You are going to need to send your gal some documents that have your original signature...  The safest way to do this is with FEDEX.  Using UPS or the USPS once the mail gets to the Phil. the mail is given/transferred to a local Phil. delivery service to deliver the mail to your gal.  If you use FEDEX, there is no worry because FEDEX will handle the your mail all the way to delivery to your gal.  The only bad part is it is very expensive.  But, the choice is always yours.

In March of last year my gal renewed her passport and reported our marriage at an consular outreach location, I think that is what they call it. This is how we did it: I visited the USA Philippine embassy website and found out which consulate served my location, and it is the Washington, DC embassy. I then learned that when I joined the email list for the Washington, DC location, I started getting all of the press release emails. Well, during early March the embassy stated sending out email(s) giving date, time, and location(s) of upcoming consulate outreach location(s) and what could be done at the outreach location and what was needed to accomplish each task. FWIW, I live in southeast Georgia, and my gal and I went to an outreach event event just outside of Atlanta. A 200-mile drive versus a 900+ mile drive to Washington, DC.
The problem, at that time, for me was learning of an outreach location after all of the appointment slots were already filled. Again, at that time, the consulate website would remove the outreach location "announcement" and email and from its website as soon as the appointment slots were filled. Joining the embassy website eliminated this problem and it was a very interesting event to attend and observe, the consulate outreach event.
Yeah, you gotta make a person appearance for the passport renewal so the consulate people can take your photo. The biggest thing for the ROM is having 4 pictures of each spouse and, of course, the approximate size and the form. I saw some couples with pictures but without the form and was given a copy of the form, had to obtain and pay for 4 copies of the document, fill it out, and return the borrowed copy. Shoot, I even knew of less than 10 people who showed up without appointments get taken care of at the end of that day. But, I wouldn't count on it happening to you if you show up without an appointment, better to see it happen or not to someone else first...

I will also agree with you that by "definition," discrimination, is not illegal. I am wondering if have you read all of the posts to the link you provided above? I did. I ask b/c I don't believe the original poster told us everything. For example, first its the co-sponsor, then its the new employer that doesn't exist yet, then talks about getting married first - this poster is all over the place. There is a lot of info. missing here. I also ask b/c poster #6 to that message replied as follows:

Wow, is this true? I have not read it. I am a member of two yahoo groups about Fil-Am relationships since mid-2007. One of these groups, I won't promote it here but I discuss it on my time line page, deals specifically with Americans who wish to immigrate Filipino/a's either by the fiance visa or the spousal visa. While it is not an everyday occurrence many people have used co-sponsors and all of the successful journeys went through the manila embassy, the only US embassy in the Phil. I have read about an unemployed son using mom and dad as a co-sponsor, many disabled men using their kid or kids as co-sponsors, just to name a few and all were successful. I still believe that, at issue, is more than needing a co-sponsor, like job history, criminal history, providing the required information and documentation, IRS documentation required and not provided, or questionable evidence or documentation provided. Heck, it is the USCIS that provides the ability to use a co-sponsor. And, then the USCIS is going to tell me that a co-sponsor is not allowed... I don't think so. Probably just like you I have also read many, many tales of how the guy and his gal got screwed over by the USCIS. I quit. This horse has been beaten to death. May it rest in peace. As I read on your timeline page, you journey is just beginning... I wish you the best of luck with your journey.

The fact that you stated that a consular officer cannot discriminate and deny a visa due to needing a cosponser. The job of the consular officer is to discriminate!!! If they did not discriminate then each and every applicant with the proper documentation would be approved.


Mr. Senior member, this is getting off-topic. I will agree that the consular officer can deny a visa application for just about any reason he wants to, and can justify. However, it has been my educated experience and observation that just needing a co-sponsor is not enough to deny a petition, there were [had to have been] additional concerns/problems that all put together got the visa application denied. And, not solely based on the need for a co-sponsor. Obviously, your [educated] experience and observation(s) have been different than mine. Last time I checked, some time ago, discrimination is against the law in the USA, or are you referring to some other country. Yes, discrimination does happen..., and it is against USA law and I don't think any government worker wants to lose their job because of a charge for it.
You remind me of another person I encountered telling me that the USCIS can deny re-entry of a US citizen for any reason. Pretty vague, eh... I did my research and found that every case I examined there were additional concerns/problems with the [mostly naturalized] US citizen regarding his association, travel and/or dealings with his former home country or other countries not looked at favorably by the US government. References - internet searches and detailed analysis,or case study, of each case.

I can only speak from my personal knowledge and observed experience. Since you have stated that you own your home, free and clear of debt, and have the necessary assets to meet the USCIS "requirements," you should be able to satisfy the K1 visa requirements. Anyone, and I repeat anyone, who is a USA citizen can be a co-sponsor for your petition. Now, I don't know that a business can be a co-sponsor for the type of visa you are applying for. I have never, ever, read in any official documentation or have heard that a petitioner can not have more than 1 co-sponsor. Visa petitioners can not be discriminated on the basis of needing a co-sponsor. So, Manila can not deny your visa application, solely, based on the fact that you need a co-sponsor.

Yes, you can apply for dual citizenship. As the previous posted stated, you will need to contact the Phil. consulate that serves your area to learn the process. In addition, your US passport should indicate that you a filipino/a and this will allow you extended stays in the Phil. just using your US passport.

