US Citizenship General DiscussionBiometric Appointment Coming Up
Sorry, but at each stage of the immigration process, K1 or I-130 stage, 2-yr GC stage, 10-yr GC stage, and at the citizenship stage everyone has to submit to biometrics just to prove that you are the same person. I have only heard that everyone has an interview at the citizenship stage if for nothing else for the testing done. My source, not VJ, tells me that you can expect to wait about 5 months, +/-, for the interview

US Citizenship General DiscussionWhen is the earliest date I could apply for Naturalization
No sooner than 90 days, before your 3-year anniversary being married to a USC, from the date on your first green card that gave your LPR status. The one poster above stated around the middle of June and that sounds about right.
Best of luck!

I am so sorry to hear about your situation.  Just try to keep in mind that you are dealing with uneducated government workers reading from a job descriptiion and/or a script.  Try to remember what it is like, or can be like, dealing with a customer service representative - uneducated people reading from a script.  To be honest, don't worry about it as long as you have met all of the requirement for "citizenship."  Best of luck!

on average, based on my experience, you gal will be asked 3 questions and they will be "common sense" questions.  Depending on your gal's knowledge and interview experience this can vary.  And, she will be asked to write a simple sentence, in english, to represent her understanding of the english language.

Best of luck!

I would only offer to you the following...  Pls take a lot of time to plan your trip home.  When I was in your country I had never held in my hand, let alone seen one, a starfish, ha!.

FWIW, any travel outside the US that is less than 6 months does not count regarding your ROC, citizenship.  However, during your citizenship app. the USCIS officer may question you about any travels you might have had.

Take a lot of $USD$ home with you.

Have a great trip!

US Citizenship General DiscussionSome form questions

My answers are in CAPS after each question.

I am practicing filling out the N400 form (Filing in 2 months time), I just have some questions..

Part 6.a. I am filing based on marriage to a USC and have only been in the US since 2011, so do I put in my address in China and the Philippines since I lived there 5 years ago, or this applies only to US addresses?

YOU WILL NEED TO LISTT ANY AND ALL ADDRESSES YOU HAVE LIVED AT DURING THE LAST 5 YEARS.

Part 10b. Affiliations.. I'm not sure what this means, just any group I belong to? For instance, all speech therapists are licensed and are members of the American Speech and Hearing Association, so I would add that? Other than that, I can think of nothing else to add.

YES, IT WOULD BE A GOOD IDEA TO LIST THIS.

Part10d. Good Moral Character. I got a traffic ticket for driving 70 on a 55. Do I have to check yes and explain that?

i CAN ONLY TELL YOU THAT MY WIFE GOT A TICKET FOR RUNNING A RED LIGHT AND WE FELT THAT IT WAS IN HER BEST INTEREST TO LIST IT.

Do I have to put N/A on the ones that are not applicable to me or can I leave them blank?

I CHOSE NOT TO LEAVE ANY QUESTIONS UNANSWERED, SO I EITHER PUT "N/A" OR "- NONE -".  IT IS A PERSONAL CHOICE HERE.

What kind of evidence needs to be submitted other than 3 years of tax returns? Do I need to send in the things I already included in the ROC packet?

PLEASE ONLY INCLUDE AND SUBMIT ONLY EVIDENCE ASKED FOR IN THE N-400 INSTRUCTIONS.  ANY EVIDENCE INCLUDED THAT WAS NOT ASKED FOR HAS THE POTENTIAL TO CAUSE ADDITIONAL QUESTIONS AND ALSO HAS THE POTENTIAL TO CAUSE UNNECESSARY PROBLEM(S).

Thanks to anyone who can help smile.png

I HAVE PREPARED THE N-400 FOR MY WIFE AND THIS IS THE WAY I FILLED OUT THE FORM FOR HER.

BEST OF LUCK!

Until you get a US passport, in order for you to travel you will still need an unexpired Philippine passport.  So, in my opinion, it would be in your best interest to renew you Phil. passport.

Just my opinion, but Option 2 best descirbes your current situation.  Again, just my opinion, but if you had divorced within the first 3 yrs of marriage Option 1 would be best.  Moreover, your gal entered as a K1 you guys married and are still married.  As stated in the instructions, Option 2 is for married people and Option 1 is for unmarried/divorced people.

I think he may be referring to filling out the N-400 online.  Even what that is done, it still has to be printed out and signed.  This is when all of the information and documentation you have collected and requried/requested to be filed with the N-400.  The only benefit being offered is just the convenience and ability to fill out the N-400 online and then print it.

