TBone and "big words..."  Mostly, people like my gal were just processed with her paperwork to enter the US.  My gal, anyways, was just reminded that she needed to get married within the 90 day time period while the I-94 was still valid.  I really don't remember but she might have also been told that she can apply for her SSC after 2 weeks, some people will tell you just 10 days, from entering the US.  But, keep in mind, that your gal will need to apply for the SSC card before the I-94 expires otherwise she will have to wait until she gets either her EAD and/or GC.  For some people, not applying and getting the SSC has created a problem in the past.  Unless there "appears" to be a problem with her paperwork I don't believe she will be asked any "unusual" questions.

If you are still in HK and have the USE interview letter/email you can take this to a local police station in HK and ask them to expeditate your request.  My gal was an OFW in HK, took her interview letter/email to a local police station, paid the fee, and had her PC sent to the US embassing in HK in less than a week in preparation for her K1 interview.  If you are no longer in HK it is going to take additional time.

For some reason the USEM needs additional time to review existing evidence you provided or will need to request additional evidence and/or time in order to approve your petition.  Typically, AP (Adminstrative processing) should take no more than 90 days.  Some here at VJ  will tell you that their AP only took a couple of day and/or weeks.  This may also be your case  but, you should be prepared to wait at least 90 days for an answer.

It might be the easiest to call the courthouse in the city/county where you plan to marry and the clerk of the court will be more than happy to tell you what you are going to need to bring with you in order to get the marriage license.  This is what I did, no problem.

What you stated in the original petition is what was current then,  Things have changed now.  Just explain everything to the CO when interviewed and there shouldn't be any problem(s) regarding the living situation.  Moving from one place to another isn't a problem.  Just be sure to explain to the CO what was going on then and what is going on now - but, only if s/he were to ask.

As a rule, from my experience anyways, administrative processing is a step where the interviewing CO either has a question about existing documentation/evidence, needs additional documentation/evidence or needs more time to analize/review new and/or existing documentation/evidence to make a decision.  The good thing is it is not a denial.  If more documentation/evidence has been requested by the CO, there is a document given to the person interviewed - I think maybe a 221g or something like that that lists what is needed.  If more documentation/evidence is needed you need to supply it ASAP.  If more time is needed for the CO to look at/review documentation/evidence your patience is going to be needed.  AP can take 30 day and up to 90 days.

Just my experience,  the NVC is just a "bridge" as other posters have stated.  I think the NVC step is just to verify that everything is in order...  For example, for me anyways, my K1 petition was received and passed by the NVC on the same day.  I hope this helps try to explain the process.

You can call if you want to but I am afraid it won't do any good.  Chances are the person you will be talking to will only have a terminal in from of them and will only be able to tell you the current status which you already know.  You petition is probably sitting in a pile of petitions on someone's desk waiting to be processed.  Like others have said 3 months is not very long.  It may seem like a very long time to you, but in the big picture it isn't very long.  Patience...

I have to say this is some of the best advice I have read on here.  I especially like the part about self proclaimed rocket scientists.  I happen to work for a different branch of the USG (not going to say where so please do not ask) and you never know when someone new is going to rotate in or someone is going to go strictly by the book and require everything instead just what has traditionally been required by case officers.  I see this happen all the time where I work and If this occurs the self proclaimed rocket scientist will say oh so sorry that is what has happened in the past. While you and your fiancée must wait while you two gather the information, get it to the consulate and then wait for a second interview or for a decision and then for the visa,  and who would be burdened here you two or the self proclaimed rocket scientist??

 

If it is requested by consulate in their packet 3 and/or 4 they are going to get it from us.

 

My gal already has everything she needs from me and will get updated documents every couple of weeks until the interview occurs.  I put together a cover sheet and divided each category listed on packet 3 & 4, showing what is inside each category.  then each category has a cover sheet and is tabbed. My parts are already inserted and me fiancee will insert her portions.

 

When she gets there and they tell her we only need this and/or that and hand her back the rest, she will either shred the extra documents or burn them as soon as we see we do not need them.  Better to destroy than to toss in the trash and have some low life get them and cause you problems later by having your information.  Also, by organizing stuff the case officer does not have search for anything in he folder.  I know when I get an organized file at work it gets processed quickly and if I am short on time one day I will do the organized file and get it out quickly rather just a portion of an un-organized file and having to come back to it in a few days and figure what I was doing with it all over again.

You petition has been approved at the USCIS service center level here in the US.  However, you could encounter requests for documentation at a later time, such as the interview.  Just bring everything with you at the interview.  There are several self-proclaimed "Rocket Scientists" here on the website that will tell you to "NOT" bring everything with you.  But, just to make sure my gal did bring everything with her and it paid off.  And, it won't hurt to bring everything with you.