Hi! I am just wondering if my fiance still needs to attend the CFO seminar if he aready attended this a few years back when he went to Dubai as an OFW. Is the seminar different if he's going here in US on K1 visa?


The CFO seminar is only required for filipino(a)s immigrating to a foreign country as a fiance'/spouse. The only seminar my gal, also a OFW was required to attend was the PDOS - my gal immigrated to the USA from HK. If your gal/guy has already attended the CFO, s/he should have a stamp in their passport indicating so attendance and is not required to attend again. This is based on my personal education and experience with my gal, also a filipina.

Based on my personal experience you can not track your package. If you can track your package please let me know as my gal could not. On average, it should take about 2 weeks for your case to be put in the system and get an embassy case number.

Yes, you are required to go to a CS before and in order to file your AOS. If you file you AOS within 1 year of your home country medical you are not required to have another complete medical performed. However, it would be in your best interest to have copies of your home country medical to show the USA CS all of the shots you have already had. It would also be in your best interest to visit your local health department and have any vaccinations and updates as needed based on your age. The USCIS is going to require you to have an I-693 signed by a USCIS CS.

In the Philippines there are requirements when a female under the age of 24 wishes to immigrate outside the Philippines to have documentation from both her parents that they are aware of their daughter's intent. This is mainly for the CFO, if my memory serves me correctly. If my memory serves me correctly, a female that is at least 18 years of age and less than 21 years of age needs explicit, notarized documentation from both parents indicating that they are aware of their daughter's intent to immigrate and marry outside the Philippines. Also, both parents may need to attend the CFO seminar with their daughter for this requirement to be met. If the female is over the age of 21 and less than the age of 24, the female is required to provide documentation, maybe notarized, that both parents are aware of their daughter's intent to immigrate and marry outside the Philippines. Again, this is only required for the CFO seminar.

My opinion, most get denied at the interview stage for not being able to satisfy the IO's questions regarding a bonafide relationship and provide sufficient evidence/proof of the relationship. For example, the interviewer didn't believe my gal really knew me, luckily, she asked the IO, woman, to ask her whatever she wanted to know and was prepared to answer every question satisfactorily. You just need to make sure you are prepared for the interview with documentation, evidence, and proof of your relationship.

What you have for the medical is good. As far as what to take to the interview - I had sent my gal my entire I-129 petition file and it contained all original documents and artwork (photos, documents, etc...). I think the idea is to make sure you have any and all documents that are either needed or have been sent to the USCIS just in case they need to see one for verification or if they have lost one.

"Historically" it has been case by case, it's the totality of circumstances in assessing the credibility of joint sponsorships for K-1 co-sponsor @USEM. Petitioners in fiancé(e) (K1) nonimmigrant visa cases,"USEM" are generally expected to provide the adequacy of their own financial resources to ensure that an alien, after admission into the United States, will not become primarily dependent on the US Government for subsistence. The mere submission of an I-134 Affidavit of Support from joint sponsors is not sufficient to establish that the alien is not likely to become a public charge.

Unlike the I-864 filed by joint sponsors in immigrant visa cases, the I-134 is not legally binding and imposes no legal obligation on the joint sponsor to make good on his or her promises.

Thank you for your quick reply. I clicked on all the links you provided and I also read all of the information provided in each link. Maybe my "understanding" is different, but I see no valid citation or reference regarding co-sponsors not being accept by the USEM for the I-134, only "this is what I have read or heard. Personally, I have seen examples where a child has used mom and dad as a co-sponsor and elderly men use their kids a I-134 co-sponsor(s) and all were accepted and later approved by the USEM. The problem has always been with the petitioner as mentioned on the VJ FAQ page that I cited . In the future, I will make a copy of the next instance and with the permission of the poster provide that information regarding I-134 and co-sponsors. I also peruse the Philippine portal weekly.

The 125% above Poverty guidelines (see here) states for a household of 2 is $18,912
This is cutting it very close. Maybe by the time you have to file I-134, you will be making a little more. If you file I-129F in Jan 2013, your interview should be between 6-9 months later. Depends on how fast or slow Service Centers are processing.
As far as your W-2 is concerned, USCIS looks closely at current income when you go for interview.
Manila has historically not accepted co-sponsor for I-134


My experience about using a co-sponsor at the embassy differs from yours. I am also a member of a Yahoo group that specializes in offering free assistance to Americans immigrating Filipino/a's to the USA and using a co-sponsor has never been a problem. The problem has always existed with the petitioner. I also offer this link to the VJ FAQ page that discusses using a co-sponsor for the I-134, http://www.visajourn...content/support, and it reads as follows:

Not having adequate income will not usually be a problem if you have a co-sponsor, according to experiences
posted on the newsgroup, as long as the co-sponsor has adequate income/assets.
Be aware that the co-sponsor must have enough income/assets for both your fiance, any fiance children that will

the likelihood that the foreign fiance will become a public charge. Just having a co-sponsor may not be sufficient.

government benefits and would not be working, even though the US fiance had two co-sponsors.

Do you have personal experience or knowledge that the Manila embassy does not "historically" accept co-sponsors for the I-134? If so, could you and would you post that information so that I can update my information and the Yahoo groups position.