Hope this helps, best of luck!

Yes you can.  If you included the G-1145 - when you get the email telling you that your package has been accepted by the USCIS there should be a receipt number included in the email.  You can check right away using the USCIS case status online, but it may take a few days for the USCIS system to recognize your receipt number.  Fom that point on you can continue checking the status of your N-400 application.  This is what I did for my gal, anways.

US Citizenship General DiscussionWhen to file Citizenship

I can only assume that since your permanent GC doesn't expire until 2024 it must be the 10-yr GC.  If so,  and since you have been married for at least 3 yrs. you can start the N-400 (citizenship) application process anytime.  You have until the 10-yr GC expires...   Or, longer if you choose to renew the 10-yr. GC.

Best of luck!

US Citizenship General DiscussionQuestion about N-400

My answers are in CAPS after each question you ask...

Hi All,

Jena is finally going to apply for citizenship (she's been here over 7 years) and she's filling out form N-400. We have a couple of questions, hopefully someone can help us.

FIRST Question;

Part 4. Information About Your Residence

Question 1.

Where have you lived during the last 5 years? Begin with where you live now and then list every location where you have lived during the last 5 years.

Date of Residence     From _____________            To _______________

Should the date be the first day she lived at the address? She wasn't a permanent resident at that time. She came on a K1 and didn't become a resident until 6 months later. She's lived at the same address since she arrived in the US in 2007 but didn't become a resident until 2008.

YES, IT DOESN'T MATTER HER STATUS WAS AT THAT TIME.  THE USCIS IS ONLY CONCERNED ABOUT WHERE SHE HAS LIVED FOR THE LAST 5 YEARS.  DON'T TRY TO READ MORE INTO THE QUESTION THAN WHAT IS ASKED.

SECOND Question;

Part 9. Information About Your Marital History

Question 8. How many times has your current spouse been married (including annulled marriages and marriage(s) to the same person)? If your current spouse has been married before, provide the following information about your current spouse's prior spouse.

She answered 2.

I was married once before and divorced and we are married now. I count that as 2, is that what they are looking for?

YES.

I doubt if either question is that important considering our situation but we're just trying to get it right the first time!

Thanks for any suggestions,

Kev_n_Jena

Best of luck!

US Citizenship General DiscussionUSCIS now wants final court disposition .. but impossible to now get

Just talked to the lawyer that handled my wife's case.

He told me to go down to the Court Clerks office and ask to see the supervisor and show them the letter USCIS in Tampa gave me.

Where it reads ....

"If the court record is unavailable, you must provide an original or certified document from the court having jurisdiction over your case, confirming that the record is unavailable (expunged). Claims of "No Record" must be certified by the Clerk of Court in both the felony and misdemeanor divisions in the county where the arrest occurred".

He said if they still don't give me a certified document stating that the final disposition is now unavailable, to call him, and he will see what he can do.

So ......

This is what you need to do...  I had to show my bank the visa application instructions to do the same to get my bank to give me a letter stating that I had an account there, how long I had the account, and the amount of money deposited into the account for the last year.  I truly think that if you show them the letter they will either come up with the document(s) you need or provide you a letter stating why they can't get the document(s) for you.

Best of luck!

Hi, just received our noa2. Wanted to know how far along the interviews are once the completed packet three is submitted to the consulate.

Usually within one month, depending on the case load(s). Once you have a receipt with a case number [Canadian] on it, you can contact the consulate and ask how they are going to do things.

CanadaApplying for jobs

Depends on the company you are applying with.  On most job applications is does ask for at least 2 of 3 required IDs for employment eligibility.  If the SSN card has the writing on it that require permission from the DHS, then either the Green Card of EAD is going to be needed.  Then, there is the E-VERIFY process.  Best o fluck!

CanadaCredit card debt advice

If you can get the credit card bill(s), you should be able to just write a check from a US bank and mail it to them along with the payment stub.  I did this way back when when I was gett meds for my mom and dad from a canadian pharmacy because the meds were cheaper there than here in the US - that is, I wrote a check for the meds and mailed it to the canadian pharmacy, they cashed the check and mailed the meds to my mom and dad.  No big deal.

CanadaCan I file for SSN even after K1 Visa expired?

I am just speaking from my gals experience...

She had to apply for her SSN while her I-94 was still valid, and thern again in her married name.

Since your gal didn't, unfortunately, she is going to have to wait until she gets her GC.

Again, unfortunately, there is not "wriggle room" for what you are asking for.
