 while he was here and awaiting immigration to Canada, so his situation sounds even a little more financially dire than yours. 

 

According to the information and instructions on the I-864, it appears my assets should work.  ie the house which I will sell right before I leave Canada and the monies I have in the bank or invested.  At least the instructions outline how to use these amounts on the form.

 

I'd be lying if I said I wasn't still nervous that it could be an issue, but as long as I obtain print-outs of my financial savings and investments, and the Property Statement +/or an Appraisal statement on the value of my home, that should suffice.

 

I believe I read somewhere here on VJ a few months back, that someone was required at the interview to readdress the issue of the spouse not having enough to meet the requirements, and they used their documentation of their Canadian assets to satisfy Immigration.

 

It would be most helpful and appreciated if you could update this thread, or me! with what you decide and how it goes for you.

We're considering having his sister be a joint sponsor just to alleviate the nerves thoughunsure.png

Yeah, your lawyer is soooo wrong, there is no fee.  But the other posters are right that since you're now already transferred to the California service center, there is nothing the I-129F will do to benefit your situation.

 

The only thing that might work for you now is to put in for an expedite on the grounds you stated, if they meet criteria.  Search the site here for more info on putting forth an expedite request, or else others here could chime in with better information on that.

Relax a little and you'll avoid making mistakes and losing all your hair...luv.gif    For instance, the instructions clearly state that the G-325A is done for 'both' petitioner and beneficiary.  You can do this!

 

Great questions, and just remember to read all of the instructions that come with the forms, as well as read the guides here on VJ at the top, and you'll be fine.

 

I would assume they mean your birth parent, not your step-dad.  This is all about identity, and your birth father will be the one on your birth certificate, so using a different father name will only cause confusion down the road.  You will eventually need the long form birth certificate, so be sure you have one on hand for stage 2 at NVC.  I hope you also got the long form wedding certificate as you'll need that in stage 2 as well.

 

As far as 'ongoing marital union', if you have any purchases or bills, or pensions/beneficiary information with your spouse listed, that's valuable too.  Be sure to include phone bills, some emails, Skype screenshots, or FB, even envelopes from mailings between you has been suggested.  But it sounds like you have a fairly good accumulation of supporting items, especially the travel related info.

 

The only thing 'original' sent along with this I-130 will be the forms themselves, dated and signed, and the photos that accompany the G-325A's.  Of course you can send some original photographs, or printed ones if you like, but I photocopied mine.

 

Once you get this sent off, start reading the forums especially some of threads in the months prior to you under the CR1/IR1 section, the NVC monthly thread (currently the action is in the December thread but will be restarted when January arrives), the Canadian forum section, and every tab at the top will likely teach you more... you'll have plenty of time to read up while you wait for the first stage of approval ie NOA2.

2- I would also mention the affidavit in the cover letter so they can find it easily.  Others can chime in on what they think about writing a letter.. but also, why not?smile.png  I guess it depends on whether you feel the affidavit explains the mistake well enough. 

And I didn't realize there was an address on a marriage certificate.. hmm, makes me feel I'll go peek at mine in a minuteidea9dv.gif

Right at the beginning of Part 5 it states 'Do not count anyone twice' in bold letters:)  The instruction also specify this clearly.

Perhaps you put 2 under number 5, and 0 under number 6.

Also remember that if you get your vaccinations prior to the medical, you won't pay as health care covers those shots you might need.  Whereas I understand you'll get charged for them at the medical for immigration.

So get your doctor's blood test results and update some shots if you can:)

Canadians are in line just like everyone else, nothing extra speedy:)

 

Everyone last year took a hit in the timeline as the US Immigration system had shifted their focus to things like DACA and illegal immigrant issues which meant our petition sat in a 'dusty box in a warehouse' for 6 months before being looked at.  Many others waited much much longer than that... some even nearly a year before having their I-130 approved!  Horrible, but at least now they've attempted to deal with the back-log of 500 000 petitions and get their goal timelines under control.

 

If that hadn't all happened, then yes I would have likely been done by now.

I've only got ~ a couple of months left dealing with the NVC stage and then will await the interview.  My best guess is roughly 3 months to go, hoping for not much longer than that as I miss my husband desperately, and wish to get on with my/ our life :luv:

The issue of domicile is important in the 2nd stage, ie the NVC stage after you get the I-130 approval.  So you do have some time before needing that proof.  However you should be actively starting to decide exactly what proofs you can obtain and how you will obtain it, as nothing ever happens as easily as hoped :luv:

 

We chose to have my husband move back to the US and although we're apart, we won't have to deal with proving 'intent' to re-establish which is much more difficult.  I realize that's not really an option for you, so search this thread and follow those links as already mentioned.

 

Oh, and I'm not sure about the taxes.  My husband filed even though he didn't make any substantial money (0-1000) in the years he was here in Canada obtaining his PR.

When it said 'process of termination' it is likely that NVC was entering your case into the system.  Is the money clearly taken from your account yet?

It will be unfortunate that you'll be apart during the process, yet it is what so many of us have to deal with. 

I suggest you start by reading the guides at the top of the VJ page, to see what needs to be done.  First your wife will send in the I-130 petition.  That may take months to be approved - and although 2013 saw a very slow processing rate, it appears USCIS has made attempts to speed up their timelines. 

After the I-130 approval, you both have the remaining paperwork and fees associated with the National Visa Center (NVC), which may take  roughly 3 months.  Waiting for your interview at your consulate is the final step, and each country's timeframe to wait for the interview is different.

The gaps are likely just an oversight....it gets dizzying with many prior residences, so just check your dates carefully so there are no missing months between one place and the next.  If there are many, it's best to have them written down so you can enter them quickly, since the system gives you only 15 minutes I believe.

IR-1 / CR-1 Spouse Visa Process & ProceduresHaving hard time filling out DS-260 form on present and previous address

Having trouble understanding what they want after it asks for current address. It then says the year I was 16 and right after that it for from date. Don't know what they want.

You must provide all addresses lived at since the age of 16, starting with the current and working back in time, including the 'to' and 'from' dates for each.
