She had to apply for her SSN while her I-94 was still valid, and thern again in her married name.

Since your gal didn't, unfortunately, she is going to have to wait until she gets her GC.

Again, unfortunately, there is not "wriggle room" for what you are asking for.

If I were you and the opportunity presented itself I would just give the car back and get the down payment back and consider this a valuable lesson learned. The contract you signed doesn't mean anything if the dealer is unable to find a financial institution to buy the contract from the dealership. I would have reacted just like the bank did and rejected the loan application because your "status" is "temporary." Sorry, this is just the way the banking/loan institutions work in the USA and probably most other countries.

My gal is currently processing her I-751, also known as the CRI** (I forget). The following tidbit of information was included with the "I-751 Receipt Notice:"

If you have not already done so, provide supporting documents to assist USCIS
in processing your petition and to establish eligibility to remove the
conditional basis of your permanent residence. PLEASE INCLUDE A COPY OF THIS
RECEIPT NOTICE WITH ANY SUPPORTING DOCUMENTS YOU SUBMIT. Such evidence may
include, but is not limited to, the following items:
- Lease of joint tenancy or joint ownership of assets
- Joint mortgage agreement and/or property deed
- Birth certificate(s) of any child(ren) born from the marriage
- Joint policies of life, medical and/or car insurance

Basically, evidence of co-mingling of assets.

Hi All,

I have filed a I-751 divorce waiver back in Aug 2011. 2 days back i received a RFE requesting for more documents on the below:
o Leases in both names showing joint occupancy; or deeds and mortgages in both names showing joint ownership;

o Joint checking and savings account;

o Joint Insurance policies ;

o Joint utility bills;

o Joint credit card account statements; and

o Wills or Power of Attorney showing you and your former spouse had made estate planning arrangements with each other.

I have already sent strong evidence comprising of marriage photos and dvds.However,since my ex and i lived in a house (for about 2 weeks only)ownned by his mom- i have no evidence of any joint leases or utility bills.

I really do not know how to proceed.

Any help is appreciated



I have also file a recent I-751, and as part of the "receipt notice," I received, basically, the same "mail" that you have. I can only offer you what I know based on my personal knowledge and education. As long as you have provided the USCIS with documentation/evidence asked/required for the I-751, don't worry about it. The USCIS is just giving you, in my educated opinion, a 2nd chance to make sure you have complied with what has been asked for...

Well,....we mailed out a I-751 within the 90 days expiration of her GC to this address:

USCIS Vermont Service Center
75 Lower Welden Street
P.O. Box 200
St. Albans, VT 05479-0001

and received a receipt letter with an appointment date for her to take care of biometrics stuff at a New Orleans office. She made it to her appointment on 3 August 2012. It's been almost 2 months and we haven't received anything in the mail since her appointment in New Orleans. We're expecting some notification in the mail for an interview, likely to happen in Jacksonville, FL, since that is where we went after we were married for her to get her GC.


My gal and I have also filed her I-751. According to the USCIS website, it should take about 8 1/2 months using the VSC. According to my expert, it can take up to a year. There isn't really anything you can do at this point. We can't do anything but wait patiently... And, check her case status on the USCIS website daily.

My wife's conditional GC expires 3-29-12. She is going to be traveling to the Philippines the 2nd week of January 2013 and be gone 5 weeks. We plan to file her ROC paperwork the day before she leaves on her trip. I'm hoping she'll get back in time for her biometrics appt. I've heard that if she travels within 3 months of her GC expiring she'll need the NOA letter to return even if her GC is still valid. I've bought the tickets already and I'm wondering if she should wait to leave until she recieves her NOA. Does anyone have any information to help me?

If you plan on filing for ROC before she leaves for her trip to the Phil. please note that she should get her biometrics appt. approx. 2 weeks after acceptance of the ROC petition from the USCIS. My gal and I are now going through the ROC and her biometrics appt. was approx. 1 month after acceptance of the ROC by the USCIS.
You can reschedule her biometrics appt. for a later date. I only know what I have heard from others and rescheduling any appt. can and probably will delay processing of your petition. Others may have better information about this than I do.

If my memory serves me correctly, and without taking the time to look it up, it was "optional." That is, send in [copies of] 1 year or 3 years of tax return(s) - again, if my memory serves me correctly without taking the time to look it up. I also did the same when my gal and I applied for her 2-year GC and it was not an issue/problem. Just my opinion, but sending in "lots" of evidence/information can work both ways, good and bad. "Good" for offering lots of "good" information. "Bad" for offering "lots" of evidence/information that may not look good in the USCISs eyes. But, for the record, I did follow the "instructions" for the I-751 for that time period as I know the instructions can change without notice.

Just my opinion,  I would only list your current address for mail.  If your ID/driver's license has other addresses you will need to list those.  To give you an example, my gal and I have also lived/stayed in multiple locations.  She got her 10 yr GC with no problem, no RFEs and no interview.  Just make sure you include all necessary/required info. and evidence.  The USCIS is only concerned with the information you provide them with and what they can find via legal resources.  Best of luck!

Yes, I have heard of this happening.  It is my understanding that the applicant gets "2 tries" at the fingerprint process.  The person taking the fingerprints should be able to tell the applicant whether or not the prints are acceptable or not.  The guy that took my wife's prints told her the prints were ok.

I would still use the old address since all of your mail, including any evidence and/or documentation you might need to use will have the old address on it.  And, as you say you still get the majority of your mail at the old address.  Just my opinion, but the mailing/physical address you use with the USCIS is the address that the USCIS will expect you to receive mail there from the USCIS.  Others may have a different opinion, but this is mine.

I was told this by an expert on the immigration process:  The letters that you talk about are considered "secondary evidence" and while asked for there are much more important requirements and evidence that are looked at first.  So, in my opinion, you can get just about anyone to write these letters.  For example, my wife had a filipina friend, at the time a 2-yr GC holder, provide a letter for her I-751 and I questioned it's validity with my trusted expert and the above is what he told me.

Unlike the above poster, hypnos, I really don't see a dui as a problem unless you killed someone, or caused substantial damage or injuries to others..., but this is just my opinion.  People, including politicians and clergy get duis and it is not a big deal.  But, you still have to disclose any arrests and court results related to any arrest.  Personally, I would not hire an attorney, after all, he is only going to be a mouthpiece after the fact.  To offer examples, I was the petitioner for my gal and I have a few dui's... and it was not a problem and she is now getting ready to apply for her citizenship.  My gal also got a ticket for running a red light, and from what I read about the N-600 instructions, she is going to have to list this... Yeah, I know the two don't relate but it is still part of the process.

I would just list the charge(s), arrest and disposition of the case.  Also, this is just a "misdemeanor" and, in my opinion not a "crime involving moral turpitude" but then again I am not a rocket scientist like some people on this forum like to think they are.  You really have no choice but to file for the ROC within a timely manner and unless you have a pocket full of honey money, do it yourself and forget the attorney.  You have nothing to gain by having an expensive mouthpiece nor more to lose by listing the arrest and outcome.

Getting a lawyer is an option you may or may not want to explore.  Since this case has already taken place and, from what I read, your husband pleaded guilty.  He got a conditional discharge and you guys attended counseling.  You really have no choice but to disclose everything.  You will want to make sure you have all court documentation and counseling documentation available should the IO wish to see any of it.  There really is no need to worry about it just make sure you have any and all documentation/evidence with you to show if asked for it.