I think it would definitely help you to contact your state senator or representative for help. The USCIS is just like every government agency and they don't like someone looking over their shoulder and the congressman's office should help move your case along, or at least, let you know what is going on with your case. Just remember when you contact the congressman's office and or visit the office have all of your documentation with you.

you tell us that they, USCIS, wants a letter for the last 3 tax years... Well, try writing a letter indicating that you are including copies of your income tax returns for the last 3 years and include the last 3 years income tax returns (state and federal). I would make sure to include all W-2s. This way, you are responding to the letter request and also including the needed tax returns.

In 2009 when I did the Affidavit of support for my gal the I-864 she was given from the US embassy in Hong Kong required notarization. However, I found a later dated I-864 form that did not require notarization. Just to cover my butt, I included buth I-864 forms, and had them all notarized. I learned after that that the I-864 does not need to be notarized anymore.

Question--

What does it mean for IR-1/CR-1 process at the NVC stage when it says "NVC left?" or "Consulate received"?

Every time I call the NVC, the only thing they tell me is that my case is complete and is awaiting an interview date.
Do I have to ask them specifically if my case has left the NVC, or if the consulate has received my petition???

Im very confused. Please someone shed some light on the NVC procedures for IR-1/CR-1 petitions.
Im very upset that it is taking this long to get an interview date for Ankara :(

Based on what you have provided...
Your petition has been approved by the origination visa center and forwarded to the NVC. The NVC has now forwarded your petition to the consulate for your gal/guy further processing.
The NVC has absolutely nothing to do with your gal/guy's interview. This is determined by the consulate where your gal/gal is currently residing... and the available interview times. Can you provide anymore info.\

My wife is from the Philippines and is living in PH but lived in HK for 18 months and needs a police clearance and we have found this part of the proccess confusing.

The HK POlice Clearance site says:

A photocopy of a letter from the relevant Consulate / Immigration Authority / Government Authority, which contains his or her name and clearly indicates that the production of the Certificate is required.

What document is this refering to???

My gal, now wife, also a filipina immigrated to the US from HK. She was an OFW there. What the USCIS is asking for is that you take to/mail to /provide to the local HK police department a copy of your USCIS letter, sorry I forget the official USCIS letter name, asking for the HK Police clearance. Upon paying the HK police agency, the HK police agency will provide and mail, directly, a copy of your gal/guys official police clearance to the US embassy you direct them to. This is what occurred with my gal.

Is there anyone here who filed cr1 visa here in hongkong? Any idea about getting police clearance, medical and interview?


My gal,a Filipina, and I filed the K1 visa process in HK. For her, in order to get the police clearance and medical she needed the USA consulate interview letter/email. Getting the police clearance is a very easy process, take the interview letter (copy) to the local HK police station, pay the fee, and the police clearance letter will be mailed to the USA embassy in HK. Also, the medical process is the same. There were, then, two medical clinics/doctors that did USA medicals. Make an appointment, take the interview letter (copy) with you, and you can get the medical taken care of. As my gal took the AOS here in the USA, I would advise you to get copies of the medical to present to the USCIS civil surgeon/doctor for the I-693 (forgive me if I get it wrong, it was so long ago). Copies of your medical will make it much easier for the AOS. Also, you might want your gal to go to the local county health department for any vaccinations/updates after she gets to the USA.
Just my personal experience.

You are going to need his 2011 ITR and W2s, if any. Also, his most current pay stub and letter from his employer. Maybe the employer letter can explain that his job is a "permanent" job, he is in good standing, and his current pay, weekly/monthly/etc... From what was stated in the OP's post this is probably the only information he can provide.

Thanks. Actually, 90 days may not be sufficient in my case since I have to amend all my civil documents and submit them to the consulate. Is there a rule that the consulate uses to establish the deadline? I was thinking that the deadline would be 1 year after NVC received the approved petition from USCIS.


It might be to your advantage to try and contact the consulate and let them know what you heed to do [are doing] and how long you expect it might take for you to get the documents and send them to the embassy.

Yes, there is a deadline. I have no idea what it is for your situation, but the embassy is not going to keep a case open "forever." 90 days should be sufficient time for you to gather any additional documents and send them. If it is going to take longer than 90 days you might want to let the embassy know what the holdup is and, hopefully, give the embassy an idea of when you will have the additional documents and send them.

You filed a K-1. Yes you are required to obtain the court documents for your petition. I am NOT filing the K-1 I am CR-1. My assumption is that the court documents are not needed for USCIS. Thank you for your input.

Assuming that you are a USC you can go to your local county police department and request a copy of your criminal history report. This is what I did and that was all the USCIS needed. I also have DUIs like yourself and it was not an issue. The only thing that happened was the CO officer interviewing my gal made a BIG point of letting her know about my criminal report. The fact that you must have included the DUIs on your petition has created questions for the USCIS that need to be answered and they need to see a criminal history report.
