The process will speed up considerably now. Your "approved" petition is now being forwarded to the NVC and in about a week (+/- a few days) provided there are no problems there you should receive a letter from the NVC that your "approved" petition is being forwarded to the US Consulate in the country of your fiance to prepare for the interview process.

I am only making an "educated" guess. There might have been some questions to your gal or about her/your documentation that might need to be investigated and/or verified. Admin. review can take up to 3-4 months. Sure, you can contact your congressional representative(s). Just try to keep that by the time it takes them to find out the answer(s), you will probably already know the answers, but you have nothing to lose by getting a congressman's office involved.

It will be up to the CO to make this decision. Your best best is to provide any and all evidence and documentation that will support your fiance' current and future income to provide that it will meet or exceed the 123% minimum. A minimum number of pay stubs to establish current income, say a month or two, at least. And, the employer letter should state hourly pay, average number of hours worked each week. weekly salary, monthly salary, and so on in order for your fiance' to prove that his income will meet the minimum income requirement.

I will assume that since you are a filipina you kinda know what to expect regarding the medical exam... and St. Lukes. I would just add that if you have any prior medical records please take them with you to, if necessary, explain "any prior" diagnosis and/or treatments you have had. For example, my gal has the Michael Jackson skin "blotches," for lack of a better word, and when she did her medical exam it was "definitely" in her benefit to have had her medical records with her - no problem! Dress comfortably and expect to spend 2 days for the exam and results. This was my gal's experience. If anyone should disagree with anything I have had to say I would ask them to provide a valid citation and/or reference that differs from my experience. If you don't understand and you have time and care to please read the 2 comments on my profile.

There are relationship red flags in your post, but filing an I-129F a month after being divorced is not a red flag to USCIS. It might be something asked about in the Visa interview.


I agree with the above post. I know that for you coming to the USA would be a dream come true... But, would it also be the beginning of a "lifelong" nightmare? Once a liar, always a liar... The first lie is always the toughest, but the lies come much easier after the first. And, if he has done this, starting a relationship with you, to his existing wife, will he do it to you also? If he does, it will be much easier for him the next time. Just my opinion.

I can only offer what my experience was... When my gal's case got transferred from the VSC to the CSC and then to the MSC it was just government paperwork. For my gal, her AOS was approved. For you, I would think that your gals I-129 paperwork/visa was in the process of being approved. Otherwise, you would have received information indicating that there "might/was/is" be a problem.

Please keep in mind that some people have better luck than others when it comes to quicker and slower processing times. If your sister-in-laws petition processing time has fallen out of the processing window listed on the website I provide to you, then it might be beneficial to call the 800 and inquire about the status of the petition. Otherwise, just the rest of us... it is a waiting game.

Also, I have read that, at most, you should learn of any additional document request of maybe just time to verify information. Hopefully, within 60 days you should be notified of a decision. i think the second date is when the NOA2 expires..........you have to do anything and everything within those 4months to get the visa,
someone with more info on that should shed some light to it!

 

As long as your petition is "processing," the expiration date of your petition will be extended - that is provided the information the above poster has provided is correct. 

In other words, it is not uncommon for a petition to be in processing beyond the 4 or 6 month period it was first designated to be valid.  Best of luck!

3. We have a senator who may be helping with our case, could he get the information from USCIS over the phone and advise us of what they need? Maybe or maybe not.  You have nothing to lose by getting your senator/congressman involved. 

4. typically what further information is required in a RFE? We were certain we had been included everything and more that was required  Typically,  an RFE is very specific about needed additional information requested.

Sorry to read this, you are going to have to follow the instructions for the RFE.

The NOA 1 is nothing more than an official receipt by the USCIS that your petition has been received.  Yes, there should be an alien # listed on the NOA 1.  You have received an email stating that the TSC has received your petition.  My gal's NOA 1 took over 30 days for me to receive it in the mail.  You can call and see what they will tell you..., I don't believe that they will tel you much - just my opinion.  Please be patient and stay up-to-date with your case progress and status online.  This is really all you can do for now.

Yes, you can travel outside the US with the AP, usually called the "Combo" card.  You will need the AP card and a valid Phil. passport for travel.

TBone and "big words..."  Mostly, people like my gal were just processed with her paperwork to enter the US.  My gal, anyways, was just reminded that she needed to get married within the 90 day time period while the I-94 was still valid.  I really don't remember but she might have also been told that she can apply for her SSC after 2 weeks, some people will tell you just 10 days, from entering the US.  But, keep in mind, that your gal will need to apply for the SSC card before the I-94 expires otherwise she will have to wait until she gets either her EAD and/or GC.  For some people, not applying and getting the SSC has created a problem in the past.  Unless there "appears" to be a problem with her paperwork I don't believe she will be asked any "unusual" questions.
